Two months and a half later we received an approval notice. Try to look around various sites and check how fast are they (NBC) in processing the applications. Philippines	CSPA age-out protection	Since you are under IR2 then yes you are covered by CSPA. Your age freezes as soon as the petition has been filed. In your case you were still under 21 when it was filed. Good that its under IIR2. Had it been under F2A youre no longer qualfied.   Im curious though. Whats the latest status of your case? Philippines	Appointment letter requirements not correct	Is it ok to make the appointment online? I have been calling US Embassy Manila and its so difficult to get in. My son's case had been expedited by NVC as well and is now in Manila. The guy at NVC said that I should follow up (calling USEM) to have an interview sked or wait for the  appointment letter by email. Philippines	interview next month	My son's interview three days ago was from 6:30AM - 12NN. I guess it depends or its case to case basis. Ive read some experiences finishing by 2-3PM. I would suggest an overnight stay in Manila to avoid any inconvenience to you should there be any unforeseen circumstances pertinent to your travel e.g. delay issue. If not, write a letter asking for an issuance of a certification of your bank deposit indicating when it was open and the current balance. Correction: Divorce is not recognized in the Philippines unless you file a petition for judicial recognition of foreign judgement in the Philippines. Note that if the Filipino citizen is the petitioner of the divorce, or if the divorce is uncontested, it will never be legally recognized. If the Filipino citizen agrees to an uncontested divorce, it would never be recognized in the Philippines. The Filipino citizen would then be trapped in limbo...forever. Furthermore,  the American citizen and the second spouse may be liable for bigamy in the Philippines, as the original marriage would still continue to exist according to Philippine law. The best route for all parties involved is a legal divorce with a petitioner (US citizen) and respondent (Filipino citizen). The divorce would then be recognized in both countries (after a somewhat costly judicial recognition on the Philippine side) and all parties would be free to marry, anywhere. The only option would be divorcing his first wife and petitioning your sister via K1 visa or fiance visa (the kids would be K3 or K4 i think or derivatives), then they can marry in the US. IR-1 / CR-1 Spouse Visa Process & Procedures	NOW THIS IS VERY CONFUSING	Sorry, I didnt read much of the comments or post before me but I can relate to your situation and would give you a positive statements. I overstayed my visa for five years, divorced my wife in june 2012, married my US Citizen wife August 2012, processed my papers (Adjustment of Status or AOS - dont get confused with the other AOS) December 2012, and was interviewed (us both) on April 2013 (approved on the spot and got my greencard a week after.) Just file I-485 (which is approved or processed faster) and I-130. Just ready all your docs, proofs, and all relevant papers you can use to prove that your marriage is legit. Mine is legit and we showed them bunch of proofs. The interviewer would ask questions from those docs or proofs, and even silly questions that would put you on awkward position. I called yesterday and the embassy lady said they havent received the physical file yet   It will take a week maybe. My sons case became ready on Jan 9 then again on Jan 17 ( i guess this means USEM have the docs already). Sked an interview now since it will be a month from now and it wont take that long for the docs not to arrive at USEM.
