MUY SOLO you have some issues. I find it hard that that you come and truly want answers. You really need to get help for yourself. Anyone that talks badly about the process, cannot take two months of separation, and then has the audacity to put your private information on forum and think your untouchable is living in a la la land. If you do not wish to support others in this process or do it the proper way then go about your business. This forum is for persons doing it the correct way and to illict support from others that are going thru this hellish process.

MuY Solo, I am an overstay at the moment and I guess technically illegal through no fault of my own. If I didn't have a conscience, which thankfully I do, I guess I could have chosen the same path as you, but I've chosen not to. I could not bear to hide and live in fear for the rest of my life. I have a son (I'm not sure if you have children) but never could be so selfish and force this life upon him. I love him too much for that.

My heart goes out to all of you. I have just spent the last hour or so reading through all of your posts ending up in tears.

Although not in the same position I am awaiting a decision on my I 360 VAWA filed last November. due to a abusive marriage If it is approved then I may be able to stay, if not I have no choice to return and be barred for 10 years, leaving someone so dear behind.

The waiting, hoping, anxiety and sleepless nights is unbearable. I can totally empathise with you and your journeys.

I pray that all of you soon receive the good news that you have all so desparately been hoping for. As for Mary and Tom, your story had me in tears. I wish you both peace in your hearts and strength to overcome the hand you have been so cruelly dealt.

Someone mentioned the Young Ones. The last two weekends I 've just watched the whole series and the follow up "Bottom" which we got from Netflix. I miss documentaries as I no longer have cable. I like the health channel, History channel and the Discovery Channel.

Do Netflix have "Filthy, Rich and Catflap"? That was the real follow on to the Young Ones, certainly more so than Bottom is. Not much cop though sadly.

Talking of the name Randy. I find it hilarious too, but my son has a friend here in the US called Rusty. Can I remember it correctly? NO! I've repeatedly called him Dusty and Randy, to the point where I've actually said to him "I'm really sorry, but I can't ever remember your name correctly, it's really nothing personal!". He's a good kid actually and finds it funny, but still... :blush:

Congratulations. I'm so glad everything went with your medical. I understand about the anxiety and panic attacks. I began to get them during and after my marriage to my ex here in the States after he was abusive. I also suffer from PTSD. I have to have my medical here soon for my AOS after my battered spouse petition was approved and I'm really nervous too, especially as I ended up in a pysche ward because of him. I'm trying to be positive as it was related to the abuse but it's worrying me all the same.

I agree, running away from UK debts IS irresponsible, but then accruing those debts in the first place, knowing full well
I couldnt REALLY afford the repayments was irresponsible.

At the time, as a single mum, it seemed the only way to be able to feed and house my daughter and I.
So then maybe continuing the pregnancy was irresponsible, knowing that I wasn't in a position to raise a child financially.

Hell, Im damn irresponsible, but wouldnt change a thing.
Hopefully, Ill be able to repay the vermin who target the financially disadvantaged, but Im not really going to lose any sleep over it.

I was a single mum too, with no maintenace from ex. I worked bloody hard as a teacher to support my two boys and paid all my bills, loan installments etc . Now if I had been given that damn EAD a year and a half ago I would be still able to keep paying them off now. Well I'm paying 10 pounds here and there on debts (which my boyfriend gives me) and thats all I can do.

I'm about to renew my Uk passport as it got wet and damaged slighty. The question I have is that I was married on a K1 and divorced withn 14 moths due to abuse. I never got round to changing my passport to my marrried name. I hvae been reading the C1 form and it asked if I am single, married , divorced etc. Well I am divorced so does that mean I have to send my marriage cert and divorce decree even though the passport was never changed to my married name

I'm pretty confused and have to send everything off tomorrow as it's taking 6 weeks to process. Oh one last question, would I also need to send a copy (front and Back) of my greencard. Everything is in my maiden name.

When you say my fingers are in the system do you mean with the Greencard fingerprints? I didn't have fingerprints taken for my passport when I was in the UK.

Maybe I just got a grouchy officer.......

I might call the Embassy just to check. Even that's expensive at $2.60 per minute.

I know this is a slighty different question to the normal renewal ones.

My UK passport doesn't expire until 2013. A few years ago my passport got really wet when something spilled on it. Hence the front cover ...the gold writing on it has really faded and my photo has faded slighty but still clear.All the details with the photo are absolutely fine.

I received my greencard in September and travelled back in December for the first time in 4 years. When I went through Immigration the guy looked at my passport and said I could be refused entry because of the fading. I'm just wondering if this is true and has anyone else had issues becasue of the condition of their passport?

I have to go back in August to see my family and the renewal cost is so expensive.

I'm sorry with all you are going through. It saddens me to think you were duped. It's seems unjust that such scammers are able to get through this and obtain greencards whilst people like me came here to marry a man I truly loved only to be abused by him. My case is totally genuine with lots of evidence of mental abuse yet I'm probably going to denied. I never lied about being pyhsically abused by him to obtain police records becasue I was not. In fact I was so under his control that I was infact too scared to even do so when his mother hit me. I did visit the police and spoke to them but could not make a formal complaint due to the repercussuions that would have entailed.

Thanks for adding that. I came here on a K1 so I guess it's different. My attorney told me you can apply for a fee waiver if you earn less than the poverty level for one person, which she said was about $10,000. All I had to do is submit evidence / copies of any expenses that I had to pay each month.

Hi Kdkd,


I just received a post from you asking for help and I'm so sorry you are going through this. I have been what you have been through and can certainly give you advice.

First you need to decide whether you want to stay or return to India. If you wish to return home then you can get divorced here and then go home. It is the simpler choice but not your only one.

If you wish to stay here, and it certainly seems like you have a case ,then you can file an I 360 for abused spouses under VAWA. As Hollis suggested it can be expensive. It was for me initially because I was unaware that I could get pro bono help from the Catholic Charities and spent and wasted several thousand dollars on attornies who dealt with VAWA but at the end of the day they were useless. My advice would be to seek a pro bono attorney through this organisation ( Catholic Charities) as my attorney was absolutely brilliant and it cost me absolutely nothing. The shelter you are staying at can help you find one.

You will need to gather various information pertaining to the abuse. This will include your own affadvit of every abusive incident that happened. It does not have to be just physical. I filed due to extreme mental cruelty which it seems like what has happened to you. Find anything you can to support your case. If you do have police reports this will be extremely helpful. Personally I did not have any . Get any witness statements from neighbours, councellors, doctors, the shelter where you are staying and I mean anything. It is so important that you have this evidence otherwise they may not see your case as credible. However, having said that when adjudicating the I 360 they use a standard of "any credible evidence".

You will also need the following:

Proof that you were married ie marriage certificate
Proof that you were living with your spouse ie joint bills
Proof that your spouse was US citizen ie copy of his birth certificate , passport
General proof that you are of good moral character . (This I just stated in my affadavit). You could also get a recent police certificate.

Since your husband has not filed AOS the you are probably out of status which also happened to me as my ex refused to go to the interview although he filed. You will really need to get the I 360 filed as soon as possible. Due to being in this situation I do not think you will be able to get work authorisation until the I360 is approved which could vary in time. For some it has only taken several months for me it was 15 months.

Once you have filed the I 360 you will receive a prima facie determination which basically means that if the evidence you have sent is found credible then you will most likely be approved but it is not the final decision. If approved then you can apply for work authorisation ( you can get a fee waiver as I did) and then you you will be able to work and also file a an I 485 for which you not need an affadavit of support ,as it is a self petition.

Once again I urge you , if you decide to stay, to get a pro bono attorney as soon as possible and would definately not recommend doing anything without legal advice. The advice I have given you is based on my own experience and every case is different.

Just a furter note although you can file within 2 years of being divorced it is far better to file the I 360 before any divorce is final.

I really hope this helps . If you need any further advice or just want to talk, PM me on here and I will support you any way I can. I truly am sorry you are having to deal with this. It is a very difficult and emotional process which takes time but you can get throughit . I did!!

I had all my vaccines done by the nurse in the UK -MMR T/D and hep b (I'm a teacher). I just asked the nurse if they could type up the vaccines given on headed paper and get the doctor to sign it which she did. I don't think it cost much if anything.
