K-1 Fiance(e) Visa Process & ProceduresWife did not make it past homeland and got k-1 cancelled

LOL at your edit B-)

1. US citizens cannot be refused entry into the US for any reason.
2. It's the airline's responsibility to return anyone who is found to be inadmissible. So if you're refused entry, the airline is obligated to fly you back.

Actually that not very correct. The airline would not be responsible to cover the cost. If she was holding a valid K1 visa, the airline has done it job correctly to make sure can get access to the USA. They cant be hold liable for a decision, the COB made regardless of her paperwork.

I think anything about the embassy in Athens is a mystery. Most members on here have not given any kind of details on their experiences when dealing with this embassy, even though they have been approved. So you really don't know what to expect I guess. And yes.. this is a hint and nudge to all members that will be going through the Athens Embassy to share their experiences.

K-1 Fiance(e) Visa Process & Proceduresplane ticket question

i will be flying soon,i just want to know if there will be a problem if my registered name on my plane itinerary doesnt include my middle name.
and it was my fiance who bought the ticket using his card, will they still ask me about the card or look for the card?

thank you people :D

No. You won't have a problem. Just as long as your first and last name are spelt just as they are in your passport. I work for an airline, and we have never denied boarding to anyone because their middle name isn't on their ticket.

You can call the airline and ask them to add your middle name, and if they are allowed to do it then it will most likely cost you a reissue fee.

As for your fiancee's credit card. If when he purchased the ticket he stated that it was a 3rd party purchase (basically means he purchased for someone else) then you wont be asked for anything. If he didn't then they will proceed to ask you questions about the person that purchased it. Its safe to assume that you know your fiancee, and his details so you wont have a problem.

K-1 Fiance(e) Visa Process & ProceduresBuy your ticket before the interview..

No, what is actually funny is level of your logic and statistical knowledge. You re forgetting that you would have to pay higher fair anyway since you would be buying tickets at the same time as hanging hem. For example, if higher fair is $1,500, and you bought ahead of time for $800, you have to pay $700 +$100-150 in fees. If you buy from scratch you are paying $1,500 anyway. So, all you are risking is $100-150, which is worthwhile for most people. Now, this is where statistics kicks in. Let's say the chance of visa arriving in time is 60% and 40% being late. Let's say that you buy tickets ahead of time and they cost you in average $800 (Russia to LAX). If you buy ticket 1 eek in advance once visa in hand the cost is $1,500. If you miss the plane due to late visa the cost becomes $1,650 (worst case scenario). Let's even assume that chances are 50/50 (even though they are much higher). Thus, Expected Value of the cost for visa if you buy ahead of time with chance of delay = 0.5*$1,650 + 0.5*$800 = $1,225, which is still better then $1,500. In actuality, numbers are even in greater favor of buying tickets ahead of time. the only way you can have Expected Cost better is if you do what Gary did - his fiancee arrived one month after visa was in hand. Now, this is matter of personal choice. Knowledge is power, my friend!

Wrong.
Lets say you purchased your 800 dollar ticket 3 weeks before your interview date for a flight departing 5 days after your interview. And lets say you do have to change your flight because of visa issues. When the time comes for you to call your airline they willsay.. of course you can change it sir!!!! The current ticket being sold on the date you request is 1500.00. So that 150 for you changing fee, plus 700.00 for the difference in fare.
Now you can be extremely lucky and find the same fare and only pay the changing fee, but as an airline ticketing agent for 5 years that does not happen often.

sorry..misread your post you are basically saying the same thing! :bonk:

K-1 Fiance(e) Visa Process & ProceduresBuy your ticket before the interview..

Actually, I bought my tickets before the interview and got lucky. I did buy tickets for date 1 week after the interview. We flew home together. Now, let's compare prices: If you buy after visa is in hand and if you want to fly within a week it will be extremely expensive. If you buy tickets ahead of time it will be MUCH cheaper. Let's say you did not get lucky and you have to change the date. Usually there is $100-150 changing fee... Still makes sense..

Yes, the rebooking fee can be as little as that, but that is only if the fare basis of your original ticket is available on the date you want to change to. If its not, you will have to pay the rebooking fee PLUS the fare difference from the ticket you are holding to the ticket that is currently sold on the date of travel you want. That can be in the hundreds.
As others have adviced, either by a fully refundable ticket, which are quite costly or wait till your visa is issued and then look for cheapest fare you can get.

K-1 Fiance(e) Visa Process & ProceduresAfter 1-29F Approval?

So I just recently was approved from the VSC for our I-129F.
I just have a few questions.

1. Regarding the I-134 form, It says 125% above the poverty rate? I know the poverty rate is about 11,000$, so would that mean 125% is close to 14-15000$?

2. How long should I wait till calling the NVC for a case number or will they issue one and contact me with that information?

These are the poverty guidelines posted on USCIS. Look at the household number and see which corresponds to your situation.

K-1 Fiance(e) Visa Process & ProceduresK-1 and ESTA

I am actually one of those people that check you in at the airport ;-) (or was :-( )

We do know how to handle Visa and ESTA. The systems don't let us check anyone to the US unless one or the other is valid. If you want to be sure the information is correctly entered you can always go to your booking and enter it yourself ahead of check-in (helps us too).

I agree with Saphina, I am a supervisor to the people that check you in. So tips when dealing with the airline.
First of all, tell the check in agent that you are travelling with a visa not ESTA, so that they can out put your K1 visa number into the system. These details get sent to your POE before your arrival, so you want it to show you will be entering with a K1 visa and not your ESTA. I say this because a valid ESTA will automatically match itself to your reservation in the system. The check in agent will not look for the K1 if the ESTA is valid.
The next thing they might ask for is your return ticket, I'll safely assume here that you might not have one seen you are migrating. Now here is where you might have to explain to the check in agent that your visa is to move to the US not to visit thus you dont need a return ticket. If they have never come across a K1 visa before, be prepared to wait alil bit while they clarify that, mostly by calling the CBP supervisor of your POE in the US or the US embassy. Its what I did many years ago when I first came across a K1 visa.

Hope that helps

K-1 Fiance(e) Visa Process & ProceduresHELP ABOUT FORM G325A

When the previous poster said no caps, they meant in the forums, they weren't refering to your G-325A form. You can use all caps on the forms.

You need one form for the petitioner and one for the beneficiary. So thats 2 in total.

Here I will assume that its just you and your fiancee and that you wont be filing for any children.

The porverty line for a household of two (you and your fiancee) is $19,387 annually.

You need to be at least be making the above amount to qualify. So if you are currently making 15000 a year, your options are as follows:

1.Find a close relative that is either a US citizen or a legal resident that is willing to act as a joint sponsor with you.

2. Get a second job or a better paying job to raise your yearly income.

If I have missed out on anything, other members will hopefully chime in.

Please note: On all of our online corrispondence and day to day communication, we both use our nicknames, neither of which are legal names. B is used by myself, the petinioner, (his full name ) and G is used by the beneficiary, (my full name here)

Hope that helps

B & GFemaleGreece2013-07-04 00:17:00
K-1 Fiance(e) Visa Process & Proceduresemergency advice -stolen bag at airport with visa packet

Darling, B & G never said anything about immigration officers not asking for the package. He said: "Airline will let her board because of the visa in her passport. Its all they check, 90% of them don't know that she needs the packet to be admitted into the US. But then again, its not their responsibility to make sure she does."

And the advice given was "OP, my opinion, don't risk it. Speak to the airline and explain the situation of the stolen bag and how important the package is to be allowed into the US. Airline might waive all fees for the date change. I work for a major airline and we waive payment when we have a passenger that has lost a passport or has a passport stolen.

Only thing you should make sure is that your fiancee has a police report for the theft, show that to the airline and work from there." Suggesting that the OP should change the date of the flight, get a police report of what happened and work from there with the embassy.

K-1 Fiance(e) Visa Process & Proceduresemergency advice -stolen bag at airport with visa packet

I dont think I agree with you. When I came here with my k1 the first thing the officer asked me when he saw my k1 visa, was my package. They have define procedure for every kind of visa. I've never heard of someone entering the country with a k1 visa without her package. Is SO important that if you open your package before arriving to the POE you can get deported or not allow to enter to the States (when I went to my k1 interview the CO explained the importance of taking care well of my lk1 package and the things that might happen if I lose it or opened it). You shouldn't advice him that

I think you misread what I wrote. I was not talking about the CBO when his fiancee arrives at the POE in the US. I was talking about the airline check in agent. The check in agent won't check if the fiancee is carrying the packet. What they will check is the visa in the fiancee's passport to see if its valid. If its valid, she will be permitted to travel to the US. It is the passenger's responsibility to make sure they have everything they need to be permitted entry into the US.

It is why I advised the OP to speak to the airline about changing the dates of her flight till she has another copy of the K1 package in her hands or the old one if found.

Okay I get your point now.

I think she'll be able to board since she has a visa.

You are correct there Gowon. Airline will let her board because of the visa in her passport. Its all they check, 90% of them don't know that she needs the packet to be admitted into the US. But then again, its not their responsibility to make sure she does.

K-1 Fiance(e) Visa Process & ProceduresNew and confused... Could use some guidance!

Well, hello everyone! smile.png

Me and my fiance (he is the US Citizen) have been starting to look into the process and I am still a bit puzzled over somethings.

The USCIS' webpage didn't really helped... xD

So, I'd be very grateful if some of you could help me out...

For What I have read thus far, the first step is the petition which includes:

  • the I-129F
  • G-325 of both of us
  • G-1145
  • both of our passport photos
  • a cover letter by US citizen
  • a declaration of how we met (here is my First Question, how we met the first time ever which was online or the first time we met in person?)
  • Statements from both declaring we will marry within 90 days
  • Proof of having met in the past 2 years
  • His Birth certificate
  • My Birth certificate (Second Question Do I need to translate it? It's in spanish)

We need to pay the filling fees (Third Question  Do we pay it on the back and send the receipt? Or do we send a money order?) and after getting two copies of everything,  we mail all that to the Dallas PO box.

Forth Question What is an A number?

Following we should the 1st NOA and some months after the 2nd NOA. While we wait we need to start gathering the interview package documents.

Eventually our case is forwarded to the embassy processed and they will send a checklist to the fiancee.

Fifth Question More less what will we need?

I send back some forms, attend a medical exam and go to the appointment with the rest of the checklist, the copies from the petition forms and prove of our relationship.

The interview happens and I either get approved or not.

Sixth Question I'v been reading something about a D-156K form, a D-230 form amd a I-134 form, where do this one fit? Or do I don't have to fill em?

Now, did I miss anything?

I am SO sorry for the long post but we are just getting started and all this can be overwhelming and confusing. @_@

Thank you SO much in advance for your replies.

-Mari-  smile.png

Folllow the guide http://www.visajourn...content/k1guide. It will give you a detailed description of all the steps and everything that is required as well as what forms to send at what stage.

Also you havent mentioned anything about relationship evidence, pictures, emails, skype, call records, boarding passes from visits and so on and so forth. Something that is very important, don't just send in the forms.

K-1 Fiance(e) Visa Process & ProceduresFlight Attendant applying for K-1 status.

Hello Eau_xplain - I'm new here and was wondering if you can expand on this further or if there is somewhere else that you can point me to.

So is it possible for a flight crew on a C1D visa to enter the U.S. and get married here in the U.S.  After which they continue to go back to their country and work as a flight attendant while the U.S. Spouse files for a K3 or CR1/IR1 Visa?

Thanks so much for your help.

K-1 Fiance(e) Visa Process & ProceduresSOS pls

I just wish they will deny it and let the whole process work normally. My fiance did it for good!! sad.png but this thing will make things worst!! Thank u everyone!!!

Geia sou Laspoxaroumeni. Like so many others have said already, relax.. iremise!

The expidite request will most likely be denied. I am sure that when your fiancee filed it he had no medical documentation attached with it as proof let alone the fact that what you are experiencing, is all due to stress. Stress is not something that will get you an approved expidite request, if it did all of VJ would have filed for one, myself included!

Even with the expidite request in your file, when you get to the medical stage, you will only be a couple of months away from the end of this journey and im sure your stress levels will have gone down by then. Should the doctor bring it up, just explain to him that the immigration process caused you this stress.

Saying that your panic attacks and hair loss is a mental disorder, is like saying im anorexic cuz I dropped 20 pounds in a month and a half!

I get how bad things can be with your family.. my father announced he would disown me and kick me out when he found out I was in a long distance relationship with plans of getting married and moving there. Now, my mother is more in love with my husband than I am and my father thinks the world of him.

What you and I are doing is unheard of in Greece, and it can be extremely hard, and thats not including the whole immigration process.

If you ever need to just talk, and let off steam.. PM me.

I am not from DR but Greece. I had the medical 2 days ago and I was given the MMR vaccine. Doctor didn't even ask if I had it as a child, apperantly it doesn't make a difference if you had it or not.

They will still give it to you.

If the hospital will not give him the vaccine, then wait to receive it at the medical.

K-1 Fiance(e) Visa Process & Procedures221 (g) Refusal Letter

USMSBOW - Thank you for your reply.  I will answer your question with facts inwhich you are familiar with. To file I-129 (Petition for Alien Fiance(e) you must be a 1) U.S. Citizen 2) Intend to marry within 90 days and both free to marry 3) have met in person within 2 years before filing petition.

We have meet the requirements of the Department of Homeland Security.  I can't find any requirements or stipulation in the I-129F Form or any official website of how long a petioner is required to know their fiance(e) or how many days are required to be spent together before filing.  So is a month together appropriate?  2 months together appropriate?  1 week appropriate?  Subjective per consular officer discretion.

Not being a smart _ _ _.

I think the issue here isn't that you haven't met the requirements, you would not have reached the interview stage had you not. But meeting the requirements is not enough sometimes.

You mentioned early that you have been communicating since Nov 2013 and you filed the petition in Feb 2014. That might be part why they require more evidence, the time between meeting and filing is short.

The reason why people on here have been telling you to make another trip, or even be there to hand over the evidence together is the most evident way to prove a bonafide relationship.

It doesn't matter how long, it could be for 5 days, a week, however long you can manage. What matters is that you try to prove your commitment and that your relationship is real.

K-1 Fiance(e) Visa Process & ProceduresInterview scheduled - They don't accept I-864's only I-134! Freaking out...

That's because the I-864 isn't needed at the embassy for a K1 visa. You need to prepare and submit the I-134.

The I-864 is after your fiance's arrival in the US, after marriage when you file for to adjust status.

B & GFemaleGreece2014-08-29 09:20:00
K-1 Fiance(e) Visa Process & ProceduresYes, you can visit!

Entered the US today for the first time since we submitted our K1 (received NOA2 last week) ... It went like this:

Purpose of visit (me: February break vacation)
How long? (Me: a week).
Last time in US?  (Me: Christmas)
Who do you know there? (Me: Boyfriend lives there)
How did  meet? (Me: Online)
How long have you been together?  (Ummmm almost 3 years)
Sooooo when are you getting married?   (Here is where I kind of stumbled...  In my mind I'm like, does he know I have a pending k1?  Is this a trick question?  Gah what do I say??? Do I bring up the k1?!?!? Helpppoooo... my response ended up being "like uhh uhh um uh eventually?" LOL!  Which in retrospect made no sense).

Apparently my awkward "uh um uh eventually" was good enough, he kind of laughed to himself and stamped my passport, b2 that expires in 6 months.  Did not ask to see any of the paperwork (ties to CAnada) that I had brought.

Which made me wonder, can customs officers see pending visas?

I am not sure if they can or can't. This was my experience last time I entered the US which was on Jan 24 2014 on a VWP.

It was my second trip after we had filed our I-130 (still no NOA2!) First trip was in Sep 2013 for 3.5 weeks and second one in Jan 2014.

Purpose of your visit? Vacaion

How long are you staying? 12 days

And then the officer proceeded to read stuff on his screen for at least 5 mins! I don't know if he was looking at my past trips, (7 trips since Oct 2011) or if he could see that we filed for a CR1.

He made no comments, did not ask any more questions. Stamped my passport and I was allowed in.

One thing I found out when I filed last year with my wife's W7. I could not cash the refund check until she got here! My bank said since she wasn't on my account, she had to be present to sign the check, and they wouldn't add her to my accounts until she was here in the US.

So I had to keep my refund check in the safe for six months until Kathlene got her visa!

(Yes, I did try direct deposit and the bank's computer kicked it out for the same reasons)

Uy! Boy, I hadn't thought about this. Thanks for the heads-up. So the names on the account have to line up with the names on the refund check. Still, it's worth it.

Does this mean that the work permit people will not be worked on for a little while, and Vermont can at last start working on the I-130's properly ?????

.... just pondering eb0dfafc.gif

Sarah, USCIS stopped accepting new H1B and closed. Now they have to enter into their computers and do the lottery for 65,000 people, then issue the receipt notices. Then only those donkeys will be free to process I-130s. blush.gif

Why do they bring new workers if there is a recession in the U.S ??? Totally un-justifiable !

This is GREAT!! I was on the USAJOBS.GOV website, and just for grins, I looked under USCIS. Turns out they are looking for a DIRECTOR! So, USCIS is without an Director, and VSC is without a Director. Any wonder why they are going backwards? Anybody want to apply for the job? Come on!!! Do it!! Ha ha ha!!!

I never thought the day would arrive that I would say that the IRS appears to be the very model of administrative efficiency and transparency. Can you imagine if the USCIS was in charge of collecting taxes?? They'd still be collecting from the 1970s.
