IR-1 / CR-1 Spouse Visa Process & ProceduresHow much is too much

Are sticky tabs and post-it-notes acceptable? This would be perfect as we are finding difficult on how best to present all this information.

Yes I used them and made it thru USCIS without any problems.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow much is too much

My wife and I have nearly completed our package to send to the chicago lockbox, we are a little worried that we are sending too much, the pack is beginning to look like a telephone directory, after reading all the RFE threads we just don't want to take any chances but we are afraid that if we send too much info and evidence it may just be skimmed over rather than read carefully. How much is too much? How many photo's, receipts etc did you guys send?

Regards

Andy and Alicia

Well Im doing a K-1, not a CR-1/IR-1, however I sent over 400 pages of documents when I submited my I-129F. Since you are married and sending your marriage certificate they will know you have met, but I sent whatever documentation I could to prove that we had met, along with a copy of my full passport and birth certificate. I also frontloaded with all of my supporting documentation of the relationship (this is mostly what all of the paper was), but I think this depends on the embassy you will be going thru. Some embassy's have higher fraud rates so they scrutinize more, so in these cases it is adviced to front load your petition. Also, I broke all of my information into section and seperated by sticky tabs...top was the petition and other required forms, followed by proof of meeting, passport, etc... and lastly was the proof of relationship. Hope this helps and good luck!!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp!

I think they do meet the requirement:)i wanna ask though, you said the petitioner being there is optional, but wouldn't they work me over in the interview or POE for him not being there?even though it's optional?would they like deny me or put us under AP just for that?!Thank you for your reply:)and Goodluck with your journey:)

From what I have read it always looks better if the petitioner is there, however I have heard of people being denied/put into AP even when the petitioner was present so that really doesn't make a difference. Even if he can attend the interview with you I would still make sure you have plenty of evidence to prove your relationship. Also, I have heard of 2-3 other women go thru Cairo and were approved without any problems. Personally I think it is mostly the men that have a hard time at this embassy and experience long AP times, but that is just my observation.

Good Luck!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresProof of relationship chat logs question

Thanks!! I appreciate your response and that is along the lines I was thinking but I never like to do anything blind or without thought and I guess that is why it took us 2 1/2 years to get married :) I figure time is on our side now and it took us this long to get to this point so what's the rush and it is better to ask people who are in the same boat and do it correctly :) I will check out the MENA forum too I appreciate the advise!!

Good luck to you too!!!

I forgot to mention yesterday, when sending chat logs be careful of what you send them, don't give them too much information or include something that will raise a flag. There is a girl who filed for her fiance in Morocco and they denied him because of something he said in their chats (so they say), so yes they do read them ( I think someone said earlier they probably will not)

IR-1 / CR-1 Spouse Visa Process & ProceduresProof of relationship chat logs question

sure I have all of that from both trips I took there. But since we met online don't I have to show proof of meeting and a timeline of our relationship together?

Being that your are going thru Morocco I would suggest frontloading your petition as much as possible. You don't need to send all of the chats, and what I did was a print screen of my chat log showing all the days we talked online (daily), and then I picked one chat per month to send. In your case I would send 1 chat for every few months of talking. And since you're married they will know that you have met, so along with your marriage certificate I would also send your airplace boarding passes, passport stamps, etc..

You may want to post a thread in the MENA forum and get some advice from others who have gone thru Casa and see what they did.

Good Luck!!!

IR-1 / CR-1 Spouse Visa Process & ProceduresFinally Approved

I do wonder if even if the embassy is not fully opened, files completed at NVC will be shipped to Cairo and just wait to process them till they are full staffed or will NVC hold them till they reopen completely.

I read somewhere on here that NVC was telling people they were holding all files until the embassy reopens, but I did receive an email from the embassy this morning telling me that they had consular officers in the embassy working on my fiance's case, and a prior email they stated they were only working on immigrant visa files, and for those who already had their interviews. A woman at the field office for Egypt told me yesterday that people who were waiting for interviews were going to other embassies to complete their cases.

K-1 Fiance(e) Visa Process & ProceduresStarting K1 process
Hello everyone.

I am starting the K1 process and have some questions. From what I understand I need to complete the I-129F and submit along with a G-325 for both me and my fiance, my birth certificate and/or passport, a passport photo for both of us, and a letter of intent to marry from both of us once he is in the United States. Is there anything besides this that is required to be sent at the time of the I-129?

Also, my fiance is an Egyptian citizen, but working in Saudi Arabia, does he have to go for the interview in Egypt or can he complete it in KSA? And I know its not required, but would it help when I send the I-129F to also include records of our relationship, and photos of or meeting, or is it best to wait until they request it?

Thanks in advance for the help

K-1 Fiance(e) Visa Process & Proceduresnext step??
I just sent off my I-129F for the K-1 visa. I read that once I receive the NOA2 I need to provide my fiance with the I-134 Affidavit of support, but I'm unsure of when my finance needs to complete the I-156 Visa application; with he receive a notice telling him to do this or when does this need to be sent in? Also, on the I-134 can I include child support in my yearly income?

thanks for the help

K-1 Fiance(e) Visa Process & ProceduresWhich Embassy Should I use?

Hi All,

First post so please be gentle on me if I ask questions that have already been asked.

I am going to visit my fiance again in the USA next week on the VWP for 90 days. We plan to submit the forms for the K1 visa while I am there. Which brings up a few questions.

1. Can we apply for the K1 visa while I am on the VWP?

2. I am a New Zealand Citizen and use a New Zealand passport to travel with, but I am a permanent Australian resident who resides in Australia. So do I put down the USA embassy in NZ or Aust?

3. If I brought all of my paperwork with me on my trip to the USA, could immigration use that against me at the POE to deny me entry? Would it be safer having a family member post it all over after I leave?

Thank you for your help :)

You will want to use the embassy where you will be living at the time you will have your interview. Also, I don't see why you couldn't apply for the K1 while you are on VWP. As for the papers I have read stories where a woman was denied entry because they found papers (work resume and birth certificate) that would suggest she was going to overstay her visa, so I would suggest maybe someone send them to you once you are here. Hope this helps.

K-1 Fiance(e) Visa Process & ProceduresFrontloading
Hi everyone, I've asked many questions on here and I'd like to first say thanks to everyone for their help. Since my fiance is from a MENA country, when I sent in the I-129F I included copies of cell phone bills, chat longs, emails, text messages, copies of about 6 chat conversations, hotel receipts, copy of my passport with stamp as proof we met, my flight itinerary, boarding passes and luggage receipts, photos of us together, and photos of us/me with his family. But I also have a letter from my parents stating their approval and support of our relationship and marriage, but I didn't have it at the time I sent in the petition. If I sent it in now seperately to USCIS would it make it into my file? I know USCIS doesn't really care about this, and I feel I gave them enough proof to be approved for the petition, but I'm just wondering if this letter would help my case once it is received at the embassy opposed to giving it to them at the time of the interview.

Also, I have read somewhere that I cannot be with my fiance at the time of the interview; is this true? If I can be with him for the interview, does it make a better impression or does the Consulate really not care?

Thanks all for the advice :)

K-1 Fiance(e) Visa Process & ProceduresAnybody want to post pics of their assembled I-129F package??

I'm looking for ideas! I've read the tips on the USCIS site, but I'd like to see pics of ones that have actually been assembled and submitted(and approved, ideally!)!

I didn't take pics of my packet, but I sent over 400 pages!!!! (my cell phone records were very long :) ) But what I did was put the coversheet first, followered by the I-129F, the letters, G-325A's with photos. Then I put a full copy of my passport, birth certificate, proof we met and proof of our relationship. EVerything that had more than 1 page I stapled together individually (i.e. chat logs were one, each phone bills was seperate, text messages, emails, etc..) then I used different colored post it notes to break up the packet, such as blue was for proof of meeting, red was proof of relationship, etc.. I know this sounds a bit ####### lol, but I wanted it to be as easy as possible to go thru since I was sending so much stuff.

Good luck :)

K-1 Fiance(e) Visa Process & Proceduressignature same as printed name :/

I am thinking to send my k-1 visa application ..any one of these days...today i got some forms from my fiancé overseas such as G-325 and the fiancé letter of intent signed.... unfortunately i noticed on the g-325 and the letter that his signature is not cursive which freaked my out :S ...its kind of printed in cursively.....ex: Like This . something like that ...and of course since its nice and readable he put the same for the printed name. those last 2 questions on the g-325..:( i dont know what should i do ... plus he paid a lot for that mail to come in ....:((((((((((ahhhhhhhhhhhhhh !!!!!!!!!! i dont know if that will make any problems..i mean it doesn't say anything how to sign or whatever ... everybody has their own signature...

My fiance signed his forms the same way..printed. I submitted everything to USCIS that way and they accepted it, I don't think you will have a problem. Good luck!!

K-1 Fiance(e) Visa Process & Procedureslack of address space on online I-129F/G-325A forms (and probably all others to come)

Oh man!! I read somewhere we can simply hand write it. I wrote it to fit in the little box. I hope nothing bad will happen to me because I did that... It's perfectly legible and I did type it all on the 129F actual form, it was just the G325A that had the problem.

Yes, I think I read somewhere too that you could either complete with black pen or type. I chose to type mine in because it was more legible than my handwriting, and I didn't want to keep filling out forms in case I made a mistake. I think you will be ok, good luck!!

K-1 Fiance(e) Visa Process & Procedureslack of address space on online I-129F/G-325A forms (and probably all others to come)

Dilemma:
My fiancee's addresses (current, past, employment...all of them) are so much longer than the available field sizes in the online pdf versions of the I-129F and G-325A, that there is serious question as to whether an abbreviated version would be of any use at all, perhaps requiring interpretation/augmentation by a local postman, which doesn't seem all that likely to happen. Seems USCIS encourages adding supplemental sheets for similar situations (I am doing this for the "how we met" section)... but then I also read that these address fields are scanned in order to process the forms efficiently - which of course wouldn't work if I put it all on a supplemental sheet. So is it better to try to squeeze a perhaps-undeliverable address into the available space to avoid derailing their system, or better to go with a 100% complete set of addresses (that actually will end up moving most of the G-325A info to the supplemental page)?

--Dave

I had the same problem with my forms for my fiance. I just included a supplemental sheet for both the I-129F and the G-325. At the top of the page I labeled it I-129F supplemental information or G-325 whichever it was for, then listed the question number and wrote the actual question I was answering followed by the answer. I also included on the cover sheet that I had included these two other forms. Hope this helps and good luck :)

K-1 Fiance(e) Visa Process & ProceduresNOA2 90 days, nothing yet

My fiancee and I sent our i-129f packet to NVC on 3/31/10 and received NOA1 on 4/6/10, dated 4/2/10. Since then, there has been no movement or "touches" on our case. I called and was told it was within the USCIS timeline and that we should wait onger. My fiancee is very impatient and told me to call and get a number from the USCIS customer service agent? What number could they give me and what difference would a number make? I have no idea what she is talking about. I have my EAC number off the NOA1 notice and use it to check updates on the USCIS website. The website still says 'initial review' and is dated 4/2/10.

Anyway, I have checked the Visa Journey forum and have seen people on here who have sent in their i-129f packet to NVC after us and have received NOA2 in as little as 43 days! One case i saw sent in forms on 4/2/10 (around the same time as us) and received their NOA2 on 6/22/10.

If there is a problem or an RFE, wouldn't we have heard something about it by now? Today is 90 days since we sent in our forms. Two weeks ago, the Visa journey timeline said that applications with an NOA1 date of 4/2/10 were being processed. Today, it says 4/26/10. Is this accurate or an estimation? How can I accurately find out what dates are being processed? Our forms were accurate and we checked them about 10 times. I have no red flags as far as criminal record, etc and either does she. Just wondering what could be taking so long while others are zipping right along. All the poeple who i checked got their NOA2 quickly were from NVC and fiancee from China province, like my fiancee. When i called, the lady was very vague, reading off a script and really didnt give me much information. If anyone has had a similiar experience please let me know.

Thanks
Kurt and Ellen

Like many of you I am also frustrated to see others getting NOA2 from VSC that have filed after me and I have not seen anything happening since 5/14. I called USCIS yesterday and was basically told that my case is being worked on, and that some get approved faster than others because maybe the agent working on their file has less cases than others, or their case is less complex. Whatever, I think it should be a first come first serve. Good luck to everyone!!!

K-1 Fiance(e) Visa Process & ProceduresPolice Clearance among other things

Hello Everyone!

Im here again for another set of questions. And i would like to thank you all in advance for your upcoming replies. hehehe.

1st question: Do i need to get police clearance from every country i have lived in after age 16? i have lived in the US for a short while and I am now currently working in Jeddah, KSA. Do i need to go to US Embassy/office to get my US Police Clearance? While im here in Jeddah, should i get my police clearance now? or can i get them in my country when i go home by going to these countries embassies? Pardon my ignorance but i really have no idea what to do re his thing.

2nd question: I have an ongoing Immigrant Visa (EB3) petition but due to visa retrogression, I still have no idea when my visa no. will be issued. Honestly, i am losing hope already as i have been waiting for my I-140 petition (immigrant visa) for over 3 years now. My fiance and I are now preparing for my K1 Petition and im worried if my ongoing EB3 will have any effect on my upcoming K1 petition. Is it allowed by the USCIS to have more than 1 visa application (but different types) at the same time?

that would be all for now. again, thanks so much in advance.

p.s.

special thanks to Jim Vaphoung of Vietnam for your quick reply on my previous post. Posted Image

sincerely,
xhennah

My finance is working in Makka KSA. I emailed both the cosulate in Jeddah and Riyadh and both told me that the police certificate only applies to KSA citizens, however they did suggest that since he was still there he should try and obtain it. He just took the I-797 (I think thats the NOA1) to the Jeddah consulate, they then gave him a letter to take to the ministry of foreign affairs where he needs to obtain another signature before taking it to be fingerprinted. Hope this helps and good luck!!! Also, the Consulate in Jeddah, you can only go on Saturday, Sunday, Monday and Wednesday between 1-3pm

K-1 Fiance(e) Visa Process & ProceduresVSC picking up the pace!!

I just saw mine was touched yesterday! Does that mean I'll be hearing today or tomorrow? If I call them up will they be able to tell me the status?

I called today to check my status and was basically told its being worked on, and they cannot contact anyone unless it is outside of ther processing gguidelines (5 months). I asked why some get approved faster than others, and was told that it depends on the agent working on your file, some have mmore cases than others and some work faster) Im hoping I hear something soon.

K-1 Fiance(e) Visa Process & Procedurescsc V vsc

Yea i see what you mean, but you are basing your judgement on the reports given by members on vj,take into consideration that out of possible 4.608 cases sent to uscis only a possible 1 or 2 % of us actually even know about vj let alone registered,so am afraid what we seeing here on vj is the experience of a handful of filers,i think you will find the uscis has the whole picture.

I agree with the other reply that the VSC seems to be picking up the pace...at least they did in my case :) But to answer your question, if you look at which states file with the CSC they are mostly the western states and some midwest states. The VSC sees all the eastern states and some midwest states, also filings from Puerto Rico and the U.S. Virgin Islands. Not to mention that the with the exception of California, the eastern part of the country is more heavily populated than the west, resulting in more filings being sent to the VSC. I don't know if this is fact or not, but just my theory on why Vermont is typically slower than California.

K-1 Fiance(e) Visa Process & ProceduresPost K1 Confusion...

I suppose that is what I am asking. On her trip to the States with her K1, after we are married (which in my state/city, you can receive your marriage certificate the same day at the court house which would mean we would have our AOS package in the mail with the quickness) is she legally allowed to stay in the States until she is approved or denied for her AOS? We have been told that she could be married but would have to return to Poland if the AOS was not completed by the time the K1 expires. We have also been told the exact opposite by someone in the same office at the same embassy.

Yes she can stay while her AOS is processing. If she were to leave before her AOS (without getting and advance parole) they may not let her back in the states as the F1 visa is only good for 1 entry into the country, and that is for her to come and marry you, then she stays here and begins the AOS.

K-1 Fiance(e) Visa Process & ProceduresK-1 Visa Question

I am from Canada and my Finace is from the United States and we have been discussing where we would like to have our wedding. And we have decided that we would really like to do a destination wedding (if we can), most likely in Hawaii. What we would like to know is if we want a destination wedding do we still apply for the K-1 Fiance Visa and would this visa allow us to get married in Hawaii even though he is from another state? Or do we have to get married in the state that he is from?

C & A

You can get married in any state, but you need to check with the state of Hawaii and see what their requirements are for obtaining a marriage license. Some states have a mandatory waiting period, such as 1 or 3 days after the license is issued that you must wait before the marriage can be performed, but again this is something you need to check with the state of Hawaii. Good luck!!!

International will take about 2 weeks, 4-5 days within the U.S.

I'm a former USPS employee, express mail in the US takes 1 day and Priority mail takes 4-5 days. I sent my fiance a gift weighing 15 pounds to saudia arabia and used express mail and he had it in 5 days.

Unfortunately USPS is the cheapest way to go. If you can fit all of your documents in a flat rate express envelope it should only take 4-5 days to get there and the price is less.

K-1 Fiance(e) Visa Process & ProceduresNOA1

I filed my I-129f yesterday and was received today in the mail at the California Office. How do I find that they started my application? I see people putting NOA1 before they mail the hard copy.

example:

2010-05-01 : I-129F Sent (using Certified Mail )
2010-05-03 : I-129F Received by California USCIS
2010-05-04 : NOA1
2010-05-05 : Touched
2010-05-10 : NOA1 Hardcopy recieved

How can I also find out about NOA1 before I get the hardcopy?

Thanks

When you see that the check has cleared the bank, look at the back of the cancelled check and it will have your receipt number on there. Then just got to the USCIS website, from there you can check your status and/or sign up for email and text message alerts. Also, when checking the status it will show a date that it was last handled, so if that date changes you know that your case has been touched.

Good Luck!!

K-1 Fiance(e) Visa Process & Proceduresk1 two weddings

Hi everybody!!!

Did someone else got married under a K1 first @ the court couple of days after of the arrival of the alien fiance(e) just to start as soon as possible the AOS and then got married some months after as official ceremony where lot of ppl go etc? If we do that, should be saying in AOS that we will have our official wedding whenever (tell the date) or how does it goes?

Thank you! :)

When you marry the first time that is the date you will use for your AOS. Now someone commented that you could not obtain a 2nd marriage license which is true, however, when you are currently married another marriage license is not required. My parents renewed their vows and never had to obtain another license, all they had to do was show the priest at the church their originally marriage certificate and he performed the ceremony. So to answer your question, if you wanted to have a civil marriage or even a small religious ceremony right away and have a larger wedding later you could do that. Good luck!!!

K-1 Fiance(e) Visa Process & Proceduresjust starting

hello everyone i am just starting to gather and fill out all the necessary forms to for my fiance from the uk i am so glad i search and search until i found this site i can use all the help and advise i can get plz thank you and good luck to all

Hello and welcome :)

I would suggest first reading over the guides http://www.visajourn.../content/guides on this site, they are very resourceful. I was considering hiring an attorney and the more I searched and studied the more comfortable I felt in doing this myself. The guides will walk you thru on what forms need to be completed to start the process, how to assemble the peition, and even give examples of completed forms. There is also a flow chart that will explain what happens at each step thru this journey. This process is very stressful (the waiting and not knowing), so I suggest you study the information on this site and check out other forums/threads, the more knowledgeable you are the less stressful it will be on you.

Also, one of the requirments for the K-1 is having to have met in person in the last 2 years and submitting proof of this meeting with the peition. I have read where some people send in pics with dates and often they receive a RFE (request for evidence), you need to send in stronger proof along with the pics, such as copy of passport visas, boarding passes, hotel receipts, etc...

There are many great people on this site, whether past or present experience that will help you along the way!!

Good luck!!!

K-1 Fiance(e) Visa Process & ProceduresQuestion...
Also, a DCF is only available if she marries him. If she wants to do a fiance visa she will need to return to the states and do a K1. If she decides to marry him she can continue to live there if she has someone to co-sponsor him financially back in the states.

K-1 Fiance(e) Visa Process & ProceduresStressed Out
hello and welcome :)

As the others have stated the guides on here are very resourceful, they will tell you exactly what needs to be filed and when. There is also a flow chart to show you what happens at each step along the way. Now to answer your first question, typically a k1 is faster to do than a CR-1, but only for a few months maybe. The pros of the k1 is faster processing, while the pros of the CR-1 is that when your husband arrives he will receive his greencard soon after he enters the USA, whereas with the K1 you have to file for AOS after you are married and wait to get the greencard. Also, with a CR-1 he can travel in and out of the country immediately, and the K1 you must wait until you receive your greencard or apply for advance parole authorizing you to re-enter the country, because a K1 is only good for entry into the US for 1 time. Also, with a CR-1 he can begin work, and with a fiance he has to wait until he receives permission to work.

As for being denied, I think your chances are the same whether you apply for a fiance or spouse visa, just make sure you have all supporting evidence of your relationship. And the address you put down of where you will be living at is not set in stone, sure you can change it down the road if you need to, but if you have an address you can use temporarily then use that.

I recommend you read the guides and browse some of the forums, the more you know the less stressful it will be. This is a great site with a lot of very knowledgeable people that will help you along the way...Good Luck!!!!

K-1 Fiance(e) Visa Process & Procedures1-129F Touched?

Just checked the website, and our application is under "initial review" status. Last I checked it was still in this status, but the "request for more evidence" icon was there...this time that has disappeared. Does this mean we won't get any RFE's for this stage? Also, does this mean our file was touched?

I have heard some people say that USCIS made some changes to their website, so I'm not sure if this is one of them. But you will remain in "initial review" until a decision is made or they request for more evidence. Looking at your timeline it is still early so there is still a chance you could get a RFE. Also, being in initial review does not mean it has been touched or not. Some people stay in that status until it is approved (like myself) and others notice it has been touched prior to a decision or RFE. When you log onto the website it will give a "Last update date" if this date has changed then you know you have been touched. If it doesn't change don't sweat over it, they could still be working on it. Good Luck!!

K-1 Fiance(e) Visa Process & Procedurestracking I-129f petition?

so i have sent off my petition and it was recieved on the 15th of july!
i know its still very early on, and it will most likely be a while until i recieve the 1st approval.
i wasnt able to send a personal check, so i cant check it that way. i had to send a money order.
but i have heard stories of people not even recieving anything in the mail (a 1st approval)......only recieving there 2nd approval like 3-4 months down the road....
any advice?
also, how many days after they have recieved it can i contact the Cal. Serv. center?

I would keep calling to check if the money order has been cashed. If it has you should be able to call the CSC and get a receipt number, or wait until you receive it in the mail, most people do receive the notice. After you get the receipt number you can track on their website. Good Luck!!
