In Portugal it's easy to order copies of birth certificates, and it's a pretty normal looking printed paper with just a stamp at the bottom. You can order several copies at low cost. Why would he take just a xerox copy instead of an original? Maybe things work different in his country, I guess... smile.gif

Is it enough to show money in the bank? My fiancee doesn't have a lot of income history, but she has money.

Typical K-1 request, my case got approved, I got the envelope from the embassy, with all the forms needed.
There is an I-134 included.
My fiancee is waiting in the US, we're both young (but technically adults) and we met when I was studying in the US.

- I thought the "Affidavit of Support" could be filed by me or one of my parents - but the form demands a US citizen (?).

- Can't I just show money in the bank? Me or my fiancee both don't have a stable work history (ironically, because of traveling to see each other and complications to wait for the K1). Do I really need to hit bottom and find an american "daddy" to give bank statements to prove that I can marry my fiancee and stay in the US? I thought I had already lowered my dignity quite enough for this government.

It doesn't make sense that the "sponsor" has to be american. When I went to study, I had to pay around $50k of tuition for a regular community college, and now they ask for proof that I will not be a "burden"? This is straight out of a monty python sketch smile.gif

I'm having the embassy doctor's appointment in 3 days, and I got sick recently (I might need an antibiotic because I'm having really bad sore throat).

Considering that I'm doing blood tests, is there any danger in taking an antibiotic (or other cold medication) before the extraction?

I remember the office telling me that I didn't need to take any special measures (i.e. not eating 8 hours before the blood extraction) - so I'm hopeful. Does anyone have knowledge or persona experience on this?

I gave my fiance the I-134 one from me and one from our co sponser and i gave all my pay stubs from this year and my 2006 2007 and 2008 W2 forms . My co sponser only gave her 2008 W2 form.. is this sufficiant enough or is there anything else we should include??

In your hypothetical scenario you would not pass the interview / get the visa and thus would have to wait until you did supply the requested info for the CO to examine the requested document(s). Why not do what's needed to secure the visa approval on interview day?

The OP is tying up the loose ends so that they get the visa on interview day.

Get the letter notarized as mentioned before. Simply done.

The I-134 is a short term form that will be in force until AOS when you (USC) supply the I-864 Affidavit of Support which is a binding contract that requires more complete documentation. Providing more than a W-2 for the other sponsor is advisable. (see the I-134 instructions for Supporting Evidence) Does your tax return show that you made enough to meet the earnings minimum? If so then you will be the sponsor selected (the sponsors are not blended, it's either one or another).

Remember that for the AOS the I-864 sponsor's income must be 125% of the poverty guidelines.

In MY situation, they didn't ask me for no notarized letter from my fiancee, just the documentation we all know, and "any evidence of ongoing relationship" which I believe some photos and our college cards are enough to prove (and if they're not, they failed to provide me with a complete list of things).

This is a forum for mutual help and I was doing my part by saying what I believe, and trying to comfort the OP.

If you wanna start bashing, 2 can play that game. If I didn't pass the interview, don't make it sound like it would be MY fault - I have everything that was asked of me, ready to bring to them.

Well, yes, Portugal is part of the Visa Waiver Program. But according to the USCIS, it doesn't matter - right?

I'm waiting for a K1 to pass - so I really don't believe they'll just let me travel to the country with a simple green slip for 90 days! smile.gif

I've been denied entry on the plane for dumber reasons before - like not having a return ticket! So I really don't see them caring about a guy who goes to see his fiancee while he waits for the visa, without proper clearance. I have to try and get the B2 first, I dont want trouble.

Am I making this too complicated? I mean think about it - a tourist can get married in the country without them checking anything. That would take the whole point out of waiting for a K1 with complicated background checks and possibility of denial..

We could have gotten married before I left the US, when I was in F1 status. We chose to wait to meet my parents first. Now we're half world apart for undetermined amount of time and without knowing if it's going to work out. Great way to compensate those who trust the system and do things by the book... good.gif

I'm Portuguese, and I met my girlfriend when I was in Cali studying (ex-F1).
We became engaged, we came to Europe meet my parents, and when she went back she filed for our K1 petition for me to go back to be with her and get married.
I love her a lot and we've been separated now for 2 months - waiting for the K1.

Initially we were told it would take about 3 months maximum, but later USCIS said it could take 8 months or more.
The processing times are erratic ( https://egov.uscis.g...eviceCenter=CSC ) and go back and forth.
As you know, it's a very hard situation for us to be separated without knowing when we'll be together.

Q:
Who should I trust about the processing times?
Is it really going to take that long to review a simple application and do a background check?

Q:
We're going insane and we miss each other! Last resort, she'll be coming here in christmas, but she has work and classes (and I was stripped of that here after spending time there studying).
Could I go there visit her in California as well, while we wait for the K1 petition? She was told I needed a B1 visa, but isn't that for business?

I can understand why malishka36 probably asked this.

I've been contacted by my attorney to tell me about canceling the K1 process by just trying to get married and then filing for an I-130 directly. The process ends up (theoretically) being a lot faster, with less hassles (and you'll get a green card directly, without having to wait months for approval at the embassy, temporary visa, work permits, interviews, visa, and then temporary green card).

Unfortunately, probably very few of us in this forum knew about that, but now it's too late to start all over!

I learned recently that the K1 Fiancee visa process is a long road that has many alternative legal shortcuts. But we all got caught in it, because the system is broken and nobody really cares about us.

Why would you need all that? All I'm bringing besides the documentation requested is 3 pages with printed photos of us while traveling, and kissing and having fun (and a photo of the engagement ring), since we met. It's the only thing that I can imagine that could serve to them as "evidence" of ongoing relationship.

I don't know, but I have a gut feeling just copies will be enough, because they ask for that "evidence" as a formality - it's impossible to actually prove that you have been together for the past couple of years. You love her and she loves you, and you have the documentation right? What else could they want?

I'm having my interview soon and I didn't worry as deeply as you with originals of receipt to engagement ring... :/ I worry more about all the documentation being in order. My embassy papers didn't really stress the importance of that kind of extra stuff...

Ali e Jeff - I received word in the same way as FreeAgent - text message, followed by a mad scramble over to a web browser to see if this meant approval, followed by fist pumps and "woohoos" after seeing the good news.

Hi all, added our info to the August filers list below (MURDOCK) - hopefully I got the formatting right.

Question - should I be concerned we haven't received our Biometrics letter yet? It's been 30 days since we mailed our application, but not yet 30 days since the NOA1 date (so I get the stonewall from USCIS customer service). I'm starting to get nervous we may miss our scheduled date if it got lost in the mail, or that it will come with not enough notice to ensure we'll be able to make it. Many thanks!
