K-1 Fiance(e) Visa Process & ProceduresAOS: Wait for RFE or Send Missing Part Now?

Greetings!  My wife entered the US on a K1 visa and we were married shortly after.  We submitted our AOS paperwork, but realized later that she needed two additional vaccinations for the physical.  We went to a civil surgeon and she got the vaccinations, and now have the sealed envelope with her updated I-693.  We already received the AOS NOA1 and she did her biometrics.  I fear that if I submit her updated I-693 before receiving an RFE it will be lost in the USCIS bureaucracy and then I will get an RFE anyway.  If I submit now and still get an RFE, I would have to go back to the civil surgeon to get a new sealed envelope to answer the RFE.  But maybe my fears are exagerated and USCIS will match up her new I-693 and it will eliminate the delay of an RFE.  Any suggestions?  Wait for the RFE or send the sealed I-693 now?

No issue doing follow to join, just make sure to start the process early enough so that the K2 visa is issued before the date your visa was issued.

 

Minor children who are identified and listed in the approved I-129F petition may follow-to-join their petitioned 
parent. However, such follow-to-join K2 visas can only be issued within one year from the time the parent 
was issued the K1 visa. After one (1) year, they will no longer be able to derive immigration benefits from the 
I-129F petition and you or your spouse will have to file an immediate relative or second preference petition for 
them to qualify again for immigration benefits.

Upon checking on my WAC# at the USCIS web site, it indicates that the petition is on initial review as of september 9. 2014. My question is how long usually it takes to received the NOA1 and NOA2? And my when my fiancé filed the petition he have not yet send the I-130. Is the USCIS will request for it before I received my NOA2? Or it will be during my interview?

If our application is receive, how long usually do we have to wait for a schedule interview?

 

 

Once NVC gives your fiance the case the case file number and your case file has been forwarded to the embassy, for Manila you are in control of scheduling the interview date.  I am not sure how the embassy in HK does this, you need to access the embassy instructions letter for HK (I am sure it is on their website) as they may assign the interview or you may be scheduling your own interview - each embassy has their own way of doing things.


the final verdict will be during your interview. The consul will be the one to say if your requirement meet the guidelines. But most k1 visas are approvedanywas so no need to worry ?? The most important thing to bring is your fiances ITR AND W2. recent ones.

 

All required documents and forms are listed in the embassy instructions letter from the embassy doing the application.

There is no issue doing the I-129F petition process with you being in Hong Kong and your children being in the Phils, there is a section on the I-129F, page 3, to list the children.  

 

If you are going to be processing your visa in HK make sure to use your address in HK in part 2 section 3 (NVC will go by this address when determining which embassy to send the case file to, NVC does not bother to look at part 2, section 36).

 

A family member can assist the children through the process in Manila.  It may be good to get a power of attorney to this person.

 

If you plan to fly back to the Phils to complete the visa application DO NOT put your Hong Kong address in Part 2, section 3 ... put your home address in the Philippines there.

Not sure how it is done in Hong Kong, but in the Philippines you schedule your own (in this case for your childern) interview date online.

What I like more than anything is it clearly spells out the name after marriage. So you don't get some bureaucrat telling you what you can and cannot do with the name after marriage, when its only their opinion and not the law.

 

Exactly!  And the bureaucrat that sprang to my mine was SSA staff, I read of them giving many so much ####### about their married name in the traditional Philippine format.  Now we didn't have that issue but the guy behind the counter was pretty sharp.

Minnesota's marriage license allows for changing your name completely, including your first name. The name after marriage and before marriage will be shown on the final marriage certificate. BTW my first wife took advantage of this option to change her name from the long form of her first name, to the shortened version of the name. When we got divorced, she changed back to the long version. 

 

 

That is very interesting.  There is a solution for many then... get married in Minnesota!   ;)

 

Wonder if there are other states like that, be nice to have a list, it would come in handy on here.

Change her first name?  Can't change the first name just because one got married.   Need to go to court for that.

  I am new here and probably would not have bothered joining but our K1 Visa has hit a snag. To make a VERY long story short my fiance' went for her interview and they kept her passport and papers but gave her the dreaded 221G requiring more information. They asked for her cenomar and NBI clearance using her former married name. The Clearance came back fine but the cenomar shows she married a Korean in 2001 (a moonie to be specific). Needless to say we were both kind of taken by surprise. Don't get me wrong as she has been more than truthful about this whole thing. I knew that she had been part of a mass wedding and that she was a "mail order bride" which is quite illegal. She was told the marriage was not real and that the real wedding would be in Korea after she had been taught by the "Unification Church" about their ways. She bailed out before this ever happened but the cenomar still shows married. She went to her local Civil registrars office to get a certified marriage license but they had no record even when she provided the license number as well as names and stuff. She got a certified letter stating that there is no record of marriage to the Korean.

   I guess my question is, can she simply get an affidavit swearing that she is single? I am so afraid this will have to go through the courts there and could take us well past the one year limit on producing the documents the consulate asked for. Any help or advice would be greatly appreciated. 

 

 

...whoa, this is interesting and sorry to say I think it will be a challenge as well.  My thinking is the local civil registrar is going to have to communicate with NSO to get the CENOMAR updated/amended... whatever.  And I don't see this being simple, (even thought it should be) ... after all this is the Philippines.

 

You are going to need the civil registrar to send that certified letter stating there is no marriage to NSO then hope that NSO doesn't need anything more then that to update the CENOMAR.  At least that is where I would start.

Now, I have a scheduled interview this Oct and I am unsure if the consul will accept my answer about me meeting my fiance under craigslist, since i think craigslist might be categorized as a fraudulent site? Please enlighten me on this issue. Should I tell the consul about the exact website or just say i met him thru a platonic website? Thanks for your answers in advance!

 

You met your fiance online, many have met online.  What the CO will be looking for is a genuine, ongoing relationship ... no fraud.  If you relationship is genuine and your evidence shows this then I don't see the issue.

 

Craigslist is different, but I know of some that met online playing video games.

More often than not, you will not be allowed to update your name on your SSN with just a marriage certificate. We attempted this in Phoenix and were denied and told that we have to have our EAD at a minimum. I even had the AOS NOA-1s and they said that wasn't good enough because they have to verify the new name in the SAFE database.

We also got the same run around with Arizona MVD. They would only issue my wife an ID card in her maiden name (which is the name on her K-1).  Funny was that in Arizona you sign a card for your photo for the ID first, then turn in the form for the ID, and she signed it in her married name, but the ID was issued in her maiden name. So her signature doesn't match her ID! :oops:

 

The bank didn't care about needing an EAD and happily added her to my account with her married name.

 

So I guess you don't want to hear that we went to SSA and applied for the SS card in her married name two days after we were married (Traditional Philippine format), brought a copy of her I-94, passport and marriage certificate.

 

 

The marriage certificate IS the required document for changing the SS card to the married name, SSA wants to see a certified copy.  One other fact is that SSA requires they be notified when you get married and change your name.   You got one of the many idiots working at SSA.

 

PLUS SSA requires a person to notify SSA when your change your name so they can update the records.  You for sure got an SSA idiot.  The card has already been issued (in your case) they do not have to check SAFE again, they just have to see the marriage certificate (certified copy will do).

 

Name change

If you need to change your name on your Social Security card, you must show us a recently issued document as proof of your legal name change. Documents Social Security may accept to prove a legal name change include:

  • Marriage document;

In most states, once married your simply start using your married name, there is no process, so you use your married name for EVERYTHING... including AOS documents!   

 

You grab a certified copy of you marriage certificate stop by SSA get your SS card updated, you get your driver's license update, the bank... well you get the idea.

It's been two weeks since my interview date I still haven't received any confirmation from the courier (2GO Ayala) since it is for pick up. According to travel.state.gov the visa status should be available online 7-10 days, mine is more than the time frame. I also checked at https://cgifederal.secure.force.com/ the Document Delivery Information at my dashboard is blank but the first week after my interview it says Your Passport is still at US Embassy. I also sent an email at passportstatus@ustraveldocs.com ... they replied There is no status update available for the passport number submitted. Again..the first week after my interview it says Your Passport is still at US Embassy. Checked at http://www.ustraveld...ortretrieve.asp same message  There is no status update available for the passport number submitted.

 

10 days means nothing.  There is no time frame for the embassy approving your visa.  Until you see ISSUED for status on the CEAC website.... you need to be PATIENT.

 

 

Yeah, time to call the embassy and figure out why it's beyond 10 days.

 

"If you have not received your passport in more than 10 days after your interview, please contact the Embassy call center at (02) 982-5555 and (02) 902-8930, from 8:00 a.m. to 8:00 p.m., Monday through Friday, to track the delivery of your passport."

 

10 days means nothing.  There is no time frame for the embassy approving a visa.

For my then fiancee's (now wife) interview, there wasn't a verbal oath about the 90 days but the CO did ask us about our plans for marriage that we understood we had 90 days to marry. She just never actually wanted to see the actual LOIs that we prepared and brought with us.

 

 

You were not asked to take an oath.   And you did the interview in June 2014.   Yet....

 

 

Yes there is an oath you must read at the interview.  I can't remember exactly what it said, but I remember it was posted at the interview in 3 languages:  English, Tagalog and Bisaya.

 

There was an oath when you interviewed.   And you interviewed in July 2014  (a month after Paul & Jesica)

 

 

OK?   Did one CO forget to take the required oath?  Or is the oath not required?

The 90 day marriage statement was on the I-129f  back in 2011, the 90 marriage oath was also on the 156K, back in the day, that the applicant had to sign in front of the CO.  PLUS the applicant had to take a verbal oath swearing to marry within 90 days in front of the CO during the interview.

USEM rarely asks to see the LOI, even though they state you need to have one.  However, for documents, like that, if they request, they will want (and probably keep) the originals.  The CO wouldn't accept copies of any of the documents they requested, we had to give them originals, including the CENOMAR, BC, and NBI clearance, none of which were returned.

 

So if they do end up asking for the LOI, you are gambling if only produce a copy instead of the original.  While a color printout of a color scan may look to be almost original, it lacks the impressions of the pen used when signing the document and the CO can tell it is a color copy....

 

I agree the embassy does ask for evidence of a genuine relationship with clear intention to marry so yes it would be good to have the letter even though I have not found anyone that has been asked for the LOI in years.  As the saying goes it best to have all the bases covered then to gamble.

 

h. EVIDENCE OF A GENUINE ENGAGEMENT. You must be prepared to prove to the consular officer 
that you have a genuine relationship with your petitioner and a clear intention to marry within 90 days of 
admission into the U.S. In the past, successful applicants have submitted photographs, letters, e-mails,

USEM has not asked for a Letter of Intent in years.  If you feel you want it have your fiance complete a new one that is SIGNED and send it to you.  Other wise forget about it and go do your interview.

CFO has never asked for a Letter of Intent.  What is most commonly asked for at CFO is listed in the guide in the link below.

 

Correct me if I'm wrong, but can't you sign it for him using his signature? As far as I know, as long as he knows about it and he approves of it, it will be okay. But still, I'm not sure. :)

My fiancee and I are planning to process a K1 Visa for me next. She is a US Citizen and I am a Filipino Citizen.
I read the USCIS website and checked the requirements and I have a question on the Financial Support part.
She had been living with her father eversince and has not really worked.
I know she needs to meet a required amount as her annual income that's why we have talked about her starting to look for a job in 2016.
With this, do we still need to get the 1040 and W-2 for 2015 before we could start the process? Also, I read somewhere that what they really need is 3 years worth of 1040 and W-2s. Is this correct?
 
Any inputs on this is greatly appreciated.









 

You don't need to present a tax return to start the I-129F petition process, but you will when everything reaches the actual visa application process in Manila.  2016 is two years away, the first tax return wouldn't show up until 2017.  The embassy will look for evidence that you will not become a public charge, so your fiancee will need to have income to meet the requirements of the I-864P

 

Only need the most recent tax return, not 3 years.

On the St Luke site it states we need:

 

3 copies of NVC letter/email when MNL# is assigned ( SLEC requires the NVC letter/email OR the appointment confirmation letter from the embassy that lists the beneficiary's name ).

 

Since she hasn't received the Letter yet from manila (package just was sent yesterday). How far out should we schedule the interview?

 

SLEC is not asking for the (worthless) letter that USEM mails out that states "you are ready to start the visa process", it is asking for the appointment confirmation email/letter - you will print this out AFTER you schedule your interview online.  You need either the NVC letter/email or the appointment confirmation email/letter

 

 I suggest scheduling the interview about 4-5 weeks out from when NVC mails the case file to USEM.

You could go to the local civil registrar to correct name issues on the BC, not sure how long the process takes. Most don't bother.

Do what the instructions letter states to do; bring the confirmation page from your (current) DS-160 to the interview, that will be the DS-160 reviewed.

Well one fact is once the DS-160 is completed you print the confirmation page with a bar code to being to the interview and THAT is the link to the DS-160 for the CO so even if more than one was completed the confirmation page would clear up any issues.

I canceled a K1 last year after NOA2, and when I got a letter back from the Embassy in Manila it was a form letter and it said Visa was withdrawn by Petitioner and or Beneficiary, and they had circled the Petitioner  with a pen.  I was Petitioner

 

For the OP

 

I would send a letter to USCIS, DOS, NVC and US embassy in your country and wait for feedback, it took me about 3 months to get withdrawl letter.

 

That cancellation was after USCIS approved the petition, thus it was cancelled at the embassy - and at the embassy phase either can cancel ... different from what the OP is asking

Sadly my relationship has ended as i decided i didn't want to move to the USA and leave everything behind.

It hasn't ended well, we are not on speaking terms.

I am wondering how i can (the beneficiary) cancel the I-129F, we have not been approved yet?

Can't do much at the USCIS stage of the process, but once it reaches the embassy it is very easy for you to notify the embassy you are cancelling the visa application.
