IR-1 / CR-1 Spouse Visa Process & ProceduresGeneral Confusion
nope, they will continue with the CR1 (approved I-130),

the progress of the I129F will not affect the progress of the Cr1

IR-1 / CR-1 Spouse Visa Process & ProceduresDifference Between IR1 and CR1?
you are removing the conditions not renewing the 2 year card..... you have to send in some paperwork along with some proof that you are actually together... you might have to go to an interview..

from my limited understanding of the AOS process, the AOS process is way more involved and shouldn't be compared to the removal of conditions

IR-1 / CR-1 Spouse Visa Process & ProceduresHow soon before SS number is issued?
you will most likely not get the SSN number right away .... your best bet is to go into the SSN office a few weeks after you move to the US and apply for a number.. they send the card to you in about a week....

I am sure if you explain your situation the employer would understand ...

yeah, I remember that same thing when I was going through that part of the process, they said not to use the downloaded forms..... but I had to use the downloaded ones because the lawyer seriously messed up the ones he sent me ( the smart guy thought he was being helpful and filled out a lot of the stuff but with the wrong info :P)...

anywho, the NVC never said a word about my downloaded forms

IR-1 / CR-1 Spouse Visa Process & ProceduresDS-230 Employer Location Last 10 years...
as for the employer info.. is just asks for location not the address... they don't really give you enough room on that little line to write out an address....

I think the same thing goes as for the home addresses, they just want to see if you have worked in different countries etc....

i had no way of figuring out all the specific addresses of all the different places I have lived since I was 16....

all they ask for on the sheet is city, province, country..... so if your wife moved a bunch of times but still lived in the same city, I would just put that city and how long she lived in that city.... don't worry about exact addresses

IR-1 / CR-1 Spouse Visa Process & ProceduresReceived IR1 - Now what?

I'm a USC living in Australia with my Australian husband and two dual citizen kids. We applied for, and received, an IR1 visa through the U.S. Consulate in Sydney. It arrived today (YAY)! We have six months to enter the U.S. I have some questions, though.

First, we used to live in the U.S. My husband had applied for an Adjustment of Status from his H1B visa and had a Employment Authorization Document while his AOS was pending. After five years and little movement on the AOS (9/11 happened during that time and we got caught up in the upheaval of the INS), we moved to Australia to help his family out (father was ill). My husband has a SSN and his SS Card says, "Valid for Work Only With INS Authorization." With his new IR1 Visa and that card, will he be able to work immediately upon entering the U.S.? Should we order a new SS Card with the same number? Is the reference to the INS going to cause problems?

Second, his IR1 Visa reads "Upon Endorsement Serves as Temporary I-551 Evidencing Permanent Residence for 1 Year." It has an expiration date of 1 year from the date we are required to enter the U.S. Once we enter the U.S., what do we need to do to extend this? We thought it was going to be for a longer period of time.

Basically, what is the process from this point forward? (Sorry if this seems like a silly question  )

With the CR-1, your husband can work immediately upon his arrival in the USA as a permanent resident. With his green card proof, he can go to the local social security office and explain them that "Valid for Work only with INS Authorization" can be removed now, since he is a permanent resident of USA. Social Security people know that a permanent resident can work in the USA and does not need INS authorization. The social security people then will mail him a social securiy card without that sentence. He will have same social security number.

It means, you are married for more than two years and after one year upon his arrival in the USA, he will be eligible to apply for US citizenship, if you two remain married (of course, you will, I am just telling you the rules).

This is not quite right.... You have to live in the US with your spouse for 3 years or more after activating your visa before you can apply to be a US citizen...

The OP mentioned that they are getting an IRI visa which means they have been married for over 2 years....

after you activate the IR1 visa you will get your Greencard in the mail a few weeks later that is good for 10 years.... Like was mentioned in an earlier post, the stamp in your passport is just temporary and serves as your green card till you get the actual green card in the mail....

IR-1 / CR-1 Spouse Visa Process & ProceduresA question about marriage and crossing the border...
the OP explained why here....

We don't really like the K1 or the K3 visas (for a number of reasons, one of which being that she has to spend several months or longer unemployable while within the country). The IR1/CR1 is more to our liking, depsite the fact we'd be seperated and she'd have to go back to Canada after the wedding. The thing we're looking at is the fact that she'd immediately be a permanent resident and able to work once everything was finished processing.

ok the page you qouted from says this on the top....

How Do I Bring My Fiancé(e) to the United States?

http://www.uscis.gov...wdoi/fiance.htm

the info on that page is how to move your fiance to the United States...

the OP is not looking to bring his Fiance to The United States at this time..... his fiance plans on coming to the States to visit and get married and then return to Canada.... Then they will apply for A CR1 visa so she can then move to the States....

as long as you are perfectly honest with the custom people your fiancee should be fine..... and don't give them anymore info then they ask for

the worst that could happen is that they wouldn't let your finacee in....

IR-1 / CR-1 Spouse Visa Process & ProceduresA question about marriage and crossing the border...

if the person plans to stay after the wedding, then yes they would need a visa... but if they plan on going back home after the wedding that is totally fine...

a lot of people have done that...

they might need a lot of proof that they are panning on returning to thier home country though...

I wouldn't bet a guy's future on conflicting info, though. I read the website this morning and did not see anything to indicate that this is the case. It seems sort of risky to me.

I think the OP should contact the USCIS and tell them what his plans are to see what they recommend.

what conflicting info? It is NOT illegal for a NON-USC to get married in the United States if he/she has intentions of going back to his home country....

don't worry about it  that is normal.... I had the same thing...

all they did was put a little annotation on my actual visa that said 212(g)(2)(B).....

all that means is..........

9 FAM 40.11 PN4.2 Waiver Under INA
212(g)(2)(B)
(TL:VISA-342; 01-08-2002)
INA 212(g)(2)(B) provides a waiver, in any case, where the panel physician
determines that a required vaccination is medically inappropriate. In such
cases, the panel physician will indicate this on the Form DS-2053, Medical
Examination for Immigrant or Refugee Applicant. Consular officers may
then authorize a waiver in accordance with INA 212(g)(2)(B). The consular
officer should then check the appropriate waiver box if the vaccination is
considered inappropriate for any of the following reasons:
(1) Not age appropriate;
(2) Contraindication;
(3) Insufficient time interval between doses;
(4) Seasonal administration; or
(5) Vaccine unavailable.

Marilyn.FemaleCanada2006-11-15 14:44:00
IR-1 / CR-1 Spouse Visa Process & Proceduresshots
a lot of the vaccinations on the list are not needed.... what I mean is that they are based on age....

I know here in Canada you don't need the Hepatitis B shots unless you are 19 or under.... and the only other shots you need if you are between 18 and 64 or the MMR, a recent tetanus shot and varicella/chicken pox.... but maybe the requirements are different in other countries....

Panel physicians who conduct medical examinations of immigrant visa applicants are now required to verify that immigrant visa applicants have met the new vaccination requirement, or that it is medically inappropriate for the visa applicant to receive one or more of the listed vaccinations:

-- mumps
-- measles
-- rubella
-- polio
-- tetanus and diphtheria toxoids
-- pertussis
-- influenzae type b (Hib)
-- hepatitis B
-- varicella
-- pneumococcal and
-- influenza.

Only a physician can determine which of the listed vaccinations are medically appropriate for you, given your age, medical history and current medical condition.

IR-1 / CR-1 Spouse Visa Process & ProceduresPOE failed to stamp visa!

I have a strange and frustrating issue! My husband and I filed DCF in Casablanca, Morocco. He came over here a few weeks ago through JFK POE. He tells me they were very busy and he ended up translating for other immigrants. They asked him a few questions and then said "welcome" and sent him on his way.

Nobody stamped his passport!

Now, after waiting for 2 weeks for a SS card and the permanent resident card, we get a f**cked-up letter in the mail from the USCIS service center in Texas stating that the POE failed to stamp the passport (duh) and in order to receive a green card we must send proof of a POE stamp. Did you read that? They are asking us for proof of something that they failed to provide. The letter literally contradicts itself within one paragraph.

I don't know who's worse. The agent who "failed" to stamp your husband's passport or your husband who "failed" to get it stamped.

Why are you being so mean? Your PM box is full btw.

I am not sure what his problem is

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the difference between IR-1 and CR-1?
you don't get the IR1 once you move to the US with a CR1 visa what you do is apply to remove the conditions on your green card, 2 years after your visa activation date not your marriage anniversary....

example:
Married March 6th, 2004...
Entered US with CR1 visa on April 2nd, 2005
Apply to remove conditions before April 2nd, 2007....
Marilyn.FemaleCanada2006-12-16 07:41:00
IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the difference between IR-1 and CR-1?
IR1 - married over 2 years at time of Visa activation.... you have to provide the appropriate proof at the POE...

CR1 - married under 2 years at time of visa activation.... have to apply to remove conditions between 90 days and the date of your 2 year anniversary of your visa activation...

if you come to the US with the K3 you can apply for AOS or you can go back to your country for the CR1/IR1 visa interview... but you have to let the appropriate people know that you are following through with the CR1 visa ...
