Cino: you are right that the USCIS site doesn't give "detailed-details" about the RFE. However, from personal experience, the USCIS site did forewarn us that we'd be getting the RFE notice in the mail. No "detailed-details" given on the USCIS site, but a 'heads-up' that an 'old-fashioned' letter was on its way from the USCIS regarding RFE.

In our case, the site was very helpful. Just like the OP, Scott s, my fiance (USC) was away from home for awhile (but for work). He had family collect his mail, and we forewarned them (thanks to the USCIS site) that an important letter was on route from the USCIS. Within a few days, the letter was received, and scanned to myself & my fiance (USC). I was able to get ahead start on what the RFE requested, on behave of my fiance (USC). THE END.


HOPEfully, you won't get an RFE. If you do, you'll have time to deal with it, just like the others have stated.

It's hard to imagine asking someone to open every piece of mail received at our apartment for a month, just to see if we received an RFE!


Your joking right? Just ask them to pick up your mail. They would only open the ONE LETTER that's from the USCIS .


Are you tracking your case status on the USCIS site? If you are, then you'll know ahead of time if that RFE is coming, or not.

I'm on the August, 2011 application list, but haven't yet received a response.
Judging by the associated thread, it should be happening any day.


I'll be leaving the country for a month in two days, and away for about a month.
Obviously, if I'm approved, everything is great. What would happen, though, if I instead got a Request for Evidence (RFE) in the mail while I was away?
I might not see it for a month after its arrival. How much time are you given to return it?

It's not a huge deal. Ours was for lack of evidence. Once we sent everything off, our 1-129F was approved within 6 days.
Notification of RFE was from the USCIS site, April 11th. Physical notice received by USC April 22nd.
You're given a timeline of 3 months to reply to the RFE.

Just wait and see what the notice/letter is asking for, and send them what they want.

I downloaded 'packet 3' ( which is a 2 page 'checklist' ) months ago.
When you see the 'checklist' for 'packet 3' (VANCOUVER consulate) it'll make more sense.

From that 'packet/checklist', I completed form DS-230 Part I, Biographic data. My fiance did the I-134, Affidavit of Support .

I'm SO glad I downloaded it ahead of time, while waiting all these months. It gave me time to review my passport, send away for a LONG Birth Certificate, get more photos for Medical, etc... in the long run it will save you some time.

Currently I'm waiting for the 'Letter with Case #, (this week ... fingers crossed) I'll complete the remainder of 'packet 3'/checklist. Forms DS-156 & DS-156K , Police check & Medical.

Received email notice today!
I-129F approved! Posted Image It took 6 days for the decision from USCIS-CSC, after receiving our 1 1/2 lbs RFE documents.



*Waiting for notice to arrive at USC residence, via 'snail-mail'.
*Package 3 prepared, ready to launch into that! Did whatever I could without having the NOA2*


My fiance was just here, so he gave me whatever I may need for interview time. Posted Image
He's in Louisiana, working on a ship out in the Gulf of Mexico.
Next time we see each other will be June. A few weeks apart is nothing.
Our longest time apart was 6 months. Thank goodness for cell & emails! (no skype or mail)

We filled on September 12th and was told last week we had at least another 56 days to wait ! we thought we,d timed it right to get married on August 25th which is our anniversary ...will be lucky if i get there for Christmas ! ! ! ! This process is so depressing :crying:

I too was hoping to get married on our 'anniversary'.
Didn't happen. You'll LOVE whatever date you end up with & it will be special.

You can plan only so many things ahead of time. Just concentrate on the paperwork, and be ready for what's next.

Lots of people have 2 weddings. The official/legal one in the US, then a BIG family & friends ceremony. (or vice-versa)
Claire & Joe, REMEMBER it's about you two, and what works best for you guys.
I know people that have had the BIG ceremony first, then went to a court house to make it legal.

The wedding can happen whenever. Making it 'LEGAL' depends on your VISA.

I currently am a Green Card holder & will share with you my experience, in the state of HAWAII.

 

*Lucky for you that you are on Oahu, as mostly all things government related are done through the Honolulu office*.
 

 

#1: Applied for SSN two weeks after arriving into USA. 

 

#2A: Marraige licence; needed to get married. (ASK how you get a copy of the CERTIFICATE [different from licence]).

#2B: Married . (ASK about getting a copy of your married certificate. Sometimes you can print a varified copy right off the internet).

 

#3: Recieved married certificate = Changed name on SS card.

#4: State ID: as stated above, see State link for details. You'll need your married certificate & SS card for that. DON'T forget anything! & go early or wait all day.

#5: Drivers Licence:  Multiple choice 30 questions. I read over the hand book, but this website was AWESOME & had all the questions & correct answers http://www.pixi.com/...me.htm#Overview   *You're allowed 6 wrong. I got 1 wrong*.



 

 

DO apply for your SSn, before you get married.  A name change is easy once you get your married certificate. 

The important thing is to get the process started. 

 

*When you apply, they may tell you to wait until after married; don't listen.  You understand that you have to go back there for a name change; no big deal.  And you have a long wait before you get your EAD/AP.  And by the time that comes, your Green Card will hopefully come soon after.  I didn't even use my EAD/AP card.


Okay, good luck to you!  *PS- Believe it or not, cell phones were okay @ the USCIS in Honolulu!  Your just not suppose to talk on them, but you can have them. People where actually texting & taking pictures! *

Readers here are cautioned that the answer of "not necessary" applies to Canada. In some other countries, failure of the petitioner to be present can result in a 221g or outright refusal of the visa.

Calm down, breathe deep.

Its ok.

Alot of people get RFE, could be missing or incomplete form. Could be you used blue ink instead of black. Maybe you didnt sign and date something.

In about a week you will your RFE, look it over, correct it, and send the information they are looking for along with a photo copy of the RFE. They usualy give you 30 days to respond, but the nice thing, is that they will tell you that in 60 days they will have made their decision.

Hey everyone, thanks for taking the time to read my question. I was wondering when my fiance and I submit our petition forms for the K1 visa, do all the forms have to be the originals? In other words for my part of the package filling out the biographic information, providing the passport type photo etc. do I have to send my fiance the originals or can I just scan them? I keep finding answers that said yes you could scan them and then some people would said no they had to be originals. If someone could give me a definite answer on this that would be great!




Passport photos should be original. Fiance should submit originals. (Whatever is mailed out, make & keep copies for yourselves).

Hello,

We are pretty well done our package except our addresses. I (beneficiary) would like to use a postal box as my address as would my Fiance the petitioner.
As we are both going to be moving during the K-1 Process and feel it would be safer to use a po.box. UCSIS said they CANNOT update the beneficiary's address so it needs to be somewhere I can get my mail.

1. On the 129F should for the petitioner, should we put the p.o box for question #2?

2. For question #14 should we put his actual apartment and have him call ucsis for that? or should it be the postal box as well??

3. For the beneficiary #2 and 15. Can those both be my postal box in Canada? These addresses will differ from our G 325A form.

4. Is question 2 asking for the MAILING address or Permanent residence?

Sorry for so many questions. Our moving is tricky and we aren't sure what to do. Any help would be greatly appreciated.

I haven't gone through this personally, but I'll do my best.

So you haven't mailed anything out yet, is that right?

**If you haven't already, call and ask the UCSIS if you can use a PO box.
If you can GREAT for you. If you can't, perhaps a friend or family members address can be used?

*If you have changed your address, you must inform USCIS of your new address. For information on filing a change of address go to the USCIS Website/ or contact the USCIS National Customer Service Center at 1--800-375-5283. NOTE: Do not submit a change of address request to the USCIS Lockbox.


I would use current addresses. Perhaps attach a 'continuation sheet', explaining you'll be using a PO box? People move, they can't hold that against you. You're providing them with honest answers to their questions.

My fiancee (the american in this case) and I are about to start the immigration process in June or July and I just have a few basic questions.

1.) My main question is based around our age difference I am 23 and he is 34 will this make it harder to be approved or prove that we have a legitimate relationship?

2.) I have been on 5 trips to see him in the last two years with all of the trips lasting over a month. I only have the travel documents from my first and last trip. Will this be enough? Should I get written statements from his family that I was there for Christmas or other visits?

3.) If I do get approved and move on to the interview stage what sort of questions should I be prepared to answer?

4.) He has a daughter that he doesn't see. He doesn't like to talk about it so I don't even know her name. Do I need to start prying this information out of him?

At the moment this whole process is very overwhelming for me and I just want to get it right so thank you in advance for your help.





I agree with INKY.
Even though I haven't had my interview yet... age difference should never be an issue. When it comes to the interview, just be honest General questions, from what I've read on this site.

When you submit your I-129F forms, include a 'letter of intent', which could detail how you met, the visits you've had etc, etc. Both of you submit a letter. (Letter of intent... what your intentions are, which are to marry when approved). You can always get this letter notarized, that way it's all legal. There are example letters on this forum.

Oh.. regarding his offspring, If I was in your shoes, I'd want to know more info. I mean, you're going to marry this person. But that's just my opinion.

You'll do fine. Lots of helpful people here.

New to this forum... figured I'd get some support from people who are going through the same as me. Mailed all our documents for a K-1 visa on April 19 2012....they were received on April 20th 2012(according to fedex tracking). So my question is...what's next?

Lots of waiting... and soon you'll get your 'Notice of Action' (NOA 1...aka I-797c) with a case number on it.
Then you can track your case on the USCIS website. Link-------->USCIS



Then more waiting. Months! I did a lot of research on 'what to do next 'while I've been waiting. Looks like you are a Montreal person. Best to follow the advice of the Canadians from Montreal. After all, that's your situation. I'm in Vancouver, so I tend to follow the advice from Vancouver people as it differs just a little from the Montreal experience. You can follow Canadians under the 'Forums' category, and also under the 'Portals' category.

Everyone from all walks of life are helpful of course. Less confusion when you follow your own K-1/Canadian/Montreal peeps.

This forum is a huge help! Thanks so much to all you contributors. My fiance and I thought we heard I (the beneficiary) would need a criminal record check but I haven't come across this in the checklist... can someone tell us did we make this up or does this need to happen?

Yes the beneficiary will need to have a 'Police/Criminal Record Check'. BUT you're not to do it until you have your 2nd NOA
(2nd Notice of Action) This means your petition has been approved.

I'm not sure where your from, but try to get in touch with people in your area that are filing the same thing as you. They will give you better instruction as to where to go and cost. You can research what you'll need to do when the time comes, and 'getter done'.
