Sorry to contradict, but when I read the site, it seemed that it only mentioned original "applicant" info, which is the UKC. I asked someone who's been thru the interview already, and they said that original docs (birth cert/divorce decrees) are not needed from the USC. http://www.visajourn...p;#entry3154035

Our petition was 75 pages. I used the Acco fastener, or you can use a big clip to keep it together. I stuffed it in a UPS 2-day letter envelope (the rigid kind) and sent it off. It was $12 and I could track it the entire way, and get a signature, which you'll be glad you did.

I didn't have to pay extra for the signature with UPS. I believe that's only with USPS.

It takes about a week to get to the NVC, so you will likely hear something about status if you call after that. Make sure you speak to a person. K1's are not updated on the automated status option.

Generally speaking: £190 for the medical (due when attending the medical), $131 for the visa (due at the interview), £14 for the courier fee to deliver the visa (due at the interview).

A US Citizen cannot file a 129F until they are free to marry. In my state, after a divorce, a person has to wait 6 months to be "free to marry". State rules vary.



Minnesota doesn't have any waiting period for remarriage after divorce, according to what I'm reading, so the 129F could be filed immediately.

Make sure you have your LND case number from the NVC.

Call DOS and ask them if packet 3 has been generated yet. The embassy will sometimes print everything up and then it'll sit in a pile until they feel like mailing it. As long as it's been generated you can send in the forms.

unless you are 125% over the poverty line then there really is no point of filing for the k-1 because you wont even be able to fill out your I-134 form.


Look hard for a co-sponsor. The thing they are trying to prevent is adding someone to the population who is going to need to draw on public funds. Financial support is a requirement, whether it's through your income alone, or through combined income with your co-sponsor.

Good luck with your job search! They say the economy is getting better. Hopefully "they" know what they are talking about.

I am almost positive that you need to get the visa within this time frame. If you don't, this approved petition will expire, and you will need to refile. I hope this helps.


They would not need to refile. Most embassies automatically extend the date if the petition's been active. To be safe, they could send a letter requesting an extension. I believe there is a sample form in the example forms area.

I think normally everything (all going right) is complete by the time the NOA2 expires.

You need an EAD for him to work. Normally, these take 2 to 3 months. Also, if your SO has an international license, my understanding is that they can drive right away. Check with your state's department of motor vehicles to see what is required to get a driver's license. Nebraska requires an unexpired landing card (i-94), a passport and 2 proofs of address, such as mail that's arrived in his name or a magazine subscription.

Absolutely not! It can take about a week to 10 days, to get from VSC to NVC. I would call back and talk to someone else. I wouldn't think it would be longer than the end of this week.

Take your pile of papers and proof of relationship, run it through the photocopier, send the original, and keep the copy. The copy is in case they lose the original. You don't want to have to compile all that paperwork again. smile.gif

I also see other people talk about the NAO1 NAO2 etc, what are these and should I have 1, as the only thing we have ever got from the lawyer is a email saying the USCIS have received it and dont expect to hear from us till Jan 2010 sad.gif

My fiance is British. We filed our K1 on April 1 and we are just finishing up. You'll see our timeline below.

You may want to search for the August K1 filer thread, if you haven't already. They sort the threads by whether you've filed with VSC (Vermont) or CSC (California). You can mingle with other August filers and see how their status is moving along at this phase.

Once VSC or CSC has approved your petition (NOA2), then come on over to the UK portal to follow along with the rest of it.

Keep in mind you can still travel to the US while your K1 is in process. You just have to bring proof that you have reason to return to the UK (job, return ticket, etc).

In short, he MUST leave the UK by Nov 30, 2009. Our concern is regarding his pending K-1 visa: What will happen to his "currently under AP" K-1 visa at the US Embassy in London when he leaves the UK? Of course my fiance has to ask for his passport back from the embassy within the next week so that he can leave the UK on time. But how will his K-1 visa processing continue? We have been told my a few VJ members and as well as DOS reps that he can get his case transferred from the US Embassy in London to the embassy in Islamabad, Pakistan. But this as we have also heard, depends on the receiving embassy, whether or not they are willing to accept a pending K-1 from London. So we are very confused about what will happen to my fiance's K-1 visa once he leaves the UK permanently by Nov 30, 2009.

Anyone have any guidance, answers to our questions, suggestions/comments?

Any help will be much appreciated!


I would hope DOS would have the answer to this. If you haven't had a satisfactory answer from DOS, yet, is there a supervisor you can speak to? I would hope someone higher up would know whether Pakistan's embassy has the ability to refuse the application or not. Has London offered to send off the packet to Pakistan? Of course, it would be ideal if they would... you know... APPROVE IT... before you run out of time. Have you been able to get to anyone higher up in the London embassy?

In Sept/Oct, ours was about 2 weeks from the time they entered our info in the system. Stay in touch with DOS. They can give you status about anything at this point over the phone.

Are you sure you signed all of the pages that require a signature? Maybe use a blue ink pen to show them that everything you've signed is an original signature.

Make sure you've signed the 129F and all 4 copies of the 325A, your letter of intent, etc.

You can get married in any state. Bear in mind that some states have residency requirements. Illinois does not, but non-residents will only be issued a marriage license if the marriage would be legal in their state of residence. I think this point is mute since he will be living in IL if they are married there, but I think this is mostly trying to fend off people who live in states with requirements such as not getting married within 6 months of a divorce in their home state (like Nebraska does, for example).

I think in any relationship where both people inhabit the same country, it would be quite normal to live together and determine if marriage is the right thing to do. When a norm makes sense to you and provides you with a comfort level, then it is tough to bypass the norm.

Using the VWP to spend more time together, I think, is an excellent idea. Maybe a leave from work would help facilitate more time together.

There is a risk in any relationship. Hurdles are not necessarily a bad thing. People learn and grow closer by overcoming them.

So this feels like the end but hope is a good thing (as Shawshank would say). I am giving her time.

so what to do.

I have more or less everything i need for the interview but dont have the heart to do it. I dont want to stop the process because if she changes her mind i cant go through this again. Its 8 months of real heartache.

I want to cancel the meeting and go to the bottom of the queue, maybe 2 - 3 months later , where we can see where we are.

Is this the best idea. How do i do it? I see no numbers and they say in writing? People must get ill an not make these interviews. What happens?

Some leaglities...

She can stop the process by withdrawing the petition with a letter to the consulate. Maybe she did, maybe she didn't

If you go there and state that you intend to marry this person within 90 days, when she has called it off, it is visa fraud.

Were I you, I would do one of two things...

disconnect the phone, Thank You, goodbye and book a plane ticket to a target rich atmosphere to forget about it

OR

Send her an email, tell her you ARE GOING to the interview and then will be coming to the US to marry her and if she wants to say no, she will tell you to your face. No wussy, wimpy email breakups for a guy who agreed to move across continents for her...you deserve a face to face. Then turn of your email and the next she sees you you are on her doorstep. This way, at least it isn't visa fruad if you tell her you are going to do it and she doesn't put a stop to it.

Either way...YOU grab the knobs and turn. Whatever you do, don't quit your day job. Once you enter the US on a K-1...well if you marry her, who needs the job in England? If you don't, you don't need to worry about protectng status so you can go home.


This is pressure on her and that what worries her. I need to see her without the marriage bit. What i want to do is...

Postpone it and hopefully hear nothing until the new year when i get an interview date in February

Travel over there in the next two to three weeks for a week and see how we get on. Meet her kids again and see how we get on in normal life. There has never been any argument she is just worried what happens if i come over and marry and it goes wrong. This way i cant stay. But the process doesn't go back to zero either. Yes, i do know i could be turned away at the border.

This way i get my face-to-face, with no pressure on her, with a chance to resurrect the process if she agrees

If that doesnt work i have done everything i can and i am going to go somewhere hot to forget it all for a while :0)


I think you have a good plan. If she's fearful of marriage, then perhaps she'll feel better discussing it with you face-to-face.

I can't see going to the interview under the circumstances, really.

Both parties must be "free to marry" at the time the petition is filed. Have your fiance(e) pose this question to his/her divorce attorney. There are too many legal aspects we do no tknow about to give an answer here


I live in a state where there is a 6 month requirement also. I phoned USCIS before we filed our petition and they said we could not file until I was legally free to marry.

BTW, my attorney sent a letter after my divorce was finalized saying, "You cannot legally marry anywhere in the world until the 6 month wait has expired."

I would think the six month validity of the visa itself combined with the 90 days after entry would be sufficient for your needs. If so, I wouldn't delay the interview. If the visa is in hand, more than 90 days before the planned wedding but less than 9 months before the planned wedding, simply delay US entry until less than 90 days before the wedding date.


The 4 month validity is for the 129F petition itself. This is shown on your NOA2. During this 4 months, it's anticipated that you'll go through the entire remainder of the process and have your visa in hand. Once you get the visa, like the others have said, the visa itself is usable for travel within the next 6 months, and you have to get married within 90 days of entry.

If I were in your shoes, I would:
1. Keep checking the DX site and plugging in your courier tracking number. The day before your visa is delivered, it will show up as a valid tracking number and tell you what day it's going to be delivered (which will be the next day, of course).
2. Hang in there until Dec 8. If your tracking number is still not valid, then call the airline and tell them you need to reschedule. Usually, they will do this for a fee (the last one I used was $250), which is better than losing your whole ticket price.

The embassy staff tells people 3-5 days. This doesn't account for broken printers (has happened before) and other unforeseen circumstances which might delay your visa.

I agree that you may be OK. I'll be hoping everything slides thru in time for you! smile.gif

• Evidence of a fiancé relationship (Proof of on going relationship)
• Payment of fees (What other fees is required!)

What I've noticed is that AP @ the embassy tends to happen sometimes to foreign students living in the UK. I think sometimes it's random, as well.

We went through AP at the NVC level. We think it was an FBI namecheck, since my fiance has a common name and when we Googled his name, there was someone else with that name who had had a criminal history.

Sometimes, I think it may be completely random.
