I know, same here! I'm more worried about missing an RFE/interview appointment then having troubles at the border. I suppose even if we do get an interview, they can't schedule it within the week they mail the notice can they? I would hope they'd give more notice than that. Otherwise, we might miss it if we're out of the country! We're planning on going to Canada for 4 or 5 days in mid-August.

They are breezing through August pretty quickly though, already above 60% approval rate! Maybe they'll get to September by the end of June? Wishful thinking? :blush:



VSC has picked some speed recently, August 2011 approvals on VJ is now %61.
If they go like this, they will start adjudicating September filers in this month & hopefully October filers on mid-July.

Hello All,

I know the VT process is rather slow, so I've intensionally tried not to look for the update since I filed my I-751 on Oct-2011, and bio on Dec-2011.
Today I checked my status at the USCIS website expecting to see something updated,but I don't see anything..not even mentioned I-751!!

I've received I-797 NOTICE OF ACTION(says I-751 RECEIPT NOTICE)on NOV-18.
IS THIS NORMAL that I don't see anything at USCIS website until now?

When I suppose to see the update on USCIS website?

Suddenly getting really anxious. Did I miss anything? Do I need to do something before I get the approval letter?


Sometimes they update on-line status too, but most of the time you don't see anything, you just get your approval letter in a snail mail. You haven't missed anything, so don't worry.

FYI, it is not your turn yet, VSC is doing August 2011 applications right now. You will probably be adjudicated in August or September. Until then relax & enjoy your summer !......

Hello my fellow VSC ROC 2011 sept.fillers just want to ask those who got approved if u call the USCIS to ask for a service request just want to know if we need to call them or the just start approving for the VSC which it takes 9 months waiting since we sent the application...anyway congrats to the VSC ROC 2011 who got approved...hoping we will be the next !!! have a blessful day everyone !!!



FYI, average waiting time for VSC is approximately 10 months, so you have still 1 month to go.

Mine's the local office as well


FYI, it always lists the individual's local office at the left bottom of the letter, but the approval letter actually comes from the Zip Code of 05479 which is St.Albans, VT.
You can check & see the postmark on the envelope. CONGRATS !......to September 2011 Filers who have been approved.

So, I've got...

1- our Tax information, and I guess I didn't include it the FIRST time, because we had submitted it every other time, guess we should have included it anyway. That'll be one of the first things I print out.

2- I will contact our insurance company, through my work for documents -- even though we are encouraged to print from the website (I already sent this in). But, I will request something from the company directly and send again.

3- We just re-financed our home, but because I bought the home on my own before we were married, the rules for the re-fi was that only I could re-fi under my own name. However, he had to sign off that I was doing this and with his approval (MI state laws). So, I will dig out those documents.

4- We own the cars, so there's nothing there. I already included insurance cards for our cars that show both our names.

5- I will contact my retirement person to see if she can get a formal document stating that he is my beneficiary there, too.

So, with those items, do you all think that would work??

Utility bills are not big deal, they are considered as secondary documents. The most important "primary" documents would be as follows :


1- IRS Tax Return Transcripts (Jointly Filed) for 2009, 2010 and even 2011 (If you guys have already filed) You can obtain these Transcript Request form is form http://www.irs.gov/p...df/f4506tez.pdf

it is absolutely free & it takes about 2-3 weeks.

2- For your case, the proof that you guys are expecting a baby/babies. It can be your OB/GYN's note with the signature. You can even create this kind of form & have him sign it.

3- Financial co-mingling, joint bank account statements & other financial documents etc... during his 2-year Conditional Residency.

4- House Mortgage / Deed & Car Payments etc...

5- Beneficiary (being your husband) of Your Life Insurance Policy, Your Health Insurance or some sort of Your Retirement Account or Your Pension Account etc......

If you have these documents above, you don't need secondary documents. They are very strong evidences.

They may have changed their rules in the interim. Right after I got my Utah driver license in December 2009, good for 5 years, they changed the rules so that now you can only get a drivers license good for as long as the documents you show them. If I had waited until January 2010 to get my local drivers license, it would have expired with my 2 year GC in December of 2011.



FYI, in our state, NJ they give the DL until NOA Expiration date + 5 months.

Let's say your NOA dated September 16, 2012 they give DL expiration date as February 15,2013 & indicating the licence written "TEMP. IMMIGRATION STATUS".

First of, If you don't send enough evidence again, they will call you for an interview. You know that you are married truly, but they (USCIS) don't, they have to see some proofs in hand.
Like IRS Tax Transcripts, Joint Bank Accounts, Joint Credit Card Accounts, Health Insurance, Auto Insurance, Mortgage Payment, Car Payment, Apartment Lease Contract, Retirement Fund listed as beneficiary,
etc, etc, etc...... I can make this list very long. Bottom line is give USCIS what they want & then you live your life as you wish. Don't forget it is their game & they call the rules !....

Thank you for clarifying this issue. So I guess my stepdaughter will apply separately 90 days before her conditional GC expires. Now I still have two more questions. First, in Section 5 does my wife include her name or not since she is applying separately. It still states all your children without reference as to if they are applying separately. Secondly, when my stepdaughter applies separately, what documentation she submits? I would imagine she has to submit the I-751 form, her fees of $590.00 along with a cover letter with an explanation of why she is applying separately and a copy of her GC, front and back. She will also submit a copy of he birth certificate and a copy of her passport showing the POE and date of entry and documentation that she lives with her mother and me. Thanks again.



I totally agree with "Vanessa & Tony".
Put her name on Section 5 & drop a note saying that "She will apply separately due to her arrival to US more than 90 days of my (your wife) arrival"
They are good documents but also include any school related document shows "Name & Address". & don't forget the cover letter.
In fact, she is not going to remove condition, she will inherit the permanent residency (ROC & GC) from her mother.
When mom has been approved she will also be approved automatically.

I am still confused because when you answered enigma11561, on the same subject, you advised only to fill out only one I-751 and pay 2 bio fees along as the children are entered in Section 5 of the form. Enigma11561 clearly states that the child entered several months after the principal beneficiary.



He said "Several months" later, I took that word less than 90 days, that's why. If it is more that 90 days, they have to file separately too.

I have began to study the removal of conditions for my wife and her daughter and I find the information at the USCIS site a bit confusing. It states that if you have dependent children who acquired conditional residence status concurrently with you and entered the United States within 90 days of your arrival, then include their names in Section 5 of the application. Then it goes on to say that if the dependent children acquired conditional residence after the 90 days of your adjustment then they have to file separately to have their conditional status removed. In my case, my wife's daughter entered the US four months after my wife's arrival, however she was granted conditional residence status within the 90 days of my wife's adjustment. So according to the first part she is not eligible but according to the second part she is eligible. Now which is it?

She has to file I-751 separately because she entered to US after about 120 days of her mom's arrival, not within 90 days of your wife's arrival. She doesn't fulfill the first condition. They might go to Bio on different days too.

OK I understood. Never mind the ASC appointment letter then, it is a mistake. If you are a military personnel or government employee working & living abroad,
you don't have to do Bio in US, they usually do in consulate offices but I guess she is not.
She can come to US & file the ROC during her 1-week stay (between 05/11/12 - 08/09/12) & leave the country. Make sure your father will mail the extension letter to you guys, next time she visits US, she has to show her Expired Conditional GC along with this Extension Letter (We VJ'ers call NOA or Extension Letter, officially I-797 Notice of Action) When the ASC Bio letter comes just do the rescheduling by explaining on the cover letter,but do not forget later you do later you get approval, for example VSC takes about 9 months to remove a condition.

Btw, I just want to let you know that if you guys send your ROC package too early, meaning before 05/11/12 you will be rejected; however if you send it too late, meaning after 08/09/12 you will be treated that you have abandoned your case. Also if you don't follow the ASC appointment without any rescheduling, USCIS also assumes that you have abandoned your case. The ball is in your court right now :) .

I actually have a similar situation. My husband and I married in the Cayman Islands in 2008, and have been living there ever since. My husband was granted his IV in April 2010, and we went to the States in the end of July (we were planning to move that winter, so we went looking for jobs). However, as we both had good jobs in Cayman, and were unable to secure jobs in the US (with the economy crash and everything), we decided to stay in Cayman. We have visited the US for 2 weeks in Aug. 2010, and for a month in Aug. 2011 (when he almost got a job, so we were going to stay, but it fell through at the last minute and we returned to Cayman). We are planning another trip this summer, but need to remove conditional status as his GC will expire July 30. We are still hoping to make the move soon, but cannot just up and relocate with no job prospects with a 2-year-old to feed and clothe :(.

Our plan is to go ahead and send in everything, and hope and pray they grant it and we can move to the US. Otherwise we will have to stay here another year+ and re-start the whole process. What I am most afraid of is that they will grant the removal of conditions, and then take away the GC when we go through immigration this summer, but hopefully if we explain the situation they will have mercy on us? It is not that we don't want to live in the US, just that we don't want to end up in my parents' basement mooching off them and/or flipping burgers at McDonald's!

Is there anyone who has gone through something similar? What did you do? How did it turn out? I know a lot of people who keep their GC even living overseas with trips to the US every 6 months/every year, but this removal of conditions makes it more difficult!

Your situation is not complicated very straightforward indeed.

In the meantime, gather all evidences which show the proofs of togetherness & the marriage was entered in a good faith.

1-Come to US before 07/30/2012 (Your ROC application window opens on 05/01/2012)

2- Apply for ROC (I-751)

3- Go for Bio

4- Answer RFE (If any)

5- Go to ROC Interview (More likely in your case)

6- Get approval (get your 10-year GC & apply for commuter Permanent Resident)

7- Happily ever after

8- If you like, apply for US Citizenship (you do not have to, unlike ROC) { If you are a US citizen you can stay anywhere anytime as long as you like}.

OK, I updated my timeline as best I could. I also found an old email I sent after we were denied at the border in Aug 2010, perhaps that will help? Thanks!

"Some background: My wife (a Spanish national) and I (U.S. citizen) were married in Spain in May 2008.

When we initially decided to move back to the U.S. in 2008, we completed the CR-1 process and my wife received a i-551 stamp in her passport from the US Embassy in Madrid on April 11, 2010. We arrived at the U.S. border on August 23, 2010, supposedly within the allotted 6 month window. Since we initially applied for the visa, we received work offers and will now live in Riyadh until approximately June 2012. That said, we were hoping to apply for a 2 year i-131 extension once her i-551 was validated in August 2010, as we return to the U.S. at least once every 12 months.

However, the Madrid Embassy mistakenly put the date of May 11, 2010 for the "IV Expires On" field (see attached). In retrospect, perhaps we should have tried to have this text amended, however we assumed it was a mere typo and the system would recognize we had arrived on time…. (turns out we were right…. see below). Anyways, upon seeing this (incorrect) expiration date, the border agent confiscated our package and simply granted my wife a tourist visa….. and caused us a delay that made us miss our connection…. he didn't care (and explicitly told us so).

Afterwards, we called the Madrid embassy and they acknowledged their mistake, however they said they needed the package that was confiscated by the border agent!


So we assumed that our application was dead in the water and we would have to start the whole process over. HOWEVER, a few weeks ago, my father in the USA received an ASC appointment notice (i-797C) for biometrics.. How is this possible if the border agent rejected her i-551, confiscated her "do not open" package and granted her simply a tourist visa? We are no longer in the US and will not return until July 2011."


It is kind of confusing story but forget about what happened in the past. Now you have to concentrate "how you are going to get out from this mess".

First of all, you have a Conditional GC which will be expired on 08/09/2012 which is very positive. Your ROC filing window opens on 05/11/2012. So you have 90 days to apply for ROC. Since you will come to US sometime in July 2012, in the mean time gather all evidences that you have been living together, financial co-mingling, all kind of insurance together, joint bank statements, IRS tax transcipts, airline tickets etc...( I am not going to go in details here which is completely different subject ). If you apply for ROC in July, you will do Bio in August (in fact, as soon as you receive the Bio appointment letter, you can do your Bio as walk-in, earlier than appointment date). What I am trying to say is "Act like nothing happened before, do not stir this situation which is already complicated" & also keep in your mind when you come to US in July, plan to stay about 1 1/2 months.

Secondly, could you ask your father what does it say "Case Type" box on the Bio appintment letter. I am wondering because when you apply a case you go for Bio but you have not applied I-751 yet ???? Your AOS (CR) was done a long time ago. This "Case Type" is extremely important, please learn it ASAP. Obviously you can not attend this Bio anyway, on the other hand if you don't, USCIS will assume the case (Whatever the case ??) has been abandoned. If you give me the answer to "Case Type" on Bio App. letter, I will try to help you to get out from this loop. To be continued ..........until then take care !.....

Thanks for all your responses! I will go through and update my timeline tonight. It's been a long, long process so I want to make sure the details are correct.

I can say though that we physically received the green card in Feb 2012. It shouldn't have been a problem with the mail because my parents are still at that address (in the US). She did her biometrics (fingerprint, etc) in Aug 2011. Also we just received a request the following I-751 request:

The records of this Service indicate that you entered the United States as a conditional permanent resident on 8/09/2010. In accordance with Section 216 of the Immigration and Nationality Act you must file Form I-751, Petition to Remove Conditions on Residence. Failure to do so may result in the automatic termination of your Status.

This is a bit of a unique situation, and maybe we will have to just do DCF, but I don't want to throw away all the work we have done over the years if at all possible.


Let me tell you possible scenario according to your timeline. She was approved on 08/09/2010 for Conditional GC & then she has never received this GC due to loss in the mail or returned to USCIS as "Undeliverable".
She has filled I-90 form to get the GC sometime in June or July 2011 & she went for Bio in August 2011 & then received the GC in February 2012. Now she has to do ROC before 2nd aniversary of the Conditional GC which is 08/09/2012.
What I am asking is "has she filled & sent I-90 to get the GC ?" As you know, after AOS approval, the conditional GC comes automatically in 7-14 days. I am assuming she has never received this original Conditional GC in August 2010???? If the scenario is like this or similar then it makes sense. If you give your timeline we will solve your puzzle :yes: .

Please give your timeline then we can help you better. You said you received GC in February 2012 & it says residence since August 2010.

When exactly was your AOS adjudicated ? What is the approval date for AOS ? Is thic GC a replacement for Conditional GC due to loss, you had to apply again by paying $450 ????

I can ask so many questions on and on , please be specific. Otherwise, not only me but nobody on VJ can guide you in right direction.

Hi everyone ,


I have my bio-metric appointment for June 4th at Brooklyn ASC, but my work is being bitchy about letting me go that day, not even for few hours. So, I have to either re-schedule it or try an early walk in. I am wondering if anybody knows whats the best day of the week to try your luck at Brooklyn office, Cuz I am gonna use a leave without pay to try my luck.

Also, what about other ASCs in new york like Hicksville, Holtsville, Manhattan, Port chester, Woodside ny, Just in case I get turned away by Brooklyn office ????

Also, does anybody know the phone number to call brooklyn ASC ?

You can only go to designated ASC which is written on your Bio App. letter.

The majority of ASCs will accept the walk-ins, but sometimes they don't especially if they are overwhelmingly busy.

I do not know about the Brooklyn ASC particularly. If I were you I would try my luck by being extra polite to the working personnel over there. Good luck !.....

It means you have Conditional GC until July 2013, If you would be married at the time of filing ROC, normally you would file it between sometime in April 2013 & July 2013. (ROC Filing window opens 90 days prior to you Conditional GC expiration date). Recently, I have noticed that there is a big confusion on VJ about ROC filing date. it does not mean you have to file on that day as soon as window opens, you have 90 days to file.
I will give you a real example of my filing. I am still happily married. My Conditional GC expired on August, 26 2011, I would file the first day which the window opened on May, 28 2011, (USCIS uses this calculator http://www.uscis.gov...Calculator.html ) but I didn't. Because we were going for a long vacation; I did file ROC 2 weeks before on August, 12 2011.

But your case is different from mine, you got divorced already. When you get divorced during the conditional period, as soon as you get divorce decree you can apply ROC with a waiver anytime (Between the day you get divorce decree & your GC expiration date, in your case February 2012- July 2013), in other words you do not have to wait until April 2013. If you ask me, earlier would be better. You want to get it over with ASAP. You can not apply ROC without a divorce decree even if you do, you will get a RFE. Don't forget it takes 9 months without an interview to remove a condition at VSC & also get ready for most likely an interview. So your case will take 1 year+ because VSC is very slow moving & your case will be transfered to local office after all that wait.

Bottom line is : Since your divorce was finalized already in February 2012. Gather all evidences (show your marriage was bona fide one) & get your divorce decree & apply ROC ASAP. Let's say you do this in the next month May, probably you will go for Bio in June & after that you will wait at least 7-8 months to hear someting so if you want to gain some time, earlier is better. You can still travel & come back to US without any problems while your case is pending, plus you have a valid GC until July 2013 anyway. However, you can file also after coming back from vacation in August or September whatever the month is, but by doing that you will loose time unnecessarily. It is up to you, the ball is in your court. If you don't understand some points, please ask me, I am not going anywhere :). By the way, next time don't give money to the lawyers for simple stuff like this.

Hello, my spouse just entered USA on CR1 VISA. What is the next step for us to remove conditions.

Are we going to recieved GREEN CARD in mail or do we need to apply for one.


Do nothing just wait for your GC, you should get it in 2 weeks & then you have to remove your conditional status before the second year of anniversary
of GC (USCIS uses this term but simply also means your current GC Expiration date) but the filing window opens 90 days prior to your GC Expiration date.
Your residence starts on the day you have entered to US soil as CR1 status & this Conditional GC card expires exactly after 2 years from this date.

Since filing Deadline is April 15. He does not have to show 2008 Tax Return.
You can take 2006 & 2007 Tax Returs & 2008 W-2's with you. They will be enough.
FYI, W-2 is also an official document which shows gross income from that particular company.
