K-3 Spouse Visa Process & ProceduresK3 Noa2 for April Filers
Hello all,

I filed my I-130 in April to the CSC for my pookie and to this date have not received anything. But I did get my case number confirmed that was on the back of my check. It does get numb hoping to see something everyday. Anything. But I wanted to include myself in this thread. I am just in the same boat as all of you

13 April 07 - Mailed I-130 to CSC
16 April 07 - Filed in CSC
24 April 07 - Date on online as received
27 April 07 - Check Cashed
 Waiting for some action

29 May 07 - Mailed I-129F (K 3 Visa) to Shy Town

Hopefully soon, we all hear something. Did ya'll know that the California Center is backed up but should be compliant by June 15th? They will hear from me if I dont see anything from them in the mail. Why is it that when people send the I-129F to Chicago, it is transferred to another Service Center? Is it cause they file it in their system and then it gets verified in the center closest to home?

K-3 Spouse Visa Process & ProceduresUSCIS doesn't list I129 or I130 for spouse in its timeline.
Hello,

Im waiting  for my NOA2 also for my I-129F I filed for my husband. It is frustrating, but when I received my letter from Chicago, it said it can take 2 to 6 months to process. So Im expecting to see something by November. Other wise, I will raise hell in California Service Center and the Customer Service Line  Im planning on seeing my husband before then. Chicago sent me a message last week that they transfered my I-129F to California. Does anyone here know the process and why they did that? Thank you.

K-3 Spouse Visa Process & ProceduresCan my I-13o or I-129 be denied cuz of my overstayed?

Hiii ...I know sounds crazy but I can stop thinking...
I know probably I have to file for a waiver I-601 after I got my I-129 or I-130 approval after a interview...
But the question is , could this be a problem for me???
Can they denied my I-130 or I-129 before interview because of this???
Have anybody been thru this? Please share with me !!!

I'm preparing already my waiver, it's crazy, lots of pressure, lots of headaches..
But now after I got my head off the I-129 (finally I got the NOA1) I've start to work on my waiver again...and this think can get of my mind...If anybody can help me with some info..I really appreciate!
Thanks .... :help:

Ps.I'm also add this topic on the Waiver tread

Hey,

Dont stress over it. I think you should call and speak to an immigration officer through the customer service line. My husband was denied entry because he was on the Visa Waiver Program. He intended to go back to Germany but the immigration officers in Dallas said that he looke like he was intending to stay cause he was bringing his cats and alot of his things. He had his round trip ticket in hand but they did not want to hear it. This was in December when he was coming to visit me but couldnt. Then we got married in March. Any how, I spoke to an immigration officer back in May about it cause I wanted to know if it will affect him getting his green card. The immigration officer told me that in the interview is when they will ask him about that. CSC has nothing to do with that. He said that there was nothing to worry about. I am not sure about a waiver, but I know when I spoke to a lawyer I think she mentioned to write a pardon letter. But we are married now so I dont feel he should have to. When my husband was denied entry, the immigration office told me the only way I can get him in the US is through the K-3. But at the time he was my fiancee. Your best bet is to speak to an immigration officer. Everyone's situation is different. ;)

Im a military member too, but I cant think of anything else I can do other than wait or volunteer to deploy. But if you find anything that can speed this stupid process let me know or even if you find out what the hold up is, that would be enough for me to know that they dont have my case sitting in the cracks. I have not received a touch since 29 May 07 and I dont know if that is a good thing or a bad one. I mailed my I-130 on 13 April and still have not received a NOA 1 for my case from CSC. Im seeing Mental Health since this is really frustrating and all the stupid bull ####### I have to deal with at work does not help. It sucks when you dont have anyone to come home to. I have gotten the run around through customer service and the immigration officers. Hopefully CSC pulls their head out their @$$es and get some work done.

ahhhhhhh. today I talked to the "immigration specialist" at the congressman's office and he totally ruined my day. He said the earliest my husband is likely to enter United States is Feb 2008. :crying: :crying: :crying: :crying:

I am not sure how correct he is......but even the thought that it might take so long hurts.

Its 6 months. I would love to be in your boat. The quicker the better. I filed late April. You can make it. Just think all the years to come you will have with your significant other. If only you can wait 6 months

Hey SumonLopa,

Are you a legal resident or a US citizen? I am just curious to see if it matters wether a member is a legal resident or a US citizen for the time processing for a relative. Thank you. Im getting frustrated with the California Service Center in the way they are handling business. They are not customer oriented at all. I wish I knew the head honcho of this program so I can complain about the service and the run around I have received from their customer service line. Its always the same excuse. I would at least appreciate an honest answer. Any how, congratulations. I could not imagine the long wait you had to go through with your family. I wish yall luck

K-3 Spouse Visa Process & ProceduresWhat is the worst they have done ?
I met my husband in person for like 4 months and since then, talked over the phone, skyped and yahoo messengered each other for over 2 and a half years. Yeah it might be beneficial to meet some one in person since people tend to hide their physical flaws through out the internet but I think that people that have grown to each other by communicating in the internet know what love is and means. Some people can not see themselves doing long distance relationships for a bit because they feel that they need to have sex then and there to be in a relationship. And yeah they have the right to be jeaolous, but I really think that they admire couples that have the patience and are committed because that is something that they are not willing to do. Its all about sex. In my opinion some people are blind and that is why they are miserable because they do not know what love is. I have only had in the past 2 years and 10 months maybe less than 15 opportunities to make love with my man. Yeah it may not be much, but I am not basing our relationship on sex. I know that I will get mine when we finally overcome this obstacle. It is not just physical but it is emotionally and spiritually. I feel complete when I see his smile every night on Yahoo Messenger smile.gif Webcams are the greatest invention ever. good.gif

Hey Gogo,

What fax did you send them? The received date for my case is 24 April for my I-130 but I noticed that on the 30-31October and 1 November my I-129F was touched and then my I-130. They havent touched any case since then so Im kind of curious to know why it has not been approved. Im dying to know what the hold up is but every time I call they say I have to wait 30 days after the 6 month mark to even inquire. Ive noticed other members have been approved. But I hope all goes well for you and all.

K-3 Spouse Visa Process & ProceduresK3- Help!
Hello,

Both my I-130 and I-129F were approved. The NVC already has my I-129F and will foward it to Frankfurt. They have not received my I-130 yet but from what I got from forums, as long as it has been approved, my husband can come here quicker with the k-3, its just that we would have to pay more and file more paper work. The whole purpose of the K-3 is to get your family member here in the US while the I-130 is still being processed. Once in the US the family member has to adjust their status. I think. Can someone verify this?

K-3 Spouse Visa Process & ProceduresOPORTUNISTAS
Craig,

Im sorry for the season that you are going through, but I know that this season will pass and make you stronger. I was in a 5 year relationship with an ex which was not really sincere. After we broke up, I did go through my season of depression. I thought no one will love me or even as much as he did (what I thought at the time was that there was only him). I didnt eat, I went from 125 pounds to 94 in two months. I cried. I was single for two years. Im glad I had two years to make my own decisions based on what I am, who I am and what I like. I realized that my ex was never my type and have been blessed to meet my hubby while in Germany. This was not planned at all. I went to Germany to do an assigned job and while doing my job I met him. He worked there and it just all fell into play. You will realize that when someone loves you or desires you, they will do things from their end. Not just you. You wont be the only one trying to impress and romance. She will too smile.gif My advice to the broken hearted is dont look because they will find you. And when you are not looking you are being your self which is what you really want the person to be attracted to. You. Usually when some people are after other people, they are not themselves. They pretend to be someone or something they are not. Take care Craig and I hope this season will go by quick. 2008 is around the corner(L)

Hi All,
My K3 has left NVC on Nov 15 and should have made it to Islamabad, Pakistan embassy by now. I emailed embassy to inquire whether the case is received, no reply yet. My question is that once embassy receives the case what is the next step? Is my wife going to receive packet 3 and send requested docs to embassy then the embassy sends packet 4 with interview date OR my wife gets one packet 3/4 with interview date and she has to take all the documents with her at the time of interview? innocent.gif
I read different things on the site here and wanted to understant the process from this point.

Thanks for your input!

Im in the same boat as you. On November 16 they sent our I-129F to Frankfurt. I was doing research and from what I understood, is that your wife will receive the packet 3 with instructions and then when she turns in the required documents, then she receives the appointment date. If I were you I would submitt the affidavit of support with your income and tax returns to your wife so she can send that to the embassy. I would recommend that you look at the Pakistan Embassy site for more info. Good luck smile.gif I hope everything goes quick for you and me.

I dont think it matters cause everyone has until April 2007 to file their taxes. But I agree with the comment posted above. You should provide your 2007 pay stubs which really should be in your bank deposit for the past year on your affidavit of support.

I wouldnt worry about that cause thats if you are going the fiancee route, which you two are married. My husband did not receive that form. But if your wife receives it, yall should call the embassy for guidance. I saw that on the guides to and read that part, but its not meant for married couples

He was handcuffed and detained, but their reasoning behind that, from what they explained to him, they had no room to keep him at the airport while he was waiting for his flight back to germany. He spent the night in jail and flew the next day. I will have him call the embassy just to be sure if he needs that waiver.

Mrs J06,

They stamped on his passport in Dallas :

VISA WAIVER PROGRAM REFUSAL
pursuant to 8 CFR 217.4

I researched it but I really dont understand much of it. All I know is that the immigration officer said that I can file a K-3 and get him here as my fiancee, but now that we are married we persued the I-130 and the K-3. At this time my husband received packet 3 and is about to send it off.

K-3 Spouse Visa Process & ProceduresAnyone denied entry at POE before?
Hello,

Im nervous because my husband is about to have his interview scheduled at Frankfurt. Long story short, he came to visit me and marry me under the Visa Waiver Program last year in December. At the Port of Entry in Dallas, the immigration officers questioned his intention in the US. He pretty much told them he was visiting. But that contradicted to what I told the same immigration officer. When the immigration officer called me on my cell, he asked if I knew him and what were our intentions. Honestly I did not know about the restrictions with the visa waiver program or any immigration laws at that time, but I told the officer he was coming to visit me for my promotion and graduation to becoming a Staff Sargeant, we were getting married in Las Vegas and we were going to file the paperwork once we were married so he can legally reside here. Im such a dummy. They denied him entry and he voluntary went back to Germany. A couple of months later I went to Germany and got married to him, claimed him as my dependent although he is not living with me (he has his military dependent ID card) at the moment and I visited him a couple of times last year and this year. I just would like to know if anyone has gone through this and any advice on what we should do. Thanks very much. helpsmilie.gif helpsmilie.gif

Dont give up though. Im a military member too. I had to wait 6 months to get my husbands I-130 approved. I filed the I-129F in the end of May and got that approved on the 31st of October. With HOPs, your spouse will need a visa anyhow to fly in one. But you can claim her as your dependent if you have not done so yet. My husband got his dependent ID in germany. Is Turkey under the visa waiver program? Im not sure if she can visit while her petition is being processed.

Thats weird that they cancel the K-3 cause both my I-130 and I-129F were approved on the same date. But the NVC to this date only received the I-129F and fowarded it to the embassy. K-3 Spouse Visa Process & ProceduresTOTALLY FKD OVER
Divine Mercy,

Although you will not be able to persue the K-3 route, at least your petition has been approved yes.gif There are reasons why things happen a certain way. For about a year from December 3 2006, my husband was denied entry into the US. That was the worst day of my life. I really had no desire to function. I felt let down by the Department of Homeland Security, whom sent my hubby back to Germany, and is also there to secure the borders of the US. And here I am in the military willing to fight any war that the US has to face, but not able to have the love of my life here with me to give me the energy and willingness to do my job. After a year of waiting, I realize that this distance has made me and my hubby stronger. Not many americans or really anyone can go through this. I think people who give up easily really dont know love or even want it. I want the love my pookie has to offer. And I want to give him all the love I have to give no matter how long I have to wait, even if it will take forever. Its a sacrifice for all of us to go through this process, but persistence and patience has gotten all of us this far. Dont give up and think of your children. They are one day closer to having their dad. You are one day closer to having the love of your life although the finish line seems distant. And I am sure he realizes all the sacrifices you have went through, are going through and will go through for him. Thats LOVE. I beleive in Karma and I beleive for all this time you and me have missed out, we will get ours a trillion fold. heart.gif

I am worried about my package. NVC said they sent it out to US Embassy in Ukraine on November 15. Today they is already 27th and still not delivered. 12 days has passed and nothing. The embassy said that they got an electronic version, but not hard copy (without which they cannot send packet 3 out).

Anyone out there had similar problems (long delivery time)? I hope DHL did not loose our documents. Is it possible, and if they did what can be done?

Thanks...

You know, the delay could be also due to the holidays. I would call the NVC and ask if they can track that packet and inform them of what the embassy told you. Im sure that they probably also send other cases along with yours to the embassy and track it for incase. Call NVC. They are active until 1100 I think or 1200 eastern time.

Happy Thanksgiving all. God bless america too for giving all opportunities to live here!!!

Im in the same boat as all of you and Im also going for the K-3 rather than the I-130. My husband and I dont care if we have to spend more money and file more forms, we just want to be together. Below is my timeline, so my husband is pretty much waiting to receive notification from the Frankfurt Embassy

NOA 2 for I=129F: 30 Oct 07
Received NOA 2 for I-130 and I-129F: 5 Nov 07
Called NVC for Case # status: 13 Nov 07
Received NVC letter and case # for I-129F: 16 Nov 07

So I was wondering, just to get this straight, my husband needs to get police certificates, passport, two pictures, marriage certificate, affidavit of support (from me with tax forms, bank statement with date opened bank and deposits for last year and current amount) and proof of relationship. Is there anything else we will need? I looked at the Frankfurt site just to see. We would love to be ahead of the game whistling.gif

Nothing to do with anything..

I've been trying to push this out of my mind during the day. I started to become non functional which is not really an option when I have to raise my three kids and work everyday. I've been praying for peace of mind and patience which I believe God has granted however, my dreams have taken up the extra work of worrying. Every night for the last week I have dreamed of visas, petitions, USCIS, approvals blah blah blah. This morning when I woke up I almost reached for the phone to call my husband and tell him we've been approved. Thankfully I realized it was just a dream before I dialed his number! This whole thing is a real life nightmare.

You will be approved. It seems that they are working pretty quick with approvals. I was in the same boat as you. Desperate and irritated. I kept calling every once a week to USCIS to see the status of my case. They told me it was still pending, and I had to wait 30 days after the 6 month mark to even inquire and then allow an additional 45 days to even receive a response. Long behold one day after work after 207 days of mailing the I-130, I see two approvals in my mailbox for the I-130 and I-129F. Even though the site still states that they are both pending. Im sure that USCIS does not have time to update their system. Im sure they will surprise you before this year ends. And wait till it goes to the embassy. That part of the process is way to quick I think. Once you get that approval, do your resarch and have your hubby get the police certificates, marriage certificate, pictures, passport and send him your affidavit of support so you two are ontop of your game. Thats where me and my hubby are at. I just want him here. I dont care if we have to spend $1010 and 390 something dollars and file additional paperwork. I hope everything goes well and you are able to have your hubby soon !!!!

Yep. I have called for a receipt. They said to allow the processing time frame. I did have a touch on it on the 29th of June, but thats it. I called USCIS in Friday ..and I was told that the process for both I-130 and the I-129F is still on Dec. 2006, WHY?

Is it really that hard to process a legit case.

Wait a minute ... what are we talking about here, I-130 taking years to finish, I-129F the same, WHY? WHY I SHOULD BE SUBRATED FROM MY WIFE? WHAT KIND OF IMM. SYSTEM IS THIS, you will never hear things like that anywhere else.

I can't believe that in order to bring your wife you have to get blood purser, diabetic, and couple of hard attacks, and at the end you have to prove ridiculously that you love your wife is really you wife, WHY?

I am not asking for my brother or relative to come here, SHE IS MY WIIIIFE, can’t we live together?!

it really frustrating to wait a year or two, and read thousands of pages and file hundreds of papers and forms to just be able to bring your wife WHYYY?

I am sure it’s not employee fault, it’s how the system been designed.

Hello,

Dont get frustrated. This will only make you both stronger. Not alot of people other than people on this forum would be able to handle long distance. My co workers have admitted that they would not go as far as I have with my husband. Its been 2 years that we have been doing the long distance. Im pretty pissed too but all I can do is wait. Just to let you know, I sent a request for at least my receipt for my I-130 on the 25th of May and I just now received a response in my mail. So it gives me some kind of relief to know that at least they got to it. Maybe two months later but they got to it and responded. It pretty much states that they are still processing December petitions. My petition was filed in April. Are you able to go visit your wife? Im planning to see my dude for a week in Germany. Hopefully, maybe by then I might receive something. For now, all I can do is be here for my pookie. And visit him. I have a feeling that after 30 July things will speed up. If people are paying the updated fees, USCIS will have money to hire more people and serve the purpose of charging alot. Speed up the process. Hopefully

I have not received any receipt from CSC for the I-130 and the I-129 F. I am dissappointed in them. I feel that the person that has my case maybe has something against germans or military members :crying: I noticed some April filers received a notice or receipt. Any how, Im hoping that I will at least receive approval when I get back from seeing my pookie in Germany. Any how, I wish everyone here a quick process.

Hey Tareq,

Just to give you a heads up, they sent my I-129F from Chicago to California for "quicker processing". Just be prepared. If you look in USCIS site under the press room, you will see that the filing instructions will change eventually. If you are closer to the East Coast, Im assuming they will send your I-129F to Vermont, but if you are West Coast, expect it to go to California. Mine is pending in California and I received a notice from Chicago about the transfer. I called USCIS on Friday about my I-130 I-797, and the immigration officer pretty much told me that they never sent anything in the mail cause CSC is doing catch up, which should have been done by the 15th but they are still catching up. She told me to call the first week of July if I dont receive anything. I am so dissapointed in them. I have called probably 4 times before, and the customer service reps pretty much lied to me. They said they sent the receipts and the immigration officer pretty much tells me they did not send me anything. I wonder who I can file a complaint about their system cause it is not right. I would be fine if they said it would take 6 months to get a receipt. Dont lie on the case status online and state that a receipt is mailed. Anyhow, I am happy to hear that you initiated the K-3 process. Its hard not having your partner with you. Let us know how things go. I will keep you and all posted on anything that comes about

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed help with NOA1 timeline from any May I-130(Spouse) filers to CSC?
Hello,

I am in the same boat as most of yall. I filed my petition in mid April. Californ i a did not receive it until really the 16th but inputed it in the system on the 24th and cashed my check on the 27th of April. I found out my case number by looking at the 3 letter 10 digit number on the back of my check. ( knowledge is power, thanks to these helpful forums). To this date I have not received any notice or receipt. But I will tell you this. I dont remember the I-129F stating that the I-797 needed to be included. All I read is that they needed proof that the I-130 was filed/ pending or approved. Mine is pending, so I mailed the I-129F with a copy of my check front and back and I provided the slip on line in the USCIS sight, where you type in your case number and it shows the current status. I confirmed my case number by doing an infopass. (I was given the runaround through the customer service line. They told me sometime in mid May to do an info pass with an immigration officer, since I realized I had to make a correction on my petition. So I did on the 24th of May, and turns out that they could not tell me much in the Sacramento Field Office, but they did confirm the case number and my name and my pookies. The immigration officer there told me to email USCIS and ask the status since I have not received anything. So I did that and then I receive a response that they are not to receive inquiries from the public but they would "re-send" the notice. The person stated that I needed to call customer service. Of course Im pissed cause its not my fault that the customer service told me to see an immigration officer who told me to email who told me to call customer service. Once I got ahold of someone, I told them that I did not like how they are passing me off. She told me to wait 45 days at the most to receive a receipt and if not try again and was nice to transfer me with an immigration officer. I told him my situation and told him that I wanted to take the K3 visa route. So he typed some stuff in and gave me a transaction number and told me to wait 30 days. If I did not receive anything in 30 days, to call customer service and provide them the transaction number for request of receipt. I hope that answers someones question. Yall are not alone

Hello,

Have you seen the press room in the USCIS website? http://www.uscis.gov...pdate052407.pdf
This is pretty much telling you the dates when USCIS should be compliant in sending you a receipt, depending on the date you sent your stuff. I sent my I-130 in mid April to CSC and my I-129F to Chicago. Still have not heard anything. But as of 15Jun07 (when it states they will be compliant) I will definitely call them and see what is going on with my receipts. I did confirm my case number (numbers behind my check) through an info pass but I have not received anything. Hope all goes well for yall :innocent:

IR-1 / CR-1 Spouse Visa Process & ProceduresUSCIS response vs. VisaJourney statements
Hey, I just thought about this. What if we sent a petition to USCIS with like an overwhelming number of names for cases not approved or in the process? Send that to Congress or Senators. I bet yall there would be a trillion petitioners all over the US.

IR-1 / CR-1 Spouse Visa Process & ProceduresUSCIS response vs. VisaJourney statements
Hello all,

I have a question for all of you. Are you all citizens or legal residents? Did you mark that there was an immigration proceeding with your spouse or family member? I ask cause I wonder if there is a trend here for a reason why our cases could be on hold or set to the side. I filed in mid April and my spouse was actually denied entry to the US cause DHS said that my husband seemed he intended to stay even though he wasnt and had his roundtrip ticket on hand, under the Visa Waiver Program. But any how. My case was received by a Semegi through USPS receipt, so Im sure that pretty much everyone that has filed in CSC knows who this person is. So obviously some people's cases were set to the side. I have only gotten one f ing touch since April on my I-130.

Is the whole purpose of the California Service Center to do background checks or screening on the sponsors (US citizens and Legal Residents)? I think I have read that somewhere. Then the Embassy does the background checks on the spouse or family member. Any one know?

Im in the military, so I know that that does not mean much to USCIS. Not that Im any different from yall but I would figure they wouldnt think twice with me especially since I have been in for a couple of years. There has got to be a trend here some how. Cause I noticed people that filed after me have received approvals already. I should just have my husband fly to Mexico and walk over. That would be alot easier and quicker than this #######.

I am going to send a message to some news station about this #######. USCIS needs to work on their customer service.
