If you are just now filing your I-129f petition, it is way too early to send the I-134 to your fiancee. This is only needed for the interview, and you are looking at the least a 6 month wait (possibly 6 to 8 months depending how long it takes to get an interview). For the I-134 they are looking more for current income, so as long as your current income is OK you shouldn't have any problems.

When I filed my affidavit of support, I had 2 jobs--one I had worked at for over a year, the second I just started in July. My income was not sufficient with just the one job, but with 2 jobs I make enough. The problem is, since I only worked half a year at my second job, my annual income for 2012 was still short of the poverty level. Add to that, my previous tax returns were also below the poverty level. At the interview, they accepted my I-134 and my level of CURRENT income as enough support for my fiancee. They did not even ask for my co-sponsor information--in fact they handed it back to my fiancee. Her visa was approved without any problem.

It won't strengthen your case by much at all. You need to place more emphasis on the personal relationship you have with your fiance, such as YOUR time with him, photos, passport stamps, phone calls, etc.

In other words, if its something fairly easy to include your family members' involvement then by all means include it. But if it will take a considerable amount of effort to to so, then really the benefits you gain isn't really worth it. You need strong evidence of you and your fiance's relationship, not your fiance's relationship with your family.

Don't waste the money on a lawyer, because the process is rather simple and using a lawyer would be a waste of time and money. The biggest help for me was the K-1 guide, the example forms, and the many helpful people on VJ. We have all been through this, some of us still going through the processes, so the wealth of information is enormous. The process was not designed to be difficult, you only need to prove 3 things on the petition: the petitioner is a US citizen, you are both legally free and willing to marry, you have met each other in person within the last 2 years. Nothing a lawyer can do to help you with it, because YOU have all the proof and information you need to file.

As was said, some of the stuff you don't need to include in your petition. It won't hurt to include extra, but it will have no bearing on your petition case. The extra fluff will be just going to the embassy for them to review it after your petition is approved. At the same time, you want to send a fairly compact petition that won't take ages to go through because it could prolong the approval process.

As far as how to assemble your petition: use paper clips. Keep like items together with smaller clips, and use a big one to hold everything together. I did this with my petition, and then I went to the post office and slid all my paperwork into a priority mailer and mailed it. It's that simple.

For the Apt numbers, you can leave those boxes blank in Part A & B. In Part A, 8b the A# you can leave blank. For part C, if I understood you correctly and you are NOT serving overseas in the military, then you should write NOT IN MILITARY SERVICE in the first box, second box can remain blank.

So I called the Georgetown Embassy today and the lady told me they haven't received our physical case yet but recieved it electronically. I called NVC and the officer said they had mailed our case in 1/29. I also receive a letter regarding that had mailed it. I am so confuse. Does anybody have any advice for me?


Just be patient and wait. Electronic copies are nearly instantaneous whereas physical copies could take a week or more.

It wont be in the instructions. The I-134 is used for many visa cases in which that question applies. It does not apply to K-1 visas. Question 10 should be your NOA1 date.

If your fiancee's current income is at least 125% of the federal poverty level for the household size, there wont be any problems. If the household size is 2, then your fiancee's income is plenty.

They dont care about bankruptcy. They care the sponsor makes enough to support you.

Best to wait until closer to the interview for a few reasons. First, the validity of the visa could be based on the date of the medical...it was for my fiancee. Second, if the embassy thinks your medical is not recent enough, you may have to redo it. Third, when you file aos you wont need another medical in the US as long as your medical is less than 1 year old.

Each embassy is different in what they are looking for, and some have different requirements. There are some embassies from high fraud countries that REQUIRE a lot of proof of a bonafide relationship in the original I-129f petition, otherwise they are likely to just toss it and not give it a second glance. There are also a lot of embassies that are more easy going and don't really require the frontloading of the I-129f petition. I don't know how Poland is, maybe some one from there can better answer how the embassy is there. My embassy is in Colombia and it is a fairly easy embassy to go through. I only included a few pieces of relationship evidence, the same as what you are planning to include, and we had no problems at all.

For the I-129f, you are sufficient to just include the photos, passport stamps and boarding passes. The extra stuff you include, in my opinion, is the perfect amount for helping to prove your relationship. It is not necessary to include it, because only the embassy will look at it. However since you are not including too much I think it is perfect.

Since I don't know the embassy you are going through, you may or may not need to include a LOT more relationship evidence.

If you want to send an offical invite you have to do an I-134 for her too. I have done the tourist visa process already so I know what she will have to prove. I am talking specifically about having two I-134s out at the same time and how that could potentially affect our K-1 visa.



Having his mom at our wedding is the USA would be much easier than having my entire family in Guatemala for a wedding. That is why.


If you have an I-134 for the tourist visa, and also one for the K-1 visa, this will not affect the K-1 visa. Just that when you do your I-134's, you need to include the person from the other I-134 as a member of your household and have enough money to support for the household size. For example, if you do the I-134 for the K-1 first you obviously will put yourself and your fiance (and anyone else that you provide support to). When you do the tourist visa I-134 second, you will need to include yourself, his mom, AND your fiance (because its on another I-134).

Basically you need to put down everyone you are supporting on the I-134, including people that are on previous I-134's you are still obligated to support. As long as you have enough financial support to support your household size then there will be no problems.

This could be embassy specific as to how many you need. We needed 2 for the medical (one for the medical exam and one for the laboratory tests), 2 for the DS-156 and 2 more for the interview. We didn't attach the photos to the DS-156 forms, they stapled the photos at the interview how they wanted it. All we needed was 6 photos, and it was also clearly stated in the K-1 instructions sent from the embassy.

Hi, Everyone-

My Fiance filed the K1 visa this month(February) and finally received the NOA1 last February 11th. But right now, Im bothering to some things because I'm already looking forward on the interview. So to begin with, after 1 year and 9 months of talking, my Fiance came here to visit me and his relatives for 19 days. On his visit we actually talked that were going to take the K1 visa route. So theres no such engagement party happened just merely both agreed about it. So when He came back to US we prepared all the things that we need, I mailed Him my G325A together with the Fiancee Letter of Intent with my signature on it. What bothers me right now is that *We dont have formal engagement party/ring yet and He just visited me once. Is this can be the possible reason for denial?

PLease help me. I know you're all very supportive and im asking your assistance/inputs regarding this.

You have nothing to worry about. The fact that you have signed a letter of intent is proof enough of your engagement and your willingness to marry. Proposing isn't about having something 'official' or fancy like an engagement party or getting down on one knee and popping the question with a ring, its about agreeing to spend the rest of your life with someone in marriage--something that is stated specifically in your letter of intent.

Like I mentioned in my reply to Emely in my original thread about this happening to me... refile. You are better off IMO to just start over and do everything correctly then risk appealing a denial and still not getting approved. Since I did not know until after I received the denial, I just refiled. I am not sure what you can do now. Someone mentioned to withdraw the original submission. If that is an option, then do that and start over now. Don't wait a few more months just to more than likely get denied.

One other thing, to appeal a denial its $630 as of March 2012. So like mentioned above, it's cheaper, and I think safer, to just refile.


Just to mention that you CANNOT win an appeal unless you can prove a mistake that USCIS made that caused the denial. If YOU made the mistake (ie you forgot to include all the required documents) then there is no basis for appeal. It's a waste of time and money if you are clearly the one at fault.

Your situation is a bit different if you are simply missing ONE form. They will prob send an RFE for that one form you are lacking. RFEs are sent for little things you are missing, maybe you forgot or didnt have the right information. They just wont send an RFE if the entire petition is just not there.
