Packet 3 Form update from September 1st 2013 - DS-260:

Applicants returning their DS forms after September 1st should now complete and return the DS-260, rather than the DS-230 and DS-2001.  

 

It's unclear what those who have already complete their DS forms (Packet 3 return) but are interviewing after September 1st should do.  Probably wise to complete a DS-260 as well as the forms already mailed.  Read follow up comment: http://www.visajourn...uide/?p=6480459

 

Hey Lost at sea. Can you clarify...? I am confused if I am to complete the DS-230? On my checklist from the Embassy for everything I need to bring to the visa interview it states to complete the DS-260 Electronic Application . Nowhere on the form states to complete a DS-230?  

 

Also, am I right in thinking that after the Medical, we will be contacted for our interview date? We have a medical date for Dec 9. I wasn't sure if we were to call and make the visa interview appointment or not?

Can you also call the DOS to enquire about a case number? Most people are receiving their case number a few days to 2 weeks from their approval date in London but we have been waiting 5 weeks for our case number!

My DH had his medical on the 9th Dec and we completed the Submission of The Notification of Applicant Readiness online. Do we just sit back now and wait for a letter via mail to tell us when the interview in London is? 

 

Can anyone advice the 'about' time it is taking from the day London Embassy are getting the medical until the interview is?

I mailed the petition for my British husband I-130 on 22nd Oct. The fee has come off my credit card but I still haven't received an email confirmation? Am I being impatient? I thought this NOA1 only took about 1-2 weeks?

I feel awful for complaining about my wait time when so many of you have been waiting for what seems like forever. :(   Just waiting for our last hurdle - the interview now. Completed Submission of the notification of applicant readiness form on 13 Dec. Still no interview date set (DCF - London)  Anyone else filing through London?  Curious as to what the average wait time is to get an interview date...

Can anyone advise if it is ok if I (and our children who have American passports)moved back to the states earlier (ie., got a job offer) and my Brit husband who I have petitioned the I-130 stay here in London until his visa process is complete - would that be ok in terms of our application?

You might want to hold off on the police cert, .

 

Edit: Sorry, it totally slipped my eyesight that you're filing through DCF. Ignore me biggrin.png but others who are doing it from abroad should wait until the NOA2.

Yes, we filed DCF in London since we are living here. So, waiting times are different. :)

Hi October filers. :) Anyone else find this process completely consumes their mind!? All I can thing about is this Visa Process! 

 

We got our NOA1 on the 25th. :) (The email had been sent to my junk mail). I am now preparing my next form I-864 along with DH's joint sponsor (that was a bit stressful finding someone!), filing my back-taxes, ordering police cert, and getting DH's vaccination records to get ready to send to the London Embassy once we receive our NOA2.

 

Also, sending off forms and fees to our solicitor and agent to put the house on the market here in the UK.

I just filed an I-130 at the London Embassy, it arrived yesterday now just waiting on my NOA1. From seeing other people's experiences, especially on the Britishexpats.com forum (http://britishexpats...isplay.php?f=35) it appears people are getting through the entire process from 3 to 4 monhts.

 

While you're waiting for your NOA2 your partner can obtain their criminal background check at http://www.acro.police.uk/ for the UK and you will also need one from any other country your spouse lived in for more than 12 months I believe.

 

You should also start preparing your I-864 (http://london.usembassy.gov/i864.html) you will probably need someone in the US to sponsor your spouse because you've been in the UK so long. However, you will also need to fill out an I-864 so make sure that you're up to date with your US tax returns even if you haven't earned any income there in a few years.

 

Hopefully I've explained this correctly but definitely check out British Expats forum or the DCF board on here.

The 1-864 - If I need to do my taxes for the last 4-5 years do I do that before I fill in this form? Obviously, I haven't been earning in the US while in the UK. I filed the first 5 years I lived in the UK but, then I stopped as it seemed a bit pointless.. hmm...

Dear MLD,

 

This problem probably applies to you, because your wait may be extended for the same reasons.  However, you are currently together with your family, which is great.  Hopefully, you can remain together there, until the green card for your husband and children comes through - but don't expect an immediate turnaround.  If my memory is correct, your I-130 will be routed to the Chicago Lockbox, then probably to NBC.  Look at your I-797, and it will say whether it's at the NBC at Overland Park, Kansas.

Sorry for my ignorance. What is NBC?  I just assumed that it would all be sorted here in London. I had no idea it would be routed to America.  hmmpf.  ALso, what is an I-797? Again, apologies for my ignorance as I just started researching yesterday!

I did read on another site that filing the I130 in foreign country if you are a US citizen speeds up the process... Wish someone that lives in the UK that has petitioned their spouse to move to the USA could confirm this.. 

 

It states :

Residency Requirements

Filing the I-130 abroad may shorten the total immigration timeline. However, this option is only available to US citizens living abroad. The DHS office on London has set the requirement at six months minimum residence in the UK -- both legal leave to remain permanently and actual residence.

After they email, then you should also receive a hard copy and notice that they have cashed in your check. Then the waiting game begins.We have a long wait ahead of us. (possibly 11 months)

 

Thanks for your response lovex3!  11 months. ugh. That is a long wait. How soon after the application has been received are the interviews usually booked? 

 

Is there anything ie., paperwork or docs that I can be collecting in the meantime?

Does this apply to everyone that is doing the I130? And, what about those that do not live in the USA currently? I petitioned my husband to move to the US and we both live in the UK so obviously the application was send to the Embassy in London.

Hi new here and trying to get some info on the process of the I 130. Filed this for my husband and was mailed off today (22 OCT) to the Embassy here in London, England where we currently live. 

 

Am I right in thinking firstly I will get an email stating they have received the application. What happens after that?

Someone correct me if I'm wrong, but in the spaces where you write your income for the past three years, write something in there like "did not file". This is because it is asking you to enter an amount as it appears on your tax returns (which you didn't file). My husband will be doing this for the year 2011 because he was unemployed at that time.

so he is still including the tax form for the year that he didn't file due to unemployment?   I had not planned to add any of my last 3 tax return forms and just do the affidavit explaining that I was not employed.

I need to send an affidavit letter in lieu of my last three tax year returns  as I have not been working and did no file. Can someone tell me what I should include in the letter/explanation? Has anyone done this? (I was told this by an immigration lawyer/friend)
