Sorry to hear about your setback. But I am in the same boat as you. My case was sent back to USCIS and got no resposne from them for nearly two years. So I hired a lawyer, and they told me to refile the petition and start over again. But now I recieved a notice from USCIS saying that they are reopening the case. They originally sent it 10 days before I actually sent the 2nd packet, but I didn't ge it till today because they sent it to my old address.

I was told just like you to wait, but I called and called and sent letter after letter, and USCIS did nothing but ignore me. So I got a lawyer. I really don't know what the old case will do, I already have a NOA1 for the new case. MY advise is to seek a lawyer. PLEASE DO NOT WAIT 2 YEARS LIKE I DID WAITING FOR THEM, IT IS A WASTE OF TIME.

Sorry to hear that, i think that i find out what is the issue. The translation of marriage certificate has the wrong date. I find out the a week after it was approved. I caught it while i was adding my wife in the Army's family member database, actually, the lady that was working on it saw it. I sent the right one to the NVC but i never contacted USICS about it since i already had been approved. Big mistake

Is there anything that you can think of that may be "off" with your marriage cert's there or something to that effect? Im TOTALLY speculating, but perhaps something slipped through USCIS and NVC that caught the consulate's eye.
Sometimes docs make it through USCIS and NVC but when they reach the consulate(since they are more familiar with local docs), they see there is a problem. I have seen that happen, but they still have preformed the interview and explained the problem to the applicant.

You know, now that you mentioned that..with the english translation of the marriage certificate there was a problem that i knew and was approved anyways..the date in the translation says "12 September 2002 and should be 12 Septembere 2008..I think that was the problem. I caught that a week after the I-130 was approved. I contacted the translation agency and they fixed it and i have it here with me. I sent a right one to NVC..thanks you..you just told me what is going on...

Im sorry to hear that. Admisinstrative processing(AP) is not a re adjudication of your files. It is usually additional background/name checks. There is no timeframe for it unfortunately. Women in AP is pretty rare actually. Hopefully it is swift.

According to USCIS, the embassy was the one that kicked it back without my wife going with the interview. She waited for almost 1 hour and half and she had to get up and asked if they had her for interview and they said yes, but the case was sent back to USCIS. USCIS dont have information stating why it was kicked it back, USCIS told me to talk to the embassy to asked them what was the problem. Question: What you mean with "re adjudication".

I'm not sure I'm following... so your wife went to her scheduled interview, but no interview took place? And they sent her file back to the U.S. without an interview? Is that correct?

I've never heard of that before (which isn't saying much, as I haven't heard of a lot of things...) I have no advice, but in any case, I'm sorry you're going through this! It must be awful. I wish you the best of luck in sorting things out.

Thats correct, just what you mentioned. Even the officer whom my wife went to ask what was going on, called the vice consul to see the case. They explained to wife that it was a rare case and even let her go inside and see the computer. They told her that they would do what they can to find out what happened. The vice consul emailed me and told me that he personally had sent an email for explanation since an explanation was not given the time the USCIS requested the case.

Stop calling USCIS, they have no detailed knowledge of the status at this time...so whatever they tell you will be conjecture. Your wife's case is in Administrative Processing (AP) which as Y's h explained to you is a re-evaluation of your file...additional background checks, etc. While it is rare for women, it still occurs. sent them an email asking if they can provide an explanation as to why

learn anything.

We will do our best to find out what happened and what can be done to
move the case forward.

It is confusing and my wife did not explain clearly but we can clarify.

The petitioner’s claimed signature on correspondence between Petitioner and Beneficiary does not match Petitioner’s signature on notarized documents.

I signed my first name instead of my fullname because it is informal.

Well. What would you do if you had been the Officer that did the interview? Those basic questions not being answer may tell that there is not interests on the beneficiary part. They are basic questions that anyone in love should know by heart. Thats just me. I will be suspicious also..like i said, thats just me..

That is bizarre. You had your case completed at NVC, and then instead of sending to the consulate, it looks like they sent it back to USCIS. I've never seen that before

It was sent to the consulate. My wife had her interview and the date of the interview she was told that her case has been sent back to United States and no reason was given to her. She did not have the interview. In other words, it was not denied nor approved.

The thing is, "sending it" to USCIS then to the embassy is just wiring it back and forth, the embassy technically always has the case at the embassy after it receives it. So there was probably some confusion with the interview but upon review the embassy cleared it up and decided to not have ot go through USCIS. Also, there is a lot of information about how the USCIS is getting backlogged and absolutely don't want more cases to deal with that they have already approved. They request that the embassy not send cases bac to them unless its just total obvious fraud, or huge discrepency of paperwork or proof on the side of the applicants. In this case, be happy it is going to be handled at the embassy, we really don't know solid answers to why the embassy does certain things but I hope your journey is smooth from now and that you will receive the visa soon.

BIZARRE

After USCIS ask for the case from U.S. Embassy April 20 to review it (my wife already had had interview and cancelled because of USCIS asked for the case) and the case going from embassy to NVC to USCIS, the Vice Consul of the embassy just sent me an email saying that USCIS is sending back the case to the embassy and hoping to give my wife an interview a week after they receive the case.

Is this something normal?? What could have happened with this case that it was sent back to the U.S then back to the embassy without telling me what happened???

Anyways, its all good now. I guess the letters that a Texas senator and my congressman sent to all of them this past wednesday worked out.

Just wanted to know if any have had this before,

Things I did not see on the Step by Step Instructions for CR1/IR1

I have read step by step instructions about bringing my wife to the U.S. NOA2 Approved was received on 12 Feb 09. This is for CR1/IR1. I did not get these things from the intructions:

1- The documents that are not in English. Do they have to be translated from Spanish into English? The country where the consulate is located at is Spanish speaker region.
2- Do I need to send the same documents I sent in the I-130 to the NVC?
3- My wife is currently in Uruguay and I in U.S. The DS 230 has to be signed by her. Can I sign for her since it would take time and money if she actually do it? As I read in the instruction, I send the DS 230 here to the NVC

Two ways. Which one is the right one?

When it comes to deal with NVC on documents. I have been hearing two ways about the documents that my wife in Uruguay has to gather (our marriage certificate, birth certificate, police records, etc). Does she send them to me so that I can send them along with the DS 230 to the NVC here in the U.S. or does she keep them with her and bring them to her interview?

In case I-130 and I-129F Approve at the same time

The I-130 was approved 12 Feb 09. I sent the I-129F the 6 Feb 09 and today i got both NOA and NOA2 (approved) from I-129F. It was sent to NVC just like the I-130. What is going to happen since both I-130 and I-129F are in NVC? In the NOA2 form I-129F in the Notice Type says valid from 12 Feb 09 to 11 June 09. I want to persue the CR1/IR1 not the K3.

Error Verification

Mistake!!
This is the issue. On saturday I called NVC and the machine told me that on 13 March they sent a letter because i had missing documents. Now, i get the message "The NVC has received the checklist letter response on 16TH March......
Whats going on??

Before I posted the first one I already had seen the automated messages at VisaJourney. Apparently you did not understand the first one thats why I came with another way to make people understand what i am trying to say. Its obvious that NVC already received the DS 230, but I am trying to find out if the automated message means that they are creating a checklist to let me know that i am missing some documents. Did you get a message like that in your case? if you did. Did you have to send documents that you forgot in your packet for example, Photocopy of the marriage certificate, etc.. Does this make sense to you now???

Letter to my congressman worked

I just had an issue with USCIS and the Embassy. Embassy sent back case per USCIS request April 20 2009. I never got any concrete reason as to why it was sent back so I let them deal with it. It was June 15 and I had to send a letter to my congressman which he replied to me saying on 8 July that his office will ask USCIS, NVC, and Embassy what was the issue so that the case could get moving. 10 July I got an email from Vice Consul at the embassy saying that USCIS was sending back the case ASAP. The congressman office contacted me 11 July telling me that USCIS and Embassy sent to his office a response telling him that the case has been sent back to the Embassy and will give my wife a new interview as soon as they received the case. Well, today my wife received a call from the embassy to ask her when was the best time for her to come for an interview which it was set for next Tuesday. I am sure that the letter from the congressman to the parties involved had our case being seen and taking care of.
If you have a case where none of the parties can tell you what the heck is going on with the case, then contact your congressman. It worked for me!

CR1 VISA APPROVED WITHOUT INTERVIEW??

My wife just called me and told me she did not go through an interview instead the Vice Consul asked her for her passport and told her the visa had been granted. What happened was that i had to go through congressman for some issues going on with the case and i believe that played an important roll. Anyways..thanks God she got the visa.

My I130 was approved 12 Feb 2009. What is going to be my next step? I am in the U.S. and my wife in Uruguay. I also submitted a week ago a I129F packet and wonder what i should do. Should I stop I129F (K3) packet? Also, if i go with the CR1. Where the DS 230 would be subitted?

It might be an issue. I knew a case where the foreign spouse had suicidal marks on her wrist. The doctor that conducted the physical exam recommended to postpone her interview to evaluate her mental status. It took almost 2 years for her to be given the Go Ahead from the Doctor. Her interview then was scheduled and had to wait 7 months for that interview. Dont know if she was granted a visa. Now, i guess it all depend on the Doctor.
You know, i deeply love my wife and at one point i wanted to get a tatoo on my forearm with her name. But i decided not to do it because I thought I did not have to go that far to let her know how important she is in my life. I would not want her to do something like that either. I would not want her to hurt herself just to let me know she loves me.I think is a childlish act, but that just me.
