Thing is... we have been married for 3 and a half weeks. We got to live together for 2. How is that going to be considered proof of an ongoing marital relationship?? And the only people who got to see us married are in the UK.
He cant even come see me!

We got married on the 6th of Jan this year with the bright hopes of doing a DCF after his contract for work and lease was up in the UK Feb 28. He is flying out here the 3rd of March to stay a few weeks before going back home to Australia. Plans were for us to file our stuff there, but thanks to the new law thats no longer an option.

We know we need to file our I-130 ASAP, but for him to straight to Aust. seems pretty drastic. How can we show we actually are married and fulfill all the requirements they are now asking for like joint bank accounts, tennancy etc. witout he and I actually being allowed to live together.

We would like him to stay here for the 3 month limit, but that puts us in danger of problems. And, I just got back from London carrying literally half his posessions!

I am so confused and the more I read, the less I understand. I am so frustrated, alone and feeling hopeless because of all this. I am feeling like we should not have gotten married now. Damn the gov't for not giving anyone a heads up on the change of policy here. We would not have done this if we knew that 3 weeks later we would be cut off at the knees.

I dont know what to do anymore and am feeling so so helpless and that this is going to be another 2 years of heartbreaking distance. Australia isnt that easy to get to like the UK. Nor as financially feasable...

Anyone with any light? Anyone with hope? Anyone? :crying:

Honestly, I dont have any friends who could sponsor him. I moved where I dont know many people and my closest friend is on disability with on again/off again part time jobs. Im pretty much on my own here. But I have faith things will work out. Im not financially despondent and make well over the guidelines. Supporting Rob is not an issue at all, just dont want the tax returns to become an issue.
You're right, I shouldn't fret over what could be nothing at all. Hell, the way the system seems to move, I will have 2 tax returns under my belt before I am asked for those anyway!
If I can afford plane fare (Virgin Atlantic!) to the UK to see my Aussie treat every 2 or so months, I think I'm in good shape!


As kitkat said, you don't supply your tax, income, or support information at the time of filing. You will need to supply that information at the consular interview, which is the last step before getting the visa.

That gives you a fair bit of time to gather this information and figure out what you are going to do in those regards. Right now, my advice would be not to worry about it at this point. Go ahead and get your I-129F filed and get that started before worrying about all of this other stuff.

From your description, I think you could probably provide enough evidence of acceptable income. Do you have any good friends that can back you up as a sponsor just in case? I don't think there are any rules that say it has to be a family member.

Well, I do have enough income, so thats not a problem. If I needed a sponsor though, I am dead out of luck. I have no family to help out in this. Its just little ol'me.

I am still waiting for my finalized divorce decree (which took forever!) to arrive in the mail so my beloved and I can file for our K1, so in the meantime I am compiling all my info for our initial package. This is going to include 3 years of tax returns of which I can claim to have worked for 1. I was a stay at home mother for 10 years and was almost solely supported by my ex.
My big fear is that now that I am on my own and have been for almost 2 years, I have only one real tax return to prove that I can sufficiently support Rob and myself until he gets his work permit.
Im scared that this will cause an immediate denial of our application and force us to go the harder route of a K2. Anyone have any knowledge of this? Who can I contact to try to get some real information while I try to obtain the other 2 years. (The ex is a meanie and wont give them to me along with other things...)

You can request copies of your prior year tax transcripts from the IRS.

If you don't have enough income, you can use a sponsor.

You don't need to provide financial support for the I-129F petition - that comes into the picture at the consulate interview as well as during AOS (adjustment of status).

Hi everyone,
My boyfriend and I are still waiting to be able to file for our K1 (i found out recently that my divorce never got filed!! So i am now waiting for the final decree to be mailed to me)
He is planning on entering the lotterly again but we are thinking that if he does and we file for our K1, somehow he will be automatically rejected for either one as it will look like the marriage will be a sham and he is too desprate to come to america. He is Australian living in the UK. We have been waiting for this to all happen for months! Please give us some direction as we dont want this to be messed up permanently and we will never be able to get married! Its our worst fear.

Thanks! I have been focusing too much on the K1 that I dead forgot about the DCF option. He will be stoked to hear about this option as he has not been looking forward to returning to Sydney.

No way to guarantee he won't get sent back at the POE. He needs to be prepared to prove ties to his home country and intent to return - apartment lease/bank account information/letter from employer, etc.

Which is the big problem. He is quitting his London job in Jan to go back to Oz where he will not have employment just yet and he will not have a lease, only the benevolence of his parents for a few months. This is the biggest problem we are facing. I know lots of people are tourists here for about a month on the way back to their home country.

Indicate where he lives at the time of filing. When the petition is approved, change his address directly with the consulate.

we are unsure how this will affect our process. Currently we are waiting for my divorce decree to come (I filed a year ago and the ex and his lawyer have held things up sooo badly! another story!) so we have not filed yet. But Fiance' has decided to move back to Australia from the UK for a few good reasons. We plan on him being out of there by the end of Feb, and of course we are sure my divorce will have been processed correctly by then. Thing is, he would like to take a month or so holiday here before we both head off to Sydney for him to temporarily live with the 'rents or a friend and for me to meet the folks. He will be holding a one way ticket to Australia when he comes in Feb, so how can we 1) make sure he wont get sent back to whereever and 2) how do we put this change of address/country down in our paperworks? We dont know what to do, but him staying in London is becoming a burden and more stressful than him actually living in Sydney. He has his 3 months left on his lease and thats up in Feb, and then from there, we have no way to show any kind of familial ties or work ties to make him appear that he is "going home" and just here on a holiday, which is the total truth. Anyone have this kind of situation?
