Hey, I just dropped in from the Europe Forum and wanted to say CONGRATULATIONS to all new preggos.

I am almost there and it really isn't fun anymore. Yesterday we were driving in the car for about 2,5 hours and my belly started contracting all the time. Luckily it went away as soon as I got out of the car but it's really uncomfortable. I didn't have any morning sickness and my whole pregnancy really was picture perfect. We're hoping for an easy delivery.

I needed two Passport Photos for the medical. They just clipped them on the papers and that was it. I also glued the passport pictures on the DS 156 and then didn't need them at the interview anymore. Take the photos with you to the interview anyway.

MIss_USA: I sent my pack 3 via certified mail with return request "Rueckschein". Although there were rumours that the consulate won't receive them...I felt better, having the little pink piece of paper in my hands though.

I don't think it really matters where your POE is. I mean you have the visa so they have to let you in (unless they find a reasonable explanation for not doing so). My POE war Charlotte, NC (final destination was Houston, TX) and after having trouble there with entering on a VW for five days I had no problem at all when I entered with my K1 several months later. don't worry. I think your experience there depends a lot on wheter the immi officer had a good coffee in the morning or not :lol: . You don't have to enter the US according to a certain pattern. IF your final destination is San Diego and you want to stop in...lets say....Atlanta, just go for it and do so. It really doesn't matter, a POE is a POE. Good luck and don't worry too much about it.

As long as the documents are in either the language of your country (Italian) or English, you do not have to get it translated. Now if you were going to the interview with a German Police Record then, yes, you have to have it translated since they need it in Italian or English

It is amazing that some of the legal offices in the military have no clue about the whole immigration issue. My husband (USMC) was told to just "screw the K1" and they told them to marry me in the US with me staying there illegaly for the rest of my life so he can get BAH etc. I don't believe it. Don't worry about the touch. I had my greencard approved in June (I know, you are still waiting on your K1 but the case is similar) and may last touch was on August 18th. I guess all they do is review your case and probably store it somewhere. No reason to worry.

Well, if everything goes well and you finally get your NOA 2 she should be able to have the baby in the US. If it takes too long, she might not be allowed to fly anymore. I don't know if your baby gets a visa right away but I don't think so since I have read about cases here where people applied for a K2 for their children.

You don't need to send anything to the CSC since in the first three months (I don't know how far along she is) anything could happen. She should just let the doctor at the medical know that she is pregnant so they don't do the X-Ray or give her some shots.

So they should change the requiremtens for the J1? That is bull. Most J1s are trainees or Aupairs and then they have to change the laws there too, since you cannot be married for that (at least not for Aupair). Not all J1s get married while they are in the US. Most of them return to their home country.

Why? Most of them are going back. There will always be people breaking the law and adjusting a status (rather than entering the US knowing they gonna get married without a visa and THEN adjust status) from a J1 is basically the same like a spontaneous marriage. He didn't know he'll meet that girl and in the end get married.

It should say that in your passport OR on the DS2019 in your passport (the white page that was stapled in your passport). If your training in the US is sponsored in part or fully by an agency or the US government or your government you will have to return to your home country and remain there for two years (I think you should be able to visit as a tourist though) OR you can file for a waiver (from your home country) which in the end probably takes two years, too.

EDIT: Seems like the problem is solved. Yep, you can get married and send in all the AOS papers after the marriage. All the best.

According to that link, you cannot adjust from J1 ONLY if you do fall under the 2year rule. Other than that, I don't see a problem with not doing it. I knew a bunch of aupairs who fell in love - or wanted to be in love - got married and adjusted their status. Later we even had a word for it (well, two). What they did was husband hunting cause they wanted to live in the US sooooo bad.

You could go ahead with the wedding and then only file for AOS from the USA. That would mean that you do not have to return to your home country prior to the wedding. However, make sure you are not under the 2year home requiremt rule.

I was also on a J1 visa and I put "None" in the box, not knowing that my SSN was actually still valid.

I actually did not send any copies of my J1 and the DS2019 with the initial I129F package but I got a letter from the consulate in Germany asking me to send copies of the visa and the DS and also they wanted to know what agency I was in the US with and who sponsored it (noone did, since I did an Aupair year, wihich I payed all by myself).

She don't need to enter any SSN at all. I had a SSN and didn't enter it in the paperwork cause I didn't know it was valid. She can go to the Office as soon as she is with you and bring the paperwork in so the people there can look for the number.

Well, I was at VSC myself and we got approved within 12 days (ohhh, sorry for backstabbing you :D )

Did you try to check your case online with your receipt number at www.uscis.gov? I don't think there is anything more you can do but wait and check your status online or on the phone. Sorry about that. I'm sure it's the holidays that back everything up.

See where it says Edition Date? 5/23/06. Versions other than the 5/23/06 edition are not acceptable. This is the ONLY form right now that you can use until they update it again. You can go ahead and start filling everything out.

You can find the the date (23/5/2006) at the bottom on every page. You'll be fine.

I guess you are the petitioner??? If so then all that is needed now is your birth certificate. Your fiance will have to show his birth certificate at the interview later in the process


Also, I find the Filing guidelines here so helpful but can anyone tell me why I cannot find similar guidelines at the USCIC website? How come they don't have anything there to tell you exactly what to include with your petition? There is more information here than there?

Actually they do have something like that and it's called "Instructions" but there is alot of information on them so it is easier to just check here what you need but also read the instructions and double check if you have everything

I agree with Misa. Get married in Germany and go the K3 route OR you can wait until he is back in the States and he can send in the petition for the I129F from there. Either way, you will have to wait in order to get your visa. However, you cannot enter the US, get married and stay, that is illegal just as getting married, not applying for a K3 and then entering the US to adjust status. Don't rely on the people from the mis-information line, they usually know less about visa and immigration as we do here (actually I think that some people here are VERY helpful due to the experience they've made).
