Hello guys,

My husband has all the documents ready. He's going to send in the petition for K3.
His I-130 package includes:

Cover Letter
I-130 form
Check worth $355
Copy of our marriage certificate
Copies of his divorce decree
G325A for him
G325A for mine
Copy of his birth certificate
Copy of his passport
Evidence of the Bonafide marriage
1 passport style photo for him
1 passport style photo for me
Pictures of our wedding with friends and family

Thats all what he has for the I-130 package. Tell me if we have left anything out.
My husband will send in the petition this week. We would like to know where is the proper
address to send it into. My husband is from Florida, so which service center should he submit the papers?
Thank you very much. Any infos are highly appreciated!
Good day to all!

Your filing location will depend on the US Citizen's State of residence. Start here:

http://www.uscis.gov...iling062107.pdf

You'll find a link to the filing chart for I-129F in that document. Please read the document first.

Because our I-130 will be transferred to the same location, (either California or Vermont) the most efficient way to petition for a K3 visa process is to send both petitions together in the same envelope to the same address. Then your proof of filing the I-130 is in the same envelope as your I-129F petition. There is no need to wait for "proof" to be mailed back to you because it's in the envelope.

I see your husband is from Florida. Florida files in Vermont now, not with Texas. TSC no longer processes I-130 or I-129F petitions.

NOA2: Notice of approval. That means your visa application has been approved by USCIS.

Shortly after that, your case will be transferred to NVC for background check. And once that process is done, the entire package will be sent to your fiane(e)'s local embassy or consulate to arrange an interview date.

Prepare for your Affidavit of Support

You should also start to collect evidences to perpare the up coming interview for your fiane(e).

Congrats and best wishes

K-3 Spouse Visa Process & ProceduresOpinions: what would you do??
QUOTE (dphyled @ Aug 27 2007, 10:37 PM) <{POST_SNAPBACK}>
Wow, thank you very much for the quick reply!
For the first method, i had thought that it was only illegal for her to come marry in the US if she is planning on staying after the marriage... This paragraph from the uscis helper "how do i..." file at http://www.uscis.gov.../article/A2.pdf makes it sound like she could come just for the wedding, then go back and wait until the K-3 visa goes through... (?)
QUOTE
What if my fiancé(e) uses a different kind of visa, or
enters as a visitor without visa, to come here so we
can get married?
There could be serious consequences. Attempting to get a visa or
enter the U.S. by saying one thing when you intend another may
be considered immigration fraud, for which there are severe
penalties. Those penalties include restricting a person?s ability to
get immigration benefits, including permanent residence, as well as
a possible fine of up to $10,000 and imprisonment of up to five
years. It is not appropriate for your fiancé(e) to enter the U.S. as
a visitor with the intent to marry you and remain to try to become
a permanent resident. It is appropriate, however, to enter as a visitor
to have the wedding in the U.S. and then return to a foreign
residence for further processing for U.S. immigration as a spouse.
You should come prepared with proof of your clear intentions in
this regard
.

For this method though, we just weren't sure because one of the ladies on the USCIS phone thing said that it takes the longest (more than a year)...?

If we don't go this route, then I think we will probably do the same method as you did maekai! After your husband went to japan and you married eachother, he could just go back to America to wait?? Would he have to go back for any other interviews or other stuff in japan, or just for the wedding to get married?? (not that i don't want to go to japan, i really love visiting japan, but right now i have to stay at my job so that i can show proof of being able to support... i think?)

Anyway, the method 1 sounds the best right now, if it is legal... anyone have more info on that way?
Thanks again!

No if you marry in Japan and come back here, you do not have to go back for a interveiw.
Make sure you go thru the I130 guide and the K3 guide so you know what papers you will both need to be collecting.
The sooner you start that, the sooner you can file after the wedding.

I filed my I130 last december and we just got the visa yesterday. That is a full 9 month time line.

K3 guide and info

It is not so fast, but the I130 is by far the better visa and well worth the wait.

Hang in there, if your love is truley ment to be, it will stand the test of time.

Hi VJer's.

This question is for any Canadians that married a USC and owned a home in Canada. My questions are:

If I have a co-sign for the ownership already, can they still live in the house without me?

Will I be penalized in any way?

Can I sign it over to them fully without penalty??

Thanks again for your help, VJ is the best, I can't wait to understand everything like some of you so I can help others as well !!!

I would think that as long as the note is met each month, they could careless who lives there.

As for signing the note over.

That would be better directed @ your loan officer @ the place you got the loan thru.

K-3 Spouse Visa Process & ProceduresI-130 approved, but RFE for I-129F :(
QUOTE (Sangrita @ Sep 1 2007, 02:49 PM) <{POST_SNAPBACK}>
Hello!

We called California Service Center and found out, our I-130 has been approved, but they will send out an RFE for our 129F. The lady on the phone couldn?t tell us, what kind of additional evidence they need, we have to wait until we received a mail letter.

We also didn?t receive any mail regarding our I-130 approval and the status is still pending (so we don´t know - is it really approved?).

We asked if they would forward the approved I-130 to NVC. She said ? NO ? they will wait until I-129F will be approved.

I read on this board, that in cases, where I-130 is approved before the I-129F, they will forward the I-130 to the NVC.

Can anyone clarify please? helpsmilie.gif

Thank you!

If your I130 is approved,

Then yes it will go forward to the NVC.

Maybe you left a paper out of the 129f.

But the I130 is a total differant differant visa process.

If approved. It will still go forward.

It is the better visa.

Copy of Medical insurance cards
Copy Credit Crads in both our names
Copy of Honeymoon travel?airline and hotel information.
Bank Account in Kiev in both names
Copies of all travel we have made together --- we have been to egypt together before marriage and will go again in a few weeks.
Copies of all tickets where i flew to see my wife-- (have been going for almost 1 year now)
Copies of phone records

You will not be asked for the bona fide marriage when filing but you will be asked during the embassy's interview in the last stage .
Keep those evidence in an envelope till later.

Actually, the new I-130 does ask for some additional evidence of bona fides at filing. Those who've never lived together and are newlyweds can usually get by skipping it but if you have it, send it. Most of what you've listed, I would save for the interview but since you do have a joint bank account and insurance cards, I would include copies of those with your petition and save the rest for interview.

pushbrk is correct.

Include copies of your bank and medical records as well as a copy of your marrage certificate in the I130.

Save the rest for the interveiw.

K-3 Spouse Visa Process & ProceduresDo I have a right to take my paperwork from my lawyer?
QUOTE (WAITING_FOR_FAM @ Sep 8 2007, 05:10 PM) <{POST_SNAPBACK}>
My lawyer (the Weasel)'s office assured me that my wife's I-129 was sent in the middle of July, but after receiving yet another bill from their office, it appears that it wasn't actually sent until August 21st.

As I learn more about the process here on VJ, I lose faith in the Weasel's ability to move my wife's paperwork through the system more efficiently than I could do it. While I'm sure he will eventually get it done, my incentive to get my family here is a little higher than his-he already has his retainere and my case is another file in a stack.

If I request to drop him and work the remainder of the process with the assistance of VJ, do I have a legal right to take my entire file or make copies of it? If I can do that, how do I notify the SC that I no longer wish for him to represent me?

As soon as I get a case number from my I-129F NOA1, I will be able to track it online and keep better tabs on the Weasel and his office. I've already gotten an email account set up for the I-130 so I can track that. (We may go the CR-1 route anyway) So I have half a mind to stay with the Weasel and just continually drop by his office every time I see a touch or action on the CIS website.

Any comments or suggestions would be greatly appreciated.

Yes you should send him a letter advising that you wish to end your agreement with him. Also you should make a copy of REVOCATION OF POWER OF ATTORNEY. http://www.formsguru...s/revpwrat.html

Ask for your case file with all materials and that he notify USCIS of his change of status. Make sure you include those demands in the letter of dissmissal.

On the other hand you may wish to have a chat with him and set him straight on the fact you are monitoring the progress of the case and you find the time line of filing un-acceptable. Make sure you send a letter to him stating the same fact.

best of wishes

Hi everyone!!

I am new to this form and I have few questions and I hope someone would take some time to answer me back.
First, here is the timeline of my application
Form Receive Date Notice Date

I-129F 4/6/2006 10/12/2006
I-130 3/7/2006 6/26/2007
###********** 10/23/2006 ( corresponding case number for 129 in the embassy )
###********** 6/25/2007 (corresponding case number for 130 in the embassy )

as you all see, I was asked after I recieved 129 approval by the american embassy in the country where my wife is from to fill out some forms and send them. I did that then I have been trying to contact them vial email with no avail. Now the 130 form is approved and I was asked lately to fill out affidavit of support. I was very last year, and that is why I did not purse the issue aggressively. My questions to you guys are as follow:
what is going on?
what should I do now?
How long do I expect to wait till my wife be able to come here?

I really appreciate any help you all could offer or guidlines yo refer me too.

Thanks again

Did you fill out and return the AOS ??

If so then it should not be a lot longer before it hits the embassy. You will get a notice as to when they have sent it there.
Also guides are listed at the top of this forum.

Ann went for the CFO Seminar today. After the seminar she had to go across town to get the stamp for her visa at another office. At the second location she was interviewed. She was not expecting to be interviewed. She said the interviewer was hostile. She was asked why she was marrying me. The lady asked her about my 2 divorces. Then the woman told her that my middle name was incorrect and she could not issue the visa stamp because of the discrepancy. The woman insisted that my middle name was Flanagan (my mother's maiden name). Ann told her it was Brandon. The woman told her she was wrong. Fortunately, I had advised Ann to take all the documents that she had brought to her interview to the CFO seminar and she did. Ann was able to show her my original birth certifcate. The woman also wante to see the divorce decrees. Ann was the able to get her visa stamp and get out of there. Ann's embassy interview was less than 5 minutes and very friendly. Her CFO interview was ten minutes and unfriendly.

The 2 most important things are that your spouse knows your middle name and the last name of your Mother.

If they get that wrong or mixed up, when first asked. Then the CFO person will get agressive as they take it the spouse

was not paying attention @ the CFO.

PhilippinesStay away from Remit2home
QUOTE (remithome @ Feb 28 2008, 01:07 PM) <{POST_SNAPBACK}>
Remithome vs. Remit2Home

We at remithome ( http://www.remithome.com ) have been following your discussion of Remit2Home and are happy that those posting on visajourney.com realize that remithome is NOT the same as Remit2Home.

Remithome Corporation is a U.S. to Philippines online remittance service based in Oakland, California, and has been providing remittance services since 2004.

Remit2Home, on the other hand, is not even a company name. Remit2Home.com is a domain name owned by an Indian company called TimesofMoney Ltd., which has only recently been used to market its services.

Since we had concerns about customer confusion caused by TimesofMoney using a variation of our registered REMITHOME trademark (registered both in the U.S. and the Philippines), we filed a complaint with the National Arbitration Forum, which provides dispute resolution services for the Internet Corporation for Assigned Names and Numbers (ICANN), the organization responsible for overseeing the use of domain names worldwide.

A panel of the National Arbitration Forum reviewed the evidence and found (1) that the domain names remit2home.com and remit2home1.com are confusingly similar to remithome Corporation?s registered REMITHOME trademark, (2) that TimesofMoney lacks rights and legitimate interests in the two domain names, and (3) that these domain names were registered and used by TimesofMoney in bad faith.

On February 21, 2008, the panel ordered that the domain names remit2home.com and remit2home1.com be transferred from TimesofMoney Ltd. to remithome Corporation.

Remithome Corporation

I realize that Remit2home is not the same as you.
But since we have stuck with western union. My wifes family's electric was shut off, while we were being jerked around by Remit2home.
We did finaly get the money back by filing a claim with their carrier bank.

Would beleave they have had the nerve to call us 3 times since and ask if we are going to send more money thru them?

What a crock of BULLSH*T!!!!!!!!!!!!!!!!!!!!!!!!!!

Caution using Remit2Home.com for money transfers!!!!

First I want to mention, this is not slander. Slander is making false statements or false claims about some person or business. This is all accurate and true.

My Fiancée lives in the Philippines and I live in America. I often send her money for some support, or to build up some savings for when I arrive there to live.

I have used a few of the money transfer companies available on the internet, which I will not mention except Remit2Home.

From the comments I will leave, you will have a good hint who they are. All work fine except little irritations, fight over fees and such EXCEPT Remit2Home.com

At first I had used a company that has been around for many years. They first started their business sending telegrams. I stopped using them since there fees were too high.

I then found a company that would send my fiancée an ATM debit card and all my money would be deposited into her account. The fees were less, but she would be charged a fee every month and each time she used her card. One day I get a notice that there is a problem with the state of Florida and they will not allow money send from here. I do not know if the problem was resolved yet since.

I then switched to another company. The new company worked great! I could send money from a credit card, a PayPal account or directly from my bank account. Then my fiancée could get it delivered to her home, pick up at a bank, or deposited directly into her personal bank account. I had never had any problems with them. For a hint; zoom to where ?X? marks the spot is where I prefer to use.

Then Remit2Home started flooding the internet with their ads. They said their fee was less so I decided to try them out.

I signed up, and proceeded to send Elena some money. They did their test of my account sending me a small amount then taking it back. I then got a phone call from them wanting to know everything about me except maybe my blood type. One thing they did ask was the test transfer amount to prove I was the account holder. This all happened within 2 days after I signed up. Then we waited a week, nothing. Then 2 weeks, still nothing. They advertise 24/7 support. WHERE? Their phones are never answered and their Chat Live crashes or never works.

Oh, one time they answered the phone, and the girl said she would contact someone in the customer service department and have someone return my call. NEVER HAPPENED. I would send emails and 2 days later I would get a promise they are investigating. 2 days ago, I get an email saying the money has been deposited. Well, my fiancée went to her bank and NO, NOTHING THERE. Also now all I get is their <auto> response email, but nothing more. It has been ONE MONTH and no money. My only thanks to GOD it was not my the last of my money and it was not needed for an emergency.

I have noticed they do not advertise on Goggle anymore and I am wondering if they are out of business

I do not know if anyone else has used Remit2Home, and/or if it worked, but I think you should use this as a warning and use some other service.

********************************************************************************
************************

I did not write the above part of this. But in my case the same thing has been exact.

It is going on 2 months and they still have not delivered the money to my wifes family.

No 1 answers the phone. And emails are automated responces saying we will look into it and get back with you in 24 to 48 WORKING hours.

Money has been withdrawn from the account, but, not delivered.

It would be nice if admins made this a sticky for a while.

People here have enough to deal with without getting shafted trying to sent money home to their loved ones.

IR-1 / CR-1 Spouse Visa Process & ProceduresTranslation of Birth certificate
QUOTE (Pinkix @ Aug 25 2007, 02:36 PM) <{POST_SNAPBACK}>
Hey guys!!
I already send all my paper work, but unfortunately today I received a letter from the USCIS, requesting for my birth certificate. I didn?t send it the first time, cause I thought with my passport was more than enough, and also cause it was in Spanish.
Now reading this web page? http://www.usabal.co..._cert_info.html
In the bottom of the page says that to translate a document it doesn?t need to be trahnlate by a certify interpreter, is just enough if its not a family member. That information is correct? Can I ask to any of my friends to do the translation for me? Or does somebody knows where can I translate my birth certificate??? I am in Orlando. Thanks so much!!

IR-1 / CR-1 Spouse Visa Process & ProceduresIncome Requirements for I-864 EZ
QUOTE (JTM123 @ Aug 18 2007, 09:02 AM) <{POST_SNAPBACK}>
Hello there,

-I am the petitioner
-My wife is the only person immigrating
-I am only using my income (No assets, co-sponsors)

Currently, I am in the process of filing I-864 EZ for my wife. In Line 18, it says "My Individual Annual Income is currently:" Now, during 2006 tax season, I was employed by a different company making around 50K.
I have changed my job since then and moved onto a better paying job in April of 2007. Which salary do I use for the purpose of this form I-864EZ? Do i use the old salary (shown on my tax return) or my new salary (possibly a letter from the new employer)?

Anybody here with a similar situation?

Thanks again
John

Your income from the job you have now.
I would also suggest you take out insurance on her thru your work.
Even though you do not have a ssn yet, a copy of the marrage certificate and they have to honor the marrage with insurance.
Soon asd you get the papers. Include them to show you have allready accepted financial responcibility of your wife.

WOW!

That is beyond me!

I can say this.

My 129F was sent to USCIS for investigation.
But they approved it a couple weeks later.

As for your problem. You really need a attorney.
Sounds like you have a nasty fight on your hands.

Good luck

we will pray for you
