Yes, my husband just called CSC as well, (using the RFE trick) and this is what he emailed me a while ago:

"I talked to an Officer Ellis at USCIS and he was very nice and helpful. Not rushing me in any way and looked into each of our cases. Unfortunately our 2 files have not been assigned an officer yet but he said that it should be worked on within a couple weeks.
Today they are working on July 27th I-130 files (I realize this is our date) and some files w/ prior dates. He also said they are at July 30th files for the I-129F submittals."

Our I-130 Notice date: July 27th 2007
Our I-129F Notice date: August 22th 2007

K-3 Spouse Visa Process & ProceduresUpdate on Processing Date on USCIS website
With a Posted Date of Jan 15, 2008 there are new processing dates on USCIS. Just noticed the change today, I didn't check yesterday.

Processing Timeframe
For I-130 ---- July 15, 2007
I-129F----July 19, 2007

What does this mean? Is it good progress? If I recall correctly, the last dates were June 18.

Thanks for the reality check, Elbereth! It is so easy to get impatient and frustrated! I think since we sent our I-129F in August, and most likely both I-130 and I-129F are stapled together, we won't see anything till they process August files, even though our I-130 is from July. Even so, there is no harm in hoping. Good luck to all.

Hello all, I just posted on the July K3 Filers. After all the rumors in the forums my husband wanted to talk to someone at USCIS so he just called. This is what he just emailed me:

A very nice lady by the name of Officer Mangan today. Nothing exceptional. She said they are working on July 31/08. That does not mean and actual day it's a time frame. She said ours should be ajudicated very soon but it has not been assigned an officer yet. When it is assigned an officer things will go quick, either approval or RFE. I continued to ask questions and shew was very very polite ended our conversation with thank you very much thank you for your patience. She took my number and said she will be off phones tomorrow and will find our file to make certain it's in the correct location then call me and tell me whats up.?.!? Let's hope she actually calls!

This was due to all my I129F questions. She really was uncertain herself. It seems that yes any I129F application w/out fee (after july 31st) will be cancelled upon the approval of their I130. I said, so we will not be given an option between the Immigrant I130 and Non-immigrant K3 I129F? USCIS is going to make that choice for us? She was uncertain at that point! I said, we would have paid the fee if that was the case but USCIS waived the fees. She really didn't know after she thought about it from that perspective.

Also, I mentioned the Ghana person and Mexico person who have been approved with dates later than ours. She said did they have I129F K3's? I don't know? That could be the difference, she said. So the I129F NON IMMIGRANT process may have hurt rather than helped? Again she was unsure but said possibly!!!>:( This is why she is suppose to be looking into it for us and calling back tomorrow. I asked her to look into our file to see if the I129F has delayed us? She said okay.


So, it seems that even within USCIS/CSC they are confused! We are in their hands, and they have no clue what they are doing!

Hi guys. This could just be my paranoid side coming out, but could it be that they are just dismissing filers who "got away" with filing the I130 with the old fee, and then I129F with no fee? blink.gif

My husband also got the same information from a CSC officer last night, saying that they are cancelling K3s filed AFTER July 31st.

I'm anxious to see what comes of the K3 Teleconference tomorrow.

By the way, my husbands call last night generated a touch on our I-130, but NOT on our I-129F.

I just read the K3 Teleconference thread, and it says that rudeness/unhelpfullness from a USCIS rep on the phone is grounds to contact the Ombudsman. Also, they are SUPPOSED to tell you their name when they answer the phone, and their # when requested. You guys are so overdue for an approval!

That seems to be the case Monalisa. I'm already starting to study the NVC Flowchart and the James Shortcuts to try to save time whe we FINALLY get approval, since I am anticipating having my 1129F cancelled. (Hopefully not...But I usually hope for the best and prepare for the worse). Problem is, my husband is a bit computer challenged and might be overwhelmed with the James Shortcuts!

Yep...I guess my husband's frecuent calls weren't good or it was bad luck we got a rude person on the phone. Today they told my husband that he's already called twice this month and to not call back till another 2 weeks. Then first they said that they couldn't give him information because the system was down, and then said that 'it was still pending'. My husband doesn't care about their 'warnings' and will call again next Wednesday if there isn't an approval or RFE...I'm worried that this could backfire!? Anyways, yeah, they seem to get pissed with frecuent calls (are 3 calls frecuent?!)

We are in the exact same situation as you. (see signature) We were touched every day, and then no chance since the 30th. I was getting excited thinking an approval was coming, but my online case status still says "Case Recieved and Pending".

I was also curious about your question, as I've read on VJ that folks in similar situations call the hotline to ask about their case only to recieve the surprise that they've been approved...or recieve the surprise in the mail (either surprise approval or surprise RFE). My husband said he would call yet again today, but I'm starting to get nervous that they'll "get mad" because of his frecuent calls.

I guess this doesn't respond your question at all. Just know we are in the same boat!


Oh, and one more thing. My husband never recieves any 'CRIS' emails either. I thought people recieved emails for every touch, but we've never recieved a single one. (I've checked the settings several times and we do have email notifications activated)

As I understand it, it's really only worth using the RFE line once you have reached 180 days from your NOA1 date. If you were to call you'd get the standard information that you'd get from looking at the website...plus maybe pissed off from them telling you "call in 6 months".

We waited till we were 6 months to call and still were only told our case was pending and not in the hands of an adjucator yet. We are still waiting, we filed in July.

Hello,

If anything I WOULD overwhelm them with papers. You want to make sure that you prove that you have a bonafide relationship, you want to avoid recieving a Request for Further Evidence (RFE) later on that will slow down your progress.

Send everything that you can think of that can prove you have an ON-GOING BONAFIDE relationship.

We sent in candid pictures from our wedding and reception with his family and mine; pictures from trips; copies of stamps on his passport entering Nicaragua; copies of plane tickets to Nicaragua; postmarked envelopes; copies of life and health insurance with me as beneficiary.

Hello Nita,

I can't imagine your anguish right now. I don't want to add to your confusion, but the K3 is suppose to reunite you with your husband quicker...BUT...we all know that dealing with USCIS is hell. If they already cancelled it, what makes you think that reopening the case isn't going to cause problems and further delays? The lady you talked to seemed to sympathetic, but not enough to call you back. I'd say stick with the I-130, trying to reopen the K3 might delay it longer and you have no guarantees that it will in fact be quicker. I know you just want to get him home ASAP, but I am so skeptical, and dissilusioned with dealing with USCIS. I hope this gets resolved soon.

Just to have a bigger sample size: We paid the OLD fee for the I-130 ($190.00) and then NO fee for the I-129F (waived). And later on were told that the K3 would be cancelled.

I think this could be the situation. Folks who paid the NEW I-130 fee ($355) and then NO fee for the I-129F (because now it's free) will be "safe". It sucks for me and a couple on VJ, but it makes SOMEWHAT sense. I just wish they would have said something...We would have paid the extra money to ensure we'd be reunited quicker. Hence, Family Reunification! wacko.gif

Ok folks. I am very surprised by the message I just recieved from my husband. The Officer at CSC that my husband talked to last night (through the RFE line), and who took our phone number, and said would look into our questions, and call back, ACTUALLY CALLED BACK! good.gif

The Officer called back. She left a message.
Her exact message: The I129F did slow it down. It went to the filing of the I129F date instead of the I130 date (as we suspected). She sent our I130 to division. End of message.

Nothing refering to 'cancellations' of the I-129Fs. I guess we know they are going by I-129F receipt dates, and not I-130 reciept dates for those of us who filed for K3s. unsure.gif

I'm still in shock the lady called back!

FruitBodyWash, my husband called CSC using the RFE line, so he didn't call the regular customer service 800 number. Firstenburg also used the RFE line, where he got this information.

Like I mention in a different thread, I think the problem will be for filers who "got away" with filing the I130 with the old fee, and then I129F with no fee. It also seemed to me that it was too good to be true.

By the way, BOTH our files were touched AGAIN today...maybe they were really confused with all of my husband's questions after the lady said they would just cancel our I-129F. OR they are blacklisting us...one or the other. wacko.gif

I believe it'll be us late July filers and later filers that are going to be affected. (The ones with the I-129F fee waived). However there are SOME July filers that are getting both petitions through. My husband just called CSC and got the same answer that Firstenburg and Nita&Assad recieved. I can imagine my file sitting in the late August pile because of the I-129F...only to have it cancelled in the end. #######??!!!!!

you are not alone. We are also still waiting. Our congressmen & senators have been enquiring for us, but USCIS doesn't respond to them either. All they say is that we are with an "adjucation officer" but that has been their story since the 27th of Jan...and still nothing. If we do have an RFE, we would like to know to send them the information ASAP, but there is NOTHING!!! This is so frustrating...so many aspects of our lives revolve around this approval, and we have many things on hold becasue of it. Sorry to vent...

my husband just called the RFE line. NOW he is told that both our I-130 and I-129F are going to be looked at and that they would be both forwarded to NVC. (I know that the I-130 is supposed to stay at USCIS, but that's what he said).

ANYWAYS, my question is this: The officer told my husband that my "alien number" is an eight-digit number. It doesn't start with an "A", but he said it is my alien number. What is this number? Does it mean anything? It is not on any of our NOA-1s.

After a long stressful wait we have recieved our approvals!!! I was in the mountains with no cell phone signal and miracoulously had half a bar, enough to get my husbands message to call him back for some great news.

I was taking a break from VJ and obsesively checking USCIS. We are still waiting as well. The senator/congressmen reps came back to us with the same info we heard from CSC officer rep: Our case has been assigned an adjucating officer. Thing is, it's been in his hands for a month now. Maybe we are stuck in security checks, I don't know.

Also, we recieved a letter from one of the reps saying they were told our "I129F was administratively closed".

An I-129F is for fiancees; but you may submit an I-129F for a K3 visa, which is a NON-IMIGRANT visa for spouses of USC. You recieve a K3, enter the US, and apply for Adjustment of Status while being with your Spouse. It is SUPPOSE to reunite families a lot quicker...but now with USCIS taking forever, who knows!

An I-130 is "better" because once you come into the states you are ready to start working and don't need to Adjust Status, however it takes a lot longer to process at the NVC and be forwarded to your consulate/embassy.

I personally perfer the K3, I just want to be back with my husband as soon as possible, even if it means I can't work right away or that I have to pay extra processing fees. But it looks like USCIS is making that decision for a lot of folks now.

You are not alone. There are still quite a few July filers waiting for approvals. My husband has just finished writing up a letter to send to his congressman/senator. He has asked his family in Ohio to do the same. It's "only" been a little over 6 months, but we are not going to wait any longer to get people involved. We really don't want to be in the same place 7,8,9 months after our NOA1...

This sounds like what Nita&Assad were told. I'm going to be really upset if we are FORCED to go the I-130 route and be away from my husband even longer. sad.gif
