Hi All,

I need clarification on few items on what to do next after the I-130 and I-129F are approved. Also, today I received a letter from NVC that states the I-129F petition will be forwarded to the embassy within a week.

When do I send my wife the Affidavit of Support?
- Do I need the AOS notarized?
- Do I need the last three years tax returns?
- Do I need all the supporting forms (Schedules, etc..)?
- Do I need them notarized?
- Do I need the W-2 for each return?
When do I need to pay for the AoS fee?

I am in the same boat. My I-129F for K3 was approved, then VSC send the petition to NVC. The Case # was generated but when I call the NVC AVR, it says there is no record of the case number. Thats pretty weird.

Anyone has a clue on what is going on?

Actually its the I-129F, NVC says:

"The State Department's NVC has recently received an approved I-129F petition filed on behalf of you spouse. This letter is to let you know that within a week the petition will be forwarded to the visa-issuing post overseas that is reponsible for processing visa cases originating in the country where you were married..'

What does your I-130 Approval Notice say? If your I-130 is being sent to the NVC, then you will be able to pursue the CR-1/IR-1. If it is being held for you to file Adjustment of Status in the US, then you will have to chose between K-3 and CR-1/IR-1. There are steps to get the CR-1/IR-1, but it will take longer. Correct. Bear in mind, that the forms themselves are the clue to this. The I-134 has a place for the notary to sign. The I-864 does not.


Oh wow I wished this question was asked before I sent in my AOS application. I had my I-864 Affidavit of Support notorized by my bank, now I'm wondering if I will get an RFE for that or something. I didn't know the I-864 did not need to be notorized.



The new I-34 does not have a place for a notary. So. I'm assuming it doesn't need to be notarized any longer??
Also. I have tax transcripts from the IRS , do these need to be notarized??

Hi VJers,

10pm EST my wife has her interview at Mumbai for K3. She sat down with the agent for all the usual stuff. The agent told her that the I-130 has also been approved!!!! So they will process that instead of the I-129F. Only she has to pay for the extra fee for the I-130 CR-1 ~$400, which she did. And she has to pick up the passport at 5p.m.

I'm ready to book the tickets and see my love this weekend!!!!!!

I originally filed a K-3 petition for my wife. But they granted her a IR-1 at the time of the interview, maybe my wife misheard/mis-spoke.

Hi all,

I originally filed for the K3 visa, but at the time of interview my wife's I-130 petition was approved. So, wife called me and said she is getting a CR-1 visa. But when she arrived here, I saw they granted her an IR-1 visa. But the only thing is that, we got married may 2008. And from what I read about IR-1, it is given to beneficiaries who have been married for than two years. Is that correct?

Was the wrong visa issued by the Embassy to my wife?

Also on her Visa above the two lines that the reader uses there is... "Upon Endorsement Serves as Temporary I-551 Evidencing Permanent Residence for 1 Year".... What does this mean?

Another thing concerned me is "IV Expires On: 22OCT2009" Only six month after it is issued "23APR2009"? Isn't is supposed to expire in 10 years for IR-1? Or even CR-1, two years?

Hello everyone,

So maybe a question that has not been asked.

I´m in the process of putting together the proof of meeting your fiance within the last 2 years for the I 129F. However, I realized that all my passport stamps proving I have been to Brazil, Argentina, and Italy with my girlfriend have been stamped in my Italian Passport. Yes, I am an American citizen and I do have my US Passport but with no stamps other then entering back into the USA. Is this a problem? Can I use my Italian passport stamps as proof of our relationship?

I only signed my middle initial and nothing has been sent back.... yet.

 

From a purely legal standpoint, you can sign an "x" as your "John Handcock" and it's still considered a signature and it's still legally binding. I'm not sure how the USCIS feels about that... but legally it's still binding.

 

I did read that it's best if you fill out your application in black ink and sign in dark blue ink (as well as sign on top of a magazine so the signatures are imprinted in the papers) that way they know the signatures are legit. happy.png  

 

I don't think signing your middle names makes a difference, but if you're not sure go ahead and sign them if you haven't sent your paperwork in already, just to be sure and for your own peace of mind. Think of how many people's signatures are completely illegible! laughing.gif

At first I was clueless on this visa slang but found out along the way "touched" means how many times your application was handled, whether that means moved from one shelf to the other or actual work performed on it. I was just wondering about that mostly I see on average applications are "touched" twice while at the service centers, and I was a bit alarmed seeing my application "touched" 3 times. I just hope that it does not scream out loud "RFE coming my way". oh well at this point i'll just wait and see. :whistle:


HOw exactly do you check to see that your application has been "touched" ? I don't get how people find out this information.

In terms of any other red flags-- I'm not sure where there would be any. He has never solicited a visa and we answered all the questions honestly. It really is super hard- but like sam&jensi said, we may need to just travel more. Gather everything up and pray that the next round is easier. I know anything that's this much much has to be worth it- so we will keep going strong, I'm thinking that the marriage route is better only because at least we will legally be together and then worry about the rest later.

Does anyone know how long we have to wait before we get married?

As some of my friends on here will know that my fiance and I were denied the K-1 visa. The CO was very upfront about questioning the validity of our relationship. We were even moved into the interrogation room for questioning. We answered all of those questions the same.
CO questioned us after the interrogation and then determined on his own that we could not be in a relationship because I had only visited my fiance for 3 days in the last 2 years.
I explained to him that we had been together for much longer than two years and brought all the evidence to prove that. I also explained that I had lost my job in 2009 and had since started a new job and have been employed for about 2 years now. The circumstances under which we could meet were limited and brief because of both of our jobs. I filed in June and interviewed in Dec. We were given a white slip and he circled the option that said " relationship was for immigration purposes"

What can I do-- I was thinking maybe we could motion or appeal the decision-- but I'm thinking we may have to just get married in the DR and petition him with a CR-1 visa.

Mexico, Latin & South AmericaRe-scheduling K-1 interview in Peru
We rescheduled our Peru embassy interview back in March. We had a lot of problems in that we were told one date, and the system later had another date. No idea what happened. I was shocked when I called a week later and was told of another date. I had already bought my plane ticket but decided not to risk changing the date again and just accepted the system date. Morale of the story is call often to to confirm the date.

Also, the new packet won't go out until exactly a month before your interview date. Best for you to call and request that a copy be left at the Embassy for your fiancee to pick up. You'll likely be in Lima anyway doing all the police and check-ups. All you really need from the new packet is the new invitation letter. You can use the rest of the original packet 3 while you're waiting.

I have not come accross anyone on here that has re-scheduled their interview. But, from what I see the Embassy has improved quite a bit and there should not be any problems.

My fiancee received package 3 from Lima Post. In it, there was a OF-179 form (biographic) that they asked her to send back immediately.

It looks like a shortened version of the DS-230 (without Part II). Does anybody know if they'll accept the DS-230 instead? Why did they send this OF-179 instead? It appears to be rarely used (it's not even posted on the NVC or State Dept websites). I plan on calling the Embassy, but if anybody knows, I'd appreciate it. Many thanks.

My fiancee and I just had our visa interview in Lima, Peru and everything went great!

The only concern we have is that we foolishly left the original certificated birth certificate with the Embassy instead of leaving a copy. Apparently, I think they just wanted to *see* the original but would have been fine with being left with a copy.

Does anybody know how likely it is that we can ask for it back at POE? The American consular who interviewed us said it would be in the secure brown envelope that we give to the POE/HS officer but was vague about the likelihood of it being returned then.

Obviously, we would like to know so we can request another original birth certificate (requires a lawyer) before my fiancee leaves her country.
