She not he, and it wasn't Igor's List I saw it on, it was one of the time line graphs. However, thinking back, it might not have been an accurate one as it was being shown as a "what do you think of this idea" kind of things. I just remember seeing what appeared to be around 5 or so October approvals on the graph. I apologize for the confusion.

I'm Charmarie, 28, from Washington state, and my other half is Benjamin, also 28, from Australia. We've known each other online since 2003 but never believed there was a chance for us to be together realistically, so we kinda just ignored our feelings for one another and remained friends. After a couple of horribly failed relationships on both our sides, we decided we owed it to each other to meet in person and see what happens. Best 6 weeks of our entire lives!! It's amazing when you finally meet the right one for you, how everything really does just "click" like everything is where it belongs. I am praying that CSC gets a move on it, because this waiting to be with him again is driving me insane!!

We debated it for a long time, but I think we've decided to just go ahead and do a JoP when he gets here and wait til early summer for our actual handfasting (we're pagan and planning on a traditional year and a day ceremony). Unfortunately, his family won't be able to come over for the wedding so we expect to have a small party to celebrate it when I go over for his interview. We've talked about maybe doing a renewal of our vows in a few years over there instead. We'll figure something out, I'm sure smile.gif

Yeah, the paper in Australia is the same, I think it's called A4 or something like that? Anyways, I doubt it will be a big deal to anyone, I didn't bother cutting it shorter or anything, just slid it in where it belonged in the package and mailed it off smile.gif

I am sponsoring him as I am the petitioner, but I'm a full time student living off my financial aid for the time being so my mother is really his sponsor as far as the financial side of it goes. If you make enough to meet the poverty guidelines then I wouldn't worry about getting a co-sponsor, but if it's close or you don't at all, then you'll definitely need one. I'm so thankful my parent's are around to give me a hand, I would have been devastated knowing it would be several more years before I would have a job and be able to sponsor him myself! Yay for heavy duty majors tongue.gif Just gotta keep reminding myself that all this trouble now will pay off in the end smile.gif

I just sent my i-129f on the 17th (certified, priority). it arrived at Laguna Niguel at 11:03am on Oct. 20th. They cashed the check on the 21st and it cleared my bank today, the 23rd biggrin.gif I've never been so happy to spend that much money on some papers being looked over by someone. ha.

My parents are going to be sponsoring my fiance (since i JUST started my new job in september and i think i make just at what you need to make to support someone but i dont want to get denied or have this process take longer so my parents said they would do it.) so would i just pick one parent to do the sponsoring or would both of them fill out the forms? If its just one parent, I am going to use my dad to sponsor my fiance because my dad has been at his job since he was like 20 years old and has been with the same bank since the 70s and is part of the union and has dependents.....so i think he would be a great sponsor. I'm not sure when everyone is starting the next steps...but now im glad i can ask you all smile.gif

Hi Kristine, welcome aboard!!

I had actually started the other paperwork before I mailed in the first part! I was waiting on the stuff from my other half and could go no further with the petition, and I was getting antsy waiting, so I headed to the embassy page to find out what they wanted and began downloading and filling in the information for the next step. He's not good with paperwork anyways, so it was just as well that I do it all, minus the signature and dates! I've pretty much got our package assembled now and ready to go, so as soon as we get our packet three we can immediately turn around and ask for our interview date.

My mother is co-sponsoring and she's already started assembling her information. I'm not worried about it being too far ahead of time unless our case is extended much longer than average. If it is, I'll just have things updated, but I'm gonna think positive and not worry about it for now!

I understand the poverty guidelines are established by the size of current household plus the immigrant and any kids they bring. How does it work when you have a co-sponsor?

My mother will be the co-sponsor, she has no one else in her household she supports, so how is household size figured here? Myself, my two children, my fiance, and my mother for a total of 5 and income level $31,000? Or is it just herself and my fiance she has to support?

Also, her actual working income is about $500 shy of the needed lvl assuming it's a household of 5 that needs to be figured. However, she recieves an additional $750 a month in spousal support from my father out of his military pension. Is this countable income? If not, I'm assuming I will need to find a 2nd co-sponsor, but reading that has totally confused me on how they figure who supports which family members.

I'm not sure if I have special circumstances or not. I've been told if you've been married previously it's a pain, which I have. I also have been told I might have issues with the affidavit of support since there's a good chance I might be going on SSD in the near future and have had help through DSHS for the past year as I've been putting myself through school. While I do have someone who should qualify for the affidavit, I'm still under the impression that me having a "history" of state help is a possible hinderance. Any ideas on this part?

I wanna make sure I'm understanding this right. When submitting the original package of info, I'm to fill out the G-325A, even though I don't meet the poverty guidelines for support. This is not actually taken into consideration when filing the I-129F. Later on when foreign fiance is doing the interview, he needs the I-134 from my mother who will be sponsoring him, and that's when all that will be dealt with? Or is the G-325A supposed to be filled out by my mother also? I'm scared of doing this wrong and getting an RFE!! (The RFE itself doesn't scare me, the delay in getting him here does--it's already been way too long!!)

I'm in the same shape you are, and this is how I've interpreted it. Being a full time student is not the same as being employed (even though both are "work"!). If you are not employed through the school or on your own, you are unemployed for purposes of filing out the form. Therefor, you're most likely going to need a Sponsor. They need to make above 125% of the poverty level. When figuring that amount out, you include everyone in their household that they support, plus your beneficiary, and compare it to the figures on the poverty guidlines chart to see if they qualify. Later on in the process, they will have to fill out the I-134 and provide proof of their financial status, along with yourself (even if you're unemployed, you must still fill out what's applicable to you on this form--I chose to list on my I-134, in lieu of employment info, my school info and am including a copy of my financial aid award letter, as it is income into my household). Hopefully, your embassy is one that will accept a Sponsor if it's necessary.

As a form of our ongoing relationship, would printing off bank statements that have both our names on it be a worthwhile show, or would it be construed somehow as the relationship not being bona fide and one party just in it for financial support? I don't want to give them a reason to suspect that's the case, but sharing a bank account seems like something more serious to me, and proof that there's a relationship. I know I wouldn't do that with someone I wasn't planning on marrying!!

He can purchase a one-way ticket on a K1 visa. Though sometimes return tickets are even cheaper than one way tickets! For tourist visas it's always a requirement to have a return ticket.


That's what I was thinking, but he had me second guessing myself!! Thanks for the heads up on the possibly cheaper round trips, I'll be sure to look at both when that time comes!!

I don't think it really matters, but I chose to make anything I copied that was originally in color, copied in color as well. I keep hearing "read and interpret literally" and it says "exact copies", so I did just that. As all items are to be at the interview for further inspection later on, I don't think it will matter if copies are in color or B&W, just that they be legible. DO NOT send in originals, take them to the interview. Good luck!!

Yours looks like it's 3 pages, so it should be even less. It's usually available from the clerk one day after it's been filed, which normally is done the day the judge signed it.

Marriage and divorce are usually public record, so anyone should be able to get them. I got mine 2 days ago with no proof of who I was or anything. Maybe a mom or sister or someone can get them for you?

This is incorrect. Once you go see him in November, you may then file the K-1 at that time. You do not have to wait 2 years from the date you see him, you just have to have seen him at least once in the previous 2 year period prior to filing. So, if you go in November and come back in December, you have seen him in the past two years and therefor are eligible to file the K-1 at that time. If you wait until December 2010 without visiting again, then you have gone more than 2 years without seeing him and are not eligible, and must make another visit (or he visit you) before you are eligible again.

I don't know that that is such a good idea. I've seen others say that sending money makes it appear as the relationship is based on financial gain, not love. And China has a tough consulate so it seems, so I don't know that if I were in your shoes, I would be willing to take a risk along those lines.

I met Donesa through an introduction agency and started writing to her in June of 2006 and then visited her on 4 different occasions in the Philippines, in January 2007, November 2007, April 2008 and July 2008.

This will suffice, or will i need a bot more detail about each trip, where we went and what we did etc?

From my understanding, this question is referring to how you met in person.

Mine simply states "After speaking online for 8 months, on May 5th, 2008, I traveled to Australia by plane and spent approximately 6 weeks at my fiances home until my departure back to the US on June 15th, 2008."

I don't know that I would put "introduction agency" on there as it might be a red flag for a CO to think marriage broker in disguise? Maybe dating site if you even feel it's necessary to mention that aspect at all, rather than just a generic "online"?

Don't need every one, just a few here and there to show they extend over a period of time. Remember, they are secondary evidence, visits are the biggest one.

Ended up phoning the headquarters in Brisbane and was told Australia's police certificate is country wide, so as long as the fiance has only lived in AU, the certificate will cover all states he's lived in there.

What makes you think that you have to wait for the package 3, or even the NOA2? Of course, I am processing through a different country's embassy, but assuming it would be similar since it's a US deal...I was told the medical is good for 1 year. I know there are some embassies that require it the same day as the interview, etc, but that doesn't mean all embassies will handle it that way. Best idea is to click on embassy info at the top of the page and see what their web page says, and if still unsure, call/email them. It is very possible you might be able to make a trip over for the medical well ahead of time, then travel again closer to your interview date. Check your embassy's info page.

When I had my gall bladder removed, I was laid up for about a week. I had a 2 year old I had to care for and I managed fine. Unless you have major complications, I very much doubt they're going to help you out. Seriously, it sucks to be away from your loved one and we all want our cases expedited, but chances are it's not going to happen. Focus on getting better and helping your mom through her struggles as best as you can, and be patient with the application process. Quelch your id.

I have already filled out all the forms that I downloaded, and just left the dates/signatures blank. I've accumulated what proof we have now, and I keep adding to it as more is received. I contacted my embassy, and the police certificate/medical records are good for one year, so we plan on doing them around the time we expect our NOA2--even if we get it later than we expect, they'll still be good for a year after that date. So, yes, you can prepare now and get your stuff together and ready to go as far as is possible. I don't like sitting around waiting, so this makes me feel better about the situation. And when the time comes that we receive our packet 3, we will have very little left to do to finish preparing and can get an interview date ASAP.

You need to contact your embassy and find out how long they are good for. My embassy accepts them a long as they're within one year of the interview date.

I do not know why people continue to say this... there is no visa fraud to come to the US to get married.... The problem is if you come to the US and enter on a non-immigrant visa (or visa program) with the intention to immigrate permanently on that visit. It is the use of a non-immigrant visa to circumvent immigration law that is the problem... not simply the marriage event... Subtle (maybe not so subtle) but important difference!!!!!!!!!!


I understand that, I was responding directly to the OP's situation, and while I may have misunderstood her intentions, it def read to me that she was asking about coming over on a tourist visa to marry and stay (as opposed to marry and return and wait it out that way). Hence, my additional comment about other ways besides the K-1 (K-3, CR-1, etc), but they all cost time and money. Otherwise, yes, you are correct.

Would it just be easier for us to get married when i go on a planned visit in March and try and stay there and get approved? Does it take longer for the process to go ahead? And during this process of approval to adjust my status would i be able to work?

I honestly dont know what to do. I look at some of these timelines and BOY! are they scary. We already took it so slowly and are finding it hard being apart. But i wouldnt want to put my partner in a situation where he would be the sole provider for an unknown period whilst an adjustment goes ahead.

The other thing that worries me.....if we did go down the K1 route and applied tomorrow, would they let me into the country for a planned visit in March? or would they be unlikely to approve it because I am trying to marry a citizen?

Has anyone gone through this themselves? Any and all help and advice is appreciated before we hurry head long into either the K1 process or plan to get married on entry in March.

If you enter the US on a visitor's visa with the intention of getting married, you are committing visa fraud. There are other ways to do it besides the K-1, but they all take time and being apart from your loved one. It sucks, but it's a small price to pay to eventually be with them when everything is said and done.

The immigration process requires the USC to support the immigrant because there is a time period when you will not be able to work (not to mention future situations that might come up). Immigration is expensive and you should be aware that it is very likely you will spend a couple months here before you're able to work and your other half will need to support you. If this isn't something that he is able to do then immigration to the US is probably not a feasible idea. Be prepared to pay a lot of money and spend a lot of time waiting on this process. In the meantime, do what you can on your end to save to help get through that time period as smoothly as possible. You'll probably have a good 6+ months of waiting from the time you file K-1 til you get here as it is, lots of time to help offset that financial burden you two will experience for the time you're unable to work.
