Not sure if this is the right spot, but I saw this today and haven't seen it posted on here yet. If it has been already, then I apologize for posting it again.

USCIS News Alert

In November 2010, USCIS transferred approximately 36,000 Immediate Relative petitions from our California Service Center to our Texas Service Center. We anticipated that this redistribution of work would result in more timely adjudication of these petitions. Due to a number of unforeseen circumstances at our Texas Service Center, many of these cases have not been processed and are beyond our estimated processing times. We sincerely regret any inconvenience this may have caused you and we are making every effort to remedy this situation as soon as possible.

On Feb. 7, 2011, we implemented a rapid response plan to expedite the adjudication of these petitions. We have transferred a large number of these Immediate Relative petitions back to our California Service Center to take advantage of resources currently available to immediately process these cases. Petitioners will see an action such as an approval, denial or a Request for Evidence (RFE) on their case from our California or Texas Service Centers by the end of February. Additionally, we have briefed the Department of State’s National Visa Center about these cases.

When I got my visa I just used my fiancé's information for my contact address. I didn't want to buy the tickets until I knew I'd get the visa so I just went to the airline website, put all the information in as if I was purchasing the tickets right then, printed off the screen that has the summary (before you actually purchase) and sent that in. I had no problems with that and then just purchased the real tickets after I got the visa.

For my husband it seemed to go pretty fast during the whole process.

I submitted everything on April 14th of last year. It took about 63 days from the NOA1 to NOA2. No RFEs or touches during that time, just went from initial processing to approved. It spent about 4 days at the NVC and then was received in Rio about 5 days later. Once we had confirmation that they had received it we emailed the consulate asking about our interview date. We received an email response with the date and time and then on the 15th of July we received the packet 4. His interview date was on August 24th. It took about 127 days or 4 months from the NOA1 until the interview.

My husband and I were originally going to get married in Brazil, we instead went with the K1 option. But previously to that decision we had done what we could to do in order to marry in Brazil. Here's the information from what we did, though it can vary greatly what you will need as far as documents since each cartório can require different things. For us I had my birth certificate authenticated by the Brazilian Consulate here in the US. Since I was actually already in Brazil at the time, I had my parents mail it to the consulate and then put the address of where I was staying in Brazil as the return address so it was sent directly to me in Brazil as soon as it was done. It didn't take too long to arrive. As far as the single status document, that was easy to obtain from the US Consulate in Brazil itself. They will just required your ID for documentation, probably passport and then you just sign some form stating your single status, very easy and was about $50. I had my original birth certificate, already notarized by the Brazilian consulate in the US translated into Portuguese in Brazil. I was also requested to have a CPF, which was easily obtained at a post office in Brazil. I was also needing proof of address in Brazil, which was a bit harder to prove since they (the cartório) was requiring strict requirements on that. Lastly we were going to need to wait a few months before they would approve everything and give us the go ahead to actually get married there, which by the time that would be approved I would have already returned the US. Due to that fact and the problem we had with the permanent address in Brazil, we decided just to do the K1 instead. Which for us was much better as then once we were married we wouldn't be separated waiting for my husband's visa to get into the US. As for the criminal record, I was never asked for that, nor did I have it if they would have asked. So for that part, it was never really an issue.

My husband and I were originally going to marry in Brasil, but having to go through all the requirement documentation and some of it wasn't even possible for us to complete due to what they require and all the differences between the different cartórios. So we ultimately just filed for the K-1 once I returned the US. It took us just over 4 months to have approval (from interview) from when we filed. As much as I would have loved to been married in Brasil, the K-1 was the best option for us.

My husband and I want to register our marriage at the Brazilian Consulate in Chicago, but are confused about the requirements. We tried to email the consulate to find answers, but didn't get very far. Maybe someone on here will have a better idea as to what we need to do. We are confused about the part of showing single status before marriage. The website isn't very specific so we're not sure how we go about showing our single status prior to marriage. He is a Brazilian national and I'm the US Citizen. How do we show single status for each?

Yeah for Brazil. You would both complete one. I filled out mine with zero income and a letter explaining that was in college and was not employed then had my cosponsor fill out the same paperwork and submitted with their birth certificate. (You'll have to do the same for the AOS as well if still using the cosponsor).

When I went to Brazil last year with the intent to marry there I had my birth certificate sent to the Brazilian consulate in Chicago for them to authenticate it then had it sent to me in Brazil. Once it arrived I had it translated in Brazil to Portuguese. Unfortunately due to the extra long wait time the cartório required we would not have time for the marriage by the time I had to return the US. We tried 2 different cartórios in the state of RJ and one quoted us 60 days wait before they'd issue the license, another was 90 days. The other forms required like the evidence of single marital status only took a week or so to get, just had to make an appointment at the US Consulate in Rio to get that, very easy.

This is the medical exam review from my fiancé who had his medical done earlier today.

MEDICAL EXAM

Today I made my medical examination, with one of the registered Medical Doctors of the Consulate of the United States in Rio de Janeiro, Dr. Joaquim Duarte Silva.

As you can see in this link http://www.embaixada...edMarco2010.pdf there's a full list that the United States Embassy accept in many cities in Brazil. As for Rio de Janeiro, we have 4 options, being distributed in 3 different neighbors, Botafogo (2 Medical Doctors, same building, same office), one at Leblon, and Dr. Joaquim Duarte at Castelo (in front of the Consulate, just across the street).

After me and Sara read several reviews at the Visa Journey Forum, many people said very good reviews regarding Dr. Joaquim, that was a good thing, another, the fact his office is located just across the street of the Consulate of United States, made for me, a good difference.

Review:

My first contact with his office was back in April 16, I called his office and the lady (his secretary) asked me right on what was my e-mail and she would be mailing me all the instructions for the medical exam. In that time, she told me that they only schedule appointments after you have your interview date set. Well, very good, by the time I had hang off the phone, I opened my mail box and there was already their e-mail with all the instructions.

Later, with our interview date scheduled, I called again and could schedule my appointment. Again she sent me the e-mail with the instructions.

As the e-mail is all in Portuguese, I'll make it short with the information:

Documents required:
- Passport
- 3 pictures 3x4
- Case Number (if have)


The appointment can be made 1 day prior of the interview.

Blood exam:

V.D.R.L. (Syphilis) - Can be made at the Doctor office, or there's two laboratories that Dr. Joaquim accept: Laboratório Sérgio Franco or Laboratório Lâmina. Both in same street, Ouvidor Street.

If you have health insurance, I would suggest the Laboratório Lâmina, they have a very nice phone service support for all questions, good quality of employees, you can see your results before hand at the internet.

X-Ray:

Seems you can do it at the office of the Doctor, or also at a single clinic very close of the Doctor's office, Clínica Radiológica Dr. Lauro Coutinho, located at the Araujo Porto Alegre Street, the clinic accept health insurance, and the results you get as soon you make the exam, just a wait time of about 20-30 minutes.

For women, is needed to make a gynecologic exam (well, that do not apply to me, hehe), Dr. Joaquim accepts the exam made by Dra. Márcia Grimberg located at the Uruguaiana Street.

Vaccines:

There's in many websites graphics or tables with the correct vaccines each person should have, regarding their age.

Since I lost my Vaccine registration, I had to take all the ones that applied to me:

At the "Posto de Saúde" I could get
- TD (only at "Postos de Saúde)
- MMR (also, this one you can get on the Doctor's office for a fee of R$ 70.00)

At the doctor's office, during the exam he applied on me the Varicella vaccine, as I've never had the disease before, this one has a price of R$ 150.00)

The Exam

I got 40 minutes in advance of my scheduled appointment time, the secretary asked me for all the required documents, plus my X-Ray and Blood Exams, she started to fill part of the forms, and soon I got invited to enter the Doctor office itself. Dr. Joaquim seemed to be nice, a bit serious, made the questions on the form in a straight way, without making trick questions or nothing like that, everything went fine and very fast during the questions (yes / no), I did a small amount of jokes due the content of questions we need to go through (besides me and Sara we had already read all the medical forms and what should I expect).

During the physical exam, he asked about my fiancée, where she lived, we could chat a bit as I talked good things about his specialization (as he is a "Intensivista"), my blood pressure was a bit high (my usual by the way) - 140 / 90 mm/Hg - he said that could be because my stature and weight, and he said " - Oh well, your interview is soon, you must be stressed, so that's also cause blood pressure to be high ", explained that would not be a problem at all at the documents and forms for the consulate, also kept chatting and saying that it's hard to see a K1 case be denied, unless the person has not clean criminal records, or has overstayed a visa before.

In the end, I had to ask " So Doctor, did I passed? Am I approved? (laughs) " and he answered a yes. Then he said " - Good luck on the interview and on your marriage Carlos, by the way, the interview is easy, the hard is the marriage! Good luck! "

Well, maybe it's a Brazilian way... all the bureaucracy we need to bring the medical exam forms sealed in a form and etc, but the secretary told me (and another patient, a fiancée in the case), we should go take xerox of the documents 2 copies of the first form (where goes our pictures), and 1 copy of the form DS-3025, the copy of DS-3025 we keep with us, to proceed for the Adjustment of Status when at the United States. By the next street, has a place that makes copies (xerox), and besides the long lines, we could come back, and wait again for the doctor sign all the new copies, the secretary put all the documents into a folder, staple it, and then put a seal over.

Interesting, when I was at the office, 2 weeks before, and got his requests of X-Ray and blood exams, his stamp was a Brazilian traditional medic, at the folder he use another stamp in English, with his name, MD, and what he is regarding the U.S. Consulate.

So, be prepared to wait a total of 2 - 3 hours for the total process, specially if you plan in do everything by the office. The exam with the doctor itself even with vaccines is very fast and last about 20 minutes.

Prices at office:

Appointment: R$ 220.00
Blood Exam: R$ 80.00 (might be wrong, didn't paid attention at the other patient talking)
X-Ray: R$ 20.00
Vaccines:

Thanks everyone! My Portuguese is very bad, almost non-existent, but he is fluent in English, so we have no trouble communicating at all. Often when chatting if he pronounces a word wrong in English I'll immediately say it correctly, then he'll say it back a few times the way I said it. It's almost become automatic that we do that, but it doesn't happen very often. He's always concerned if people will be able to understand his English, but I've almost never had any problems to understand what he's saying. We have been studying what papers we needed and going over them and reviewing that they are filled out correctly since we got the NOA2. I'm always worried that I forgot something so I'm always having him check or checking the copies of the pdf for the forms I sent him that I saved on my computer. About two weeks ago was went I sent him all the forms that are requested, since it was easier for me to print them for him. I also sent him an entire copy of the I-129F with original evidence paper-clipped to the copies in the I-129F. I have it all split into folders for him, the new forms required for the interview, the new evidence (not submitted yet), the I-129F with evidence and the affidavit of support information, which I hope is enough. I sent both I-134, one from me, one from my mother. I included a letter explaining why I am not required to file a tax return (no income) and my mothers last three years of tax returns, her three most current paystubs (copies printed from internet as she doesn't get paper copies) that were as close to the interview that I could get without the package arriving late. Also a letter printed from her employer's website showing her job title, annual salary, employed since, and a copy of her German birth certificate as well as her US citizen born abroad paper.

I am a bit concerned about the lack of showing daily contact. We do have the email history that shows we email back and forth quite a bit, about 420 emails starting in January 2009, but sadly I'm unable to provide the proof that we talk daily. Instead of using Skype or Yahoo Messenger to talk over the internet to one another, we use Ventrilo. Which I have been unable to find a way to show history. I pay for the service which I have had since August 2008 (for gaming) and we have always just used it to speak to each other privately with a password because it's easier for us to use. I did put in a letter that I submitted with the original I-129F explaining that we do communicate via Ventrilo and that it does not have a feature to show history on it as far as I can tell. It does go back to the beginning of the current month, but all it can do is show the login name, date/time and IP address. I originally submitted a copy of that for one month showing them the amounts of time that it shows us connected vs. disconnected to try to explain the situation. I just hope it won't end up hurting us later on. We are connected to it almost 24 hours a day. The only time we are not on it are when we are rebooting or have to shut down our computer for some reason, otherwise we have a "sleeping" channel we made to put ourselves in to let the other know when we are sleeping or when we are awake.

We'll probably go over the questions this weekend to see what his answers will be. Since we won't know exactly what they will ask, I have found some on these forums to help kind of see what they generally ask. And I'll keep drilling him until I am satisfied that he can answer these honestly and with good answers without sounding rehearsed. I know he will be very nervous, so I want to make sure we go over as much information as we can and make sure all the forms are in order, filled out correctly and not missing any information.

Right now we have the interview this coming Tuesday and the only thing he still needs to do is pay the Citibank fee which he is planning on doing the Monday prior. I told him I would feel more comfortable with him paying it on Friday (just to make sure it's done), but he said Monday will be fine.

Thank you again to everyone! We have been reading all the Rio interview reviews almost daily to see if there's anything we should focus on or that we're forgetting. I'm glad those are there and I can't wait to submit our own to help others as well!

My fiancé has his interview next week and we are wondering what we can expect. From the reviews that we have read it seems pretty straight forward and "easy" when it comes to the question parts. To give a bit of background, neither of us have been previously married, he has never overstayed a visa as he just acquired his passport this year and has never been out of Brazil. I visited him twice before spending a total of 6 months with him and his family in Brazil. Neither of us have children, his criminal record is clean, medical exam passed. We are both unemployed currently as we have been students during this time. I have a co-sponsor, my mother, who makes more than enough for the affidavit of support. The evidence we are including are the boarding passes from both trips I made there, photos taken from both trips of us as well as a few with members of his family, cell phone records, email history through screen shots showing the inbox, some sample emails, and a few snail mail letters that I was sent while I was there showing my name and his address sent by my parents.

We've been reading a lot of posts and interview reviews from many different countries. We have noticed that Brazilian interview questions seem to be normal and not so much "tricky." I've noticed that some other countries have trickier questions such as what high school did you fiancé(e) attend, the name. Are these tricky questions common to be asked at the consulate in Rio de Janeiro? Have they had the question where you are asked to locate your fiancé(e)'s place of residence on a map or questions about why you decided to do the K1 vs. K3? I will not be able to attend the interview with him as I have university classes starting that week that I have to attend. So I hope that doesn't look bad for us that I won't be able to make it there.

So far things have gone well. We have not had any RFEs and have not had much trouble with anything, so with the interview coming up in a little less than a week we're getting a bit nervous and are hoping for the best!

You can get one-way or round trip, it doesn't matter I believe with a K1. Round trip is usually cheaper I think, but if you can find a one-way cheaper then I'd go for it!

I am currently unemployed as I'm a full time student right now. My mother was the co-sponsor for my husband and we had no problems. I submitted both I-134 (one for myself and one for my mother). On mine I put that I was a full time student and attached a not explaining why I had no tax returns to submit or income to show of. For my mother I submitted print outs of her tax returns (she filed all online so I just printed what she had), a letter from her employer showing how long she has worked there, her job, salary, etc., and her birth certificate. I did not include any bank information since my mother's income was above the income required. My husband submitted all that information at his interview in Rio and had absolutely no problems at all. Not to say that they might want something more, but for us what I sent was fine.

When my fiancé (now husband) had his interview at Rio they had 9 K1 interviews to do. He said they had about half with the petitioner and half without. I was unable to make it for his interview, but it didn't hurt us in the least. It actually had no bearing whatsoever on his interview. Basically my husband's interview consisted of 4 questions and that was it. The ones he was asked were:

How did you meet your fiancée? (Gave a short answer, asked if he would like more background and complete history, he said it was not needed.)

Your fiancée came twice to Brazil right? (Short answer, from X month to X month and X month to X month.)

What does your fiancée do for a living? (Short answer, just told the place.)

What do you plan to do when you arrive in the US? (he did a more complete and long answer, by the middle of it the officer was done writing and was looking at his computer.)

After this he was given back some of the papers that he had submitted, such as his original birth certificate and was instructed to speak to another lady to get a green slip and then went on to pay the shipping fee for the passport. The interview took about 4-5 minutes and no extra evidence that we brought was checked at all. We did submit evidence when I had originally submitted the I-129F, such as photos, copies of airline information from my two trips there, emails (maybe 4-5), cell phone records (from the most recent month), and a few other things. Nothing too much, just a few samples of each item listed on the guides that we had. For the interview I had sent him the originals of the evidence I submitted with the petition and then more recent evidence such as more recent emails and cell phone records, just in case it was needed.

Also, you might already know but just in case, for an approved visa she will also need to pay TNT for delivery of the visa. That varies in cost depending on where it'll be sent to. For my husband it cost him R$30.00 to his home right outside Rio. After my husband's interview he was given a green paper, told about the package that would arrive. Then he had to go down to the first floor, fill out a form for TNT (to deliver the passport and brown envelope) and paid the fee.

My husband just went a few days prior to his interview as well to pay for it. He did hear from someone on the day of his interview who went to Citibank to pay their fee and Citibank tried to tell them they had to pay the Tourist Visa fee as well. Which they didn't, they just needed the K1 Visa fee. My husband also took a copy of his interview letter with him when he went to pay it, to make sure they were giving him the right fee to pay for the visa his interview was for. I had also read about someone being told they needed to pay the Tourist fee as well prior so we thought it was better to take the interview letter along, just in case.

We're starting to get the documents ready for my husband's N-400 filing which he can send in on March 2nd. We currently have copies of the tax transcripts from 2011 and 2012 that we got last year when we filed for his ROC. We have filed our 2013 taxes but just have the tax return copy (we filed online) that we printed off. Would it be ok to just submit that with the two previous years of tax returns or would we be better off going to the local IRS office to have the 2013 transcript printed off? I just don't want to make a trip downtown and deal with the hassle if it's not totally necessary.

My husband and I are working on getting everything ready for his ROC, but I'm worried about our change of address. We initially were living with my parents when we were first married. Since then we have moved twice and both times I filed the AR-11 electronically but when some mail came from the USCIS recently about the ROC needing to be done it was sent to my husband with my parent's address on it. Does that mean that the electronic forms I sent didn't go through or should I not worry about this? I don't want us to get in trouble for not updating our address, when I did both times we moved through their website online.

Originally we could have filed in March. But due to life we haven't had much time to get things organized and together. Hopefully we'll be able to get it all soon and get it sent off. I'm sure I'm probably missing some things, but here's what I have together so far. Any suggestions of things I might want to include are most welcome!

  • Copy of Marriage Certificate
  • Copy of green card
  • Tax transcripts from 2011 and 2012 (we didn't file anything in 2010)
  • Electricity bill statement from 4 different months at two locations were we have lived (only in husband's name)
  • Cell phone statements from 4 different months (showing both names)
  • Cable statements from 4 months (showing both names)
  • Copies of driver's licenses of both my husband and myself
  • Copies of joint credit cards (showing both names)
  • Copies of car insurance listing us both and our vehicles
  • Copies of health insurance cards with both names
  • Copies of our Sam's Club membership cards with both names
  • Copy of health insurance plan information of all plans since 2011
  • Copies of dental insurance showing both insured under same policy since 2011
  • Lease agreement
  • Copies of credit card statements showing cards (from photos) being active

After reading the instructions I don't necessarily see that it's saying it's required to send affidavits. It asks for as many documents as you can... should include but not limited to. But it doesn't say it requires. I'm sure if you don't have a lot of other documents to provide then the affidavits might help. For my husband we did not send affidavits. We sent the birth certificate from our son born after we were married, our lease from our current home as well as a letter explaining our living situation prior to our current residence, tax transcripts from the last two years and a letter explaining why we did not have tax transcripts for the first year, bank statements/credit card statements which I provided for every quarter (some send every month, we did not). We had a lot of documents showing co-mingling of finances through several credit cards, bank accounts, medical/dental/vision insurance, car insurance, membership cards, and our ids showing the same address. We sent very few pictures and no affidavits. We must have had enough proof in the documents that we sent to show a good faith marriage whereas I'm sure those who don't have as much to show, the affidavits might help.

The bank statements I sent was one for every four months (so quarterly basically). We had lots of deposits and withdrawals. For the credit cards that we had, most had only been open for a year or less. I scanned each of our cards, side by side on a printer showing that we both have a card, same credit card company with each of our names on them (showing we both are users on the accounts), then I printed off the most recent statement for each card, most are in just my husband's name but it shows that there are two cards on the account (or at least transactions made from both cards). All our cards at the time were pretty much maxed out, so I don't think having debt on the cards matters at all, if anything it would probably show that they're not just for show, but are actually used. The reason I did the statements with the credit cards was because not all of our cards have the same number on his and mine, so it would show better that they are actually linked cards (authorized users).

Ours has finally showed up at the main sort facility in Des Moines. So hopefully that means it'll be headed our way. Tomorrow would be great, but I'm thinking it'll probably more like Monday before it gets delivered. At least it's in the same state now.

Still waiting on our card. It was mailed out on Tuesday with the 2 day shipping but the last update on USPS is that it went through their Sort Facility in Knoxville, TN on 9/10. No card yet or new updates. I'm hoping it'll show up sometime next week and didn't get lost some place. Scheduled delivery date is still showing as 9/12.

Received a text/email today saying the card was shipping out today, then just received another with the tracking number! Looks like we should have it by Friday. They even put $100 insurance on it. Haha! I'd say it's worth a lot more than $100.

I'm thinking maybe it looks like a few of us got these white letters that appear to be from the Nebraska Service Center, maybe they have to notify CSC or something to get the card ordered and that's what triggers the status update online. Or I could be completely wrong. Either way I hope yours changes soon! I was checking all week long for the card in the mail, now I know I can give it a week or two before I start checking every day again, since now I have a more definite date of when it was ordered.

Received a text today about our status changing so I checked it and had this message, "On September 6, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you." So it seems the plain white letter is official!

My husband received his approval letter and his online status still says Initial Review. The letter we received was very different from the normal looking letters they send out, just typed letters on a blank white sheet of paper, doesn't even show the receipt number on the paper. Looks like ours was sent to the Nebraska Service Center and was approved from there. So I have doubts that our status will ever change from Initial Review.
