K-1 Fiance(e) Visa Process & Procedures	Visa Denied because I am ugly???	But, you see, you cannot deny a K-1 visa because someone is ugly, either.  If you have a bona fide relationship or marriage, supplied the necessary documents, and are not otherwise inadmissible you will be approved.   People suggest after a failed K-1 to get married because it shows that you are serious and pursuing your relationship anyway.  Not because if you get married you get a visa.  A married case after a failed K-1 will have to address the issue that caused the K-1 to be denied in the first place.  if they don't address that issue they will be denied again.   Yes, I understand that and was just clarifying my initial position.	r060106	Male	Poland	2013-09-25 22:41:00

The simple answer is no.  A I-130 petition cannot expire so if the visa is denied the I-130 petitioner gets a chance to rebut the findings when the I-130 is revoked.  So in that sense it has more staying power. A I-129F just expires most of the time, so people can try again.   But a lot of people think marriage is a stronger immigration case so they get a meaningless marriage and think it is the key to a visa.  It's not.  You still have to prove a bona fide marriage and relationship.  The fact that two people are legally joined is not that meaningful for someone wanting to commit fraud, unfortunately.   I was speaking as if the marriage was bona fide, obviously. All I was asking was is the CR-1 harder to deny on weird grounds like "you're too ugly" because of a legal, bona fide marital union.      Yup.  That's what I had in mind.  It seems to me that often the answer here in VJ has been "if you fail on K1--get married and they'll accept you then."   Now Harpah Timsah threw in a curve--but I heard nothing about it being "your evidence shows a lack of relationship."  With adequate proof of relationship it seems to me that ugliness gets thrown out as in impediment--it's a done deal--they are married.   Therefore the ugly part no longer matters.   It's sort of a circular argument though--if the petitioner is too ugly for the petitionee and they go and get married I suppose that a consular could say: "it's fraud, because you're too ugly to marry," but the consular official really did not accuse fraud... or maybe they did.   I dunno... the whole thing makes my head hurt.  Poor OP I can imagine if it makes my head hurt thinking about it...it must be rough.   well said.	r060106	Male	Poland	2013-09-25 19:43:00

Can you be denied because you are ugly.  Yes.  The consulate officials are agents of the Embassy.  The embassy acts as demi-gods and are for all practical reasons untouchable.    Thailand embassy/consulate has determined that a child cannot be taken out of the country without permission of both birth parents.  In America hearings are held, and though state rule applies--essentially both parties are looked at and custody is often given, allowing a child to be moved to a distant location--if the Court determines it is in the best interest of the child.  So The Thailand consulate simply makes its own rules.   Therefore they could quite arbitrarily refuse you because you did not wear pink shoes on a Tuesday.  Now, of course, you could sue, but I really doubt that you would get anywhere as there is no Federal District Court who would hear your case.  You could take it to a higher court and eventually to the Supreme Court--but 99% of cases are never acted upon.   There is no libel/slander because this was told to you, not to others.  For slander/libel to hold true something has to be conveyed, and believed by another and damage from the action must occur.  Further, if for instance, you were placed with ten other people of approximate age, race and gender and if a group of random people were chosen and they repeatedly said: "that person is indeed--ugly," then there is no defamation," because truth is the absolute defense to defamation.   It's not sexual discrimination or any other actionable discrimination because ugly/beautiful is not an attribute protected by any law.  Neither would it be any form of discrimination if you were denied because you were too short and people do indeed discriminate because some of us are short (See:	r060106	Male	Poland	2013-09-25 16:59:00

The petition will be sent back to USCIS and you will be notified of the official reason for denial.  It will NOT be because you are ugly.   some possibilities...   1. You are making this up for fun   2. She is making it up because she does no twant to marry you, did not go to the interview and is feeding you BS   If you are not making this up, then you may want to check with the consulate and see if she even showed up for her interview   You don't think the consulate would deny someone for such a reason? It makes me wonder if K-1s are easier to deny because there has been no marital bond established yet. Does anyone agree with that statement? What ever the case I am happy to know they have a chance no matter what time from we are both talking about....     Where did I indicate I didn't know what you were talking about?? I'm trying to let the OP know what the total time from NOA1 to POE is for the spousal visa. I realize you were just pointing out the I-130 and didn't say otherwise. K-1 Fiance(e) Visa Process & Procedures	NOT APPROVED	Meaning the turnaround time for I-130 is 7-9 months. As far as NVC it depends.  I have seen where others once they receive their NO2 they are already prepared and have all of their paper work ready to go, and then their are some that are not prepared.  No two case are the same.  I saw a post from one of our Haiti members whose I-130 was approve in 2 months and then sent to NVC for processing (see post below).  Therefore always think positive, but most importantly know that you do have another chance.   The wait after the NVC has been averaging 5-6 months lately and the wait for the NOA2 has been 7-9. So like I said, a year to 15 months. It's not 7-9 months and hasn't been for a very long time. There are still some people from March of 2013 waiting for their NOA2 and my wife and I sent our petition in September and are still waiting after five months. The turnaround time for the I-130 is 7-9 months at the USCIS stage and another 5-6 months from USCIS to approval at the embassy. So a total of 12 to 15 months. I am spanish citizen and engage with a beautiful us citizen. We are in the process of obtaining our K1. I already have obtained my criminal records in Spain. However, when I was sixteen years of age I spent 10 months living in the United States as a foreign exchange student (when i first met the girl who at present is my fiancée). The question is weather I will o won't need my 'criminal records check'from the Police Department in the area that i spent those 10 months in 1999. I usually read others stories and comments and I find this site to be really helpful, so I decided to sign up and share my story hopefully I can get some help. We are in September and no communication from the embassy, no packet 4, which means he doesn't have an interview date and he's unable to do his medical. I have one month and a week and a half before NOA2 expire. Should I be worried? 2/2/11 NOA1 (received) 6/17/11 NOA2 Approved 8/4/11 He received Packet 3 at the Post Office(no call or communication from the embassy) 8/5/11 He emailed packet 3 8/8/11 brought in a copy of form DS 3032 and was told that they will contact him and we are still waiting Your I-129 was approved on 6/17/2011? K-1 Fiance(e) Visa Process & Procedures	We didn't write on the back of the photos	Hello, everybody! We are a K1 July filer and have been waiting on our NOA2 for 55 days now. I was just wondering if it is mandatory to write on the back of the photos or if in the case we have sent all proofs it is not so relevant at all? My fiancee sent all primary and secondary proofs required for the process: copies of every single page of his passport with the visa stamps, boarding passes, itineray, skype, emails and facebook logs and the photos, but didn't write the dates, places and people's names on the back. Has anybody out there gone through this before without getting a RFE? I know all we have to do now is wait and see what happens but any reply will be very appreciated! Thanks! We didn't. No RFE.
