K-3 Spouse Visa Process & Proceduresfiling the the U.S., but interview overseas
I filed my wife's k-3 visa process here in the states. Her interview will be overseas. From what I have seen and heard, the nvc will mail all my documents to the embassy overseas. Since the embassy will have all the documents, will my wife need to take copies? For example, ds-230, ds-156, ds-157, i-134, copies of my w-2's, and proof of financial support. I know if the process would have taken place overseas, she would have to, because the embassy doesn't ask for all of the document's until the interview. Since the embassy will already have the doc's will she need to take copies? god bless, and happy easter!!!

IR-1 / CR-1 Spouse Visa Process & Proceduresprocessing dates not able!!!
The VSC received my I-130 June 16th, 2007. The next couple months I was checking what dates they were processing the 16th of every month!! It was helping to know when my I-130 would be touched or approved!! In September, the lazy people in the USCIS stopped posting the dates and started putting 6 months. Leaving everyone in the dark, unable to see when they would get to documents. Last month when I went to look at the processing dates there was a paragraph saying that people who filed in June 2007 and after could expect longer processing times!! My 2 questions are, "Does anyone know the processing dates for the I-130 at the VSC right now?" or "Has anyone had there I-130 approved at the VSC who filed after me?" Thanks for the help and god bless!!!!

K-1 Fiance(e) Visa Process & ProceduresI-864 problems
The first time I filled out the I-864, I put my wife and daughter as dependents. Soon after I called the U.S. embassy. They told me that I didn't need to put my daughter, because she is already an American Citizen. I filled out a new form and excluded her (my daughter). I sent it in the next day feeling confident.
After mailing the letter, I found some more info online. This info was about the next steps in the process. I saw that at the interview the embassy will want another copy of my I-864. I thought okay no problem, just fill out the I-864 and DS-230 and I'm good. The problem is that on the DS-230 they want to know about any children and who will be traveling to the states with my wife. On number 19, they ask about the birth place of any children. Number 21A asks who will be traveling to the states with my wife. I am worried that since I didn't put my daughter on the first I-864 it could hurt my wife's chances of coming to the states. They could see that I do have another dependent, and that she is traveling to the U.S. the same time as my wife. On one form it will have her traveling alone and only having two members in our family. When they flip the page, the DS-230 will say we have a daughter and she is traveling to the U.S.
On the next I-864ez that the embassy wants, should I put my daughter? Will this be a problem if I didn't put her on the first I-864? I'm between a rock and a hard place, the lady at the embassy really screwed me, I'm thinking. Any info would help, i'm really frustrated and need to know what to do!! Thanks for your time and God bless!

K-1 Fiance(e) Visa Case Filing and Progress ReportsOur case is progressing

Hello,

We first received the first notification from USCIS on December the 3rd via text and email. Then got the hardcopy of NOA1 via mail few days ago. This morning, we received (my fiance - the petitioner) this notice via text stated that:

On December 10, 2013, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E). Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance

And, when we checked online case status on USCIS website, there's further notes to above text message stated:

During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.

Can anybody tell me what is it exactly?

From my understanding, it is a notification to let the petitioner know that the beneficiary has already been assigned Alien Registration Number but, we will not know the detail until the petitioner received formal notification of NOA2. So, yes it is still under ?initial review? stage where the process now advanced and if we refer to K1 flow chart guidelines, we are still at Step 3.

Can anyone enlighten us on this? Many thanks!

Azeera

K-1 Fiance(e) Visa Process & ProceduresFiance visa and religious ceremony

If it is a legal marriage there, then it is a legal marriage for the purpose of immigration. You cannot get married and then enter the US with a K-1. A K-1 is for unmarried persons only. The marriage must take place in the US within 90 days of entry. Your K-1 would no longer be valid and you could not enter the US with it if you marry first.

Dear Jay-Kay,

Many thanks for the link. We missed this document before! This document is very helpful, indeed! ;)

And, to all members that responded to this thread, thank you so very much! And, this really put both of us back on the right track. Sometimes, it is easy to lose sight of things that very critical throughout K1 visa process. As in my case, we both need to consider my parent's point of view that certainly want us to get married according to religious principle. In my religion, a unmarried single woman need to get her father/ guardian permission to get married (called as 'wali'). Plus, in my country, we have dual system where Islamic laws applied to Muslims - all Muslims, while civil marriage for non-Muslim couples. The reason that we planned to do religious ceremony in Malaysia first before I fly to the US is to consider my parents and family religious background. As for now, we need to make a detour and come out with new plans and put more efforts to explain to my parents. We're thinking to bring my parents to the US and do the religious ceremony after we register the marriage under the US civil law. The religious ceremony can be held in Malaysian Embassy or mosques nearby. But, by doing this my parents need to apply for B1/B2 visa category.

Additional to my note earlier, we would like to know whether this move will complicate the K1 visa requirement.

K-1 Fiance(e) Visa Process & ProceduresFiance visa and religious ceremony

Hello,

We send out the petition in November and we received Notice of Action NOA 1 in December 10th, 2013 confirmed that our case is in initial review stage. As a Muslim, and in my country to be able to legally married, Muslims need to register their marriage under the Syariah law. My fiance and I is planning to do the religious ceremony (get married under the Syariah law) once we get the fiance visa (K-1), before I move to the US permanently. But, we curious whether is possible and not messing-up the fiance visa procedures. Appreciate thoughts and perspectives from members of this forum.
