Hello VJ,

It's been a while since I've been in the forums but as I had my biometrics appointment today I thought I'd look in to see how long things might take from this point.

I just added my information to the timeline. I was pleasantly surprised how quickly my biometrics appointment was scheduled after submitting my I-751 so I'm keeping my fingers crossed that we'll be done with this step of the process soon.

If a K-1 visa holder who has got married within 90 days, leaves the US before being granted either Advanced Parole (permission to travel) or their Green card, they will invalidate their K-1 and will require a spousal visa to gain entry back into the US. If she had left before you'd got married then you would have also had the K-1 as an option but as you are now married it will have to be one of the spousal visas (K-3, CR-1, DCF).

Applying for her AOS before she left would not have prevented the problems you now face. The only document that would have allowed her to leave the US before being granted her green card would have been Advanced Parole. This is applied for in conjunction with AOS and allows a K-1 holder with a pending AOS application to travel outside the US without abandoning their AOS application. Emergency AP is also available to people with family emergencies etc..

It is not going to be possible to apply for her AOS now that she has left the US. She will almost certainly be denied entry if she attempts to come back into the US.

If thats correct then I would assume that as long as you have the required visas and paperwork to visit the Gambia, you are free to visit there from the US for as long as you are permitted to stay as a tourist.

Do you mean the NVC (national Visa Center) or the NSC (Nebraska Service Center)...

If you mean NVC then it looks like Nebraska took a while sending out the NOA2 which is indeed your approval. If you mean the NSC then someone seems to have lit a fire under some of the officers there because an approval in a week is pretty amazing !!

Did you ever receive an NOA1 from Nebraska and if so what was the date on that ??

A lot depends on which country you are from.

In the Uk the police record and medical results are admissable for 12 months from the date of issuance. For most people that is long enough for both their visa interview and their AOS application.

Different countries may have different rules regarding the validity period.

Hi All Anybody else from the Uk had this problem? When i asked for my vaccinantion records I was told I had none! Apparently during the 60's and 70's vaccinations were given at schools and clinics and GP's weren't notified. When i suggested to the Practice Manager that I have a blood test done she said they dont do that and there must be some way to find the records? Anybody have any ideas?

I didn't have this problem being a wee bit younger but my suggestion would be to go ahead and have everything done anyway. I'm sure that there is a list of required vaccinations available somewhere... if you haven't had any booster shots of the required vaccinations since you were a kid, most of the stuff you'll need should be re-doable. Anything you can get done by the NHS before you leave the UK will save you mucho $$ when you get to the US !!

I'm just going to stick some scenarios out there...

If your personal reasons have anything to do with one or other of you currently being married to someone else then that will also cause problems for any kind of K visa. You both have to be legally able to marry at the time the application is sent and that statement has to be backed up with copies of divorce decrees etc..

Working visas are almost impossible to get hold of unless you are highly skilled in an area that is lacking workers already in the US. Most working visas require sponsorship by an employer in the US and you have to really be in demand for a US employer to consider going through that process to employ you.

I'd strongly suggest that you lay out your story within the public forums. It would probably suprise you what varied stories people have come from within this forum and the more people you pose your question to, the more likely people will be able to help you.

Can I ask where you are living right now ? That will have a large impact on the ease with which you can be granted a visitors visa, never mind how hard it might be to get a K-1 approved.

Visitor visas are only granted to people who can prove strong ties to their home country and a prior intent to return home at the end of their visit. Unless you can do this then a visitor visa may not even be possible. In addition, on arrival in the US you have to be able to convince the CBP officer that you still have those ties to home. If you don't have significant proof then you could get denied entry at the border and be returned home.

If your US "Fiance" cannot afford to come and visit you and you can't afford to visit him, how do you hope to support yourselves if you are successful in your entry to the US anyway ??

As previously suggested take some time to read the guides section of this website. It's far more complicated than getting on a plane and getting married !!

Biometrics are normally a piece of cake !! All they do is take prints of all fingers / thumbs, take a picture of you and get you to fill in a form with your height/weight etc..

Most people only have to attend one biometrics appointment to cover both their AOS and EAD applications but some people thanks to the ineficiencies of the USCIS ende up having to attend 2 appointments.

It really is nothing to worry about. make sure you take your appointment letter(s) and some ID.

If only....

I had excellent credit in the UK but unfortunately, because the US credit scoring system is based on different criteria and it's almost unheard of that comapnies in the UK would share thier information with credit agencies in the US, I didn't find any way to get mt credit history transferred when I moved.

I was lucky enough to be able to secure a credit card in my own name a few months after arriving in the US and just a week or so ago looked up my credit score with the three big reporting agencies (Equifax, Experian and Transunion). I was pleasantly suprised that after about 8 months in the US I've generated quite a decent score.

I haven't looked into mortgages or anything like that yet but i'd imagine that unless you have generated a score of your own, applying alongside your USC spouse might actually negatively effect the mortage offers that might be extended to you.

You can apply for AP (Advanced Parole) but only once you are married alongside your AOS & EAD applications. Until that time, although you won't be stopped leaving the US, you will be stopped on re-entry. This will normally mean that you'll need to re-apply, either for another k-1 or for a spousal visa.

Basically without AP you won't be able to travel outside the US without experiencing almost garunteed problems when you try and get back in.

As far as I am aware that is the ONLY way that you can get a police check completed in the UK. Incase you were not already aware they have to return your completed check within 40 days. Most people wait almost the full 40 days for theirs to materialise.

If you are approaching a possible interview date make sure that your Fiance submits his application ASAP to avoid holding up the issuance of your visa.

Hi working history in Morrocco should have absolutely no bearing on him being granted or denied a visa at the Embassy interview. The Embassy is only interested in the employment history of the USC.

From a practical point of view however, it would be a good idea (unless you earn big bucks in the US) for him to bring some money with him when he arrives here. It will be several months before he'll be able to work in the US and any extra money he can bring with him will help you guys until he's able to work legally in the US. If he can get a job and put some money aside before he leaves Morrocco, that would be great.

The only POE that issues any form of EAD is JFK. However you should be aware that if you're entering on K-1, this temp EAD will only be valid for 90 days and will still require you to obtain a Social Security Number before being able to legally accept any employment.

Once the temp EAD expires you are not legally allowed to continue working until you have received your 1 year EAD which is obtained in conjunction with your AOS application.

My only question would be what do you do for income when you're spending months at a time in the Philippines ?? One of the stipulations of the K-1 is that the USC petitioner earns enough money to meet the requirements of the I-134 Affidavit of support. Do you have a job which will allow you to work outside the country for months at time or do you have a large amount of money for you and your Fiancee to live off once she arrives in the US.

If you spend large amounts of time abroad and you don't earn / have access to a reasonable amount of money to support you both once her visa is issued, do you have a co-sponsor who will be able to help you meet the income requirements for the I-134 ??

Our I-129F wasn't ever touched and it was in the black hole known as Nebraska for 146 days before we got our NOA2 !!

Touches are by no means a guarunteed part of the process and even if you are touched, it could mean as little as your file being moved from one pile to another. Although comparing your own progress to others is helpful in some ways, every single case is unique and therefore are processed at different speeds. You really could drive yourself :wacko: if you measure your own progress against everyone elses. Work on the premis that no news is good news and sit tight for your NOA2.

As previously stated you cannot file for a K-1 visa until your Divorce has been finalized because you have to be able to prove that you are legally able to marry your new Fiancee. Until the divorce is finalized and you have a copy of the divorce decree to put in with your application, you will have to sit tight on applying for a K-1 visa.

I'm assuming you wish to change the date of your interview ??... I'm also assuming you wish to push back your interview date rather than ask for it to be brought forwards ??

If the above assumptions are correct, send an email to londonconsular@state.gov explaining when your interview is currently scheduled for, why you need to change it and when the earliest time would be that you could reschedule it for. Be sure to include your LND reference number in your email too !!

There shouldn't be a problem pushing the interview back but be aware that your new date could be quite a while away !!

Don't give up yet... yes the chances of being granted a waiver based on your case is highly unlikely but is meeting in person, just once, really beyond the realms of possibility ?? That is all you need to be able to prove to meet that fundamental requirement.

I'm assuming that you're hoping she'll be allowed to enter the US on a visitor visa for this 3 week visit ?? If she doesn't have a visitors visa when she arrives next Tuesday she'll be forced to activate her K-1 when entering through Atlanta. If that happens there is almost no chance of her being able to leave the US 3 weeks later without invalidating her K-1 and needing to start from scratch, either with a new K-1 or, if you get married during those 3 weeks, a spousal visa such as a K-3.

The K-1 is a single entry visa meaning that once it is activated you cannot use it again to enter the US. Once the K-1 is activated you have 90 days to get married, not 60 as you stated earlier. Once you are married, in addition to applying to adjust her status and requesting employment authorization, you can choose to also apply for Advance Parole (AP). AP normally take a month or two (AT LEAST) to be approved and only once an approved AP document is in her hand will she be allowed to travel outside the US without having re-entry problems when trying to come home again.

If she leaves the country before AP is granted then although she won't be stopped leaving, when she tries to re-enter the US after her trip to Russia her leaving the US will be seen as abandonment of her Adjustment Of Status and will cause her to be sent back to Russia while you apply for a spousal visa. Emergency AP is available to those where a family member is crticaly ill but those applications have to be accompanied by a doctors letter outlining the severity of the relatives condition. She will not qualify for emergency AP and consequently will have to remain in the US until a regular AP document is issued.

If she absolutely has to be in Russia to close the deal on her business my suggestion would be for her to remain in Russia until that is all done. Then she can fly to the US with her K-1 and she won't have to worry about needing to leave the US again until she is legally able to. That is by far the simplest way to deal with the situation your have outlined.

Yes... all foreign language documents that you're submitting with your application or may present at the interview will need to be a certified translation. Most of the staff in US embassies are actually American and therefore foreign language documents will be of no use to them in adjudicating your application.

And may I suggest that if he does come to visit that he use the Pre-clearance centers at SHannon and Dublin airports.. that way if he does get denied, he'll only have an hour or so flight home instead of a lot more hours...


While this is always a valid option, unless the OP feels that her Fiancee has had some past issues with US immigration such as overstays or previous POE 'grillings' on earlier visits which might increase his chances of problems OR he happens to live in Ireland, I would say that flying via Shannon or Dublin is an unneccersary detour for most UK VWP visitors, even once a K-1 application has been submitted.

Given the number of people who have successfully travelled from the UK during their visa process compared to those who have had any kind of problems, I would say that unless he has any previous history of problematic visits to the US, he will be fine flying directly to the US.

Obviously there are no garuntees (pending K-1 or not) that a foreign visitor will be granted entry to the US, but under these circumstances, it's my opinion that he will breeze through his chosen POE with no problems at all.

I was in a similar situation to the one that your Fiance is in. I am the UKC and at the time that we applied for our K-1 it was much easier for me to travel to the US than my Fiancee travel to the UK.

I visited the US twice after we submitted our paperwork, both times receiving no more scrutiny at US immigration than on any of my previous visits.

As previously mentioned there is no reason for him to not travel but he should travel prepared to answer any and all questions that he might get asked. Although I knew I wasn't doing anything wrong, on those two occasions when I did travel I had a large envelope containing additional proof that I fully intended to leave the US at the end of my stay and had significantly binding ties to the UK still. I had a letter from the HR dept. at work stating that they knew I was on vacation and when they expected me back in work. I also took recent cellphone bills, bank statements and any immigration related documents I had at the time in the hope that if the POE officer did doubt my intentions to leave, I could use these documents to try and persuade him. As it happens I was never even asked any extra questions let alone asked for additional documentation that I planned to go home.

Your Fiancee can go ahead with his travel plans. Answer any questions honestly because there is nothing about his trip that should cause him any problems. Take any extra proof of ties that he can get his hands on but don't slam all that down on the POE officers desk unless asked for it.

I contacted my local congressmans office to try and get some answers on why my EAD application was taking so long. I actually ended up dealing with his Immigration Liason but did receive some emails from him personally. I am convinced that without the help of his office, I might still be waiting for my EAD to be processed.

I had to fill out a form giving them permission to access my file and also provided them with a very detailed chronological account of all the steps I had completed up until the point at which I was contacting them. The woman I dealt with was very knowledgable about the steps and procedures that made up the immigration process and was able to get me information that I wouldn't have been able to get through normal channels.

As for your case... the point at which you can start asking for information on your case is when the posted processing date at your service center is 30 days after the date of your NOA1. California is currently processing I-129F's received on or before Dec 31st so if your NOA1 is date Dec 1st or before you can start making some noise. The 60 -90 day processing window printed on your NOA1 is simply a guideline. if your petition has been there for 61 days it is still within the projected processing timeframe and therefore there is little that a congressman / woman will be able to find out for you.

You'd have to check with the issuing authority. In the UK a police certificate is valid for 12 months from the date of issuance. I beleive it varies from country to country.

I can apprecaite 100% how long and frustrating those months have been. We had to wait 145 days for our NOA2 and just like you we never received a touch or RFE before that magical email arrived !!

NOA2 to interview is normally a much faster process. You'll be together before you know it !!

The other thing to remember is that there is a pretty good chance that the documentation you are gathering now won't even be asked for at the POE.

I made 2 trips through Chicago after we'd submitted our K-1 and even though I had a big envelope full of prooof of ties to the UK, I was never asked to show any of it. WIth regard to the rental / mortgage agreements I was already living back with my parents when I travelled so had nothing like that with me.

While I'd always reccommend having some extra stuff to show at the POE just incase, I wouldn't sweat over it too much. The fact that you are prepared to show *something* in terms of extra proof demonstrates that you're aware that entry is not always garunteed and that you have done more than the average VWP traveller.

Answer any and all questions truthfully, including the fact that you're visiting your Fiancee. You should be fine !!

P.S I see that you have filed for the K-1 already. If your Fiancee can fax or email you a copy of your NOA1, that further demonstrates that you are aware of the USCIS approved way of doing things and that you are less likely to try and jeopardize your visa application by overstaying or dissappearing once in the US !!

1. She doesnt know her dad's birthday as her mother seperated from him a long time ago and the dad is deceased with no familyand mom doesnt remember his birthday, what do you think we should put? "Unknown" maybe?


Is the father not listed on her birth certificate ? While I agree that putting 'unknown' is better than leaving it blank, I'm not sure that unknown will work with the USCIS. You may end up receiving an RFE for that information so it might be worth checking with the births and death record department where her father is from to find that out.

2. I dont have any photos from when I went to Hong Kong as I wasn't going to meet her specifically but I do have an email where she describes us meeting, do you all think that might work


An email on its own will not satisfy the need to prove that you have met in person in the last 2 years. Do you not have any other receipts, ticket stubs, evidence of any kind that you were in Hong Kong and have met in person. Doe she not have anything that could lend weight to your argument ?? Without this basic evidence, regardless of the validity of your relationship, you stand a pretty high chance of being denied at the service center stage.

If you are granted a K-1, once you enter the US and get married within the required 90 days, you will be able to remain in the USA. Once married you will apply to adjust your status from a K-1 holder to that of legal permanent resident. The result of adjusting status is the issuance of a 2 year conditional green card.

You don't have to apply for another visa once you have been granted the K-1. The K-3 visa is for a USC that is married to non USC. They would need to file for a K-3 so that the non USC spouse could come and live in the US. If you apply for a K-1 that is the only visa you will need to stay in the US permanently (as long as you meet all the requirements of the visa !!)
