I have email PROOF that my lawyer told me these were not needed, and I also have email evidence that she was informing me to file an I-130 after we get married in the states on an I-129f along with the AOS. Can I sue her to get my attorney fees refunded? These are TWO MAJOR overlooks on her part. I want my $5000 in fees back.

Why in the world would you even pay an attorney $5,000.00 for something you could have filed for yourself. Plenty of useful information, guides and samples here. Good luck. I doubt very seriously you will get your money back from an attorney.

Doubt it could all get done in a week. How quick the embassy kicks the visa out to 2GO can really vary from a couple days to a couple weeks.

Nice thing is the Manila embassy is really good about letting the petitioner in for the interview.

I already have my flight booked so I will be there for the interview, but I am planning to hang out for a couple months before flying back so no stress with waiting for the visa.

Your not needed for the interview nor does it really help. I went to my first K1 fiancees, now ex, interview back in May 2010 at the Embassy in Manila. We went to the pre-screeners windows where they asked her and I questions, but I saw our file and it had already been stamped "Approved". This was before we even went back to talk to the consular officer. I was allowed back into the interview with her and the counselor officer. He talked to her the majority of the time and asked me very little. It was a waste of my money for the trip just to give her moral support. Would not do it again.

You could also just share your screen on Skype with someone offering help, and then could walk you through it. That way, you don't give any remote access into your computer.

If they don't want my assistance remotely, that is fine. I am an IT Support person working for a reputeable company that is both U.S. and Worldwide. I am not a hacker and they can close the session down anytime. They can see what I do or I can just watch them to see where the problem is. Using Skype will not tell you what problem they are having, but watching them you can actually see and help them. Whatever decision they make, I will resepect. Just offiering my services.

P.S. You have to change the printer from your default to the XPS viewer when you click on "Print" from your browser, select "Print", and then it should prompt you for a file save name and location.

Let me know if your problem is fixed. If not I can remote into your PC using teamviewer.com. You will have to run it on your PC, it is free and then you will give me the code and pssword it give you. I can then see what you are doing and try to help you if still needed. I am an IT Support Technician.

your passport and the visa packet are the most important things that you have to have with you when leaving. the rest, will be up to you.

they said the I 94 was handed to them in the plane. But i got mine in the POE. they immigration officer asked me if i filled out an I -94 and i said no, so he gave me the form.

You will fill out the I-94 at your POE, the first entry point into the United States. A USCIS Officer will take your sealed envelope and process you into the US Immigrations system. They will document your I-94 and staple it in your passport. You then continue on with your journey to your final destination in the U.S.

Before or after the interview at USEM, your fiancee needs to must CFO counseling, after which a sticker will be placed in her passport. Your fiancee must attend that counseling and get that sticker before she can exit the country. Here the link to the CFO website.

If you received your NOA2 you can call the NVC and get the MNL number. Once you have it, have your fiancee pay for the VISA fee and you can go online and set up the interview appointment. The link for the K1 Interview Preparation Packet is below. Make sure your fiancee has all of the information listed in the packet. If she went by more than one name and it is annotated in any of your proof of realtionship paperwork, make sure she get her NBI with and A.K.A. Also have a Cenomar ran with her birthname and A.K.A. also. They may tell her she doesn't need it, but she needs to be firm with them and tell them that the US Embassy requires it. If she doesn't have them if needed, the Consular Officer can terminate the interview until she has the missing documentation. Once the interview is scheduled she will need to take her St. Luke's Medical Exam at least a week prior to her interview. It is a 2 day exam normally. Hope that she doesn't have a period right before she goes for her exam or it will cause you problems with a delay. They will not do the physical exam of her if she is o her period. Just make sure all paperwork is completed and accurate listed in the packet, the correct number of copies, etc.... As for your I-134, you don't need to send it anywhere if you will be bringing it to her. It requires your origianl signature. What I gave as supporting documents for it was my last 3 years of IRS tax transcripts, W-2's, 6 months of the most recent pay stubs, Letter of Employement from Job stating my position, hire date, standing with the comapny and salary. I also got a letter from my bank. Some of this may be overkill, but better to have more than not enough. Now that you have everything organized and in accordance witht he preparation packet, have her go to the interview and dress presentable, be friendly and smile. She should be able to answer any questions without a delay and if she doesn't understand the question or did not hear it clearly, she should politely ask the Consular Officer to repeat it. So I'm retrieving all of my information for the I-134 with my bank and work, I am traveling to be with my Fiancee in a few weeks, so I am just bringing the 1-129F packet with me and the I-134. I don't have to mail the I-134 form to anywhere do I? I'm looking over and over the information and be quite intimidating just because I want everything to be right. When does my Fiancee start setting up for medical and interview and all of that. In like a week or so I know I have to call the NVC, What happens after I talk to them? Do they send me something a packet or anything? I know people will say look at the guide and info, but sometimes it's better to have extra help and info. Any info would be greatly appreciated. Hello Vj'ers. I wanted to share a link for a new chat/webcam application that may help some of you for proof of relationship. A friend mention to me and I installed it on my PC and fiancee's PC and we used it today. When you create your login make sure for your name you use your real name and no nicknames, that way when you use it for proof of relationship you don't have to get any paperwork with A.K.A.'s for you interview. For the video call, both of you will be seen side by side and your names are displayed at the top of each others webcam screens in oovoo. Very nice. To capture you desktop of your vedo call session just press Ctrl + PrntScn and then you can open a word document and right click and select paste. Now you have your screenshot you you talking to each other. You can also open your video call history and do the same when you get enough video calls. I will provide the link below and try to upload pictures to show what I am talking about. It is free to use and very nice. Hope you like it. Take care and good luck on your journey.

Agree that VAWA is not an issue here- looks like she's gone back to the Phils anyway, thus abandoning her residency (which would be good for you, as you wouldn't be financially responsible for her anymore!). Do make sure your new fiance knows all about the old one, as she will be asked about it at interview.

She is in Redwood Citym CA and is on CherryBlossoms trying to find her next victim. Hopefully USCIS will do the right thing and deny her removal of conditions and ask her to leave by midnight on November 2, 2012 when the conditional card expires. Of course my current fiancee knows everything. I laid all the cards on the table from day one. Don't believe in hidng anything, especially when I didn't do anything wrong and I was the victim. She will get her own one day. Karma will catch up to her. Take care.

If you are not convicted of a crime, you should be ok. However this is your second petition within 2 years, did you need a waiver?

I submitted a waiver for time limitations as the petition was only 1 year 9 months old. I have a clean record, don't fit any of the crimes or abuse of the immigrations system in IMBRA. Police have never responded to my house for anything. I don't see them denying me for submitting 3 months shy of 2 years. The petition is now over 2 years, so I will wait to see what USCIS says. Worse case scenario I may have to resubmit and pay the fee again andf then IMBRA would no longer apply as it would be ovewr 2 years old. I hope they have a heart and realize I was the victim. I already submitted evidence to the local USCIS office and they related it would be forwarded and palced in her packet. I do have pictures of her with another man, but I didn't submit them for legal reasons and threats from her American brother-in-law. Time will tell.

I learned about VAWA some what on VJ. I have a question concerninf it. I brought a fiancee over from the Philippines in June 2012. We married in August 2010. I filed her AOS and she received her conditional green card on November 2, 2010. She made me wait until June 2011 to have a baby and this was influenced by her American brother-in-law who visit Redwood City CA every 6 months to make money under the table to support themselves in the Philippines. THey stay at his mother's house in Redwood CIty CA and she is elderly and losing her mental faculties. Once June 2011 came up, my wife at the time started and argument, she used it to leave my house and stay with her friend. 3 days later she had left Indiana and went to Redwood City CA. I never put my hands on her, never had police called to my house and had my best friend and his wife living in my house since they lost their jobs, house and are now on disability. THey witnessed the way she acted and that I never did anything to her physically or of an abusive nature. I was a victim of a scam to get the green card and take care of her brother-in-laws mother. THey left her in Redwood CIty and returned to the Philippines.I divorced her on August 31, 2011 after seeing pictures of her in another mans arms. THe brother-in-law told me it was his best friend and she could do whatever she wanted since she had left me. I know he and his wife orchestrated the whole ordeal. I stil have those pictures as evidence. I gues my questions is can she file a VAWA petition against me and will it have an impact on my current K1 petition. I have no history of violence, domestic violence or any criminal history that is specified in IMBRA. I don't want her to make false allegation for the sole purpose of getting her 10 year green card. Anyone that has knowledge or experience with VAWA please feel free to comment. I was the victim, not the other way around. I also submitted a complaint against her to be put in her immigration packet after talking with a USCIS officer at the local office here in Indianapolis. I included a character reference stated from the wife of my best friend who lived in the house during the marriage and witnessed my exex actions. Also explained in detail what happened, included her on two new dating sites and informed them I had pictures of her in another mans arm less than 3 weeks of leaving me that I could bring into a local office but could not be put into her packet for legal reasons as her brother-in-law is sue happy and threatened me because it involved his friends. I think I am good..I have included all this. I am going to file my 2011 income tax tonight, so that will go in, and tomorrow I will pick up my employment letter from my boss. I am a tiny bit confused about something you said though. It is my understanding that I DO NOT include DS-156 or DS-156k??...that he prints this and fills this himself..the only form I filled out was the Affidavit of Support. I hope this is right !

I completed it for my fiancee and sent it to her. He can fill it out. He should pay the VISA fee before he goes to the interview. Make sure he takes the number of copies specified in the interiew letter.

Just see what the packet requirements are for the interview. You don't need huge stacks of paperwork. Make sure he has pictures of you meeting him with family, photocopyu of your passport with entry stamps, letters from employer and bank, W2's and IRS tax Returns or transcripts (I provided 3 years worth), does you company give you access to print out your paystubs? Include caal history, webcam screenshots if you have them, letters and cards you sent each other with the date stamped envelopes they came in, the required official forms that the Embassy requires in that country; it may be DS-156, DS-156k, DS-157 or the new DS-160. Search on VJ for review of the Embassy in his country toi see other experiences and questions asked. Don't panic, the interviews are normally very easy as long as you meet the proof of relationship requirements and can prove it and meet the minimum income requirement to support your household. Hi everyone. This is my first post in VisaJourney. I'm a little nervous because my fiance (haha it still makes me giggle each time I use this word) and I decided that we would be pursuing a K-1 visa without any professional assistance (i.e. expensive attorneys). I just want to do everything perfectly and this site seems very helpful and friendly so I decided to just take the plunge. :-)

We are preparing our I-129F package and I have a few questions:


1. Letter of intent to marry:

United States Department of Homeland Security
U.S. Citizenship and Immigration Services
[ADDRESS OF FILING LOCATION] --> Should we put the Texas lockbox address here, or can we put the USCIS address in Vermont since it's closer to Massachusetts (where my fiance lives)?

2. G-325A:

My address and occupation cannot fit in one line, will this be accepted?

What should my fiancé be starting to prepare/gather for the I-134 this early? Or is this unadvisable since these documents have a specific validity period?


Apologies if these are answered in a FAQ somewhere already, I tried my best to exhaust VisaJourney's resources before posting.

I am just copying an pasting what I provided someone else. Even though some forms expire soon, USCIS does not necessarily put an updated format up. If they do not update the expiration on the forms then the prvious ones are still honored. Meet you fiancee in person, take lots of pictures, have call history, webcam screenshots, passport with entry stamps, airline tickets, etc,,,, and then follow the guides found on VJ. She should be able to answer any questions without a delay and if she doesn't understand the question or did not hear it clearly, she should politely ask the Consular Officer to repeat it. I sat in on my first ex K1 and it was stamped approved at the prescreeners window. When I sat down with her during the Consular Officer interview, I was asked a couple of questions, but most were directed to her and he even gave her the option to be asked them in Tagalog. The officer was very nice, courteous and professional. Good luck. Don't hesitate to ask me anymore questions should you need further clarificaction. I will also provide a link to the Embassy reviews so you can see thw questions and experiences of others who went there for thier interview and for Saint Lukes. When you have successfully passed the interview, they will mail the sealed packet via courier and her passport with K1 Visa in it will be outside of the sealed packet. Do NOT open that packet. Thanks for the support. I think you missed my point about sending though. I didn't say 150 pages is needed. That is the size of the petition. Hence, there is alot of information there my fiancee needs to be aware of. I stated in an earlier post it was just best to prepare the fiancee with what is going to be sitting in front of the CO at time of interview. Every case is different. That is great nothing was asked of you from your petition. However, it is not uncommon for a question to be asked referring to what is presented in the petition. Not prepared means not being able to answer. My petition is larger than some because I frontloaded. The CO could very well ask my fiancee anything about any of the evidence I sent. It wouldn't make sense for her to not have that information. Again, it is suggested in the guides for the fiancee to have a copy of the petition along with the things you stated. To each, his or her own though. If one doesn't think it is worth the expense to send a petition to their SO, so be it.

Easier said than done. One way or another, someone is paying for it, and everyone doesn't have the luxury of their own printers. Everyone's situation is different. Sure, there are different ways to retrieve the information, but it's more than likely going to cost money. I prefer my fiancee to have the packet exactly the way I made it and not have her pay to print it out. It is around 150 pages, maybe more. It might be cheaper for her to print than for me to send, but she has enough to do with the other preparations. To me, it would just be easier and smoother to send the packet along with the other things she needs from the petitioner. There is nothing cheap about this process.

Good luck. I don't see where 150 pages is needed, but it is up to you. The Embassy will have everything they need that you filed when you first sent your petition in. All they really need it what is stated in the K1 interview packet that is on the U.S. Embassy website. Like I stated your original signature on your I-134 is important. I have attended and been to an actual interview at the Embassy back in 2010 and all they asked for from my fiancee at the time was what was in the K1 interview packet, NBI clearance, NSO birth certificate, a few pictures, cards, email, moneygrams, etc... No where close to 150 pages. Take care. I wish you well.

You don't need to mail the K1 packet. Just e-mail and have her print it out. The only thing she will need is your I-134 with your original signature. The supporting I-134 docs such as IRS transcripts, W2's, paychecks stubs, etc can also be e-mailed to her to print out. She should print out pictures, paspports with stamps, bring any moneygram receipts, e-mails, call history, etc.. along with what is stated in the K1 interview packet from the U.S. Embassy Manila. Don't waste money sending documents that she can just print out. At this stage the I-134 with your original signature is the only document with and original signature that is needed. Send that to her by whatever carrier and it should be that exensive. Good luck.

If your fiancé passes her Medical They will give her a date to come back to SLEC and get her results and medical will CD of chest X-ray

On the interview date she will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.

Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.

You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:

battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted
bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers

If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.

They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).

That's it for the USEM interview. You can now breathe a little easier.

Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.

It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas). Now CFO seminar can be done in the beginning before obtaining the visa and passport. You will need to return to get the CFO sticker and Stamp in the passport after receiving the visa passport upon approval and delivery.

Very well done. I believe they should be able to carry in a handheld divider with all of the paperwork in it. I attended and interview back in 2010 and we had a cloth binder and we were never denied entry with it into the Embassy. Thanks for all of the information. Unfortunately I had a bad one and I am getting ready to have my new fiancee go to her interview hopefully sometime in May/June 2012.

One other thing that needs to be paid is the travel tax of around 1,640PHP if you purchase the airline ticket from abroad instead of from the Philippines. Thanks.

It is NBI and it is National Bureau of Investigations. An NI clearance is a police clearance that checks your background. One is needed for your fiance/fiancee in order to get a passport fr travel and is also required for the interview at the US Embassy Manila.

Since our 5 months are just around the corner I've been checking Igor's list and the "Processing Dates" multiple times a day..

For example this week only 5 people have posted that they received NOA-2.. I mean folks, come on! If you receive it, post on here - it is heartbreaking to see the "Based on timeline data, your I129f may be adjudicated between May 5, 2012 and May 9, 2012*" keep getting further and further because nobody is updating their timelines... or is USCIS taking a break this week?

I recently posted about the (negative) status of my relationship with my Fiancee. I anticipate people will judge, but I am looking for the groups advice, outside of the personal relationship side of what is going on. There are details (as always) that will never be explainable in any forum about the relationship. I'm not willing to go into the details, I'm wondering about processing the petition. So here is the situation:

I filed 4 1/2 months ago. I would anticipate NOA2 in possibly 2 weeks give or take. There is still a possibility that we would continue our relationship after the bumps in the road we've had, but there is a possibility we won't. Either way is a possibility. So I am wavering on cancelling the petition, but haven't yet decided if I will do so. Time is the only way to know, and there isn't much left in our NOA1-NOA2 timeline. I just don't have it, so I'll do what I need to do as much as I can within the process.

The questions:
1) 6 years ago I filed petition, my fiancee received a visa. She immigrated, we got married, had kids, gained US citizenship, then we divorced. In December I filed for my current? fiancee. That means I have filed 2 petitions in my lifetime. It hasn't been approved, but it has been submitted. Even if I withdraw my petition now, I believe this means I've "filed" and would be required to file a waiver if I ever wanted to go down a similar road again. Is this correct, or only if it's actually been processed/approved?

2) If I don't withdraw my petition, and it's approved, even if we don't proceed after it leaves USCIS, I believe that meets the criteria for "had a petition approved within 2 years" assuming I do this again anytime within the next 24 months. Is that correct?

3) Assuming 1) is correct, I am already required to file a waiver, and whether I withdraw it now or wait a couple of months after the petition might be approved is immaterial. That would certainly allow more time to sort through our relationship. However, if 1 doesn't require a waiver given the current situation if I withdraw it, then 2) seems that it most certainly would require a waiver if I don't withdraw, but wouldn't require a waiver if I do withdraw it. Is that correct?

I would rather not be in a waiver situation, not knowing what the future may hold... but I may be there already anyway. It's not the most critical thing in our relationship, but it may impact how we handle our current petition. If I'm leaning towards "no future" then withdrawing now is the best, if I'm leaning towards "yes future" then of course I don't withdraw... but I'm stuck in the middle and time is running... If I'm already under the waiver requirements from 1) above then I have time that doesn't impact waiver requirements either way.

Yes your wife has o become a U.S. Citizen first. You cannot petition for her family, as they are not your immediate family. If what I have researched is right, your wife is eligible to apply for U.S. Citizenship 3 years after issuance of her green card, as long as she has not lived outsid of the U.S. for an extended period of time while having it. So i called NVC and they said they received the application and it's already under review and that they will forward it to US embassy in my fiance's country in a week or two through mail. They advised me to call USCIS about my NOA2 hardcopy

So did they have the MNL # or are they just reviewing it before they assign it. You don't need to have your NOA2 to receive the MNL # from the NVC if they have already assigned your petition one for forwarding it to the U.S. Embassy in Manila. Call back again until they give you the MNL #. The NOA2 won't have it, it will still have the WAC # on it, but will say it is approved and what date the approval will expire. etc....

They do it by chronological order, but as there is not only one adjudicator (and hopefully!!), some cases with a more recent NOA1 date can be adjudicated sooner that some with an older date.

It makes no sense to do Chronologically by name or why even have NOA1 dates? They are supposed to adhere to their processing average dates or they are useless guideline. The ones that get through to me are flukes and the petitioners are lucky. I expect my petition to be approved soon. If Not I will call USCIS and then go to my Senator if still no approval in a reasonable time.

It seems as no one is updating their timelines. If you get your NOA2 for the CSC, please have the courtesy to update your timelines so we can see the dates the the NOA2 are being received or approximate dates USCIS is allegedly processing them. I am so close to 5 months, it is killing me. Some people I know that received their NOA2 1 day earlier than mine already got their NOA2 approval last week. for the last 2 days the K1 timeline for the CSC has not changed. I find it hard to believe that no one has received and NOA2 from CSC. Where I screwed up is I forgot to attach the G-1145 to the petition packet. I am now at the mercy of the USCIS website that may not update on a frequent basis. How am I dealing with a high fraud. I don't have any problems with the U.S. Embassy at Manila and as long as you have all of your docmentation together, proof of your genuine relationship and meet the income requirements, I don't see many denials. Only the suspect ones and the ones where the petitioner doesn't meet the income requirements.

Dear I am the American and do you want to know honestly, each one of these question at one time or another have been asked. Like I said in an earlier post look at your embassies reviews the good reviews will list questions ask. Some interviews got so personal some didn't even want to post it.
Sorry you got offended. Many questions asked isn't as much for the answer as it is to get a reaction.
And name calling is never cool. This process is stressful enough. To get someone to laugh out loud I see no harm or foul. Good grief. :(

:bonk: Very ignorant. What I got out of the questions is that is how you view us Americans. If you feel that way why even come to our country?
