You need to send originals of the forms, but not everything else - assuming that you kept original birth certificates at least?

Anyway, if you just mailed in originals of your evidence, you'll be ok most likely since you have copies. Keep trying to gather evidence of your relationship to take to the interview & take the copies of what was already mailed. Keep in mind that you won't get anything back that you give to USCIS!

Nairobi is the consulate for K-1s from Uganda, so anything you are filling out would need to have the Nairobi address.

Good luck! We have a thread (kind of buried at this point) in the Sub-Saharan forum for people going through Nairobi with lots of experiences. It can be difficult to find reviews and such because VJ does not have Nairobi listed as an available consulate when you are creating your profile/timeline!

(PS - I see what you are saying about the address (ie, putting it up top as the place you are addressing it to.) We did the same thing - just use the Nairobi address.)

K-1 Fiance(e) Visa Process & ProceduresReady to begin our Journey

First of all I just wanted to say thanks to everyone who contributes to the forum. I've have found a wealth of information on here and feel more confident now beginning this huge process. Oh yeah I just proposed to my baby last week in Mallorca weeeeeeeeeeeeee.

First a little history in case it helps to answer any of my question.

My Fiancee: Thai Citizen who has been living in Germany since she was 11, she married a German man and was later legally separated and finally has gotten her divorce official as of a couple of weeks ago. We have been waiting on the paperwork from her lawyer. So in case you didn't catch it she was married and divorced here in Germany.

Me: U.S military who was stationed in Germany and met the love of his life 4 month before he had to move back to the states. I wish we would have met earlier so we could go the DCF route but oh well. I am now in Germany on a short 2 week visit and proposed (she said YES!) and coincidentally she got her divorce decree from the court while I was here. That is one of the main documents we were waiting for before we could file.

So my questions) are....

1. All of her documents...passport, previous expired visas, current visa she is listed by her maiden name and we plan to file all the paperwork using her maiden name. The only paperwork that we have that list her married name is her actual divorce decree. Does she need to go thru the German system and have her name legally changed back to her maiden name before we can file? I'm pretty sure I know the answer to the question but just wanted to bounce it off of the forum.

2. Her father/mother are deceased and she doesn't know any of his details (date of birth/death/birth location). How important will this be...will it be ok if we can just add an explanation to the form?

3. As she is a Thai Citizen someone told her that she would have to go Thailand and register her previous marriage/divorce. I call BS on this as she was married in Germany and Divorced in Germany so anything in Thailand shouldn't matter. Am I correct in my thinking?

I can really only address your 2nd question. My husband's parents are also both deceased and he just wrote their names and "unknown" in every other blank - except the blank for city & country of residence, where he wrote "deceased." His K-1 was approved and we put the same thing on his AOS application which is going well so far.

Your first & third questions I have no experience with, but hopefully someone else will!

Hmmmm I'm not sure. It's certainly not illegal to be living abroad while the petition is processing, I know someone who did that. But it may raise some questions I guess if your permanent address with USCIS is listed abroad. There's also the chance that the mail wouldn't get to you anyway, since I doubt they put international postage on the NOAs - I'm guessing they are just run through a machine.

Is there anyone in the US who could collect your mail for you? That way you could have their address listed, it wouldn't cause any strange questions and you'd be sure you had access to any important mail.

I filed an online change of address, while abroad, so that my mail can be collected and I can receive any mail sent from USCIS. I just realized there might be a chance that this is some sort of mistake or it is illegal or it might come up during the interview process, etc. Am I being paranoid? I just don't want to do something that jeopardizes this process, of course. If I messed up, can anyone suggest a solution.

I live in the same address and never worked abroad should I typed in the same address??? Or put n/a????


We just put Sifa's last address in Kenya there, even though it was also listed in the address section before that. No problems arose.

The employment verification letter is not required, just can be useful. What kind of documentation does she have? Tax returns/transcripts and recent pay stubs? I think that would be sufficient as long as she is over the income guidelines.

Are you applying for a K-1 or for Adjustment of Status based on a K-1? Either way your co-sponsor does not need to write a letter. For K-1 they will need to fill out an I-134 and for AOS they will need to fill out an I-864.

Keep in mind that for either one YOU as the primary sponsor will also need to fill out one of those forms (even if you have no income...you are the sponsor, they are just the co-sponsor.)

Well Ladies and Gents, I got the second official notice of action from the USCIS, they said they sent it May 11th, but I got it today, so 1 week.

So at the end of this week, I am gonna call the NVC and talk to them, I was reading the NOA2 and it stated that NVC would send me a notification in the mail, so Im curious because I hadnt read this happening before.


Yep, you'll get a letter from NVC saying they received your approved petition and are sending it on to the Embassy in Russia.

Everyone's online case status says that when the petition has been approved. It doesn't mean that your fiancee is going to get the visa without an interview and medical exam.

The I-129F is run through USCIS. The interview and actual visa issuing is a Department of State thing. I'm fairly certain they use the same case status update check page for ANY petition or application filed through USCIS, some of which will include interviews THROUGH USCIS which is when that one would be updated. Since the I-129F does not include a USCIS interview, it's in post decision activity once they have made the decision to approve your initial petition. It now moves on to DoS where she will have the medical exam & interview at the consulate which is when they will decide whether or not to issue the visa.

You are through a major part of the process! I hope the rest goes smoothly. Prepare for the interview & medical exam - check out the forum for the country your fiancee will be interviewing in, they will have lots of helpful tips I'm sure :) Good luck with the rest of your journey!

You should be fine as long as it's not a legal ceremony. I would avoid carrying like...a photo album of the wedding in her luggage, but otherwise as long as you LEGALLY marry in the United States it's ok to have a non binding ceremony in another country. Most of the time people only run into trouble with this at the interview, which will clearly be over by that point.

Varies by Embassy really. I was in the same situation and I only brought my 2008 return which didn't qualify me. But I had employer letter, pay stubs, bank statements etc showing my current income...that was fine at the Nairobi Embassy. The CO briefly glanced at my tax return and then just handed it back to me (I went with my fiance to the interview.) He only kept my info regarding current income. You'll want to check with others who have gone through Finland though.

You may want to go ahead and request the transcripts. Can't hurt, it's free, and you'll need them for the AOS anyway - they are required at that point even if it doesn't qualify you or reflect current income.

Hi, i don't know if anyone can help clear my mind and maybe put me at ease (probably not, it may go the other way) but i have my medical on the 30th in London, i am type 2 diabetic, it is quite poorly controlled i.e i have missed prescriptions and appointments, however my last Hb test my blood was 9.1, i know its high but not that high, and all my other functions were normal i.e kidney, thyroid, cholestorol, urine and blood pressure. I am tablet and diet controlled, not on insulin, im just worried now that this is gonna cause me to fail my medical, i know they dont primarilly look for diabetes but when i declare it im worried they are going to want to see my records...i should add that i do now have it under control and have got my head around the fact that i am diabetic..the last Hb test was done with me taking my meds over the past 6 weeks not the 12 weeks that they test for which is why it is still high, the nurse told me that my next one will be a lot lower...i am really stressing about this and i know it's my own fault just been hard over the years to come to terms with but i now have a hold on it, anybody else been in similar or same situation??


Don't worry about it - the government only cares that you don't have an infectious disease that you could potentially pass on to others in the US. As long as you don't have anything like that, you are good to go for immigration purposes.

I wouldn't worry too much. My (now) husband applied for a student visa back when I first moved back to the states & I was on some of his forms (including using my address as his residence while in the states.) He did not list me as his girlfriend at the time and he was approved for the K-1 without question. Just be honest on the forms that you have applied for a visa and been denied before & you will likely be fine :)

I just want to add that I received packet 3 yesterday. Instructions said that I will need to submit I-134 @ the interview. Sometimes even CO's don't know what is correct I-864 or I-134. I know for sure that I-864 needs more proofs and supporting documents than I-134. I advise you to prepare both forms and bring to the interview. When the CO asks for one he will probably be specific and you'll be able to provide him with which ever form he asks from you.


I would agree with this - probably best to have both forms prepared, that way no matter what they ask for you have it.

Include whatever pictures you like, but I wouldn't count on USCIS examining them to the point that they notice what shirt you are wearing and make the connection that it must have been taken within this year. We did date stamp a few of our pictures when we were together knowing that we were going to be filing the petition, but for most of them we just wrote on the back who was in them, the date they were taken and where we were. Don't stress too much about the pictures :)

While in final preparations to send off our I-129F packet, I just realized a possible problem with my the debit card records that I'm using as a prominent part of the evidence of meeting. At the top of my checking account records both my name and my dad's name are listed; this dates back to us having some kind of tied account when I was in high school, which I never bothered to change. Now, I think that the interplay between my debit-card records and the other evidence I include is pretty strong, so that only an incredibly ####### examiner would give an RFE on the basis that it could have been my dad who met her on various occasions rather than me.

Still, I'm a little worried, since from a cursory examination of the checking account statement it's not clear at all that it's a record of exclusively my transactions. I figure there are three options:

1. Don't mention it at all -- assume that they either won't notice it or will understand that my account is just tied to my dad's name.

2. Mention it briefly: "Please note that the name of Recondite Grape?s father, Elder Grape, also appears on his debit-card records, as Recondite Grape's checking account is tied to Elder Grape's."

3. Mention as in #2 but also provide "proof" of the fact that this is my checking account in the form of a voided check that has only my name on it (and the same account number). One problem is that it's not clear to me that this is really proof at all or just question-begging -- is it common for a check for a joint account to have only a single individual's name on it?

My bank account when I sent in the I-129F also had my mom's name on it (same issue - just never changed it) and I used my bank statement from one of the times I was in Kenya to show withdrawals there. No questions were asked. I didn't say anything about it at all. Do you have boarding passes or entry stamps in your passport showing that YOU were in that country on the dates you are showing on the bank statement? If so I say go with option A definitely - I doubt it will cause any problems.

Also in response to your question, when I shared an account with my mom I was the primary account holder. All of my checks, debit card, etc only had my name on it. The only thing that had my mom's name was the actual monthly statements.

Check your state/county requirements for a marriage license...in Texas you must use a marriage certificate within 30 days of it being issued otherwise it's not valid, so I don't think that would be all that useful for the interview. If you already have invites and such drawn up couldn't hurt to take those though - I have read about others on here doing that.

I don't think that's the case. Perhaps the person you were speaking to is ill informed. When your fiance receives the social security number, the card should say 'valid for work only with DHS authorization' which is your EAD. Your original understanding is more accurate.


Correct - the person you talked to didn't know what they were talking about. The lady that did Sifa's SSN also told him that he could work once he got the SS card which isn't true. The card came in a week or so later and says "Valid for Work Only With DHS Authorization" just like bluenoser said. It's amazing sometimes how little government workers know about these things. You/your fiance won't be able to work until they get the EAD or the green card after applying for AOS.

DCF can only be filed for a spouse (CR-1) visa, not a K-1. Also both parties have to be living in the same country (for most people this means that the USC is living in the country of residence for the non-USC and has been there for a certain amount of time - not just visiting.) You'll need to file the traditional way.

Hello?There is a difference between K-1 Visa and K-3 Visa. K-3 Visa mean you are already married..so how do you know what would take less time? I am in U.S.. My fiance is in Ireland. I know there is a way to cancel it because it probably won't get approved due to the 134 form.


Right, but the K-3 or CR-1 still takes time. There is no visa that is automatic, even if you are already married, so you're still going to have to wait. Why not just stick it out with the wait you already have 3 months invested in instead of starting all over and waiting (still separated!) again?

The only thing i can think is her birth certificate was in spanish, or maybe because her letter of intent to marry was missing... It's probably for her letter of intent. That is definitely required from both parties. The birth certificate is not required at the I-129F stage for the non-USC, I don't think. Either way, get back whatever they need ASAP and your case should proceed normally :)

The Embassy in Egypt may not HAVE a pink slip. Everything varies by Embassy. My (now) husband was given a blue piece of paper just saying to come pick up his passport a week after the interview (Nairobi does not mail you your passport/visa, you MUST come pick it up.) Don't worry about getting any slip at all, just focus on what the CO tells you to do.

If you do get a slip of paper it would be directly handed to you at the interview, not put in a folder or anything else. Don't worry about it - just do what the CO says in order to get the visa. Check with others who have gone through your Embassy/consulate - they will tell you more specifically what EGYPT does.

Good day ! just got my EAD last saturday,but the middlename as typed by the USCIS is my middle maiden name,below that name is my signature which i used my last name before i got married..during my biometric,the local office staff asked me what middlename to be used,so i finally said to have my last name as my middlename since that's the system we've used over Philippines..now in the EAD,things i expected is wrong...would this be a problem?


I think they have to use whatever middle name you put on the actual application, not what they ask you it is at biometrics. What did you put on the I-765? If you used your maiden name as your middle name there and all of your other documentation says that you might call - EAD won't be valid after you get your GC anyway, but it might be good to check before that's issued & is a bigger hassle.

I've never heard of a case where USCIS was actually able to match up random paperwork sent into them with the correct file unless they specifically asked for the paperwork by sending an RFE. Guarantee that your case was denied because you didn't send in the proper documentation WITH the I-129F in the first place. You will need to completely reconstruct all of your paperwork - and send in a COMPLETE package this time. USCIS will not use whatever paperwork you sent in before.

Hiring a lawyer will not make your case go by faster...everyone has to wait in the same line whether they do everything themselves or pay someone to fill everything out and put the package together. Just follow the instructions, do everything again and send it all in TOGETHER! :) In my opinion, forget about the original petition you sent in. An infopass will not help, do not file to reopen the case, etc. Just start over and take your time to do it correctly - that will be faster than trying to go through USCIS to open a case that they will likely just deny again or take forever to decide anything on.

I think a copy would be fine. We didn't receive our NOA2 until well after the interview (long story...) and were never asked for it at all. I have it now, finally, since we will need it for AOS.

If I were you, I would make a copy of every page of the passport for proof of US Citizenship, then another copy of the relevant pages with the stamps & the bio page (so they know it is your passport) for the evidence of having met section. When you put the packet together you'll be organizing it in a specific way, and while it seems like USCIS would be smart enough to figure out that the passport stamps are supposed to double as proof of having met...I wouldn't take it for granted.

When my husband picked up his visa, the CO said to triple check that the name was spelled correctly, the expiration date was correct, etc. Apparently a few days before 2 women had come in because the date on their visas had been misprinted (it said 2007 instead of 2010...big error.) They didn't check, went to the airport & were turned away. The embassy said it would take a few days at least for them to re-print them with the correct date. I wouldn't buy ANYTHING before you have visa IN HAND!

Yep, that's pretty much what would happen. As others have said, a K-1 is only for a fiance(e) so it is no longer an option if you get married.

Actually I got 2 forms: one was a letter, typed on white NVC letterhead, saying that they had received and processed the approved I-129F from USCIS and were sending it on to the Embassy in Nairobi (this sounds like what you found.) The NOA2 is different...it looks just like the NOA1 (printed on that colorful paper with the Statue of Liberty on it) saying that your petition has been approved. THAT is the paper you'll need for AOS, not the letter from NVC.

We didn't need the NOA2 at the interview at all, only at AOS, although I'm sure they could ask for it at the K1 interview. Hope you can find it!

1. I included lots of handwritten receipts for hotels, bus tickets, ferry tickets etc (I never once in my almost 2 years spent in Kenya got a typed up receipt for a hotel or bus, ha) with both of our names on it and they accepted them.

2. We also included stuff like this. I had a letter from Peace Corps saying that I volunteered at the hospital in my town, and he had a letter from his employer saying he also worked at that same hospital during the same time period. Does that necessarily mean that we met? No, but it still counts as evidence. If you can include something showing that you were ALSO living in that same town at the same time, go ahead and include it. (You may want to attach a post it note explaining the connection...)

3. Good evidence as well.

Do you have passport stamps showing entry? Work visa showing the time you lived in the country? Plane ticket stubs? What you have is good, just include anything you can possibly think of and it will help you feel better about the whole thing :)

Then I was evacuated from Peace Corps and didn't get to see him again until May 2009. 17 months! It SUCKED. I saw him for 2 weeks in May 09, then again in January 2010 for his interview for 10 days until he finally moved here in February 2010. I feel your pain. Just keep pushing forward - soon she'll be here and you'll have the rest of your lives together :)

My (now) husband was denied for student visas twice and we had no trouble with the K1. As long as the other visas weren't denied for something serious (like misrepresentation or something) and were instead denied for something like intent to immigrate to the US, you should be ok. Just get your relationship evidence in order and go read up in the MENA forum to get info about what your consulate wants to see.
