  Ok...dont freak out but be more specific.  Since they requested a CENOMAR I'm assuming that your wife is filipina working in Hong Kong...and if she's gotten that then one down.  Your next questions of "when will they send your case back" makes no sense.  You have up to a year to fulfill the 221(g) requirements and if not then your case goes abandoned...never being sent back.  The only reason for the embassy to "send back" an applicant is if they assert that the USCIS shouldn't have approved it in the first place...so...relax...and get them the employment letter ASAP....and yes...it is normal to go from READY to AP after an interview with outstanding documents....good luck.

  Hello all,

 

      This is my first post here hoping to gain some knowledge from past experiences...

 

Firstly, I filed a 130 for my wife back in July (5th) and then relized that I also needed to file one for her son...which I did (NOA1 August 15th) and wrote a letter stating that I had errored, giving the mom's msc number and asking to process them together...

 

On November 22 I got a text and email saying that they had been transferred...but once I received the hard copy I found that one went to Nebraska (moms) and one to Texas (sons). I called and talked with a tier 2 and she said that she would message Texas to send sons to Nebraska...

 

Ok...to further complicate manner, my wife lives on Northern Cebu and was adversely effected by both the earthquakes and typhoon.  Therefore, I called to expedite both cases which was granted....

 

On December 26 I received and RFE on my wifes case and responded December 30...heard nothing from the step sons case...

 

On January 9 I received an email approval for my wifes case and still nothing for the step son....

 

   Questions: 

 

            Since I received both an RFE and an approval from NCS for my wifes and both have been expedited should I be calling a tier 2 for his case??

 

           Next...is there any hard and fast way to pair these cases up together so that they can do medicals, interviews, etc together???

 

   I realize that Im showing my ignorance here but any input and past experiences would be greatly appreciated.

  Does anyone have EXPERIENCE weither the USEM asked for a CEMAR during a CR1 interview???  I know that a CENOMAR is required for a K1....but Im looking for someone to tell me that they have been to an interview for a CR1 (or IR1) and were or were not asked for a CEMAR.  I only ask because I've gotten mixed conjecture...and a CEMAR seems pointless in that we are already married....thanks....

ok..an update....firstly, yes i included a CEMAR...and yes the margin notes were readable....funny thing...when I called this morning they said that they havent reviewed my civil docs in that they just got them on March 3.  The email was auto generated and I should disregard..hhhuuummm????  Either way, Im having my wife mail in a new CEMAR, marriage certs with annulment margin notes (from the NSO on security paper) and this time complete annulment docs with seals...we'll see...

  Today I got an NVC checklist for proof that my wifes pervious marriages have been terminated.  In the original IV packett I sent the two marriage contracts with the annulment notes in the margins.  Issued by the NSO...on security paper....what else could they need???...its got me confused...any experience with this?????

Thanks Greenbaum...but those and many other web searches were exhausted several years ago and until recently.  Along with 10's of thousands of dollars in investigation fees to chase down various leads.  Believe me...I would have perfered to find him alive and have her divorce her...but that didnt happen...and it seems like the whole thing has simply fell into a black hole....

Nope...did several searches over several different years...found one matching name and number but the number was wrong...sent someone to the address and they know no such person.  I have seriously hired several investigators to knock on several doors around the world...making every attempt to locate either a date/place of death, a death certificate or find the person alive...and nothing...which is why we finally went the presumptive death route....

Hank....I understand what you are saying...but that being said...the following is an excerpt for the US Embassy, Manila website:

 

 

A common basis for refusal is a prior marriage for the beneficiary or the petitioner that has not been legally terminated. There is no divorce in the Philippines. A consular officer will only accept a death certificate or a court ruling of annulment or of presumptive death as evidence that a Filipino marriage has been terminated. A U.S. citizen may terminate a Filipino marriage through a U.S. divorce.

And believe me...if a death certificate was obtainable, we would have several years ago.

   Does anybody here have experience with a "presumption of death" marriage termination in the Philippines and any issues with it??? We have never been able to secure a death certificate because he was thought to have died in Canada (not knowing the date and city its impossible to get a death certificate) many years ago.  The only option was to have the courts deem him dead...which we did....any experiences with this????  Thanks....

   To the OP...like Hank's...my wife won't let me drive there...and thats actually good...a car and a driver...sit back and relax....regardless what folks say...the driving there is insanity...with NO RULES (that I could grasp)..period...and yes...On Cebu...we saw deaths everyday...so its just not worth it...good luck...:-)

   Good morning folks...I have a question about documentation at SLEC.  My wife and stepson have been expedited through (yeah right there almost 2 months) the NVC.  The embassy agreed to expedite once the NVC collected all fee, forms and supporting documents, which they now have...Now, because the Embassy agreed to expedite, the NVC won't make the Interview Appointment and since its not a K visa, we cant make it online. The NVC have told me that the Embassy will make it and let us know. 

 

  My question is:  Can we plan on and complete the medical portion??  If so using what docs??  I've heard/maybe read that you can use the conformation page from the DS 260 to get into SLEC (since we obviously wont have an NVC appt letter).  Does anyone have experience with this???  What other docs may be required??   Thanks...

  Does anyone have experience with a CR1/IR1 being expedited thru the NVC and to the USEM??  The NVC has collected all forms, fees and documents from us and is now forwarding everything to the USEM....since its expedited, apparently the USEM will make the appointment for the interview (and no...we cant go online and make an initial appointment like a K1).

 

    Makes questions are:  

 

            Has anyone had experience with this??  if so, how far out was the interview appiontment??  did you have to contact the EmbassY???

 

            And...is it safe to send my wife to Manila for her medical, even without an appointment date, we have pre-regristered at SLEC, she has copies of her expediate from the USEM, approved NOA2, paid receipts for all fees and various emails from the NVC with case number, etc.

  Today my wife and stepson had their medical.  Both has "issues" with their xrays and are suppose to start the three day sputum test tomorrow.  After talking with her brother, he said that he had the same issue and asked to "re xray"...that set came back fine....anybody ever hear of that???  The request to "re aray"??? (ata cost of course)....thanks for any input....

  Hello all...well my stepson just tested positive for TB after the three day sputum test (wife was negative, so far).  That being said, I need to move my wife and stepson from Cebu to Manila for the 6 month TB treatment at St Lukes.  While this really sux, we dont know the area and were hoping that someone out in VJ land knows the area and can suggest a decent place (condo/apt) for them to stay during this timeframe.  Any input would be greatly appreciated...thanks in advance to all...

  To the OP.  You might want to go online and search for a company that secures the clearances for you.  My wife worked in Canada and needed a clearance and we were told the 30 to 60 day thing.  However, we found a company in Canada that officially secures the clearances in days and can DHL them to you (we needed to fax her fingerprints and a photo to them).  It was expensive, about $125 for the clearance and another $100 plus or minus to DHL from Canada but my wife had her clearance in less then two weeks.  Just a thought...Good luck...

Update...contrary to Greenbaums advice I did contact my senator 7/18 and faxed all supporting documents to him 7/21.  His office contacted the embassy and they (USEM) called my wife on 7/22 asking "if issued can she leave before her medical expires" (of course she can).  The visa went from AP to "issued" 7/23 and was updated as "issued" again on 7/25 (Im assuming because of the DC computer issue)....

  I dont know for certain...firstly, they didnt know that they had it...SLEC asked my wife for her passport (in that she needed to Update her medical)...once she said that it was at the embassy....SLEC looked for it and found it...they said that they would release it and updated results back to the embassy (on July 11)...but it seems like noone really knows whats going on...:-(

   Good day all, my wife had here interview JUne 9th and received a 221(g) for a CENOMAR and NBI clearance with all names.  The embassy received all back (thru 2go) on June 20th and last update on CEAC was July 11th.  So is this usual or is it time to contact a Congressman/Senator??....BTW, mixed in with all this we had a feasco where St. Lukes had her passport for 2 weeks (for a medical update) and didnt know to send it back to the embassy.  Anybody have experience of how long such 221(g)s should take....thanks....

OP...I agree with apple 21....and DO NOT do what Sirliner suggests...the 221(g) gives you specific instruction, one of which is to attach a copy of the email to your response..also, the Embassy should have given you a paper to give to the 2go which lists what you need and allows for free delivery.  Have your fiance DHL whatever to you...and you send them through 2go...if your fiance tries to do it from the States it will confuse and delay things...good luck...

  Hello...I am pretty certain that I need to file separate AOS's for both my wife and stepson.  My question is part 2/1 (Info on principal immigrant) and part 2/2 (family member 1).  Obviously, my wife is the "principal imigrant" in her 864 and the son is "family member 1".  Do I simply switch them in his 864??? (Making him the "principal immigrant", and my wife "Family member 1",  which would make sense....)...thanks....

   These posts bring up a question about the two 864's....On the parent's...you list the spouse as the principal immigrant and the child as "Family Member 1" that will immigrate at the same time.  For the son's do you change these??  (List him as the Principal and the spouse as "Family member 1") or just submit two copies of the same???...thanks...

   OP...firstly, listen to Darnell...that is correct.  My taxes are in the mail as we speak...filed married, joint...sent to Austin Tx with w7 (spent hours on the phone with IRS confirming this process).  Leave to ssn spot blank...IRS will fill it in once the number is assigned via the w7.  Then IRS will forward for tax return processing.  I was told 3 to 5 weeks for the w7 then another four to six to process the paper return....hope this helps...
