Hi Divya,

We do not have to pay any fees if all have been paid earlier. We only need to pay Rs387 VFS courier fees. ALso, my attorney told me that, all the original docs will be returned to us at the consulate on the interview date. For submmiting the docs at VFS, Copies should do if you have them, else you can always show them the letter from NVC which confirms all the docs received by them and if they have asked for some specific docs to be carried , you can take only that.

I have a few questions and would appreciate any clarification in that regard.
1. The petitioner pays the visa fee of $404 at NVC, isn't it?
2. The beneficiary only needs to pay Rs 384 or something similar at VFS?
3. Since all the original documents will be sent to NVC, does the beneficiary submit copies of those documents at VFS? If not, how?
4. The DS-230 I and II are to be sent back to the petitioner for submission at NVC, isn't it?

After going through that link provided above, I'm a bit confused about these things. In quite a few places, it has been mentioned that after the biometrics, the beneficiary is to pay the visa fee at the consulate. If so, what is the fee amount we're talking about? I'm totally confused here, as there seems to be conflicting information.

OP, there are no "quick fixes" here. And if you ask me, no evidence is enough evidence. And the evidence can be accumulated only over a period of time. Don't look at how soon you can go about collecting evidence. When you have a bonafide relationship, you'll automatically have enough evidence with you to convince a consular officer.

my another question is if she come to india and we get married here in court ? than how long she need to stay with me ?

is she can file for a cr1 visa for me after she go back to usa ?? which one is fastest way ?


Getting a CR1 approval would again depend on you being able to prove a bonafide relationship.

Not TSC. They don't handle the I-130s. It'll either be CSC or VSC. If your case number starts with WAC, it's the CSC, and if it starts with EAC, it'll be VSC.

Hello all.

I will be submitting Skype call logs to USCIS and I have downloaded a file that extracts the logs. The problem is that because my computer had crashed recently, the file that had the information about all the calls got erased and, as result, I can't generate the call logs on my computer. Now my husband can generate all the logs but unfortunately his logs have my name on it rather than his (I am the petitioner). Do you think submitting those logs will be OK? After all, we are trying to prove an ongoing relationship.

Something similar happened to me too. I think it's perfectly okay, so long as you have the logs as proof.

It is more than likely a false RFE, but just in case, I'd suggest you call up NVC and confirm.

Greetings all!,

I've been reading over some of the topics here and the WIKIs and guides, and I've gotten a little confused. My wife also is lost and I am posting here hopefully so you all can give your advice.

My wife is a Japanese national. We have been married less than a year. I am in the states, she is in Japan. I have filed an I-130 and received a I-797c, and I-797 notice of action and approval of said I-130. I'm in the military (how I met my wife). I have a few questions, maybe you guys could answer.

1. Is the IR-1 visa the proverbial "green card" that my wife keeps talking about? Is that the visa I should be perusing?

Since you've been married less than a year, the visa type will be CR-1. At her port of entry, your wife will get a two-year temporary green card stamped.

2. Can I fill out an I-864EZ vice an I-864?

I'm not qualified to answer this bit.

3. My wife is pregnant and will have our child in about 2 months, will the baby be able to accompany her when she finally gets her visa?

Yes. If you look at travel.state.gov, this is what they say. The birth of a child abroad to U.S. citizen parent(s) should be reported as soon as possible so that a Consular Report of Birth Abroad can be issued as an official record of the child’s claim to U.S. citizenship. Report the birth of your child abroad at the nearest U.S. embassy or consulate.

Actually the baby is my biggest concern as of course I would like to see my child ASAP. We are aware of all the paperwork we need to file for the baby's birth abroad and hopefully we can get it all done, but if the VISA comes before that time will she be able to bring the baby with her to the states? Thanks in advance for any advice you can give me.

Hello everyone! I have read this forum for the past few days and have learned a lot. I still have not started the process for my husband but we will in the next few months. . So I am the USC. I am also a citizen of Croatia(was born here) and we live together in Croatia for 5 years already..married last year and have 1 child. Now we want to move to the USA. I have a lot of questions but I'll start with my first. Do we have to be separated throughtout the process? I wanted to go to the US in a few months with my child and then my husband to come soon. I do not know if this is possible.. I see that it is very unlikely that he can come on a tourist vist if they see that he is in the process of getting a green card? we are just worried about the separation especially because of our baby. If anyone has had a similar situation please any advice would be appreciated. Thank you!


You do not necessarily have to be separated throughout the process. First of all, find out if Croatia has DCF (direct consular filing). If yes, then go ahead and file there. if not, send your petition to the Chicago lockbox with your Croatian address, and perhaps that would gain you an expedite. And like the person above mentioned, you'd eventually have to prove domicile in the US.

I am gathering all documents required to respond to the USCIS for the RFE I got last month.

My fiends and relatives signed an affidavit stating their knowlege of our relationship and our wedding before and post-marital.

Do I have to send the original notarized affidavits or copies? If I have to send the originals, does the US consulate accept copy of the affidavits during visa interview?

I translated all my wife's documents into English, do I have to send the original translations or just copies?


You send only copies of documents to USCIS. Originals are sent only to the NVC. And yes, you will have to send the copies as well as translations.

As far as I know, G-325 is to be filled by the USC and G-325A by the foreign citizen spouse. Correct me if I'm wrong.

So my husband has a lot of miles with American Airlines, which he is going to convert into a ticket for me to fly from India. I'll be flying Etihad from India to Abu Dhabi and then to Toronto. From Toronto, it's an AA flight. My question is if I would be required to have a transit visa for Toronto. I have been trying to get this information, but no one has been able to help. I am in the middle of filing I-130 to get my wife from India. She does not have any last name (family name) on her passport. She only has a first name. Is that going to be an issue? Do I just leave the field of Last name as blank on the form?

Since you're just getting started, why don't you ask your wife to renew her passport in her married name? You can still send across a copy of your wife's old passport along with the I-130 application, but when time comes to submit copies to VFS, you can submit copies of the new passport. That's what I did. All you've gotta do is submit a copy of the marriage certificate when she re-applies for a change in name.

My wife's interview is this coming May 4, 2012. I received an email from NVC a month ago indicating her interview date and the documents that we provided. It stated there that "Any original documents that were requested by the NVC but were not submitted to the
NVC must be brought to the visa interview".

I called the NVC number to get verification if additional documents (original, copy) should be provided during the interview. The representative told me all the necessary docs, including the original, have been received by its office and there's no need for my wife to bring additional original docs or docs I sent to NVC.

I was just browsing the forums here and it seems that many of you guys stated that original copies should be brought to the interview. I am kind of confused right now and one week is too little of a time to get all the paperwork done and send those to her (especially the police clearance, which took her forever to receive).

Please help....

You probably read wrong. The original documents are returned back to you at the interview.

Why don't you look at getting married via the Hindu Marriage Act? You don't necessarily have to go to that particular temple/priest that you were mentioning earlier. You can go to any temple that would allow you to get married and sign their register. That's what we did. We went to a temple which is an hour and half away from my city, got married there, signed their register, and later proceeded to the subregistrar's office to register our marriage. We did print a coupla cards for future evidence purposes too. We got the certificate in hand in a week's time. If you still don't wanna go that route, then you can just do the civil wedding, but I'd say you get that NOC even if the registrar is saying you don't need it at the moment. You never know when these people could change their mind. Just go to the consulate in Delhi and get the NOC as required. If you can fix up an appointment even before you head out to India, it'll make it all the more easier for you.

I need your expert help with my visa questions. been reading the forum for a few days but still really confused.


I keep going back and forth between the two visa options: K1 and CR1/IR1.
I am a US citizen and she is in India.the priest told our families that religious wedding can be done in november and if we go that route and then file papers,it may take two years from now till she comes here and this is killing us both.

Why would it take two years for her to get there? My husband filed my CR1 in August, and today I'm waiting for an interview date. We're at 7 months since the day we applied.

i am trying to find if there is a faster way of getting her to usa or if you can provide any other suggestions.



here are some questions that i need help with.

K1:
Can we get married(religious hindu wedding) at any point with this visa?
There are some people I personally know of who've done it, but I wouldn't advise it. For she becomes your wife from that moment, and if either of you slip up at the interview, you're doomed. Moreover, if you get married and still go for a K1, it's visa fraud.
her family was told that after we get the visa, we can do the religious wedding ceremony before she comes to USA. is this true? is there such an option?
If we get married either before or after she gets a K1, what will happen to the K1 application, does it gets converted to CR1 saving us time or does the process starts all over again?
If you get married, K1 doesn't switch to CR1. You'll just have to start the process all over again.



CR1/IR1:
Can i go over for a week and we do a court marriage in india and file for CR1 based on that?
That's totally up to you.

i cant find any info on court marriage in india, from all the info her family gathered, there is no such thing as a court marriage and only a registration of marriage after the religious wedding ceremony.
will doing a court marriage now, and then a religious marriage in november work out well with the whole process? i don't want our case to be denied because of this.

There are two routes you could take. If you're both Hindus, you can get married via the Hindu marriage act, which would be a religious ceremony followed by getting it registered with the registrar of marriages.

If either one of you is not a Hindu, then you get married via the Special Marriage Act. For this, you, the USC, will have to come to India and first approach the consulate for a No Objection Certificate. Once you've obtained the NOC, both of you'll need to approach the Registrar of Marriages and apply. Mind you, there's a waiting period of 30 days if you take this route. At the end of 30 days, you can get your marriage registered. Bear in mind that the USC will have to be physically present both at the time of applying as well as at the time of registering.


which visa has a better option of getting approved or in other words, which one is more risky of the two visas?

I would any day vouch for a CR1 as opposed to a K1. If you're going thru the New Delhi consulate, you have more than a fair chance of getting denied a K1 visa petition.

In either case, you'll need extensive evidence as proof of a bonafide relationship. This could include, chats/emails/phone logs, money transfers, joint property, joint bank a/c, getting her added on to your health insurance, pictures of wedding (if you choose CR1), pictures of engagement (if you choose K1), pictures with family, pics of holidays taken together, affidavit of relationship from family members.

For a K1, you should have visited her within the past two years at the time of filing the petition. I'd suggest you read extensively on both the visa types before you make up your mind. It's a long and stressful journey, but well worth it!

I had applied for i-130 for my wife and it got approved more than a month back. Now when I called NVC they told me that they have received my petition and created a case number. But I have not received the fee bill for AOS or 3032 form. Can I just email them the 3032 with the case number or should I call them up to ask for the fee bill.. how does the process work.

I have prepared all AOS and DS-230 ready to submit once they start asking for it. I am just wondering what is electronic processing means. Do i have to go for DS260 or DS230. i am confused. please help


India does not fall in the EP category, so it's the DS-230 for you. Now that you've received a case number, do go ahead and email your DS-3032 immediately. You will receive an acceptance email in about two weeks.

For filing I-130, I found that there is some conflicting information between VJ and USCIS. Please look at both links below:

Couple of examples:
1) on VJ they are asking us to provide the beneficiary's birth certificate or all pages of her passport, whereas no documents related to beneficiary are being asked to submit according to the instructions on how to fill out I-130 by USCIS.

I'd say, do send in a photocopy of the beneficiary's BC as well as a photocopy of the biographic page of the beneficiary's passport along with the I-130 application and G-325A forms.


2) On VJ they are asking us to provide certified copy of marriage certificate whereas on USCIS they are just asking for a copy of marriage certificate (no certification necessary is what I am reading here)

You do not need to send a certified copy along with your I-130. All you need to do is send in a photocopy, but if it isn't in English, then you need to send in the photocopy of the cert as well as a certified translated version.

Please help resolve this ambiguity!!

The DS-3032 acceptance mail takes anywhere b/w 10 to 14 days, so don't worry. Once you receive the acceptance mail, your IV bill will be generated. And honestly, don't bother with a hard copy via snail mail. The e-mail works just fine.

I would like to know if I can ask my wife to mail me form DS-230 and DS-3032 signed like NOW? I just got NOA1 with a 4/5/2012 date. Or do this forms have an expiration date and its to early to start collecting that from my wife?. I know for DS-3032 I can send the email, but just in case.


Don't do it just yet. When you hit around five months from your NOA1 date, I'd say you should ask your wife to start getting all her documents ready for the NVC stage. As for the DS-230, she can send it to you once you get your NOA2, along with the rest of the documents.

Thanks for that info! I hope it shouldn't be a huge deal. I was thinking that he might also be able to get titers done as he might have immunity or have been vaccinated to a few of those illnesses on the list. I would just hate for him to find out at the medical exam that he has to get vaccines done then, and THEN wait other 3 months or so for the follow-up dose before he can travel to the US. If there are going to be delays in visa processing or interview approval based on vaccines, I would think that many of us would like to know this well in advance when there is time to deal with the situation.


FYI, if indeed he needs certain vaccines, he's just gotta get the first dose and is free to travel. The followup shots can be taken in the US. I can give you more info on this once I'm done with my medicals the coming Wednesday.

Hi my fellow vjers i have just received the news that my case is closed at the nvc stage and now i have to get ready for interview and i would like for you guys to help me with that, what are easy ways in getting everything in order from the folder down to the ways to dress all your advice will be of much help to me so i would like to say thank you in advance..


Although I'm not sure how it works in your country, I think there are a few basic things to keep in mind at the time of the interview.
1. Do not be nervous.
2. Remain calm and collected.
3. Always answer to the point.
4. Do not volunteer any information.
5. Dress comfortably and smartly.
6. If you do not understand a question, make it a point to ask the consular officer to repeat it.
7. Be prepared with all sorts of evidentiary proof, right from logs of emails/calls/chats, pictures, money transfers, to everything. No evidence is too much evidence as far as this process is concerned.
8. Speak out with clarity. Do not mumble/stutter/stammer, as these are signs of low confidence/lack of confidence.
9. Be pleasant and have a smile on your face when the consular officer greets you.
I think this should be good enough. You'll do just fine. You could also go to your country's/consulate's review page and check the various questions people have been asked in there. That helped me a great deal, and I'm sure it would help you too. Good luck!

It takes about two weeks to receive the ds3032 or choice of agent acceptance mail. Now that you have your case number, check the website on a daily basis to see if your aos bill has been invoiced. If it has, then pay up and confirm payment before you mail out the aos package.

Yes, send the DS-3032 as soon as you receive the case number and IIN from NVC. You'll get a notification immediately, but it'll take up to two weeks for them to send you an acceptance email. The NVC will send you the DS-3032 form too, but you don't really have to bother with that. Just go ahead, use the template, and email it.

Yes send the form from the beneficiaries email address. The beneficiary must sign this form. Send it when you get your case number. :thumbs:

Hey guys,
I have just received my US visa.

I have booked my flight to US.
Flying from: India to London (British Airway) to Dallas Texas (American Airline) and then to final Destination city in US (American Airline) .

My q's:

1) Would i face any issues? since i'm stopping in London? connecting flight 2 hrs wait time
2) What paper works do i need besides my Immigration papers to US?

IR-1 / CR-1 Spouse Visa Process & ProceduresDamaged "Do Not Open" envelope

My envelope arrived today and it has 2 tears in 2 places due to rough handling in transit. The tears are about 1 inch each, as in the picture.

I am tempted to write to the Embassy to request a re-seal.....

The rest of the envelope is fine.

Is this an issue - should I be worried?

I'd write back to them. You never know if it could be an issue. Might as well be on the safer side. There will be a cut on one of the corners though, which you don't have to worry about.

Are we turning in any 'Originals' during the NVC stage? I know we have to turn in the original police certificate. What about Beneficiary's Birth Certificate? I was planning to turn in a certified copy.
