They are working overtime on weekends in order to clean the backlog and speed the process, yes you can receive touches even approvals on Sunday.

It doesn´t matter if your fiance is unemployed. Anyway, salaries in poor country are very very very low compared with US salaries.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa for my Domincan Fiance
I have been reading the responses here and i doesn´t make any sense to me, doing the whole process of going to other country to get marry and so on.

First, the consulate go thru an investigation with the foreing fiance in this case DR it is the foreing, in case you move which working info are you going to put in the papers?

Pleople let´s do things right, this is the main reason of the delays at the consulate, because US consulate knows the we (dominicans) are cheaters and they do extensive background check, check and rechecking of the information.

A lot of people get denied because they find the mistakes and error that people do, trying to be smart, and the consulate has access to all the database information of this country. TO ALL. but of course they are not going to give the people their reasons when they find fraud or other stuff.

Trust me, I know what I am talking about star_smile.gif yes.gif

My best advise to you is; gather your papers and put them in the mail and don´t mess things up. You can come to visit anytime you want your SO. yes.gif good.gif

congratulations to you kicking.gif

@YMR, couple received NOA-2 2007 January, does it really take that long to get an interview date in Dominican Republic?

Yes, it was 2-3 years in the past. THe main problem is that here people get fake papers, documents and the Consulate has to investigate a lot about each paper submitted.

An example is the police record, if you have a problem with the police, court or whatever it is and your name is in the police computer with a record, easily with some money you can get a clean report without problems. So once, you get the police record and submit it to the consulate with the packet, they go back with their investigation unit to check if your name is in the computer or not. Mainly to check if the record is for real. They do that for each document requested and submitted. THis is the main reason for the delays.

Anyway, now is faster because here in DR now the birth certificates, ID and so on are into a computarized system in the past each paper investigation was done MANUALLY.

Yes a lot of dust there. devil.gif

Both letter have to be in English as well as other documents, that´s why they request to have the foreign birth certificate translated. You can type the letter for her, email it and she can print and sign it.

Do you can imagine an adjudicator reading a letter in Spanish when she/he is not a bilingual person? devil.gif

Plain English is the correct language for the paperwork related to the application.

K-1 Fiance(e) Visa Process & ProceduresExtension letter...necessary?
Consulates will automatically extend the validity of the NOA2, becasue they are aware of the situations where going thru the gathering of the documents, medical and so on takes time.

Don't worry about that, I am sure you have enough with the interview by itself. good.gif whistling.gif

What do i do? The sample forms don't have that issue. I am using the lates rev of the form which is OMB No.1615-0008; Exp 05/31/09 that I pulled from the USICS website.

Any suggestions?

K-1 Fiance(e) Visa Process & ProceduresQuestion about B1/B2 Visa
You can apply for the K-1 visa, during the process for her traveling between countries she has to prove ties that she is coming back to Guatemala and she can be denied to enter to US.

By the time that she goes to the interview the Consular officer cancels the B1/B2 visa and then stamp the K-1 visa in the passport, that is only 1 time valid for entering to US for marriage purposes.

No flamage here, it's a legit question. For some it's a little extra spending money, something to make life easier. I send money to my SO so she can have a little extra cash, go out a little more often, buy clothes, etc. She still has to work and pay her bills. It's my way of making her comfortable during this long wait.

Should I include those in the K1 petition along with emails/phone logs etc. I don't want to lose the cards. Has anybody included cards as part of the K1 packet (I imagine they would be very useful at the consulate interview). Any input/thoughts will be greatly appreciated. thx

I included our e-cards photocopied in our packet when we mailed it.

Hello,
My fiance and I would like to get married this next summer, but we still have to file for the K-1 Finace visa since we believed that he could come here on a tourist visa (which he has for the next 8 years) and then we could get married before he overstays his tourist visa (within 3 months). Is this possible, or would we have to pursue getting a K-1 Fiance Visa for him to immigrate to the U.S. and marry? How long does it usually take to get a K-1 Fiance visa, if that is necessary for us to get married?
Thanks all!

Tourist visa of 8 years? I never knew they gave those out :S

Anyways, it is recommended to file for a fiance visa indeed because, if they want to follow the rules, it is not allowed to change status from a tourist visa even after you get married, like the previous poster also said, they are very skeptical about those things and they might deny the AOS and that might even result in getting a ban from the US. So yeah, if is possible to marry on the tourist visa but it is risky and if you want to avoid problems, be sure to file for a fiance visa... I am pretty sure you will be able to marry during next summer if you file now smile.gif

Tourist visa of 8 years? I never knew they gave those out :S
Yes, up to 10 years, it is the maximum of the B1/B2 visas.

Usually people post a copy of what they received with their application number x'd out, but there's never been any mention about what time of day they received that email. We're filed with the Vermont Center btw, so EST conversion would be greatly appreciated by any that respond.

Thanks!

K-1 Fiance(e) Visa Process & ProceduresDoD civilian - K1 or K3?
QUOTE (maadams2004 @ Sep 28 2008, 12:10 PM) <{POST_SNAPBACK}>
I have a unique situation (I think) and wanted to solicit details from the knowledgable folks here.

Some background:
I’m a government civilian employee. I’ll be taking an assignment to Germany on orders from the Department of Defense in late November. I have a fiancee who is a citizen of and lives in Santiago, Dominican Republic. She has two minor children. I’ll likely be in Germany for two to three years.

I’ve done some researching here on the site on the K1 and K3 process and can’t quite find a situation in the forums like mine. I guess I’m trying to determine the best course of action to take towards my end goal of marriage and having my fiancee and her daughters with me.

I understand that if I go the K1 route, my fiancee recieves the visa, she can come to the U.S. and we have 90 days to get married, file for change of status, and wait for….her green card? But she can’t leave the U.S. until this process is complete. The problem is I can’t leave my assignment in Germany to come back home and wait this process out. The one option is of course to leave my wife there in the U.S. while I continue my duties overseas. But I don’t want to. I’m not going to bring my new bride to the states just to dump her there – in a foreign culture – and go back off to Germany. And I have no one she can stay with until the process runs its course.

The K3 route seems to be the same except we’re getting married outside the U.S. Doesn’t she still have to wait in the states until she receives her green card? Yes, she has to wait to receive the green card and she can travel outside of the US but with an advance parole but she can´t stay a long time out of US

Can anyone give me any advice as to how to proceed? I want my fiancee, once we’re married, to be able to travel to Germany with me on my assignment. I’m going to call the USCIS Monday to ask some direct questions, but I was hoping some of you folks may be able to assist

It is best to stick your official residence in Seattle and use California Service Center. Also the forms ask for your home address and your office address, if you write the same in both places they will realize that you are using the office address.

OK my girlfriend is from Columbia, she is here in the US( I met her here) on a 5 year business Visa. She has been here 2 years and has never left. The immigration is telling her she needs to leave the country for a month and then re-enter. She can no longer make any money in the US to support herself and 2 kids, any money has to come from Columbia to stay here. If she goes back home to columbia with her family i know she wont come back. I have a huge dilemma, we have been dating for 2 months and i think that's too soon for marriage but not out of the question if i have no other options. I know if she leaves for a month, I may never see her again. Can i get a fiancee vise for her even though she is here?

No, you can´t. She has to be in her country for you to place a petition for her

I am just trying to buy some time for us to get closer before we marry, if that happens. I don't want to see her go, it breaks my heart to think about it. Please advise we only have a month (maybe) before i have to make a decision
thanks
