K-1 Fiance(e) Visa Process & Procedureslast question the ready to send

is it ok for me to send all the info (I-129F, G325, etc.) in a three ring binder just so nothing is lost??
thanks for all your help

You're probably just making more work for them. They will just take it out and throw away the binder. I suggest concentrating on making sure the papers are all there and all complete, and forget about stuff that doesn't matter.

I just stapled stuff like multiple emails and copies of receipts, and used paperclips for everything else.

I think they have to scan most of it anyway so they need the forms easily accessible.

Don,

I believe you will find that it is the authority of the Philippine govt to determine if the child can leave the country with one parent. Once their requirements have been met then of course it would be the US govt decision to give her and her child the VISA.

Yes, she is the daughter of my fiancee but the father remains UNKNOWN to either my fiancee or her illegitimate child as is stated on the birth certificate, affidavit of illegitimate, and statement of illegitimate.

Don,
If I was in your situation I would probably get a lawyer in the Philippines to make sure this isn't not going to be a show-stopper at interview time. But then again I'm just like that.

My fiancee has been reading posts here for some time but this is our first post.

I believe that thru our investigating that we have completed all required documents and supporting evidence and we are planning on mailing them to the Nebraska Center tomorrow. If anyone is willing to look my list over and make any suggestions it will surely be of help to us both.

If there is anything else I should include, or a document is listed as a copy but it should be an original, or if anything isn't listed as notarized and it should be .. please let me know.

WOW, you've gone way overboard here and you may just be causing yourself problems.

Sending the I-134 Affidavit of Support now is a probably waste of time and will probably be out-of-date at interview time and you will probably have to redo it before interview time. The same goes for all of the proof of support items you listed.

Sending the CENOMAR and NBI Clearance now isn't required and these could be out-of-date at interview time and you will may have to get new ones for the interview.

The Statements of Intent don't have to be notarized but I suppose it does no harm.

Is the daughter the child of your fiance? Be advised that you may need the permission of the child's father to take the child out of the country, even if the parents were not married at the time of the child's birth. There may be some pending changes in family law WRT this.

First of all...hi guys!

Secondly, our petition to apply for the visa thing was approved in August. I cant actually remember the whole date. Im wondering how long we have after that to apply for the actual visa, to make the interview and whatever. Im worried because weve been waiting for a couple of forms now for going on 6 f*cking months, and Im afraid theres a time limit on how long we have to apply for the actual visa. Anyone have any experiance dealing with this?

K-1 Fiance(e) Visa Process & ProceduresI-129f question 19 marrage broker??imbra law

hello,,,
has anyone had any problems with meeting your fiance online on one of the marriage broker sites and the imbra law,,,i met my girl on filipinaheart.com and i did pay the membership fee so i guess it applys to me.....now that honestly answered question 19 by saying yes what kind of delays should i expect????are they going to do a background check on me now???i just mailed everything off and now i kind of regret admitting to it if its going to cause me more waiting......thanks..........

Do you have someone to sign saying they are your broker? did they set up the meeting? a membership on a web site is not necessaryliy a marriage broker.. not if you met her in person on your own accord.

well the law says:::::::

Compliance with the International MarriageBroker Regulation Act (IMBRA).
If you met your fiancé or spouse through the services of aninternational marriage broker, you must notify USCIS ofthat fact by answering Question 19 on this form. The term“international marriage broker” means a corporation, partnership, business, individual, or other legal entity, whether or not organized under any law of the UnitedStates, that charges fees for providing dating, matrimonial, matchmaking services, or social referrals between UnitedStates citizens or nationals or aliens lawfully admitted tothe United States as lawful permanent residents andforeign national clients by providing personal contactinformation or otherwise facilitating communicationbetween individuals. For additional IMBRA requirements, see items 4 and 9 of these instructions.

www.filipinaheart.com charges a fee and i paid the fee so as i see it,,it applys

Yes it applies, but no it won't cause you delays or additional background checks. Just be honest on the questions. This part of IMBRA is a little strange.

I have to ask why you would want to send the I-134 and employment letter with the I-129F?

Well for one, I already have it, for TWO, its going to be part of the package anyway.
Well I thought it would be, so I figured why not send it.

Yeah I also knew about sending a copy of the I-129F to my lady, I was planning to see her in Feb., so I can take it all then.

The I-134 isn't part of the I-129F package. You only present that at the Embassy at the time of the interview.

Feel very fortunate, becoz we were waiting over 2 months before you even visited your fiancee for the first time and still have another 2 months to go at least.

K-1 Fiance(e) Visa Process & ProceduresQuestion about proof of meeting within 2 years

Hi,

I'm a newby here. This site seems like an awesome source of information. Since we all have our own special "twists," I hope no one will mind a simple question. Right now, my fiancee and I are beginning to gather docs preparing to send the I-129f to NSC.

I saw on the guidelines pages photos need to be dated for less than 2 years. Does "dated" mean the internal camera date must be superimposed? This may be a problem, because I never had the camera date the photos. Or can I simply write the dates on copies of the photos?

My fiance and I met summer 2004, and have many photos and many jointly signed documents. We lived together for almost all of 2005 in Kiev, and have a copy of the lease. If the undated photos won't work, there are a few other items, too.

I'm also assuming I will send copies of airline ticket stubs, and other goodies documenting our meeting.

What's the easiest and simplest evidence to establish we have met within the last two years? If all I need to produce for Nebraska Service Center is some photos with the date scribbled on them, and ticket stubs, why bother with the other docs like the apartment lease and the like?

Thanks,
George

No you don't need computer-dated photos. Most people just write the date and location on the back. Having lived together you should have a lot of other evidence of genuine relationship that you should focus on. If both of your names are on the lease that's pretty good evidence IMO. Also, plane tickets and boarding passes, copies of your passport (with stamped pages). You should also write a short description of how you met and were together, either as part of your statement of intent or as an addendum to the I-129F. The concensus is that a variety of evidence that paints a picture of a real relationship is preferable to a lot of the same type of evidence. Having lived together you should have a ton of stuff you can use.

K-1 Fiance(e) Visa Process & ProceduresG-325A with I-129F

Hello. I am a US citizen and my fiance is a Japanese citizen. We are starting the application process for a K-1 fiance visa (I-129F).

Reading the instructions for the G-325A it seems that I should fill out a G-325A with my information and she should fill out one with her information. But, looking at the examples on the step-by-step guide from this website, both examples are exactly the same as far as I can tell.

So, should mine be only my information and her's be only her information with our own signatures on our own forms?
Or, should both my and her G-325A forms be only her information and the signatures different?
Or, are both of these incorrect?

I called the ICIS information number and tried to get clarification on this but the only thing she would tell me after much rephrasing of my question is that I am the "Petitioner" and my fiance is the "Applicant", so any place that says "Applicant" should be my fiance's information.

I appreciate any clarification on this. Thanks, Buraian

You will fill out one set of 325A forms for you and one for her, and they are completely separate. Note that there are 4 forms in each set and they all must be signed.

K-1 Fiance(e) Visa Process & ProceduresAddressing age difference in K1 Petition

I am back with yet another question so please bear with me...

My fiance is 18 years younger than me and in his culture it is very rare for a younger man to marry an older woman - I am assuming this will be brought up during the interview and am wondering if I should address our age difference in the 'how we met' section of the petition and how should I do so. What should Kumar say during the interview if/when it is brought up? For the record, this will be a first marriage for both of us and neither of us has any children - we have talked about adoption.

Anyone BTDT?

This is just my opinion. If you think you will have to address this at the interview then be prepared to do so at the interview. I personally would not try to address this in the petition. YMMV

I concur.

These statements have been seen in many variations, but the one thing you MUST say in both statements is that you intend to many within 90 days of entering the US. Everything else is fluff, but it's a nice place to say nice stuff about your loved one and your relationship.

K-1 Fiance(e) Visa Process & ProceduresExactly how honest to be?

It's prostitution here so I'm pretty sure it's prostitution in the U.S. (except Nevada).

Anyhoo...

http://asialaw.tripo...es/waiver3.html

SUSPICION OF PROSTITUTION AS GROUNDS IN THAILAND:

In Thailand, where some women work in entertainment establishments such as go-go and hostess bars, there are concerns that this employment may be connected to prostitution and therefore establish grounds for inadmissibility. If the BCIS determines that the woman was actually involved in prostitution, this may result in grounds for inadmissibility. However, an application for a waiver can still be applied for.

If the BCIS independently discovers employment that could be deemed as prostitution they will interrogate the individual in order to confirm or deny such employment. If a visa application failed to list such employment (whether directly involved in prostitution or otherwise) this could result in additional investigation which may complicate the future waiver process.
In the event that there is a criminal record of prostitution occurring within the past 10 years, it may be advisable to submit the waiver application subsequent with the visa application.

The BCIS Bangkok Office will not provide any advisory opinions as to the likelihood of an application being accepted or rejected; applications and individuals are considered on a case by case basis.

It sounds like an employment gap would raise suspicions as well. I would imagine if someone wanted to hide this type of employment they would have to fabricate some sort of fake employment record to fill the gap, but would that be a criminal offense on the part of the petitioner?

I'm pretty sure that blowjobs and handjobs for money are still considered prostitution in the eyes the US Government which would make her technically ineligible for a visa.

I looked for info about Akane on the web. If I found the right place, from what I saw I really think you should NOT list it as a job. I think this would raise serious questions.

A normal visit might look something like this:
Enter Akane Massage, choose your girls, let her (or them) lead you to your room. When choosing the Fashion Massage courses, all masseuses will wear sexy see-through lingerie. You will lie down on a special "massage bed". You know the ones with a hole cut at the head for face down massage servicing. Before though, you will be bathed by your lady. This will include thorough cleaning of ALL your body parts. A Japanese style massage also always seems to include a good butt massage.
Now finally, the massage can begin. The PePe cream lotion doesn’t have any smell but makes the whole process very, very slippery. As said before, there is no full service but the special handand lips service is more than some people can take:).

Akane Original Lotion Massage Course
Using Pepe lotion which made by see weeds, prices include special hand service
for all of courses. No, 2 and 3 courses include prostate, testicles massages

Fashion Massage Course „
Sexual massage with See through wear, Lip service( by using condom)

We do not provide intercourse and service by with out condom by negotiation.
Please understand and enjoy our relief service.

Lotion Massage
Starting with a shower in the company of one of our girls and follower by a Pe Pe Lotion wrap, the traditional Pe Pe Lotion is made from sea weeds and is used in Japan for relaxing tension and massage. No part of your body will be left out and you will be relief from the tension built by the experience wit the special hand service provided by the hostess.

I'd be inclined to "forget" to put in on the form and just list her previous employment. More than likely there are some women doing "extras' there and the local officials know it.

I recently talked a friend into quitting her job at a kaoroke bar for a similar reason. Even though she was not "dating" customers, some of the women there do that, and any guys she met would know that, as well as the consular officers.

K-1 Fiance(e) Visa Process & ProceduresGetting Shots Before Interview

Hello,

I was wondering if I were to find out which shots my fiance would need to get in order to come to the United States, and she were to go on her own far before the interview and get them, and also get records and that yellow international vaccination certificate thing (I have one of these from traveling that I got some years ago), would she be able to bring that to her appointed medical exam in order to make things easier later? I'm not sure if any of the immunizations required need booster shots or anything, and if so, it would delay things by some time for her to wait for the second shot. If she had them done sooner, and just brought the records to the medical exam, I would think things should be fine. Is there any reason to avoid doing this and to do the shots at the appointed medical examination instead?

Heh, and also, finding a doctor who can give that information and certification for her and give all the required shots gives us something else to work on while we wait! (makes the time go faster).

-Tim

US immigration will probably not accept vaccination records from anywhere except St. Luke's.

K-1 Fiance(e) Visa Process & ProceduresIs Guam a US POE?

You might consider Northwest MNL-NRT-LAX or Cathay Pacific to MNL_HKG-LAX. Or better yet, Philippine Airlines has nonstop flights from MNL to LAX. Why not make it as easy as possible on your fiancee?

Unless I missed something here, it sounds like the Guam-Honolulu POE is very easy and fast for my fiancee, and since I'm going to be with her it's easy and fast for me too.

I've been on 12-hour non-stop flights, they suck. I'd much rather be on two shorter flights of 5 to 7 hours. I'm taking the PAL flight myself from LAX->GUM->MNL to go over there this time and there's NO WAY I would put my fiance thorugh that! It's 16 hours on the same freakin plane! The Guam stop is just for fuel and you don't even get off the plane. :o

You think I didn't check the other airlines already? Right now on the dates we need to travel, NWA MNL-NRT-LAX is like $1200 and Cathay Pacific is like $1500 and PAL is 12 hours nonstop and is like $800 (and we would have to stay overnight in LA before our next flight, yikes!).

I assume your using Continental which stops in Hawaii, anyway, customs will be done in Hawaii.

Yes it's Continental Airlines, Manila->Guam->Honolulu->LAX.

garya505,

You make a very good point. For some languages that do not use the Roman alphabet there is no one consistent transliteration system. I have known of situations where inconsistent transliteration of names on translated of documents has held up issuance of the visa while the alternate spelling are run through the name checks.

Yodrak

I also think it's a good idea to get the BC at the time of filing the I-129F so you can make sure the name on the BC matches the other documents exactly. You don't want to find out later there is a problem with that.

jasman,

To be precise, one must be literate in both languages. Fluency is of little value if one cannot read and write.

Yodrak

I believe that if you are fluent in both languages you can do your own translations. ......

Ya, my fiancee's cousin just found out that her gender is not shown on her BC. Since she is doing this now (at time of I-129F) she has time to get this corrected (it can take 2-3 months where she lives). Imagine if she found out there was a problem with her BC a month before interview. :o

i'm from california, but living in new york. my job has turned to sh*t and i want to move back...
but im a week or two away from sending my application in for the I-129f............

would i be a fool to go back to california and start the process there? does it take way longer than vermont? i've looked on the timelines but i would rather ask personal advice from people on here. i'll stick to this job if i have to for another six months but if it doesn't make any difference, then i'm outta here.

and....what if i move part way through my application process? say i mail it in now for vermont but in two months i move to ca? any difference?

I would suggest filing to Vermont using your current NY address and then drag your feet as long as possible on the job change and move. Then send a change of address to USCIS after you move. I asked my lawyer about this when I filed, as I was planning to buy a house and move.

I WOULD NOT use someone else's address, as it's not really your address and could be considered fraudulent information.

K-1 Fiance(e) Visa Process & ProceduresReady to start - where is the new I-129F form?

I spent a couple of weeks searching for an immigration law firm to help me out ... then I stumbled onto this site, read and re-read and re-re-read the FAQs, FORUMS, and GUIDES, and we have decided to tackle this process on our own. This is very exciting. Based on what I have read tho, I think I will take the $!800 I saved to hire a lawyer and instead get a gym membership to work-out the upcoming stress from all the waiting it looks I will be doing .....

So .... my very first question. I saw the notice that the I-129F Rev 5/23/06 will be accepted until 2/18/07. Since we are just starting to gather info for the initial petition, I seriously doubt we will be able to get this done by middle of next month. But the FAQ and USCIS links for the I-129F form still link to this old form ... where can I download a new post-2/18/07-acceptable I-129F form?
