It can take 2 weeks or more for USCIS to send it on to NVC and for NVC to receive it.

Follow the shortcuts and keep the I-130 moving through NVC, more than likely you can get the K-3 dropped in favor of the SUPERIOR CR-1 visa.

Since USCIS has been approving I-130 and I-129F at the same time, this has essentially negated the reason for the OPTIONAL K-3 visa. The K-3 was for a spouse to enter the USA and WAIT for I-130 approval, so that they can then return home and interview for immigrant visa, or adjust status.

CR-1 visa gets GREEN-CARD upon entry to the USA, NO adjustment of status ($1010), CR-1 can WORK and get SSN. K-3 needs to adjust status, CANNOT take a job, or get SSN until after getting EAD or green-card, which can take MONTHS or longer.

Your tax transcripts have been approved by the IRS, the ones you have might not be what you submitted to the goverment. They might want to see them just to make sure you have paid your taxes on time and do not owe any money.

OK, some explanations:

- Thank you so much to try to help me/him!!!!
- Even some guys had fun with hormones" deal
- I came to US Aug 14th, 2009 (his Green Card in the mail dating Aug 14, 2009)
So his card will expired in a year
- I divorce him in "15 minutes", not in 15 month.
I found out he was on web site, looking for other women from September 2009
- He doesn’t want to go back to Russia
- He still doesn't speak English, he can't get attorney or anything like that
- I'd like to help him. I love to help everybody even they hurt me.
I was thinking it's real marriage, may be I was stupid!
- My mistake was to get married. I am too independent, too strong too ... everything :)

USCIS will know the divorce is final when your ex husband files the I-751 and submits a copy of the final divorce decree. If you are looking to help his petition, you can do a number of things. Help him fill out the forms, gather the evidence, and provide a sworn affadavit attesting that the marriage was entered in good faith (I am assuming it was, if it was not the case, then don't do that.)


May be good idea to wait when he start work, real work with withholding taxes?

Did you divorce all ready and is it final?

if so did he file for removal of conditions? (do you mean in your post his card will expire in one more year from now? or is it expired now?)

He does not have to wait for the two years to be up, as soon as the divorce is final, he can ROC himself. He will need to prove that the marriage was entered in good faith.

He came here in August 2009, In January I found out he was on romantic website looking for other woman, becouse he understand he is not good enough for me or so..., I divorce him in 15 mionutes, yes, I have final paper. Do you think INS able to know about this final? He would like to stay in US and I willing to help.

There is no doubt you can go with her to the visitor line, however, after asking the control officer, my wife (then fiancee) went with me through the Citizen line.

Are you sure about this? I thought that only applied for Fiance-type Visa where you go in for another interview to show that you actually got married etc (because you have to get married within 90 days of her arrival here).

However, for the case of a Spousal Visa (CR-1), is the same true? I just want to make sure because I did not see that process anywhere. So what you are saying she has to get an application and fill it out, send it in for "Removal of Conditions?" within 90 days of Conditional GC expiration?

What if a person never applies for this removal of conditions? What happens then?

I am positive that tourist visa has nothing to do with your immigration.
US Embassy must be sure that you will be back.

Hello Svetlana, you have the option to file jointly even though your spouse is neither a citizen nor a legal resident. There is such a thing called "Non resident spouse treated as a resident" which requires you to obtain a tax ID for your spouse i.e. file w7. Read here for more details:
