K-1 Fiance(e) Visa Case Filing and Progress Reportshow to wait patiently & positively

Hello All!

I was lucky enough to spend 7 months (I studied there) with my fiance in his country (Morocco). I returned home (US) 3 months ago. I'm trying to keep myself busy with work and school (I'm a university student), but still feel distracted with this waiting process. It's hard for me to feel focused or grounded in the things I do now that I'm home. I think part of what I'm experiencing is reverse-culture shock and the other part is simply missing my fiance. I'm curious about how you all have managed to keep focused, positive, and patient while your loved one(s) are so far away. I look forward to hearing any of your anecdotes, stories or tips! :)

Skype, and work is working for me, i left my laptop to my wife and pay for her to have internet so we always have that communication level.

IR-1 / CR-1 Spouse Visa Process & ProceduresA paticular question in the I-864
Morning/Afternoon/Evenning..

Question is in regards to the question asked in Part 3, #8 "I am sponsoring the principal immigrant named in Part 2 above." and right below that it has a [ ]yes [ ]no(Applicable only in cases with two joint sponsors)

Do I even need to fill Part 3 out if its just my wife that I am sponsoring and there isn't a 2nd sponsor involved here? I've read the instructions and from what I have read Part 3 only pertains to if you have 2 joint sponsors?

Thanks in advance!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about i-864a

If your using an I-864A, your cosponsor is basically stating they are allowing you access to their income level to make the poverty level needed.

Carefully read the instructions for the form, your co-sponsor would only count the people they are responsible for (like dependants, spouse, immigrants sponsored).

They would not count USC's if they are not responsible for them. (from what you posted - they would not count you or daugther - just his wife, your wife, and your brother (and himself)).

Thanks for the info, like always  . I would've assumed that was how it was. Just on the edge about the forms and making sure my ducks are in order to prevent that "further delay"

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about i-864a
Hello, there are many posts that are in regards to the i-864a. I have a specific question in regards to how NVC looks at the income portion of the co-sponsor as well as the sponsors income.

When the NVC recieves both i-864 from me as well as i-864a from my co sponsor. at that time if my income is not sufficient enough for their poverty guidelines, are they just looking at my co-sponsors income, and throwing mine to the side?

The household size is and will be:

myself, step father, mother, and my underage brother, my 6year old daughter, and soon, my wife will add to the mix here.

so household of 6. my income alone is at 26500 and his is 32900. So, approx 59400 annually, combined. According to the 2009 guidelines household of 6 is 36912(125% already figured into).

So would my step father(Co-sponsor) need around 37k annually to co-sponsor?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 and i-864a questions

Your SF would need to make enough income for himself, wife, son (younger), and your wife. (4 people).

So with the info you posted - he makes enough.

Between the two of you, no issues.

Remember - you fill out an 864 and he will fill out the 864A. Be sure to obey the instructions for evidence (USC/LPR/Income/Household)

man your awesome with the responses thanks. whats LPR by the way?

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 and i-864a questions
Hello- Question I have is in regards to filing my Affdvt of Supprt for my wife.

The reason for the question is because like most I worry that her visa might get denied based on the financial aspect of things. When looking at the I-864p(Poverty Guidelines based off of 2009) Im looking at the dollar signs and thinking wow. My income from my job is at 23.5k a year and I recieve 3k a year for child support I would be adding in as part of my income to become eligible. So overall 26.5k a year. My household size is currently Me,my 7yr old daughter, 5 yr old daughter, my wife, and soon to be son in June. So 1+1+1+1+1=5. So according to the 2009 Poverty guidelines that requires income of 25,790 x 125% = 32,237.5. So I am $5,737.5 short.

I currently reside with my parents, since Jan 2010. My step father has agreed to co-sponsor with me with the I-864a. His individual income is 32,948.55(Based of agi of 2009 taxes.) Now his household consist of himself, my mother, and my younger brother(under 21) So household of 3. My understanding is that he would have to meet the poverty guidelines for his own household..?

Overall our income combined is at $59,428.55. Would this be enough to financially support my wife's visa?

IR-1 / CR-1 Spouse Visa Process & ProceduresI've been a bad girl!!!

The quoted statement would be accurate if instead of "owe", it read "have an IRS lien". It's not an IRS limitation but something the Consular officer might (and has done) do. The OP said nothing about an IRS lien, so I doubt there is one. If not, then simply disregard.

Thanks for clearin' that up man, because my co-spon owes but has a payment plan, and does not have a lie with irs
jandkMalePhilippines2010-04-04 20:56:00
IR-1 / CR-1 Spouse Visa Process & ProceduresI've been a bad girl!!!

You will need to bring your tax filings current to get a visa. If you owe money you must also make a payment plan and expect the money owed to be subtracted from the amount you make in calculating your income. If you have your taxed filed by interview time then your should be OK. If not your inability to follow US tax could land you in trouble as you are dealing with a government agency that it known for a lack of humor and not filing taxes may be a criminal action that would exclude you from being eligible to petition for a visa.

Question regarding the statement made in this quote. "If you owe money you must also make a payment plan and expect the money owed to be subtracted from the amount you make in calculating your income." IF you owe the IRS why would you deduct what you owe from what you make annually. Is there a publication from the IRS that says this? I only ask because my co sponsor (step father) has a pymnt plan w/the irs

IR-1 / CR-1 Spouse Visa Process & ProceduresHoo long does it take to get interview letter after submitting DS 230 packet to NVC?

Hi all:

After submitting DS 230 form, how long is the wait for interview letter?

Thanks

I sent over my AOS and DS230 over around the same time you did, and when I called them the "nice" NVC Customer service rep told me it could take 6-8 weeks to review the papers, and hung up on me. So in my opinion they are required to tell you the time frame BUT i believe its better stated "upto 6-8 weeks"

IR-1 / CR-1 Spouse Visa Process & ProceduresMarried to filipina with 3 kids, need help ith process!

Hi everyone

I was married in the Philippines on Dec. 11th 2009, and lived there with my wife and her 3 young children. Now I want to patition them to the USA. I see a few options of visa types. I am hopeing to find someone that has already been down this road for advice and guidence. The 3 kids have bith records as illagetimate so not fathers to deal with. My wife has never been married tilll now to me. I only receive disability income from the TSA and so I will also need a co-sponsor. I want to use the IR1 and IR2 for my wife and kids is this the best? i would like her to be able to work as soon as she arrives.
So the first step would be to find co-sponsor right? after that fill out the forms (not sure of what is needed) for both me and the co-sponsor. I know i need to fill out the I-130 and maybe the I-129f? then submit all to the uscis office for my state along with all fees, right? like I said I really need to chat with someone that has been there before.
Thanks everyone......Rod, Jube Joy, Alexandra, Heaven and Yanis Justin....Brown family

The type of Visa would be considered a CR-1 because you have been married less then 2 years. If you don't meet the income guidelines then yes you would need to find a co-sponsor. The way I did this was combine my income with a family members income. That form would be the i-864a but that type of co-sponsor would need to reside in the same house as you. Send me a message if you need help, I will personally help you out if i can. I have some times on my hands until the new job starts. :) Take care

My sign in failed today but the AVR does not say "case is complete"..is this normal or will it take a few days to update?

Hey congratz on the SIF, mine was also SIF as of today's date. I called them because I had the same question about why the AVR isnt updated. The lady told me its because it was just completed today. Also probing about possible interview date eta. She told me for sure it wont be in November because that month is booked. she told me that about the 2nd week in November they will start processing more interview dates, so she said we MIGHT get an interview in December. Lets all hope its sooner. :) Goodluck

IR-1 / CR-1 Spouse Visa Process & ProceduresI-864 Employment Letter

I was looking at the requirements for the I-864 and it states that you need 6 months of pay stubs and/or employment letter if you believe any of these items will help.
I have a stable job with government and copies of pay stubs. My issue is with the employment letter. Being a government agency our HR department is less than cooperative in most manners.

My question is, do I really need this letter?

try looking up your job through www.theworknumber.com they have a part in there for immigration purposes it verifies your income and doh

IR-1 / CR-1 Spouse Visa Process & Proceduresplease help. very new in this site.please

From what I understand, banks require a SSN card to open or add your name to a joint account. My wife was able to open a U.S. bank account without an SSN card. She originally came to U.S. on an H1-B, a work visa. Her employer contacted the bank and made it possible.

his fiancee can put him on her credit card accounts as an authorized user w/o ssn involved. Showing that there is a "REAL" relationship requires proof of her maybe helping the OP out with moneygram or western union xfers. also OP send your wife cards, hand written letters, tons of pictures of the two of you together. chat logs, video logs, phone records.. pretty much everything that it requires to maintain a relationship.

Goodluck ingat ka

IR-1 / CR-1 Spouse Visa Process & Proceduresfilipino filers?

Hey guys,

I just filed this month of october and i've received my NOA1 dated oct.20th. although i'm a little familiar with the process i would like to hear from the couples that have gone through it. From their days with the NVC to the medical in SLEC, dealing with the US embassy in Manila and finally to the interview. What should I expect? any tips on getting through smoothly and what not? I just want to see or feel how it will be once my husband and I are in that final stage.. Thanks in advance. God Bless :)

Jillymae

Well it does play its toll on life to have to wait through the process.. BUT good things come to those who wait, right?
Our process has been smooth, in between the times we were waiting for NOAs', an RFE, and things just waiting to get approved, we kept our sanity by pretty much skyping.. Now we are at the end just waiting for the Interview. All i can say is paperwork paperwork paperwork.. any questions let me know :)

Good day everyone reading this;

I thought I would mention that I received a SIF today. So I thought I would make this topic for anyone else who had theirs approved as well today! Keep us all up to date if this applies to you, on your journey to the Embassy. I did call NVC to inquire the next steps and they told me that more then likely the interview will be in December of this year. Good luck to everyone!

IR-1 / CR-1 Spouse Visa Process & ProceduresSign In Failed Question

Hi Guys!

I got SIF on Nov. 14 (US time).
I called called NVC on the 16th and I was told that case is under final review. I called again the next day (17th) and the operator said the whole "Your case has been completed" spiel. When I asked her when it was completed, she said it's in the final stages. So I got confused. I called again today, the 18th and the agent said it's still under final review and I should just wait for the interview letter.

Has any of you experienced this?? My hubby, especially my MIL got so excited when I told them about CC. I don't wanna let them down in case there's another RFE. =/

hey there Aur,
We went through the same process, and they do tell you to wait 6-8 weeks but if you look at my signature under this you will see the most accurate time frame in which we got our case completed by NVC and when we received the letter, but its different with each case and when it gets approved... by the way mine came to our email. About this time, start preparing for the medical exam, and make sure you have your ducks in the row. Start looking up the process for St. Lukes, and tell her to expect to be real early. my wife got there at 6:45am and she was #98, and waiting nearly all day.. some people were told to come back the next day.

Good luck

K-1 Fiance(e) Visa Process & ProceduresWould I be hurting our chances if I applied for a K-1 now?
I am a firm believer to "things happen for a reason" for her to get denied, there is a purpose. sounds like you are to pushy and dont allow her to think for herself. you seem to want it your way and to convince her to come to America isnt a way to show her you care or love her. To try and come onto the forums with the mentality of "I BET THESE GUYS KNOW THE TRICKS OF THE TRADE" its not that people on here dont want to be helpful. but your pushing a BIG decision onto someone who isnt ready. Slow down, relax, breathe and either 1. work on yours and hers relationship and take it one step at a time, or 2. move on from her. If she isnt wanting the same thing you are.. then your spinning your wheels, plenty of people out there with similar interest as you..Sounds like her interest is her own independant life without needing someone to be there to take care of her.

Goodluck -K-1 isnt a way i would approach the problem.. focus on her feelings before yours at times.

K-1 Fiance(e) Visa Process & Proceduresdocumnets to be sent together with the crba

hi zeth..

all i have right now are the:

1.) birth certificate of my daughter
2.) my pre-natal book when i was pregnant
3.) an ultra-sound during my 6th month
4.) quantitative technique during my operation cause i was cs.
5.) pictures after my operations (after i gave birth)
6.) marriage certificate
7.) picture of my daughter in day 1 til now
8.) notarized copy of my husbands passport
9.) notarized copy of his certificate of naturalization
10.)plane ticket during his visits
11.)his employment records

are these documents ok.. or do i need some more documents? hope you can give me some more ideas ... thanks so much....

Looking over what you have, it looks like everything that is needed plus more. According to the DS-2029 instructions page, you would need the following:

Passport, employment records to show residency, plane tickets to show he was there when your child was conceived, NSO copy of birth certificate, marriage certificate, his certificate of naturalization.

Couple questions... has your husband been married before? if so he will have to show proof the marriage was terminated. and also, has he resided in the US 5 years prior to the child's birth?

K-1 Fiance(e) Visa Process & ProceduresK-1 visa interview

Can Anyone tell me the average processing time for a visa review? My petition for a fiance visa was sent back here to the USCIS in the United States for review. My fiance had her 3rd interview at the U.S Embassy in Hong Kong just an hour ago and they (3 women 1 man)all but acussed her of wanting to come here for the sole purpose of a better job and life. Our petition is to expire on March 5, 2011. Any help would be greatly appreciated. Thanks

So, you say it was sent back to the USCIS for a review? I would think it would go back to the NVC, wouldnt it? My application is waiting upon an initial review and its a 6-8week review process. It may be the same for a K-1 but im not a 100% sure because I filed for a K-3. I would say keep pushing at it. Maybe there is not enough evidence to show a "real" relationship. I wish you guys luck!!

K-1 Fiance(e) Visa Process & ProceduresPlease answer my questions! Thanks!

It's the same number but it's 1-888 so on my cell bill, that's the number you'd see. It's not a card card that I could save, I just always reload it when I need to call. Our main communication 24/7 is yahoo messenger though. So should I still submit all my income stuff along with my parents or just theirs? Ugh this stuff is so straight forward and simple, but I still get confused. Haha. Thanks for replying!

You know what I use for calling there. I use Pennytalk. its reloadable, and a good price per minute. Ontop of all that it logs the numbers you call.. :) Skype works well as well. I would use a co sponsor in case its brought up. As long as your income now is sufficient you should be ok.

I'm still waiting for my NOA2 since July 30th of my NOA1, but my Fiance needs to move because her sister leaving on Nov 30th 2010. If she can not find a trustworthy roomate to replace her she would have to find a smaller place for herself. So, my question is if she does move to a smaller place, will this effect the processing of the Visa when I update her address?

not at all, as long as the embassy, uscis, and nvc have the right address. just call them and make them aware of the change.

Hello, If your fiances brother and sister both did k-1 this could of also been the help for a denial because I do know that those are red flags and maybe it was that along with a combination of other things like the answers he gave etc. sometimes the co's just try to find any reason for denial.
