Congrats, My hubby just had his POE Dec 6. We checked off to receive his social security card but was told that we can just apply at the office right away. We did this within the same week and in 2 weeks we got his social security card and welcome letter stating we should get the green card within 30 days.

Hello,

I filed for the I-130 and received my NOA1. With the I-130 package I sent a cover letter stating that I would also file for the K3 visa. I have not sent the K3 as yet, but if I decide not to file the K3 visa, should I notify the service center that I will not proceed or since I haven't file as yet it doesn't matter? I've read on here that if you noter you will file the K3 the service center will wait for the K3 before proceeding? Is this correct? What should I do if I don't file the K3?

Hello,

I have a friend who resides in Jamaica, she is the beneficiary, and her interview at the Kingston Embassy is Sept 21st of this mth. She wants to know what are all the necessary documents she needs to bring to the Medical Examination and also what size photos does she need to bring. Is it the passport size or Visa size? I'm in the same process of petition for my husband but I haven't reached this far, as my time line shows, so I do not know. Could anyone pls give me some advice on this matter as her appt is near.

When you call the number (603) 334-0700; the options are 1, 1, 1 after this third 1, you may want to listen for the 3 letters before the numbers. If it is WAC, that is option 4; once you confirm the 3 letters, enter in the 10 digits followed by the # sign. I hope it is finally at NVC. If nothing yet, check back with them in January.

Thanks for the NVC number. It's now stored in my phone along with the shortcuts. I checked and there is no record as of yet. I guess because it is the Holiday season, everything is taking longer then usual. Well, I appreciate all the replies from everyone. I will wait patiently and keep checking the automated system.

Hello,

On Dec 11th, I received an email from CRIS stating my I-130 petition was approved and that a letter was mailed out. It's now going on 2 weeks and I have not yet receive this letter. They have the correct address as when I received my NOA1, everything was correct. Is this normal or maybe it's the holiday and it's taking way longer then usual? Any advice on what to do?

Hi all,


Just got the wonderful news that my case (I-130) has been received at the NVC. I actually got an email from them stating it was received with my assigned NVC case number. The funny thing was that the email was a reply to an inquiry I emailed them about. I wrote them asking if they received my case since it was approved by email on Dec 11, 2007 and it's going on 3 weeks and I haven't received the NOA2 by mail. I was always checking the automated system and I would get the same message that it either has not been received or I input the incorrect case number. Up to yesterday I was still getting this message, but then today the message stated my case was entered January 3, 2008. Hmmmm.....

I just want to know if anyone has have their case received at NVC but still haven't received the NOA2 by mail yet? I'm giving them until 30 business days from the approval notice before I contact them again as I was advise to do so. Also is this notice relevant? Does the beneficiary have to bring this to the interview?

I’m just wondering does someone actually comes to your house to see if you actually live there while you’re filing for your CR-1 petition. I’ve only heard of cases once you’re living together I guess someone might come to inspect. Anyone experience this?

Also, since it’s now 2008, should I send my W2 for 2007? I already have my tax transcript for the years of 2004-2006. I did this last year. My job doesn’t issue out our W2 until Jan 31st and I hope I don’t have to wait until then to send it off. Any advice would be appreciated.

Come to find out I will need a co-sponsor. My question is, I now have to send in 2 forms of the I-864, (one from me and the other from the joint sponsor) also a I-864A (Contract Between Sponsor and Household Member) along 3 most current tax records/employment letter with pay stubs.

Is that correct? Also each I-864 have to be notarized?

This is however not a "hard denial" it is a visa refusal by the consulate (DOS)...the consulate is returning the file to the original approving USCIS office for review. The USCIS (DHS) will review the returned petition/application and then send you an NOIR (Notice of Intent to Revoke) or NOID (Notice of Intent to Deny) giving you a specific amount of time to rebut the consular findings.

There is a very short window in which a petitioner has a slight chance in stopping the file from being returned. It does require you to contact your senator/congressman and provide them with all necessary information on the case, and why it is so important to try and turn this around before the file is actually returned. Your government rep has a better chance of getting this reviewed by consular management before it is returned...if you know the reason(s) why they want to return the file, it may be possible for you to provide evidence to them. Not all consulates allow this, but there are a few cases I know of where the petitioner was able to get the file reviewed by consular management and a visa was actually issued without having to go through the return process. It is definitely worth trying.

I absolutely recommend reading this documentation so you have an idea of what will happen and what your options might be. Someone mentioned something about a waiver...is this something your case requires?

update about my case: still in Madrid, my attorney is preparing a rebutted, I called department of state (almost everyday) told me is no notes wrote by the CO, what they have is my husband never show for the interview. wow.gif the visa specialist gave me the fax number from Madrid embassy, told me to send a letter with all my evidences and ask what is my status, also I got an email with the I-130 my brother in law filed for my husband, the case was transferred doesn't said where,this email was in June 10 and was touch in June 15. I called today to know where was transferred but because am not the petitioner I was no able to have any information, tomorrow I will call with my brother in law, this is the email

Hi Beth, thank you for you prayers, and yes all this process is getting me sick, I'm still fighting I know will take time I know won't be 2 months, 6 months maybe will be more but inshallah later this will be a dream,

my case is back to USCIS just half hour ago I got the email, I don't know exactly how long I will have to wait but thanks to kiyah i have a good lawyer who is guiding me and we're finally seeing the light at the end of the tunnel.
