I think all documents if not in English language, has to be translated. Well that is what i did, because i do not expect the American authorities to learn Swedish.
And for the interview if it is asked, police certificate, it will be a good idea to translate it too.

We were asked for the translated copy while at the CSC waiting for NOA2. We didn't send it in because it was not something that is asked for when you send your petition in.

When my husband (a fiance back then) sent the K-1 package he sent a check for a wrong ammount, so the whole package was rejected and returned to him. He resent it later with the correct check and everything went well afterwards, but it caused a delay for a few days. It wasn't technically a RFE, but I think it can help some people :) Always check on the uscis website for the right fees, because sometimes they change them.

Just to echo a few other posts, all immigrant visas interviews are done in Montreal and Montreal alone. Other visas can be taken care of by the other US consulates but any immigrant ie green card interviews are at MTL.

Medicals can be done by three civil surgeons contracted by the US gov't - they are in Vancouver, Toronto and Montreal.

I don't think that's the case. Perhaps the person you were speaking to is ill informed. When your fiance receives the social security number, the card should say 'valid for work only with DHS authorization' which is your EAD. Your original understanding is more accurate.


This is accurate. You do require an SSN in order to work but you must first be given official clearance to work and that's done with the approval and granting of the EAD - the same holds true if you want to travel out of the USA and return, you need to apply for Advance Parole. The K1 visa is a single entry visa for one purpose: to marry the person who petitioned you within 90 days of crossing into the USA. You can't leave and return to the US without the Adv Parole, and you can't work without the EAD. This holds true also for K3 visa holders - they only difference there is that they are married and not engaged to be married; but the K3 is essentially obsolete. The CR1 and IR 1 visa's grant you residency, travel and work authorization as soon as you get the CR 1 visa. I ramble. :whistle:

Yup what everyone said. I left a job of 15 years to come here and had no job upon arriving also because you are not allowed to work until you get your green card or your advanced parole document. You can't just cross over and start working with the proper authorization. So many people come over the border without a job because of this. And as others have said, it's about the income of the US citizen and being able to support you. Focu on finding work once you get here and once you are authorized to do so.

I would send all you mentioned and explain you didn't save those things because you didn't know you'd fall in love and later need them for a visa lol....I explained why I did not have my call logs prior to us being engaged. I did not save them and therefore had nothing to show in our early relationship. Like I said, I typed up a letter explaining that I didn't know I would later need them and neither did he. I paper-clipped it to the front of all of my chat log when I included them in the packet, so they could not miss it. You could do something similar for your lack of early proofs too.

And yes, that is enough!

I think I had the original idea to do this back in 2009. I had the idea to get permission first. SO i emailed the embassy a few months in advance and they told me I could go inside with him and so I printed it and took it with me. Then I told everyone else to do it lol, so I dont know how much they do this anymore, but it is worth a try. I was not going to be allowed in, but took that email with me in case. Good thing, becasue they took that email from me in line showed to someone and then OK'd me, but I was that close from not being allowed in. The CO did end up asking me several questions as well. Good luck!

Also, when she answered if I could go inside in the email...it was more of answer like "I dont see why not" type of answer, but I ran with it LOL

You lose your money and end up where you started because you get denied?  Your attitude isn't going to get him a visa.  You follow the rules and win or you don't and lose.  That's your choice.  I think it should be a little harder after seeing all the fakes i have seen come through (and yes, even from Turkey, so far it's 50/50 from there from the couples I've met so far, anyway) and use American women  for visas. I don't think it should be easier. Sure, it isn't perfect, but that's the government.  God forbid it be even more simple. It's not too difficult once you read the rules and ask follow up questions here.

I don't know how long citizenship from France takes for your husband, but it can't be that much longer than the K1....it usually takes 7 months to a year max...don't know what's currently going on, but it shouldn't be long till you hear something...that being said, I think it would be awesome to live in Europe...you can travel to Turkey so much easier....buuuut will you be happy in the long run once marriage settles and becomes routine...comfortable, yet routine, once the excitement if a new relationship
wears off? That's something to think about....the time waiting is hard, but it serves a purpose..

Just for the records, I haven't applied for K-1 yet or CR1. So I'm weighing my options.


If you have adequate proof of a bona-fide relationship to file K-1, you should be OK for CR-1. Add her as a beneficiary to life insurance, retirement programs. You typically don't need SSN for that. You likely won't interview until early 2012 so you will also have a 2011 joint tax return.

I would say from a strictly immigration perspective the CR-1 is better. What is better for the two of you from a relationship perspective should be really what drives the decision.

The US accepts and recognizes foreign marriages. They just don't grant LPR status based on these. Again that is for a reason since so many of the marriage and fiancee based visas are fraudulent.


This statement is at best misleading. The US makes no distinction when it comes to granting CR-1/IR-1/LPR as to where a marriage was performed as long as it was performed according to local law. Not matter where the marriage was performed, the US gov't grants the status after an an assessment as to whether the marriage is a bona-fide relationship or was entered for immigration benefit. No additional weight is granted to a marriage because it was performed in the United States.

Thanks for taking the time to reply and thanks for clarifying. I guess I understand why it's necessary. Now I have to figure out if we have an alternative. (We are currently residing in Japan and the DCF-CR1 has just come to my attention as a possibility, though whether or not we can get it done in time before we return to North America will be a close run thing.)


DCF is cheaper (~$1000) and faster(typically < 6 months). You also get green card immeidately upon entry to the US. No idea how hard it is for two foreigners to get married in Japan. All you need is the civil marriage, any type of religious ceremony you desire can be held later.

First, I would recommend you and your boyfriend try to make the decision about when and where to get married based upon what is right for you using the immigration implications as only a secondary factor.

Fiance visa is faster but he needs to be a US Citizen to petition you as a fiancee. If you want to go by this route he needs to wait till he become a USC.

He can, however, petition you as a Spouse even if he's not yet a citizen. So in your case the Spousal Visa would be faster if you badly want to be with each other.


If your boyfriend petitions as a LPR, the wait for a visa is presently about three years. Once he petitions as a USC, the visa is immediately available. What I don't know is if he files the I-130 as a LPR if it automatically upgrades once he becomes a citizen or what the procedure is and whether that upgrade procedure would be faster than just filing the I-130 after he becomes a citizen.

The K1 is somewhat faster than CR1(current estimates are 214 vs. 256 days) but the CR-1 is cheaper and does not require adjustment of status once in the US. You also want to understand what the rejection rate for K-1 vs. CR-1 is in the Phillipines especially considering what evidence you do have to prove your bonafide relationship.

This is where you need info from someone familiar with the Germany consulate. You have to understand what they look for for a K-1 or CR-1.

You don't necessarily need that much more evidence for a CR-1 than the K-1. The big difference is typically co-mingling of finances but that can be hard to do if he does not have a SSN and typically the consulate understands that. You don't necessarily need a SSN to make him a beneficiary on retirement accounts, insurance, etc. That might be enough.

Divorce was finalized in Oct 2009; we've been dating since Nov 2008

How did you file taxes - married filing separately?
Since we never were legally separated, I was told to file married filing separately (for the entire 7 years). He has always attempted to file single apparently (I found this out this year in Jan).

What other evidence do you have of the separation?
Nothing much official; my current lease agreement (2008 to present) with me on it as a sole lessee (I don't think I have the papers from the previous ones); my vehicle title that was transferred to my name at the time of separation (previously joint), my bank accounts in two states, a power of attorney form which allowed him to withdraw the fund (complete withdrawal) from one of our former joint account for his home purchase. I might also be able to provide the transfer record of my mutual funds account to his name, but I am not sure about this one.

Is your fiance in Germany or here in the US?
He resides in Germany.

Is there any immigration imperative for him to marry you?
No. They have better social safety net than US if you know what I mean. Economy is back on track in Germany (the strongest in EU perhaps), and ours was on the verge of tanking till just this morning (meaning, 8/2/11). He also has a daughter he shares custody with his ex (not emigrating with him).

Why don't you get married and file CR-1?
Until today, it never even crossed my mind that we might have a difficult case. I can consider CR1, but I am not sure if I have enough to prove bona fide relationship for valid marriage right at this point.

I am not familiar with the German IV Unit so take this with a grain of salt but I don't see anything that is a huge red flag. For instance, married filing jointly might have been an issue. The divorce/dating overlap is not a big issue since you will have been divorced two years by the time you file. An EOR letter is still a good idea.

I would familiarize yourself with the advantages/disadvantages of CR-1 vs. K-1 just to determine what is right for you and your fiance. The CR-1 is cheaper and he can work immediately once he enters the US versus having to adjust status off the K-1. However, you might have good reasons to want to go the K-1 route.

My Fiancee needs to get a copy of her Birth Certificate. I was told she also needs to get a Chinese Passport, which requires a copy of her Birth Certificate.

I was told that she needs to go to the 'Notary Office' in the place where you were born to get her "Notarial Certificate of Birth".

I was also told that she needs to go to a Notary Office where her 'Hukou' is located.



My wife got her Birth Certificate here where her Hukou is. It was just another white book based upon her Hokou. Is her Hokou still in her hometown or where she is living now?

Very few on this site are attornies and even if they were it likely for legal reasons :blush: they wouldn't identify themselves as such.

In general, it is people who have been through the process. If you feel the need to consult attorney, I would not discourage you but as others have said, give them what they ask for and you most likely will be OK. The exact timing on receiving the visa is hard to say.

Does the border INS patrol--coming back to the USA--typically ask all young females with a student VISA, "Are you entering the US with the intent to marry?" Will they be searching FACEBOOK or other Internet sites to see if there is any hint of her being engaged or even dating?


I think it is highly unlikely she would be asked. I also think she could also answer 'No' as her intent is to finish her studies, return to Canada and apply for the K-1. However, I certainly wouldn't volunteer any information as to her relationship to your son with the usual warning to never lie under any circumstances.

Since it was approved on a Thursday, it is likely you missed the GUZ bulk shipment that weekend. It should have gone out this past weekend so I would suspect you will see it by the end of the week.

And while EMS tracking is accurate, it often does not show up online until the day of actual delivery.

Also, make sure you use the Chinese side on the EMS website, the English side does not work very well.
