The US Consulate General Frankfurt is NOT the USCIS Frankfurt!!! That is important!

The USCIS is a subdivision of the Department of Homeland Security. It is just located in the Consulate Frankfurt. The Consulate is a diplomatic mission of the Department of State.

If you follow this link: http://germany.usemb..._documents.html you will find the "checklist". As I mentioned in the post above: the Consulate (Visa Section) takes documents in English and German.

My specific question is about the USCIS. The website of the consulate (!) nor the website of the USCIS is saying anything about non-English documents in reference to the USCIS. All information is regarding the consulate itself.

Jodee, it would be interesting to know for what your friend needed translations. For the USCIS (I-130!) or the Consulate (DS-230!). Or both (which is unlikely based on the above mentioned link!).

Hi all,

maybe you've read my thread in the DCF board. I have a little problem regarding my I-130. Our appointment is on the 26th and I am not sure if I need translated documents or not (for the USCIS).

What I am sure about is the acceptance of German and English documents for the Visa Unit of the US Consulate General. They accept documents in both languages. But what about the USCIS Frankfurt?

I am aware that the instructions for the I-130 are stating that a translation is needed, but the I-130 was originally made for filing inside the US.

What is your experience???

My "problematic" documents are...

- German birth certificate ("Geburtsurkunde")

- German confirmation of marriage registration from the City ("Bestätigung der Eintragung der Ehe")

- German letter from the City registrar's office, stating the joint address of my wife and me

The three above mentioned documents are official documents from a German authority. They don't provide them in English and I am not sure if I am allowed to translate them on my own?! (one exception: the birth certificate can also be issued as an international birth certificate)

- Affidavits of Personal Relationship ("Eidesstattliche Erklärungen")

The affidavits are filed by friends and relatives. Some affidavits are in English, some are in German. What should I do about these?

I hope somebody can help me! Can I hand in German Documents? Time is running up...

Well... first of all, she divorced me, not the other way around. I never felt that the marriage was failing. Having said that, things are what they are.

I would not mind an interview at all, I don't have anything to hide. Nevertheless, by submitting photos and copies of travel documents (booking confirmations, etc) I believe I would support the good faith claim.

My Ex-Wife is most likely also willing to sign an affidavit, plus I could get additional ones from friends. That seems to be supportive as well (at least to me).

I still believe the biggest asset is the fact that she filed for divorce. Not me!

What do you think?

Hi there!

My divorce is currently being finalized. It was either already signed and I have not received a copy of the decree yet, or it will be signed in the next couple days (my lawyer is checking on the status).

Couple background information: she divorced me, I didn't want it. Anyway... things happen, and I am over it.

Having said that, I would have to file in December for lifting of conditions anyway, so I guess now I gotta do it sooner. But my actual problem is the following:

I have to go on a business trip at the end of November. Even if I file I-751 in the next couple days I am not expecting to receive the extention letter in time. I am concerned, because I read online that at the day when my divorce becomes final my permanent resident status is terminated. So technically I would not be able to work and travel anymore, which is a problem!

My GC expires on 02/23/10, and I originally thought "I am good to go" until that date.

What is correct? Am I screwed? Will immigration know if I travel in November and want to get back in the country? Or is my GC valid till the date on the card anyway?

I mean I simply have no chance to file any earlier and receive the extension letter, and travel is required for me. I hope you guys can share some information and give some helpful hints!

I got divorced in October and it is now time for me to start the process for the removal of conditions. My ex-spouse agreed to actually support the petition by providing a affidavit. Below you will find the actual wording and I would like to receive some feedback. Is the below stated sufficient? Is it supportive? Will USCIS "like" it?

Before me, the undersigned notary public, in and for said County and State, personally appeared [FORMER SPOUSE], who is known to me and who, after being first duly sworn, does depose and say the follows:

My name is [FORMER SPOUSE], and this affidavit is intended as a support document of the Petition to Remove the Conditions of Residence of [PETITIONER]. I am fully aware that I might have to testify before an officer of the United States Citizenship and Immigration Service in regards to the aforementioned petition and or in regards to this affidavit.

I was married to [PETITIONER] until the 7th of October 2009. The marriage was dissolved through divorce which I filed for in June 2009. What about a letter of employment?! I mean it does not really have to do with my status here, but should I submit one as well?

And should I really write an affidavit also? That seems kind of weird. What weight does my affidavit has? They could assume that I would say whatever it takes of course, so does it really makes sense?

I am getting kind of nervous...

I send of my stuff on the 17th with USPS priority mail. It should technically take the package two days from AL to VT based on the times I got from USPS.com... okay, now there was a weekend in between, however, USPS.com still shows:

We have now the 22nd... I seriously hope this is only a mistake in the online tracking. I hope they did not loose it!!!!

This is just the location where the entry was entered. Meaning that it is being return to the sender FROM St. Albans, VT. Given that it started to travel back to me on December 22 I hope to have it on Saturday the 26th. Tomorrow the USPS is closed for Christmas, but on the 26th they work on schedule.

Well... I used a flatrate envelope. The weight doesn't matter. You all probably know the commercials "if it fits it ships" on TV... so, postage is $4.95. The USPS clerk put a $4.95 stamp on it...

I talked to the Postmaster in Vermont. It is back on the way to me, left their facility at 2:30 pm yesterday. Reason: not enough postage.

WHICH IS BS!!!! It is a flatrate letter envelope for $4,95, plus $0.70 for delivery confirmation. I went to a postal office in person and they gave me the exact stamp!!!


So... let us hope it will come back to me. And if it does: I will put ###### $50 in stamps on it... and they better deliver it. Freaking ideots.

I triple checked the address. I even printed the label twice, one for the package, one for my records. Just compared it to the address stated in http://www.uscis.gov.../i-751instr.pdf

You should, but unfortunately the DMV employs many people with very small brain capacity, similar to those of monkeys. They function pretty much like drones, so when they encounter a document they haven't seen before, they shake their heads.

What that means to you is that you have to know what might happen once you hand over the expired GC and the NOA1. Be prepared for a DMV employee to look at you like a fish trying to look through a bubble, and telling you what you have is not sufficient. You need to be prepared and have your response ready; ask to speak to the head of the Department as those guys usually are a notch smarter and understand sentences like "extended one year."

No NOA1 but the ASC Appointment Notice for Bio. So great... now I have something in my hands, but still nothing that will satisfy my Employer.

Hmpf.

Btw, Bio letter is dated 01/14/2010, the Bio Appointment itself is on 02/01/2010

I hope I am not missing my Bio because I have not received anything yet. My assumption is that if I miss the Bio the application gets rejected right away?!

USCIS told me that VSC needs currently around 30 days to issue NOAs, but my concern is that this is their standard answer anyway.

I understand that they sometimes need a little longer. What makes me crazy is the evidence that speaks against this.

If I look in the December 2009 filer thread and I see people who send their paperwork on or around the same time as the USCIS received mine, nearly all of them already have a NOA date and a lot also a Bio date.

It just makes me crazy and so worried that apparently so many have their response already, but me. Because the feeling I got from reading all the threads is that the NOA is send out fair quickly after they received the paperwork and the check is cashed. Based on the December filer thread the NOA usually has the application date + 2 to 4 days as a date of printing.

A lot of my co-workers here went to New Orleans for their Bio and to Atlanta for their Interview (for E-2 Visa Extensions or N-400). I am the only one running through the ROC here.

Quick question though... me and my co-worker tried to decypher the case number on the check... is it usually build up the following way?

A = Stand for a Letter, 0 = Stands for a Number

AAA0000000000AAAAAA0 ?!

In my specific case I believe that I can read

EAC??09600614VTS???8

The "?" are the missing pieces. Dies this make sense somehow???

Hi all,

After the USPS screwed up and I sent the package again, USCIS received it on 12/31. They cashed the check 01/06. But still no NOA. I feel like a child on Christmas Eve. Every evening I go to my mail box, hoping to find a NOA, but last Thursday... nothing. Last Friday... nothing. And to my surprise, last Saturday... nothing either!

How do they send it? By mule? Can't take that long from VT to AL?!

Am I simply doomed? Unlucky? Punished by nature? Everybody else who submitted their stuff around the same time got their NOA already.

I moved a week ago within Alabama. I put in a mail forward request with USPS, did the AR11 online, submitted an AR11 by paper and also called them to change the address on the pending application.

Given the slowness of VSC I am not counting on getting a new GC anytime soon.

Let me find out if a "then stamped passport" in addition to my expired GC would provide proof to the Germans to get a new passport....

Hey guys,

Still no sign of my NOA1, but I just noticed that my German passport is about to expire in a little less than one year. In order to get a new one I need to go to Atlanta. The process of actually getting it will probably take a couple of weeks. So how should I go about it?

My Bio Appointment is next Monday. My idea was to get a I-551 stamp if the NOA1 does not arrive by then. But I would assume that USCIS would have a problem with putting a 1 year extension in a less than 1 year valid passport?!

In addition, the German consulate wants to know for how long my "visa / alien resident card / whatever type of permit I got to be in the US" is valid for. If I apply now, I have to state 02/23/10, cause I do not have an extension yet....

So here are the scenarios:

1.) I go to USCIS next Monday, get a stamp. They will have an issue with passport expiring in less than a year...

2.) I do not get the stamp on Monday, but go to the German consulate instead. Get the new passport ordered. I don't know if they take the current - still valid - passport away while you wait for the new one or if they give it back to you (maybe some other Germans know?!). Either way... I will get a new passport, but still have no proof that I am allowed to be in the US for my employer. In addition, the Germans will have a problem with the fact that my Greencard expires in like a month. Which I cannot proof, because I don"t have a NOA1 (the stamp would come in handy here).

In addition to all of this: I need something for my employer by 02/23!

The biggest bummer would be: if I get the stamp, go to the German consulate, they get the new passport ordered, but take my old one away. So I would be here, no passport, no proof of me being legal, no nothing.

Anyone with a good idea?!

I was in the same situation.

Make an Infopass appointment. Bring your Greencard, Passport and Drivers License. Bring whatever proof you have that you filed for removal of conditions (cancelled check, proof from USPS that the package was delivered, etc).

You might get lucky and will even receive the Biometric Appointment letter before you have the infopass appointment. Than you actually know the real case number (because the case number on your cancelled check is only for reference, it is not the actual case number). Nevertheless, they should be able to find you under your A# which is on your greencard.

Explain to them your situation. They will put a I-551 stamp in your passport, usually valid for 1 year. So that will cover you.
