If you need to show proof of legal status and have still not received the NOA extension letter, you can make an infopass appointment and they will give you a I-551 stamp if you explain that you never received the NOA.

Just recently, we submitted our I 751 package and received our biometrics appointment letter shortly afterward. I have read throughout some of these threads that people have also received another NOA notice which they call an "extension letter". Can someone clarify this for me? I'm not sure if it either got lost in the mail, they just have changed policies, or they will send it after our successful biometrics appointment.

Thanks! Yes, the InfoPass basically was about asking for a stamp in her passport; which we were advised we did not need because we already had the 1 year extension letter. We did not really do anything special, just had a well prepared packet we sent them. Additionally, I had to call USCIS to have them send the extension letter about a month ago, which arrived about a week later.

Hi again, I just figured out that my biometrics letter should not be considered as an NOA, rather the "extension letter" should be. So the stats I have should not have an NOA date listed. I also amended that in my sig. I look forward to seeing more approvals soon and meeting some others in the same situation.

Hello, I want to thank the board for supplying information and vital communication to the K1 community. I have read a bit of the IMBRA posts and some of the Juarez stuff as it relates to my case. I believe I was one of the 1100 petitions recalled after March 6th. Our petition was actually approved on April 6th and the consulate in Juarez called my fiancee on May 31st to tell us that it was being sent back. Interesting, 2 days before that I had booked the trip to Juarez for both of us! Well, we are still going but it looks highly unlikley at this point that the petition will be ready for the dates of our trip. I have spoken to all of the agencies involved (NVC, USCIS, consulate) and they basically have said they do not know much but things will happen soon, keep checking. I look forward to learning more about these issues and I hope to contribute in a positive way to this group.

That would be incorrect... the CBP system accesses the USCIS database once the passport and visa is scanned into their system. Name, DOB and Country of Citizenship is enough to pull the file..

Since the CBP knows that you have a tie to the US that could affect your decision to stay past your period of stay, you need to provide evidence of factors that would require you to return back to Mexico before your period of stay expires. Examples given above can help but are no guarantee. The final decision rests with the CBP officer...


Thanks zyggy - good to know for future reference. So Lewis, if you are driving across, it's no big deal if they turn you away. But if you are flying (which it seems you are since you referred to plane tickets) you gotta be prepared.

Well, I can only try and see what happens. I'm the USC and I'm flying to El Paso and going through to meet her at Juarez. She is flying in from Guadalajara and she is flying back there after the trip. Our possible trip to Juarez will be in a taxi, I assume. It's beginning to sound like it's more trouble than it is worth due to the new complications caused by IMBRA. This was supposed to be our interview trip!

We are considering a trip to a restaraunt in El Paso from Juarez, my fiancee has a B1/B2 VISA. Does anyone have any experiences in crossing while their K1 application was being reviewed? Will it affect the process in any way?

I assume all we have to do is show evidence of returning to Mexico, which we can do with her plane tickets.

The implementation of IMBRA now begins. Hopefully, as the process moves on more info will be dispersed to aid us all in our process. A calm and logical approach is best.

One of the bottom lines of this law is that someone somewhere sometime will have to decide which companies are classified as marriage brokers and which are not according to their interpretation of this vague definition. I wonder if this list is available for public perusal or if it even exists. It will be disappointing if it will be left up to the applicant to determine whether or not they used a marriage broker according to this definition without any assistance from our government in interpreting this law.

Well, I called the USCIS today to find out where my petition was. I informed them that both the NVC and the consulate said the USCIS had it. So the person on the line checked and said they received it on June 12th. It took 12 days to get from the consulate to the USCIS. YESSSSSSSSSSS, at least now I know where it is! Sad, I'm excited about this. :dance: She could not answer any specific questions about the process.

The person on the line could not tell me much more than just wait for the notice to come and she implied there will be some sort of order to this mess which hopefully means the receipt date will be taken into account in this process. Of course, it is all speculation at this point.

It seems they generally do work on Saturdays which is odd but great. While we have been touched 4 days in a row, it doesn't look like anyone from CSC has gotten the online case status message that says the RFE was sent . . .

Check the other threads because I can´t remember where I read it, but someone did.
Same thing for a recalled case. Someone got a message saying RFE has been sent.


I'm really starting to doubt the efficiency and reliability of the online service. I'm still believing the RFEs are being sent en masse and they will arrive within the next few weeks. Of course, I will still keep on the USCIS about it also.


Any chance they are sending more RFEs than changing the status online and we will all get it pretty soon?
Or they have to open each case to send the RFE?


To be honest, I have no idea but I think this online case status thing is not reliable. There are duplicate notices sent, no notices sent and there is obviously a hole in the system that does not address this IMBRA situation. They really need to reengineer it from the top down.

I did read a post by aussiewench #1297 on page 87 of "Lets collect some information about IMBRA effects" that eased my mind a little about the NOA2ers though, you should check it out. I'm not sure where the info came from but it seems logical.

I'm really starting to doubt the efficiency and reliability of the online service. I'm still believing the RFEs are being sent en masse and they will arrive within the next few weeks. Of course, I will still keep on the USCIS about it also.

The USCIS is resposible for part of the process of issuing fiancee visas and at this point they are not doing an efficient job of it. If you look at the timeline section you can compare the wait times before and after IMBRA. I kindly disagree with you, it is the government's responsibility to be as efficient as possible and it is the american public's expectations that partly drive the government's general efficiency through feedback, elections and lawsuits. If the public does nothing, the government does not operate with the public interest in mind.

As for the political situation in our country, I won't comment but I will say the abovementioned situations should have no effect whatsoever on the fiancee visa process. I really can't see any relevance at all. In fact, the only reason all of this is occuring is due to lack of preparation by the responsible agencies in dealing with the new IMBRA law. Personally, it is hard to be sympathetic to a huge governmental agency that has no clear publicized policy on handling IMBRA.

Sorry, I can't just accept this situation as it is. My government has admittedly made a huge error and has offered nothing in return but total frustration and no clear plans to deal with it. It's very difficult for me to just sit back and accept it.

This is not a typical situation, we are talking about a future marriage here, this is not a driver's license.

I'm not sure that the IMBRA would be considerd as an error on the part of the uscis.
Thats just the way life is guy's and there isnt much we can do about it.
The fact of the matter is who is to blame ? can you place blame, even though they should have forseen the problems with the forms before hand?
I dont see where any one agency is to blame here.
Its clearly an govt. oversite that was really unavoidable.
I think if alot of the people stop sending so many e-mails and calling for nonimportant reasons maybe they can get something done there .
I dont like waiting as much as the next guy but i am not going to flood the service centers with a bunch of junk so i can slow down the process even more.


After I read this, I was kind of amazed at the sit back and wait attitude of these statements. These attitudes are exactly how and why the USCIS has become the untransparent, inefficient behemoth it is today. To imply that people trying to communicate with their government is a negative thing which slows down governmental efficiency is nonsense and to say that this was unavoidable is also nonsense. I agree, there is a possibility there is not one agency to blame, but in my opinion it was clearly USCIS error which means I have a right to request an expedite as you do according to their policy. I'm sure a lot of the other members don't consider their correspondence with their representatives, senators and governmental agencies "junk" as you do. I hope the process goes quickly also, but I refuse to just sit and wait.

Ok so if I do send this in for expedite service, who do you send it to? You will send the RFE to the department who receives the them, and the Expedited Service papers to the Expedite Service. SO why should we wait to send them, if they are going to two separate people? I am thinking about sending in the Expedite Request now, and the RFE when I get it. Maybe that will even expedite the RFE.


That's exactly what I was thinking. Anyway what is the point in sending in the request when you already have the RFE? According to the procedures on the above sites, the envelope has to be mailed to a particular address and be marked with "EXPEDITE REQUEST". If you attempt to expedite, the whole point is you want it done asap.

I'm going to work on this today, it's too hot out anyway!

I have been under this same impression, that USCIS made an error, and we deserve expedited service. The emotional rollercoaster that all of us have gone thru due to USCIS error cannot be replaced any other way. I am just wondering what we can include as evidence. How about this:

Mike, yeah, that memo would definitely be included along with a copy of your I-797C, notices from the NVC and consulate also. And a letter obviously explaining the situation and why you think you deserve the expedite. (USCIS error)

One of the criteira listed as reason for expediting is "USCIS error". Has anyone else considered this info, and are there any ideas out there about this process? There was clearly a mistake or error made in this process but I'm not sure which agency made the error in this situation. In any case, I look forward to some good thoughts on this.
