Thanks for the quick response! Where do I file the I-131 Reentry permit? so are you saying that if you stay longer than 6 months then you have to file the I-131 Reentry permit? But if you are back before the 6 Months you dont need to file? Also I spoke with a lady from Immigration today and she never mentioned anything about this? She said that you can stay out of the country for just under 1 year as long as passport and GC are valid that would not be a problem?

Yes she can still file jointly, in fact you need to file jointly, to waive the joint filing requirement you need to be divorced.

Filing if the Couple is Separated

More troublesome is if the couple is still married, but separated or otherwise not getting along. With limited exception, as long as the couple is legally married, it is necessary to have a joint petition. Thus, troubled marriages often need either to be reconciled or terminated in order to file the I-751. As explained below, the I-751 can be filed by divorced individuals, and may be approved, as long as there is sufficient evidence that the marriage was genuine when initially entered into. It is more difficult to satisfy the USCIS in such scenarios, however.

Joint-Filing Waived in Limited Cases

There are two situations in which a person who is still legally married can file the I-751 without the spouse. The first is if the person entered into a marriage in good faith, but has been battered or subjected to extreme cruelty by the petitioning spouse. The second is if termination of permanent resident status and removal from the U.S. would result in extreme hardship to the foreign national. Extreme hardship is a high standard and can be based only upon conditions that arose after the conditional residency was acquired.

Hello Rob,

I am sorry to hear of your break up! I am in an very similar position to you. My wife and I split after 14 Months together which was very sad, but the great news is we are trying to work things out but it is going to be a long process and we have no plans of moving back in together any time soon, we are going to try just dating and doing what we wished we could of done in the beggining. I was wondering in anybody elses opinions if you can see a problem when it comes to removing conditions next year? I hope we are going to stay married and eventually be back together full time.

Hello VJ's

Recently my wife and I got back together after a tempory separation kicking.gif When we separated we moved out of our old residence and we went our separate ways... She started renting a new place which I have recently moved back in too. My wife was hit with a large deposit when she moved in to her new place and we can not afford to pay out any more money so we don't want to get my name on the tenenancy as we feel they are going to want more money due to my credit. My question is! Will it affect or harm our case when I come up to lifting conditions next year? We still have allot of other things that show we are living together and remained committed to our marriage, such as, Joint Bank Acc, Joint Car Insurance, Joint Medical plans, I am going to be added to the Utilities. Will this be enough evidence? Any help would be greatly appreciated.

Does this question apply since you have been living in the USA? I know it says or abroad! I have not had any incidents since I have been in the USA or anywhere else. I was arrested in the past for a couple of things, but, I already submitted all the evidence such as police record e.t.c, I don't need to submit all that evidence again do I?

Hello,

I went for my Biometrics appointment on the 16th of this Month, I got home from work on Friday and my wife shown my yet another appointment letter asking me to attend another Biometrics appoint for 5/31 which is next saturday. Does anyone know what is going on? Is this just an oversight on CSC part, why are they sending me to Biometrics appointments? I guess I am going to have to call and find out what they are up too, I thought it was too good to be true for things just to run smoothly for a change. Does anyone have a number that I can call where I can actually speak to a person, rarther than a automated system.

OMG!!!! OMG!!!! I was opening what i assumsped were a bunch of bills and rite at the very back, I was like #### WHAT NOW!!!! I proceded to open the letter anyway already deciding I hate the INS and out pocks my green card laughing.gif laughing.gif SO guys I am now a permanent 10 yr green card holder tongue_ss.gif
