US Embassy and Consulate Discussionpreparing documents for montreal interview ahead of time
i have gotten some information about the sponsorship part through some new posts that have been put up. one says that i have to fill out an i-134, and my sponsor must fill out a separate i-134. i also understand that i need to attach my u.s. tax returns for the last 3 years, but i don't recall ever receiving anything from the irs after filing. i know for sure that i didn't get anything this year after filing. can i use my files that were prepared by h&r block or do i have to get in touch with the irs and receive some sort of statement. also, my mom in indiana will be co-sponsoring for me since i have no u.s. income. since she will meet the 125% line with her income, does she still have to include her tax returns?

US Embassy and Consulate Discussionpreparing documents for montreal interview ahead of time
this is a repost. i accidentally posted in the wrong forum.

hi friends!
due to the huge backlog at the consulate in montreal, me and my boyfriend want to get some of the requirements done before the consulate contacts us. that way, we can send the packet out as soon as we get it, and avoid further delays. i took a look at the contents of packet 3, but i don't know what any of the form numbers mean except for ds-56 (or whatever the visa application is). could anybody tell me what the other forms are and what the other requirements are? all i know is he needs a medical, a police record, and i-134 (affadavit of support). does anyone know what the specifications are for the police record? is it just one from the rcmp, or one from each town he's lived in? for the medicals--is the list of doctors on the embassy page complete? i'm just trying to figure out if there's a doctor closer than toronto (i don't like driving there i had a panic attack last time ) also, one last question. i am a permanent resident in canada. i have been living here for 4 1/2 years and i am working here. all of my sources of income, bank accounts, etc. are here---none in the u.s. anymore. my mom is willing to co-sponsor for us, and i would like to send the correct forms down to her to fill out right away, so that they are here and waiting once we receive packet 3. i-134 doesn't appear to be for a co-sponsor to fill out, though. is there a different form i need to include?
i appreciate your help!

Canadachanging consulate interview to vancouver from montreal
hi all,
i filed an I-29f with the nebraska service center in may, but it was transferred to the california service center. we'll probably be waiting at least another 3 months before it even hits the consulate in montreal and the wait times for the
k-1 interviews are just over 4 months. but the wait times for the consulate in vancouver are just over 2 months. can i change it to have them send it to the vancouver consulate after they receive it at the NVC or do i have to wait until it gets to montreal and reroute it. also, it might take a bit of time for them to transfer it from montreal to vancouver so i'm also concerned if i might just be wasting time getting it transferred?

CanadaSocial Security Number

She wrote my Canadian Social Insurance number on that line. I don't know if she was supposed to do that or not.

So far it hasn't caused any problems.

ack!! i worked in niagara falls, ny with another guy that was a u.s. citizen living in ontario and he ran into problems with his SSN in ontario. he signed up for a cellphone and since he didn't have an SIN, they used his SSN instead and said it would be ok. then a couple months later he got a call from the canadian government accusing him of SI fraud. but my ex-husband was canadian and before i moved up here, he was on my beneficiary form at work in the u.s. they put his SIN, but specifically noted that it was a canadian SIN, so not as to confuse social security. i had no problems with that.

Canadastudying while waiting for work authorization
melyssa, here is a quick link from the montreal consulate website detailing the basics:
http://montreal.usco...cument=canadian
i can't remember where i read the in-depth stuff about studying. all i remember is that you must first apply to the school, get approved by them and i think at that time, they send paperwork to sevis to register you. then, sevis contacts you, gets an $100 registration fee and sends you documentation which you use to enter the u.s. your registration is valid for one year. it has to be full-time studies, though, and you must be able to prove you have all funds for one complete year of school.
but, i don't know if it would work any differently, since you are already in the u.s.
hope that link helps a bit! :)

Canadastudying while waiting for work authorization

I'm sorry...I was presuming the OP was meaning after receiving their K-1 and moving to the US...prior to working. That's how I read it anyway. We better wait until we get clarification!

Carla (F)

that is correct, carla. it'll give my fiancé something to do instead of sitting around the house for 6 or 7 months
i didn't know that he would be able to apply for an ssn before receiving work authorization, so that's good news. how did you do it? just take your visa down to the social security office?
thanks everybody for your input!! :D

Canadastudying while waiting for work authorization
hi all, i wanted to see if anyone knows if canadian citizens in the u.s. on k-1 visas are able to enrol in college classes. i've looked up the info regarding study permits and found out that canadians do not need one. they just need to apply to the school, be able to show that they have the funds required for one full year of full-time studies, and have a place to stay. it doesn't mention anything as to what the rules are if the canadian citizen is already present in the country on a valid visa. we won't have enough money right away to send my fiancé for full time studies, but i was hoping that he would be able to take 1 or 2 classes a week, or some online courses while waiting for his work authorization. otherwise, he'll probably be dying of boredom for 6 or 7 months. another option i was thinking about if this is not possible, is that maybe if the port of entry we use issues temporary work authorizations, that would make him eligible for part-time studies?? any ideas? thanks in advance! :)

wow, i'm really sorry, ron and sharon. i hope you are able to get it resolved quickly.

that really scares me now. can they really keep people out just because they did drugs or alcohol in the past?
what the hell kinda medicals are they doing?? what if a person experimented in their in younger days, but does nothing now but have 2 or 3 beers on the weekend? come on, man, alcohol isn't illegal! does anybody know where i can find rules pertaining to this or what exactly is done and/or looked for during the medical?

CanadaFor those of you in the Toronto area

Might not be available in her area as I lived in Canada all my life until just now and never heard of WINTEL.

they're a small company. they don't advertise much besides the occasional flyer in the weekly flyer delivery. i asked to get their new local line last year. they said they hadn't started providing service here yet (40 minutes from toronto), but they had just made it available in toronto.
h_bombFemaleCanada2007-07-30 20:47:00
CanadaFor those of you in the Toronto area
WINTEL all the way!!! bell sucks so bad! i've been dealing with them ever since i moved to canada and they've given me nothing but headaches, but out of the big monopoly companies, they were the cheapest. WINTEL is a little company, they don't advertise much except for flyers in the mail occasionally, but they have a website. i have their high speed internet and long distance package. i pay about $45 a month for everything. the high speed is $38 a month if you buy their modem (you get to keep it and there's no contract) and 42$ a month if you don't. the rest of my bill is long distance and taxes. every long distance call is 25 cents, FLAT RATE. THEY CHARGE PER CALL, NO PER MINUTE FEES! :D the only thing is that there's a long access number you dial first, it rings once or twice then you will get another dial tone. you then dial your long-distance number as if it were local. if you forget to dial the access number, you will still only be charged 50 cents per call. i got a bell local phone and i pay 35-47$/ month with one feature, and depending how many times i dial *69 that month. wintel is now doing local phones in some areas, and toronto is one of them. you can get the whole package-local phone with all features included, unlimited canada and u.s. long distance and high speed internet for $70. best of all i don't think they make you lock into contracts for anything and i've never had a single problem with them. highly recommended!!

Here's here!!!! He almost got arrested at the airport (Dorval), but he made it here. *rests head in hands*

Réjean had these spiked gauntlets that he tried to bring with him. He called TSA to inquire about them and checked the website to see if he was allowed to bring them on the plane, and he was given the go-ahead. When he got to the airport, though, security accused him of trying to bring a weapon onboard, threatened to arrest him, and ultimately ended in them confiscating them. Which is a shame since they cost him $400. They also broke the lock on his guitar case, but that's because Réjean forgot to unlock it before it was inspected. oops8rh.gif

Oddly enough, they didn't confiscate his bullet belt... blink.gif

ahh! that sucks! i had that happen to me the first time i came to canada. canada customs confiscated my 2 spiked bracelets and a collar. they said they were gonna send them to "the crown" to be destroyed. at least they were only worth about $50 and not $400 ohmy.gif but they were totally cool about it. they didn't try to charge me or anything.

i had a nexus before. i applied at niagara falls in 2003. i think it was in the summer. i didn't get my card in hand until 2004 and i believe that was in the spring. if i remember right, it took something like 7-10 months. i was working in niagara falls, ny and one of my co-workers was also living in ontario and commuting to work, so he applied as well. by the time i'd left the job to work in ontario he had been waiting 4 or 5 months already.

CanadaWhere to go for the immigrating to Canada
QUOTE (Jeremy + Kristy @ Oct 2 2007, 02:15 PM) <{POST_SNAPBACK}>
My fiancee and I are getting more and more worried that her ex-boyfriend won't sign a "consent to immigrate" form or vary the custody and access court order. If we are denied a K2 visa, then I'm going to have to move to Canada, but still work in the US. Is that possible?

If we don't get that form before our interview, will the visa be outright denied, or could it possibly be approved pending receipt of it? The consulate in Montreal has not ever mentioned that such a form is necessary, but many of you on here has said it is.

I'm more stressed today after going to speak with duty counsel with Kristy than before. Do we look for an immigration attorney now, or a family law one? In the States or in Canada?

helpsmilie.gif

it is possible to cross the border for work while living in canada. i did it for a year and a half, no problems, though, i would suggest getting a nexus right away, because it does take awhile and there are odd times when traffic's so bad you'll be late to work. there are 2 options in your case if you're looking into immigrating to canada. you can apply as a fiancé or as a spouse, if you are married. you can either apply while living outside or inside of canada. to apply from inside, all you have to do is go to the POE and tell them that you plan to apply to immigrate and they will issue you a temporary residence permit on the spot, which is usually valid from 6-12 months. it will take about a year and about $2,000 to become landed, but unlike US immigration it's just one step and you're an official permanent resident. let me know if you have any more questions. i'm an LPR here.

Canadaany USC's living in Canada with fiancé(é)?
no, i moved here back in 2003. i didn't have a passport until canada immigration made me get one for my permanent residency. then they stamped it when i became landed in 2004 and i haven't gotten a stamp since. they don't stamp it for me at the border and i've always driven, so no plane passes or itineraries. i've only been in the u.s. maybe 3 times in the past 3 years, too.

Do you have any proof of boarding passes, flight itineraries, bus tickets, passport stamps, etc. from the USC last crossing into Canada?

just wondering if there are any USC's living with their fiancé(é)s in canada and what you sent with your application to prove your relationship. we sent our townhouse lease dated last june, maybe 2 pictures, a couple recent bills and bank statements with both our names and address on it. we also sent a form from work dated january 2005 that lists me as my fiancé's beneficiary. now we are getting an RFE asking us to prove our relationship wacko.gif. they also want to know when our last meeting was, lol. on top of that, both of our last two residences match and we both work at the same job. does anyone know what more they may want? or did anyone not receive an RFE and if so, what evidence did you include? thanks in advance good.gif

Canadapolice certificate with fingerprints
thanks guys! also, wondering if anyone had any problems with the rcmp sending their check back? ours was sent back stating that we didn't need to pay for police checks based on canadian immigration or passports, though the officer at the station clearly checked off "us visa". don't know if this will cause a problem, but we called them just in case. we got a call back the next day from a lady saying that we had called the main switchboard and gave us the correct number to call. she said they were so far behind that it would take around 5 days to receive a call back. it's been 2 weeks and they still haven't called. maybe they're not calling because it's not important.

another idea: can a lawyer help you with your denial mess? i know lawyers are evil and all, but in this case, it might not be a bad idea. hell, i'm thinking of hiring my own once we have to do AOS. i see too many horror stories on here and everytime i've called USCIS, they've told me seriously inaccurate information. i kinda regretted hiring a lawyer, but now i'm kinda glad, because i don't think immigration will jerk me around now.

CanadaCanada to US, now US to Canada. Help?
there are 2 ways to immigrate to canada as a spouse: either from within the country, or outside of the country. i did it from within the country, so i'm not sure what the rules are since both of you are outside of canada. the total process costs about $2,000 CDN and from within canada, takes about a year. however, you only have to file one packet of papers and at the end, you get your interview and permanent residence card. no adjustment of status #######. you will not be able to work for about 7 months using this method, but i was able to cross into the US everyday for work. www.cic.gc.ca feel free to ask me any other questions. the website isn't that great.

When I had mine done, (I didn't need the fingerprints part, but thought everyone needed them, so I ended up sending it anyways,) they stated on their website that it takes upwards of 120 days to get the results back.
When they responded to my email inquiry, they responded calling me a "Mr." and even had my last name spelled wrong.

they screwed up on my fiancé's too. the dude at rcmp clearly checked the box for u.s. immigration, but after we sent it out, we got a notice in the mail saying they don't make you pay for canadian immigration or citzenship purposes. don't know how they screwed that up, considering he used his canadian passport for i.d. obviously, he's not applying for canadian citzenship. hope this doesn't screw things up. we called them to correct it, but they never called back--it's been almost 3 weeks. i'm guessing it will come back looking the same, no matter what it's for. at least, i hope so.

Canadarcmp criminal records check
the same thing happened to us!!! my fiancé watched the dude write down "u.s. visa", we sent it out with the check, then got the check back like 2 weeks later. there was a letter saying that they don't charge for police certificates for canadian immigration purposes. we called the number on the letter and he left them a message telling them that it was for a u.s. visa and that they had sent his check back. we got a call a day or 2 later from some lady, he explained what happened to her and she told him that he had called the main reception desk and gave him the better number to call. she told him that they are super busy and that's probably why they made the mistake and also, that they were taking about 5 days to return messages. so, he calls and nobody ever returned called back. so we just left it at that, thinking maybe they corrected it and decided not to bother with him returning the check to them. we just got the prints a couple days ago and now instead of saying "canadian immigration", they say "landed permanent resident status". i guess that's good enough for me, cause technically that's what he's on the way to with the K-1.

Canadato tell or not to tell ?
i don't know if anyone's mentioned this yet, but i think the period for financial liability in canada for a spousal sponsor is 10 years, regardless of whether they stay married or not. this means that, even after a divorce, if this man decides to go on welfare or social assistance at anytime in this 10-year period, the woman must pay it all back. i'm guessing she may not listen to reason, but maybe you can dissuade her from actually marrying the guy and instead, bringing him to canada on a fiancé visa. i am not 100% sure, but the period of liability for that sponsorship may be shorter.
