Waivers (I-601 and I-212) and Administrative Processes (221g)Abused and i-485 denied please advise!!!
The rules are that you must marry within the 90 days or go back to your country, did you know that? You really should have left cause now you broke a few laws, you got yourself in a messy situation. You need to find a really good lawyer cause
1) You married someone other than your petitioner, so it looks like fraud to the USCIS.
2) You didn't leave the country within the 90 days.

You might get deported and banned. I'm very sorry, get a good lawyer or you, your husband and your child could move to your country.

Best of luck to you.

Waivers (I-601 and I-212) and Administrative Processes (221g)Oh my gosh! Somebody please help me!

If even the tests were negative and he was clean NOW, the fact that he admitted drug use in the past is reasonable grounds for the embassy to deny the visa. U.S. immigration is not very forgiving about your past illegal history and he will need to "serve his time" and try again. This will always be a part of his immigration record.

I think the only exceptions for an embassy to excuse past drug use are if you engaged in the acts over 10 years ago or before you turned 18. I could be wrong but I remember reading something about this on a past VJ post a few months ago when someone admitted smoking marijuana in high school during their medical and the doctor asked if it had been over 10 years ago.

Your journey has become more complicated so I would advise to take your time and investigate your options, your feelings, and your relationship. Personally, I would think that if the embassy ever received a positive drug test, they would be very unlikely to ever let him into the U.S. The fact that he got a one-year ban seems more like a consequence of having done drugs in the past and making sure he isn't doing them now or in the future.

This makes no sense to me, if they were gonna reject him from the start after they found out he did drugs 4 years ago, why did they ask for a SECOND test? Why not just call it quits after the first test? Why bother again with his paperwork?

God only knows what is going on, but as far as I know, the embassy wouldn't deny you unless they did find something your recent tests, not something you did 4 years ago, I mean simply think there might be tons of people working at the embassy that smoked something during high school or whatever, everyone falls (just think Lindsay Lohan), I know some people here come with cases with past addictions or criminal backgrounds and they get accepted anyway cause they said the truth, not because they did something stupid in the past.

Only God and Fady now know the truth, and that's just me, I wouldn't be upset that he did weed at a certain point of time, I'd be more upset if he lied to me. Hopefully that's not the case with you, maybe someone did a mistake somewhere. Fady would need to find a good lawyer to represent him, I'm not sure if the ban is reversible?

I hope I didn't upset you in any way, I'm honestly trying to help.

Everyone back off! Where do we all conclude he was ever found positive? If he is a decent guy and ADMITTED to once using marijuana, they may be basing this year of testing solely on that honest disclosure! To the OP, explore this possibility. You may have been right to believe him before. Don't jump to conclusions without considering all the possibilities!

He CLEARLY admitted it to her AFTER she confronted him with what she found out, hence why she is shocked now cause she never suspected it before, he has never disclosed any of this before now.

Waivers (I-601 and I-212) and Administrative Processes (221g)Oh my gosh! Somebody please help me!
The doctors in Egypt don't even tell you if you tested positive or negative cause they assume you know yourself better than they do! The embassy has no interest in lying to you, plus they have supervisors and colleagues, they won't just change his result. Looking tired or not, ALL people waiting at the embassy look very tired, I had to wake up at 2 am to drive from Alexandria to Cairo cause my interview was at 7 am, had no breakfast and I looked awful, they didn't assume I was on drugs.

I'm so so sorry, I'd be devastated and feel cheated on, but it's obvious that he is lying to you, I've never heard of a story like that honestly, trust your American embassy employees, they did good by putting him in AP.

If he did it with you then it's fine if he does it with him, after all both of you will be on the lease right? I had to fill a bunch of paperwork when I was put on my husband's lease. The US will run background checks on him so I'm sure your landlord couldn't be worse than the government! :P

Good luck!

Russia, Ukraine and BelarusMIL visa application
Sachinky is right.

Same problem with me, since Egypt has no waiver programs, my parents need a visa. None of siblings are going to apply just because the US embassy might think the whole family is going there to live, it sucks but I want my parents to be there more than anyone.

You could write her family an invitation letter and they could copy her documents (for example NOA2, visa in the passport) wedding invitation etc.. as as a proof that there will be back as soon as they attend the wedding.

Russia, Ukraine and BelarusSecurity clearances for work

I also have a problem kindof similar. My husband (USC) used to have a security clearance and been inactive for 3 years, he recently reapplied for interim, and is under investigation for it now, some of his family members have TS. He is worried that he may not get it because he is married to me. I'm from Egypt, I've been living here for 3 years, I've a 10 year GC and I can literally start applying for US citizenship on January 1st 2014. My family members have never worked for the Egyptian government, they're all business owners.

Do you think he could get denied? he really wants this job, it will solve lots of our financial problems!

US Embassy and Consulate DiscussionNot sure what to do about this.....
[code=auto:0]They may question the validity and seriousness of your relationship, since there will be this white elephant issue that occurred within the timeframe inwhich you'll were supposed to be engaged and committed to each other.

So in a few words, YES this will be a BIG FLAG for the CO./code]

That's right. I know a couple that got denied just because some stories of theirs wasn't matching and sounded suspicious.
They might think it's a visa fraud IF you seem not to care about the big fat elephant.
That child would need the dad's permission to leave the country, right? Or you mean you want to lie to them about it and say it's yours? I wouldn't sleep at night doing that, if you get caught, kiss that visa goodbye.

Good luck.

US Embassy and Consulate DiscussionPolice Certificate Expiration?
Hey All! Happy Wednesday!

I'm a K1 beneficiary from Egypt.
Today I went to get my police certificate, they told me I'll get the instant one (you get it after 3-4 days) and it costs more.

Anyway, the certificate said in English and in Arabic, "Expires in 3 months"

I heard they are usually good for one year, right? So Am I going to be in trouble if it expires before I travel to the US?

Thanks a bunch!

US Embassy and Consulate DiscussionPolice and Birth Certificate Notarization
Hey Everyone.

I'm a K-1 beneficiary from Egypt, I'm trying to collect all the documents for the packets because the consulate (In Cairo, Egypt) e-mailed my fiancé and told them they received my case and will send me packet 3.

Do I have to notarize the police certificate and the birth certificate (or their translations)? I don't understand why I would need that but some people did it (I don't think the embassy asks for it per say)

I'd really appreciate any help.
Thanks!

US Embassy and Consulate DiscussionK1 Packet 3, Cairo Embassy.
Okay, I got packet 3 today, I think it's outdated because it said visa fees are $131, how much do I pay then? Since the visa fees increased.

Also it mentioned nothing about translating documents, do I still translate them?

Do I send evidence of ongoing relationship with the packet too? Or keep til the interview? (It says attach it to one of the forms)

Also, what do I fill the forms with? Black ink, hand writing? and sign with blue ink?

I'm sorry I've scattered questions, I just don't wanna do anything stupid! :help:

Thanks everyone! (F)

US Embassy and Consulate DiscussionMy experince at the US consulate in Cairo
I wanted to share my experince just in case not everyone reads it on the reviews :)

K1 visa - US consulate in Cairo, Egypt.

The interview 7-7-10

I got there at about 7 am, gurad looked at my invitation letter, they took my phone, scanned my body, and gave me 2 numbers, I was called the first time to submit my birth certificate and passport to an Egyptian woman who asked me a few questions:
- How did you meet your fiance?
- For how long have you been together?
- Was he married before?
- Did you have an official engagement at church?
then told me to sit down and wait again, 30 minutes later an American woman took my biometrics and told me to wait again for my interview.

My name was called again for the last time, 2 men were there, I think one is a trainee since he just watched, the man who interviewed me was in his 30es, married, and very funny.
He started with 'Hey, Goodmorning!, can you please show me the DHL and bank receipt? (I kept looking through my huge bag, and I was like sorry it's just so small, and he was like oh yea it's pretty small, it's okay take your time! I then found it.
then he said : I've a couple of questions for you!'

- Did you fill these forms yourself?
- How did you meet your fiance?
- For how long have you been together?
- Do you call him Joseph, or Scott (his middle name)? I said I call him Joe :P
- When did you decide to meet?
- When did he visit you? and the second time? How long did he stay? How often did you meet then?
- When do you plan to get married?
- What does he do? what does his company initials stand for? (I didn't know)
- Do you swear to marry him within 90 days? Sign on it.
He said 'Very good!' after each answer, I felt like I'm in KG :P

He then said everything looks very good and he has no reason to not approve me and he was like, listen, I'll approve you right away! Congratulations! Have a nice wedding! You'll get your visa in 2 weeks. I kept thanking him. )

He didn't ask to look at my evidence and I didn't even offer.

Overall experince is really good, the US embassy in Cairo was always so responsive and reliable! Whole time I was there was no more than 2 hours and a half!

Best of luck for those next in line!

CanadaPictures/ proof of relationship
You do NOT have to have pictures where him and your family met, just pictures of you two are enough. If in your case they only exchanged letters then that's the proof you got and they'll accept it. K-1 visa has no requirements of families meeting. Bottom line, it's not important.

Removing Conditions on Residency General DiscussionROC and DMV drama.
So I went to the DMV to get my drivers license (first time) I went with my GC that expires on April first, and my one year letter extension. The guy didn't even look at my letter, no one would at that DMV! He just said no we don't accept those letters! Without even looking at it. I tried to explain that I'm here legally and won't get my new green card for months! I've a baby that has doctors appointments and so on. Called the USCIS they said that letter should have been accepted by the DMV.

Now I'm in a limbo, don't know what to do? We've been calling the Secretary of State office of Illinois and they've been giving me the run around.

Any advice would be appreciated.

Wow! How horrific! I am going to visit my family in Egypt with my husband and our 9 months old son. We are flying through Germany on the way home to the US. I really hope this doesn't happen to me, I couldn't imagine my husband and baby boarding without me, I'd die. I already got denied at the DMV with only the extension letter. Why would the DMV not issue you a DL based on the 2 year GC?  I find this strange.  The only reason I could think of is the expiration date, but why not issue you a DL that expires when the 2 year GC expires?

Congrats on the approval and hope you do get your DL,

Dave

I was applying for the first time with the extension letter and almost expired GC. It's a hit and miss at most DMVs. I even got a stamp but now no need for it!

Congrats

So the website updated for your case?
