The K3 has been slowly eliminated from most consular’s, because the K3 takes the same amount of time as the CR1 now.

K3-ia multiple entry visa for up to 2 years without a Green Card. No work privileges.

CR1- Green Card, with all LPR privileges.

Forget the K3, it is not easily available from most consulars. With the CR1(spouse visa) the AOS is done before the visa is issued, which gives you a green card availability upon entery into the US.

You realize that the wedding would need to take place before you file for the CR1 visa, after it is approved 9 to 12 months later then you would be looking at a reception in Jamaica. So,what are you going to do about your K1 application that is already in the pipeline?

You're right there are many lovely beaches in the U.S. I just wanted a vacation type destination for me and my family away from the U.S. I will not be getting married on the beach as I am Catholic and it has to be in a church.

But I wanted a fun reception and vacation.


Get married in the Us,then a couple years later have a re-newal of the vows in Jamaica.

Family can have their vacation then.

I want to get married in Jamaica. My fiance is from Ghana. You don't need a visa to go to Jamaica just a passport. A have a couple of questions. 1) Would the marriage be legal here in the U.S. as far as the U.S. immigration is concerned or do we have to get married in the U.S. for the fiance visa?
2) Can you fiance travel from the U.S. then to Jamaica to get married or will he have travel restrictions because of the fiance visa?



If he is coming to the US on a K1 then you cannot go to Jamaica to get married if you'll wish tocome back to the US to live immediately.

FACT_ marriage in any country in the entire world is legal according to US immigration.

IF your finance comes to the US with a K1, and leaves US territory he will needs another visa to re-enter.

Calm really isn't in my vocabulary right now. I have $2,200 in non-refundable airline tickets. All of her stuff is packed in boxes carefully weighed so that they don't get overweight charges. She had to pay for transportation to and from the airport. She said goodbye to all of her friends. She took her daughter out of school. I had a bunch of people on this end ready to meet her at the airport. Some of her stuff was sent here via Fedex. I had appointments set up with people at the school. All of my friends had helped me get the house ready for them to come here. I sent her money for the extra luggage fees. Her brother was set to move into her place and rent his.

Can you get an idea of the picture from all that? It just isn't a calm situation......



Jim, why aren't the 1st class tickets non-fundable? Now everything else is just a timming issue, and there is nothing you can do about it now. Plus with you being this non-calm is making your SO feels as if she has done something wrong, or she didn't do enough.

Sure by now you have learned you can't control the embassy, so wait out the 7 days. It generally take 7 days to re-print a visa. Is there any other document you can think of that might be close to expiring, the PCC from Japan? Generally PCC's are good for 6 months.

Jim, ok it looks as if they are going re-issue the visas. Try staying calm, it looks as if there is plently of blame on both sides. if you don't hear back from them in 7 working days them have your finance to go back to the embassy if she is able.

Jim, this is what I told you was the problem when you first reported it. Not only will you need to re-do the medical you should look at all of the required documents for the validity of their expiration date x 2(mother and child). You will need to re-pay a visa fee x2 too, if you'll let the daughters visa expire while trying to get a new visa for the mother.

How would they not know,unless he lied on the application.

Question on application: list ALL address that you have lived at. If he lied and did not list his US address, then he would be committing FRAUD.

He did live in the US at an address ,because the OP stated in her first post that he worked illegally in the US. What she didn't state was how long he worked.

If your child is the child of a USC, then you should be doing a CBA, your child might be entitled to a US passport. USC can not be given a visa,since they have the right to enter the US.

Why must it be one in VA, immigration attorney can be licensed in any state to work on a federal immigration case. If you are looking for an attorney you need one who has put in many hours related to the particular issue(s) that you are having with immigration.

In terms of any other red flags-- I'm not sure where there would be any. He has never solicited a visa and we answered all the questions honestly. It really is super hard- but like sam&jensi said, we may need to just travel more. Gather everything up and pray that the next round is easier. I know anything that's this much much has to be worth it- so we will keep going strong, I'm thinking that the marriage route is better only because at least we will legally be together and then worry about the rest later.

You can get married tomorrow if you wish, but if you do then the K1 is dead. The marriage visa is just as hard to prove a true relationship as the finance. You will be married, so now you must operate as one. Hint Hint

She only needs to provide a copy of the visa in the passport. You may run into a residency issue when it comes to tuition rates... One must reside in many states for 1 year to be considered a resident when it comes to college tuition.

A K1 visa only grants you entry into the US for the 90 days window for marriage.

After marriage to a USC a K1 entry must file for an AOS(adjustment of status) to a legal status of a LPR(Legal perm resident) which grants you a GC.

This GC(greencard) allows/gives you the right to apply to attend any US educational facility without having the need for a student visa.


There is a handbook on the USCIS.gov website that explains all of the rights and responibilities that a LPR has when they are granted a green card. This is a must read to fully understand your migration to the US.

Wouldn't you have thought that this would be something that was worked out before coming to the US. What is being talked about durning those many hours of skyping, texting, emailing and talking? When you get your USC, you pledge your allegiange to the US of America, you as a citizenof the US don't even know what it means to be a citizen. Why oh why must it be explained what it means to be a USC.

Ugh, the truth is if you are a USC you should be traveling only on your US passport. But let's get beyond what you didn't do, to what you did do, you will need to request this information from the e-passport owner. The country will need to send you a copy of all entry and exit you have made using the e-passport.

Your RFE is only good for 30 days, so you are going to have to rush on this.


Yes, we know people use their home passport to enter their home country, but once you are a USC you should only be using your USC passport. I didn't write these rules so I am not debating them.

Hello all! My fiancé and I hoping to get some advice and help with our K-1 visa!

First a quick run down of our situation:

I'm the US Citizen and he's the UK Citizen

My fiancé and I met in November 2006 shortly after we started dating online. Seven months later he flew out to america so we could meet, he stayed for 3 months then went back to England, 20 days later he flew back out for another 3 months then again returned back to England. Ten months later he was able to fly back out again and stayed for 3 months. Upon his arrival customs held him for 2 hours and told him he can stay for the 3 months but would not be able to come back to america without a visa, and if he tried it again he would be de-ported. So we looked into visas, and at the time the student visa seemed like the best option, our local collage had a program and we got everything all okayed by the school. He even booked another flight to go home a week early so he would be able to make it back in time for beginning of the school year.

My family said they would support him and provided a bank statement along with all of the other necessary paperwork.

His visa was denied because the interviewer said her friends wouldn't give her that kind of money and she didn't think it was creditable. Due to financial reasons and the visa being denied we weren't able to see each other for 3 years but talked every day and was able to keep our relationship going. This January we were finally able to see each other again and on March 1st I flew out to England! I arrived and we decided to apply for the K-1 visa so we got engaged and we submitted I-129F, on March 29th they received it and sent us our NOA1. We decided to change my flight so I could stay the full 6 months (I was already planning to stay 3) and hopefully I'd still be here for the interview. Looking back that might have been a misjudgement? I'm still not entirely sure. I'm leaving for America on August 27th.


Our only concern for not getting our visa the income. He has his own business developing apps and makes more money than the government poverty line but he only started making that much at the very beginning of this year (hence being able to see each other again since January it just took time to get my passport and everything all planned out), meaning he doesn't have tax returns for the past 3 years showing enough income, just this year, are we doomed? :| :(


We really don't want to be apart again as you could imagine, lol 3 yrs apart is long enough! Is there any likely hood that we could get to the interview before I have to fly back?

And if not is there any way I could come back if the interview happens after I have to go so I can be here for the interview? ie if the interview happens in October could I fly out again for the interview?

I'm also slightly confused by the process of it all, We sent off our I-129F and received our NOA1 and to my understanding the next step will be getting our NOA2 and then he'll have to have a medical and gather all the documents and proof we have for the interview? Is this correct or am I missing something?

Also I've read a lot of interview questions and some slightly confuse me, one person was asked when their wedding date was, how are you supposed to plann everything before you even know if your going to get your visa?

I really don't care how you respond to me. I care about helping people understand what to do to have a successful outcome. It doesn't help to confuse them by calling a petition a visa, etc. If you want to help, then learn the terminology and use it correctly. Until you do, you do more harm than good.

You are simply confusing people. No "visas" go through USCIS. Petitions do. It is the "approval" of an I-130 that doesn't "expire". If you will learn and use the correct terminology, people will be far less confused.

Cgayle, there are many different types of visa that goes thru the calif USCIs, there is the K1, K3 or the CR1. We had already established that the CR1 (130) does not have an expiration date, the K1 and the K3 does, since these two donot mean any thing to you, disregard any comments or reference to them.

My statement was in reference to all and any type of petition that goes thru the Calif USIS center. A 130 petition doess not have an expiration date, but if it is revolked it is as good as never existing.

It is my understanding that the Calif USCIS office usually just deny or let the orginal petition expire.

I know everything that was asked in the interview. I don't think that there was a problem with the interview. I do know that my husband had applied for a work Visa 2 years prior to this petition. He works at a resort and a man from Florida came there to recruit workers to come to Florida on a work Visa. My husband was denied that Visa due to not making enough money to support himself while being here. I think that is where the red flag was put up. Whats your thought?


It is the US govt objection when they are interviewing for migration thru marriage that the beneficary is not using the petitioner for false intent. They are there looking out for your best intrest, I know right now it doesn't seem that way. But that is what they are suppose to be doing. Now, a denied work visa would have no bearing on a migration visa.

You may know everything that was asked, but how did your husband answer them? If all was done truthfully and above baord, then you should be able to fly back thru the re-review of the petition without any problems. I know this waiting is hard, but right now it's all you'll can do. Just continue to live your life as a married couple and let the love grow stronger thru this trail.

Now today, I could offer up my hubby to you, since he has step on the wrong nerve today(lol), but I did marry him for better or worst. You will soon get to experience some of small wonders of married life.
