I going to apply for the CR-1 Spouse Visa so that me and my sweetheart Khan from Thailand can be together. I have filed bankrupsy two years ago. I now have a good steady job in Resort Management. I also am working to a resolution with IRS on back taxes that are owed from a tax audit over two years ago. Will this have any effect on their decision for approva.

I am traveling from the US to Thailand this coming November, to marry the woman I love. I am going to start the IR1/CR1 Spousal Visa process immediately after that while still in Thailand. Is there anything I can be doing from now until November concerning this process? I have kept copies of all the e-mails that we write everyday and hopefully I an getting all the phone records of all the calls I have made to her in the last 4 months and the to November. There must be something I can do now?

I don't have experience using such service, but if they guarantee approval they are lying, no one can guarantee that. If they offer your money back if it's not approved then maybe I'd consider it. If it was me I would do everything myself. It's really not that hard especially with all the help you can get on this website.

Thanks for the advise. They offer money back guarantee but only if it is denied because of mis information given to them by us or we have not told the truth, or we have some criminal thing,something in our past and other stuff like that. Way too many outs for them. I can do this.

if you don't have any red flags in your case, just a straight forward application then by all means do it yourself, you just need to be detail oriented. i used an attorney stateside which was a waste of valuable time and money for our straight forward case. i did use a document prep service in bkk but just for the translation of the birth cert/ house book and thai id. paid about $30 USD but that was in 2007.

I believe my case would be straight forward. I am dealing with an IRS problem presently but hope to have a solution/agreement in place with them before the start of this process. Damn IRS...always lurking! I am more than capable of taking on the process, I only worry that I may miss or mess up something and cause myself and my loved one unnesasary delays or even denial. It seems pretty straight forward, and they are not out to get me. I am just feeling the strain, being that I am at the very begining stage. I am considering using a Visa Process service company to go through the IR-1/CR-1 process. Can someone with some exsperience using one of these services suggest a company to use. I see many out there to choose from all about $800 to $1000 from start to finish, guarenteed approval. I understand there will other exspences to accur concerning consulate fees and medical fees etc. Please suggest a solid company to help process the paper work. Thanks

I chose to marry my wife in the Philippines. The time difference isnt that much diffeent, maybe around 2 to 3 months more for the spouse visa. The plus part of it is that once she enters with a spouse visa she has her green card with in a couple of weeks. With the K1 visa you have to adjust her status and wait for more paper work to clear. I say all in all the only plus of the K1 is that she will physically be in the US earlier. If you add the adjustment period the time line would be the same. If I had to do it all over again then I would still marry my wife in the Philippines.

Thanks for your insight. I thought knew it was a few months different. Is there a down side from having her here sooner and then having to change her status once here and then waiting for the Green card? I would have her with me maybe 3 months sooner and 3 months might feel like a life time after the initial wait. I am patient but I want my sweetheart with me and to stop having to work so hard at her Hotel cleaning job. It is a good job and she realy likes it but lets face it, its hard work for very little money. I may ask her to stop and I will support her while she would be able to spend lots of time with her family before she comes to the US. This would be good for her and her family. I would also help the family like she has been doing with her money earned. I want to do that. Anyway thanks for the reply.

I like the drill bit! No pun intended. I wanted to marry in November, but no real plans or date as been determined. I wanted to know which way would be better, before we decide to marry in Thailand or the USA. Is it true that with a Fiance Visa K1 it doesn't take as long as the IR-1/CR-1 and that my baby would be able to come to the states sooner. Thats all. Thanks

Are you married now? If so, fiancee visa (K-1) is not an option.

We are not married as of yet. This would be possible this coming November in Thailand.

We had planned to apply for Spousal Visa after we married in Thailand this November. Is we apply for Fiance Visa is it faster for my wife to come to the US where we would marry there instead with in the allotted time. The timelines are a few months apart from one another, longer for Spousal, but with Fiance she would be in the US sooner. Can some of the ones out there who made that decision for themselves please let me know their reasons and why I should go one way and not the other. Thanks

There is one thing I should mention and I wish I had remembered to earlier. When you start the process, DO NOT use terms like husband, wife, or wedding. If you do, then you will have a USCIS adjudicator or a VO at the embassy say, "you are married, you are not eligible for a K1, file a CR-1." When referencing your ceremony in Thailand, the best terms that I have seen people use are "engagement ceremony" or "engagement party."

First of all: Congratulations to you both! :D :thumbs:

Secondly: Since your ceremony in Thailand was not "official" in the sense that you did not notify any local authority there, the K1 process is essentially the only option available to you as the CR-1 would require a marriage certificate. So you are doing it the right way.

Finally: It takes 5 months from time of filing to approval by USCIS for both I-129F (which you will file) and I-130 (which is for CR-1 and not applicable to you specifically). After USCIS approval, the petition is sent to the NVC, I-130's undergo additional processing (again, not relevant to you) whereas I surmise based on what I have read is all the NVC will do with a K1 petition is assign it a case number and send to the appropriate embassy or consulate (which will be Bangkok in your case).

I have just returned to the US from Thailand where we had a traditional Thai Buddist weddding ceremony for her family, there will not be another chance to get them all together again. We did not notified the Thai Amphur nor the US Embassy which they both do not recongnize this ceremony as legitimatem as it stands on it's own. I understood that and that is why we did this way,for the family in Thailand and the fact that I am so in love with her and want to marry my love legally in the US. I am told that the Fiancee Visa will take a couple months less to get approved and have her with me in the US sooner than the Spousal Visa process. I am now going to file for the K1 Visa and follow the process. Does anyone have a better idea or am I going in the right direction? Thanks

K-1 Fiance(e) Visa Process & ProceduresI-129F ON LINE FORM
I am trying to use the USCIS site to fill out the I-129F form. I have found that with the addresses in Thailand being so long they will not fit in the designated box. I am able to input the entire address in the electronic form, with the box showing a plus sign so when you click on the plus sign(+) it will show you the second half of the address. However, when I try to print out the form, so I can mail it in, it will not show the second half of the addresses making the form incomplete. I was wondering if anyone elese has had this trouble with Adobe, or can tell me another site to get the forms in a more usable form. Thanks
