There was one person who posted a few days ago that was approved despite the last visit being a few days outside of the 2 year requirement. However, it was because she was able to demonstrate extreme hardship in not visiting since then, not simply because it was only a few days removed. But it is extremely rare to get approved on such a waiver, as the other posters on here have demonstrated.

Have your fiance call the USCIS service center back and talk to a Tier 2 officer. He needs to confirm with them that the case was received at the lockbox and routed to a service center, and if confirmed ask them to resend the NOA1 since you guys have obviously not received it. He needs to double-check with the tier 2 ISO that they have the correct address to send mail - a missing NOA1 does not have consequences but not receiving the NOA2 for a K1 would cause issues further down the road.

 

An alternate option would be to try making an e-request from the uscis website choosing the option "I have not received a document", however without a case # I don't know how that would work.

On uscis.gov, it says if I am a USA citizen wanting to bring my fiance to USA , there are only 2 forms it says I have to fill out. The I-129F and the g-1145( E-Notification Form). It does not say that any other forms are necessary. However , I am seeing other people and Visa Journey recommending using form G-325A and all kinds of other letters, info and pictures that I can not find in any Government Intructions. Where is the reference to using all these other forms and procedures? Fiancé Letter of Intent? I see this no where. Or is is this just a recommended procedure? I ask this because I have a co worker who brought his fiancee to the USA and to marry and he did not fill out any of this other information that your recommending in your checklist. He is looking at me in disbelief when I am telling him about all this big package presentation.

Just to give you a quick answer, the letter of intent is mentionned in the instructions for filling I-129F, together with all the other stuff you hear about here (proof of having met in person...)

I have a small question here about translation of documents : I read the requirements on USCIS website and they say the translator should sign a statement saying he is competent and blabla, but I don't see anywhere that the translator has to be approved or anything. Does that mean I can translate some documents myself ? I could as well do it, and it would be faster and cheaper !

Has anyone tried ?

Wedding heck get it done at the courthouse. Ceremony, license and multiple certificates cost us under $200. Costs may vary based on county/state/etc.

K1- yep there's the lovely fees, you may have to travel as well to get to the consulate and to get to your medical, if you don't have your vaccines you'll have to get those as well, if you have proof of them though that's fine, if you've had them but lost proof you may have to get a blood test to see which you have immunity to.

It's not cheap. Not sure how much your fiancé covers vs how much you'll cover.

There's also the cost of having another mouth to feed...that's sometimes hard to budget in before hand. you won't be able to work until you get your EAD (which if you're lucky is 3-4 months after you file your adjustment of status and related documents)

Depending on his debt load and how he's repaying it I can understand why he may be a bit hesitant.

At your point, where you had your interview and will be getting the visa shortly, DO NOT GO TO THE STATES UNTIL YOU ARE READY TO MOVE THERE.

I would say that the fact you sent uncertified copies of your divorce decrees would be a strong contender for the RFE. Although this is only guesswork at this point. I can only relate to my own RFE which was for the fact my certified divorce decree didn't show that the divorce was indeed final and settled (Scottish law). After a visit to the courthouse to obtain a signed statement from the Clerk of Court that my divorce was final, the petition was approved by USCIS. USCIS need to know that you are legally entitled to marry your fiance/e and this means a certified decree stating that the divorce is actually finalized and settled.


I got the letter, and it was the divorce decree, did not say it needed to be Certified, but I sent the wrong document, as it was the notice of entry of Judgement, and there was actually the same document, but it says final judgement, and that was the one they needed. Express mailed it today, so I hope it goes through now

I wouldn't worry too much... I went over in October, 3.5 months after we sent in our I-129F, I was preparing for all kinds of questions, but it was as easy as a breeze. I was asked for the purpose of my trip, I only answered "vacation", then fingerprints, photo, stamp in my passport and done. If he had asked any further questions, I would have told him about my fiancée and the K1 process, but I would only answer specifically what the CBP officer asks you and not volunteer any information.

I myself didn't bring any supporting documentation, such as apartment lease or letter from my employer. Of course you can bring a copy of your NOA1, so that he can see that you started the process and it would certainly by stupid to jeopardize it by staying the the country illegally.

Just wanted to share my experience from last week when I entered on VWP at LAX... In fact entry has never been easier, even though I ended up with the meanest looking CBP officer who kept sending people back to the end of the line for not filling out the forms correctly. So when I stood in front of him he first complained about those people that were in line in front of me ("too stupid to fill out a correct address..."), so I said I hoped I did it all right. He said "sure - purpose of your trip?" I said "I'm here on vacation" and before I could even start to explain that I wanted to visit my fiancée, he started his routine "four right fingers... right thumb... etc.), stamped my passport, and I was through :) So I'm really not sure he saw on his screen that there's a I-129F petition pending. Anyway, now Im enjoying my vacation with my fiancée in sunny Southern California :)

I'll be visiting my fiancee in California in 2 weeks, plan to stay for 2.5 weeks. My last visit was in April, so I hope CBP won't give me a hard time when I enter on the VWP. We expect the NOA2 within the next week or 2, right before my trip. If asked, I'll be honest anyway, will tell him that I'll visit my fiancee and that I plan to apply for a K-1 after my return to Germany.

Does anyone know if the Immigration Officer can see on his screen that we started this process once he scans my passport?

I spent June-July in the US on the VWP while waiting for my NOA2 with no issues. I actually received my NOA2 while on holiday there! In most cases it's perfectly fine but it is a good idea to bring proof of ties back to your home country. The pending K-1 & taking your NOA1 with you may help but I would recommend trying to find more. Good luck!

It was really hard, and we had a 6 month old at the time of filing too. My husband started off on a working/holiday visa that was extended, so he was living with me in Australia for 18 months.. We filed Sept 2012, he had to leave AU in Jan 2013. We got the K-1 in Sept 2013.. We managed a holiday to see him in the US on the VWP for a month in June 2013 so the longest block of time we were apart was 5 months - but yes, it was a very hard time for us! A lot of skyping!

My husband (then fiance) and I went into the K-1 process with a 6 month time frame maybe. Boy, we were horrendously mistaken! Through no fault of our own, the processing centres slowed almost to a halt after we filed (around when the DACA law passed).. It took us just OVER A YEAR to receive the K-1 visa. Having said that, I do know others who got theirs in under 6 months.. So, I wish you luck, but it's something you just simply cannot predict!

A question : If the RFE requires more evidence like photos or tickets or chat logs, can we send recent? Because after the NOA1 we made 3 more trips and have 200 more photos and a whole bunch of other stuff.

  

I was under the impression that you could ONLY provide proof of relationship evidence in the 2 years PRIOR to having filed. So anything from AFTER your I-129F filing date is inadmissible.

Perhaps someone with experience can confirm or deny this?

Maybe since both of you are from CA, they did not request this.... I have seen the majority of these RFEs are being sent to same sex couples where the petitioner lives in a state where no same sex marriage is allowed.... Also, you are at CSC (again a state that allows same sex marriage)... maybe things are different with TSC.... as we know, there's a little bit of inconsistency with these applications and in general....

hey guys, just wanted to share our experience. we filed back in the beginning of august, received our NOA2 yesterday, after 55days, without any RFEs. we used the exact template for the letter of intent found on this website. we did not specifically state where we would get married. my fiance is from TN, but lives in CA now. that's what we put down as the address. maybe that clarified things enough.

 

so not stating the state in which you are planning to get married is not an automated way to a RFE.

 

alright, all the best to you guys. now on to the waiting game. transfer CSC - NVC. i heard, transfer times are at an all time high. might take longer to reach the nvc then it took the petition to be approved.

Haha .. This is an awesome topic. This is about luck. My fiancee bought my ticket a week before my interview. And i even had problems with my medical. So my interview was postponed. If u feel confident about everything then go for it. But think about the money u gonna spend if u dont fly on that ticket u bought. My husband is so positive that he didnt even care if his gonna buy again another ticket if i cant fly, he said anyway its just money, u can find it. But the soonest u see ur fiancee is the best thing in th world more than money can buy. I felt we were gambling that time. He was the financer and i was th player, but guess what i played well.. We won.

I noticed somebody asked a week or so ago if there was a list of all RFEs so people could look out for possible "boo-boos." So here we go!

My RFE reason was;
The forms we downloaded didn't tell us to add evidence of meeting in the past two years or frontal face photographs. Which is weird because we got them directly off the London Embassy site. So we got an RFE for basically the other half of what you're suppost to send origionally. We started the K-1 appliciation before we found this forum so we were kinda just going with the instructions as best as we could. We say if you're just starting the I-129F download it from VJ...they seem to have the right instructions....

Awesome thread idea!

Maybe we can put solutions in here as well? For example, instead of getting your forms and information from the Consulate sites, or VJ, or anywhere else, always check the uscis.gov site for the most up to date version of the form AND instructions, including fee amounts.
This is one that has caught many people out. Forms take years to get changed (literally) but webpages can be updated quickly. Always double check at uscis.gov before sending any payment or form.

i got an RFE and was going crazy but it was nothing big (at least not yet...hehehe) i just overloooked a box and forgot to mark "no" on one of the sections, i mailed it as sooon as i could, to the address on the colored cover page of the packet they send ya. i pray everything else goes smooth and doesnt take so long...it just feels alot better once u know ur mistake and stay optimistic about it. i used to get nervious to call ins cuz they seem to form a wall between u and them but now i jsut dont care and i call and try to get information from them as much i can in a nice way.

I agree, this is good advice.  Some people overdo this to the extreme of sending photo albums, hundreds of pages of chat logs, and all kinds of excessive stuff.  Don't send so much that the person looking at your file gets overwhelmed with too much information.  Use the guides provided on VJ.  They are helpful.  I also attended my wife's interview and I believe that helped us as the CO asked me more questions than they did her.  The CO was gald I was there to answer questions.  Good luck. 

 

They let you go into the interview room?? I wonder if it is different for different consulates. It was my understanding that in Guangzhou I would not be allowed to go into the interview. Everything I read said I had to wait outside all day  :clock:  

 

Perhaps each country/consulate is different.

Ok everyone, thank you for all the input. Now I have a more complete idea of the reasons behind front-loading and I will definitely do it.

 

When I think about how I have to convince some person that my relationship is true, causing a lot of stress for my fiance and I, I can't help but feel angry that illegal aliens are seemingly welcomed with open arms. It is ridiculous. They make it difficult for the kind of people we want to migrate, but make it very easy for people who are almost guaranteed to become wards of the state to enter. I don't get it.

I started to doubt frontloading because I saw people that seemed to be going over the top with it - 100 pages of chat logs or similar stories. I just could not see how this would be helpful at all.

For the I-129F I just see that I am required to submit evidence that me and my fiance have met in the last two years. What is all this about proof of an ongoing relationship? Is this "front loading"? Should I specifically state on my cover letter something like:

 

proof of ongoing relationship - phone logs

proof of ongoing relationship - skype chat logs

proof of ongoing relationship - letter received 8/1/2014

 

I have letters she sent me, but not letters I sent her. Do I need her to email me scanned copies of those letters? or should i just not include any proof of an ongoing relationship since it is not requested?

 

Are they just going to ask her for this stuff at her interview at the consulate?
