I feel your frustration!! I got transferred from TSC to an unknown "USCIS Office" on 11/10. From what you are saying, I guess my case was transferred to Las Vegas for adjudication. My last touch was on 11/24. I certainly hope the 160 days is from the ORIGINAL receipt notice from CSC, and not from when it was transferred!!! At any rate, I am well within the "original" 5 month time frame, but not knowing what is going on makes the waiting just that much harder for me. Oh well, I suppose we have no choice except to WAIT until USCIS makes some kind of decision (either approved, RFE or interview at the local office). Still trying to keep a positive attitude, but it is getting much harder to maintain any optimism.

My 15 business day wait for NVC to assign a case number was up yesterday, so I sent an e-mail to nvcresearch@state.gov (along with an attachment of my approved I-797C). I received a reply from NVC today stating that THEY (NVC) would contact USCIS on my behalf in an effort to find the petition. I certainly hope this gets some results. I am also a I-130 July filer whose case was transferred from CSC to TSC, and then to a "USCIS office". My approval actually came from TSC (mesquite, Texas) although the CIS receipt number remained WAC. When I called NCSC they told me that my case had definitely been forwarded to NVC, but NVC says they have no record of receiving it. Hopefully it will turn up after the first of the year. Hear's hoping those of you still waiting on your NOA2 will get approved by the end of the year!!!! My wife in the Philippines keeps telling me to be patient. Of course she is busy with our 2 daughters planning school Christmas activities, etc... that helps take her mind off visa matters. I, on the other hand, am here alone in the States waiting IMPATIENTLY. But, at least we are able to talk twice daily on Skype. Merry Christmas and a Happy New Year to all VJ members, and may the NEW YEAR bring us ALL GOOD NEWS!!

You mentioned that you are GOING to have your divorce documents translated for the interview. You should have already done this when you submitted your I-130 petition to USCIS. Did you, in fact, mention the previous 2 marriages in the petition? Also, I don't know about the Embassy in Ecuador, but under Philippine law, you must submit a "legal capacity to contract marriage" from the U.S. Embassy before you can obtain a marriage license. This is not required by U.S. law, but the Embassy does it to satisfy Philippine law. Years ago, a foreigner and a Filipina could enter into a "secret" marriage that did not require the legal capacity. If you were married in full compliance the laws of Ecuador, then the marriage WILL BE RECOGNIZED in the U.S.

When Clinton signed the LIFE Act in 2000, the K3 visa was created which allowed spouses to enter the U.S. while waiting for the I-130 process to be completed. The foreign spouse could then adjust status in the U.S. GREAT IDEA!! Since January of this year, NVC in all it's wisdom decided, because processing times were about the same, the K3 was no longer needed. It is the responsibility of the Bureaucrats in any government agency to administer the laws pretty much as they see fit. Politicians come and go, but the bureaucrats remain, and short of being found guilty of some crime, they are secure in their jobs. It has been 6 months since I have seen my wife of 11 years and 2 USC daughters. I have at least 4 to 5 months to go before we will be re-united. I knew the process would be long, but didn't count on the insensitivity and ineptitude of the my government servants. What makes this process somewhat bearable is being able to read the posts of others going through the same hardships. Skype helps, but is a mixed blessing sometimes. To be able to see my wife and kids is great, but at the same time it hurts not being able to reach out and touch them. No matter what happens, I am committed to seeing this process through to the end. I know that eventually they will be here, and nothing will ever separate us again!! Happy New Year to all, and here's KNOWING that we will all be re-united with our families soon!!!

Rant Away! You are among friends who understand!

Living in the US and being surrounded daily of examples of people who are rewarded for circumventing BREAKING the immigration laws surely sucks when I know that we.....................us, all of us here are being screwed for following the laws! And this country bends over backwards to accommodate the illegals. I spend a fortune for health insurance...........illegals get treated at clinics for free............Our children son want to go to university out of state, they pay higher tuition..........illegal immigrants get (proposed) in state rates?

Why when we call NVC do we have to dial 1 for English? What about our spouses from Mongolia, Ukraine, China, Vietnam, Thailand, Belarus, Georgia, Nigeria, Iran, India, Pakistan, Krakozhia..........wherever............Why can't they dial a number for assistance in their own Language? it is because our entire immigration system is centered on the flood of illegals surging through the broken dam that is suppose to be a border. And political correctness run amok! Illegal immigrants simply form too large of a voting block!

So while we wait, collectively spending untold hundreds of thousands of dollars unnecessarily for travel, communications, as well as the lost wages and the absolutely priceless loss of time with our loved ones, missed holidays, missed morning hugs and good night kisses....................while we do all these things because we respect the law..........or fear the consequences..............our bureaucrats are writing new laws...........the illegals are streaming across the borders.............and Rome burns.

AGREED!! Like I have mentioned earlier in other threads, I will NEVER forget my experience with the bureaucratic bungling and insensitivity of USCIS and NVC, and the way in which U.S. Citizens are forced to take a back seat when it comes to us being re-united with our families.

As a lot of you know from reading this forum, my petition was supposedly approved by TSC on 11/23/2010, but has not yet reached the NVC. There are 4 or 5 other filers in the same boat as I, and I am wondering if it would be worth filing an expedite request?? One of the criteria for filing the expedite request is if it is due to USCIS ERROR. If my NOA2 is bogus, and someone at TSC hit the wrong button and generated the letter, that would mean that my petition is still under initial review at TSC, and has not actually been approved. Seems like this would be a very big mistake on THEIR part. Do any of you have any comments or suggestions? Or, should I give it another couple of weeks to see what happens? I have already filled out the form 7001, and have it ready to mail.

Since you are planning a trip to India, apply for Consular Report of Birth Abroad (CRBA) for your children at the American Citizen Services section of the U.S. Embassy.. They will be issued U.S. Passports, and will not have to obtain visas.

My wife's NBI Clearance states "Travel Abroad" or "Travel to United States". I don't believe you have to have "certified" copy of the biographic page of your passport; only photocopy.

One more thing - invest in a 2 gig flash drive. Backup all your call/chat logs, and immigration paperwork. Saves a lot of headaches if your computer crashes.

I asked what happens then and was told to just call when the 90 days are up. Am very happy for you and your family hope they will be with you real soon. 78 days and still counting

I gave the NVC a call last night, and noticed they have changed their phone procedures. No longer the Haitian refugees. They have put the Egyptian crisis on button 1. When you press 2, it goes straight to an operator. No more 1 hour wait times, and busy signals. That is a BIG change from when I was calling them 2 or 3 times a day back in December.

Thanks to my VJ family, I was able to remain relatively sane throughout this process. As most of you know, I received my NOA2 back on 11/23. Nope, I am giving it until tonight. Angela said that I should see it on the USCIS website either yesterday or today. If nothing tonight, I will be raising hell again.

I did get a message from the US Ambassador, Krisite Kenney, in Thailand today through her Facebook account this morning. She is on her way to Chang Mai and will be returning to Bangkok by Friday. She said that she would personally look into it for me. She just took over the post a few months ago and has not familiarized herself with the Visa Unit protocols, I guess this is a great time to get familiar with it. So far I am impressed with her, the State Department had a write up about her recently on how she has been using Social Media. She has "Tweeted" and now communicated with me via "Facebook." I am confident that she has our best interest in mind although it is not much of a help to any of you outside of Thailand.

I read a post a couple of days ago stating that they had received an email from TSC stating that all applications should be approved within 2 weeks. Most of us discounted the post because it seemed "too personal", and wasn't what you'd expect in an email from USCIS. Perhaps TSC DOES finally have it together, and approvals will start rolling in. Now if they can only get those approved petitions to NVC.

For Wade - From what I've read on other threads, the expedite is not automatic throughout. You have to expedite it through NVC also.

Yes, unfortunately, there are a lot of people that have gotten approved but still waiting at NVC. Only 3 out of the 28 approvals have gotten an NVC case number so far. It's taking an average of 45 days to get a number :(


When TomJoyce, Eguzzi and me finally get our NVC Case Nrs., it will definitely skew your "average" to the right!! 71 days for me since NOA2.

Wow everyone I know it is tough. It took 25 months from filing to receipt of visa for us. Try to distract yourselves with hobbies or activities. Stay in touch with your loved one but try to be positive and not always moan about how long the process it taking. Make plans but keep them generic as no one knows what the future may hold.

We all know the immigration process is broken, we all are/were in the same boat. I think the ideas of how to fix the process is much better than moaning about how broken it is. Maybe we can't fix it for ourselves but think of all the people to come after us.

We WILL eventually get through this, but we should NEVER forget the problems we have faced, or are facing now, and should continue helping others navigate through the troubled waters of immigration. From what I have seen though, when individual families are finished with the process, and are finally reunited, they tend to "move on" with their lives. All 50 States, and most Countries are represented here by individuals from different religious beliefs, cultures, values, and social-economic backgrounds, with ONE common goal - to be together as a family!! I, for one, will never forget, and will do whatever I can to keep the broken immigration system in the spotlight. U.S. Citizens who are being forced to take a back seat to illegals and scammers should make OUR voices heard throughout the United States, and demand we be given respect and priority.

Ditto on that. I've sent emails to various sources, but the only one to come back was from our senator - who were VERY kindly informed by TSC that, we were not late for approval, as our NOA1 date was November 30th. We then had to go about PROVING to our Senator, we were not lying, and had to send hard copy faxes of everything.

This is costing us all time and money - I'm really surprised a class action lawsuit hasn't been taken by someone with more brains than us.

We have the same faith, my daughters petition approved December 29, according to the letter received by my husband it will take 90 days? How true? My petition is also in the process of approval since TSC asked my husbands previous wife's death certificate.....how long will i wait? :)


I gave up a long time ago trying to figure anything out concerning TSC. My petition was approved 11/23, and have yet to receive NVC case number. God willing, our journey will soon be over, and we will be re-united with our families. Sometimes I feel like giving up and moving back to the Philippines, but I know this is not the smart thing to do for my daughters and my wife. Hang in there!!!

It is getting harder and harder with each day that passes. I knew the process would be lengthy at best, but when you factor in the incompetence of USCIS, the process becomes almost unbearable. In my above post I meant to say TSC mishandled our cases; not TSA. Too many abbreviations to keep straight. Even my wife in the Philippines is starting to ask why this is taking so long, and she has the patience of JOB (from the Bible). I know that when we all are finally re-united with our families here in the States, most will probably forget this nightmare, but I feel we should never forget how we have been treated. I don't know how, but I will eventually find someone with clout who will listen, and shine a light on the unresponsive, uncooperative and downright arrogant way the civil servants at USCIS are (not) performing their jobs. Like I said a couple of weeks ago, if I had performed my duties in the U.S. Navy in the manner in which TSC has performed theirs, I would have been discharged for "Dereliction of Duty" instead of retiring honorably after 23 years of service.

From what I understand, background checks at this stage are for the petitioner. Background checks do not normally take more than a couple of weeks. I recently had to have a TSA background check for my job, and that only took two weeks from start to finish. In the meantime,TSC is doing a background check on my I-130 petition. TSA is an agency within DHS as is USCIS. The simple fact is that TSA mishandled our petitions. We will probably never know by whom or why this happened. I saw that GNASHER finally received their NVC case number, so hope is still alive that we will see some movement starting tomorrow. It has been 55 days today since my petition was APPROVED by TSC on 11/23/2010. 174 days from my NOA1.

On another note, I did post a comment on Laurel Scott's chat for today. Hope we can get some insight as to what's happening at TSC.
