you dont need the affidavit and it doesnt have to be notorized. Having the affidavits are just an extra addition, not a requirement

do you mean "this form is submitted in connection with an application for: ?

in that case, we marked "other" and worte in "k3 visa"

ok...i have no son and i thank you for all your comments and advice...i only have filed the 130 and have not sent the 129...i am waiting now for the noa for the 130...i am at the begining stage of this so i guess i will not send the 129 and i will be on the CR1 path....am i correct....and pushbrk i thank you...its just i want to be sure in every step i take...so i sent the 130 sat and am waiting to get the 1st NOA...then i guess i will follow the guide to seek the CR1 path and hopefuly will have no problems...thanks again to all who helped...hoopy

Your question indicates you've failed to carefully study the appropriate VJ Guide for either CR1 or the obsolete K3 visa. Your success depends upon you doing so. I suggest you begin or begin again that study now, then return with remaining questions.

well i have been researching this for quite awhile now and have filed the 130...and does it matter if my wife from china doesnt want to be a u.s. citizen and keep her status as chinese....and im sorry to sound rude but people come here to get help...because we "HAVE" read the guides and still have no idea how to do this..we are not lawyers and are trusting people here to give us advice so we can gain some info on hte process and how we go about doing this...people like i do not need to be told to read the guides ...we have...and we are still confused...if somehas a question cant people just give them a answer....thanks anyways...and as for me...i did not fail ...its just a daunting task to do this and am just in need of some advice from people who have gone throught the process...later.

Ok...here I go...Got married in China and got her 130 in and noa 1 and 2 and now at the 864 stage and now today got bill for 400 dollars..my question is this..if im in the middle of this process as i am now..and i change jobs for a better one..but only have the letter from my employer stating what i make and how much a year but no actual pay stub yet...should i send the 864,and the bill i got today...or should i wait to send the the 864 and the payment for the bill after i get 2 paystubs...if i have to wait will only be less than a month..but i want to get this over with so my wife can get here fast...any advice would be a great help to me..i want to do it now but think i should wait till i get 2 paystubs...HELP!...thank to all of you..she'll be going thru the guanzhou embassy too if that helps...peace. helpsmilie.gif

You file an updated I-864 and mother will file I-864A, combine both income, make sure revised household size and submit to the CO.

If your mom is LPR/USC, definitely yes. There is no upper age limit. Min age of sponsor or joint sponsor must be 18 years old. Also, your mom must be domiciled in the U.S.

If your mom lives at your (sponsor's) address, she will file I-864A and you will file I-864. Yours and her income can be combined in this case.

If your mom lives at different address, she will file I-864 and you will file I-864. Yours and her income can NOT be combined and she herself must overcome the entire poverty line threshold of the household.

Friends of mine got a blue slip a few months ago at Guangzhou, because the Interview Officer felt their income was not enough, even though they were well over the minimum. My friend lives in Calif. so I can see the Interview Officer's thinking on that. I could not afford the house taxes he pays. Congressmen can not help. The final decision is all up to the desretion (personal opinion) of the Interview Officer. Sorry, but that is just the way it is. To be on the safe side, just get a joint sponsor. :yes:

What I feel is - Did you file "married filing jointly" taxes with your ex-wife last year? If yes, they need your W2/1099 with 1040 and schedules separately rather than IRS tax transcripts to separate your income out.

Well she recieved her paper from the consulant in Guanzhou dec 25th and she was told to go to the office in Guanzhou on a monday or tuesday and get the process finished.,,we figured if she went on the 10th she could advise them we are married over 2 yrs since our anniv date is the 6th of jan for 2 yrs we are married.,,,or does it matter and she can change it from a Cr1 to a Ir1 when she goes thru the POE,,,thanks,,,hoopy507

Well im not so sure you can say Americanized...I feel many that came here and still do come here still hear of gold lined streets and jobs everywhere.,,.I feel if you respect a persons culture and try not to change them..which.,..most American men do,...you can have a good marriage,,,and its not just Chinese or Asians.,..its any woman or man who is not treated well and feels that the other just wanted to get a maid or a cook or a housekeeper...This world has changed so much I know many foriegners who do not want to even come here to live,,,many say its a nice place to visit..just dont move there...but..life is life and if you treat your mate with honesty and respect you can have a good relationship...its just the horror stories outway the ones who succeed...I was married to a American girl and I am American..grew up in the same area...and same values..and guess what...yep...19 yrs and divorced cause she was not getting the material things she wanted...so..doesnt matter the race,,,or nationality...what matters is morals and love...just my opinion...but thanks for the concern...peace.,.,hoopy

My wife and I were talking with a couple and the american said his wife who is Philipine became a citizen for reasons and then we were interupted,,,,can anyone tell me why my wife should turn into a american citizen beyond the normal reasons...I know some.. but what cant she do that she can if she was a citizen,,,I was just wondering the benefits of her taking the test in 4 yrs,,,she just moved here from China,.,,any help would be welcomed...thanks....hoopy
