Waivers (I-601 and I-212) and Administrative Processes (221g)administrative reviews in manila

Ours was a CR-1 visa. After the wife's interview, she was given the 221g form, in which the only box checked was "Wait until you hear from us. There were apparently no problems with the documents submitted. We were told by the embassy one week later that they're doing a marriage index check. After almost three months, I was lucky enough to get in contact with the deputy chief of immigrant visas, where he told me a first check showed she wasn't married, then a second check through NSO says she and I were married. The case went to Fraud Prevention unit.

During the whole ordeal, I've contacted senators and Department of State officials as to the long administrative review process. After 4 1/2 months of AR, my spouse received her CR-1 visa.

Hi there. Ive been put into AR also and basically had the same kind of experience like your wife did with the interview. The consul said my documents are approvable and will review it. Do you still have the telephone number and contact person you got to talk to who confirmed your case status? Would greatly appreciate it! Thanks!

National Visa Center (Dept of State)Interview date?
Hi, guys. Sometimes I can't help it but wish for the NVC to give more consideration in giving more slots of interview schedules to CR1/IR1 petition holders. I know the number of slots available also depends on the embassy you wil lbe working on, but its unbelievable to see the tons of schedule given to K1 petitions. No wonder the embassy have a hard time catching up. The waiting for the interview is the most excruciating part especially when the case has been completed.

National Visa Center (Dept of State)Case Completion and Interview
hey there, Lebanesebride!

I, together with all the peeps here completely understand your situation on how frustrating it could be waiting..and waiting for the darn interview date. My case was completed on Dec. 9, 2005 and we are still waiting upto now if we could get an interview sched for April. So far, my husband's state congressman emailed the NVC to know whats up and possibly to assist us in giving a schedule asap(my husband is in the military and will be deploying).

So I suggest to have your husband do the same and PRAY help would come along. I just find it ironic how easy and fast the USCIS and NVC finished off our case ONLY to be stucked to wait for the last step, which is the interview. Good luck to you and to all those who are waiting for their schedules. My husband and I are doing what we can do (like the congressman and his military superiors assisting us), but in the end, it is still God's will that will prevail. So just keep on praying, guys!

oh by the way, CR1/IR1 visas usually takes 1 year-2years . I have some friends who waited for a year before they completed everything(from submission of peition till interview date).

US Embassy and Consulate DiscussionAR in the Philippines?

Well I talked to my fiancée again last night about the interview and her medical. I found out that she did get a piece of paper from her interviewer but she did really look that closely to see if it was a 221g. It was a request for her to finish her medical. She didn’t have it at the interview. St. Luke wanted to do a mental evaluation because of the scares on her arm so they had her come back a third time instead of the standard two day. They wanted her back on the day she had her interview. They ended up having her come back the day after the interview and it was transferred the following day to the Embassy. During her evaluation she was asked if he was a Shabu (M E T H A M P H E T A M I N E) user! Of course she is not and passed her evaluation without a problem but its got me thinking that maybe this is the problem.

So my questions are.....When your at the interview do they review your medical and ask questions about it? Do they ever do drug test at the Embassy? I asked my fiancée if they did a drug test but they did not so I’m wondering if in her medical report if they document the questions asked in her evaluation and im wondering if the Embassy would ask for a drug test because of the Shabu thing? This is just my paranoid mind working on reasons why she has to go back! We have had about every problem you could believe in this process. We are over a year being stuck in this process and at this point I really hate to think about being denied!!

Thanks

I have a feeling that your hunch might be true and they are going to re-evaluate her based on the scars that was seen on her during the 1st medical. During the medical, the Doctors would ask you alot of questions if you had a operation or abortion before. Tey even ask to put out both your arms to see if you have scars on your wrist, etc. About the drug test, they will be able to check if you are a substance abuser thru the blood sample that was taken from her. if she's clean from that, you can scratch it out from your list as a potential AR reason.

After her medical, the DOCs will make a final report on the patient if he/she is free from any illnesses.

So what is your finacee going to do now? Is she going back to St. Lukes?

Thanks Jasman but if there was a document missing wouldn’t they have asked about it in the interview? My fiancée said everything went very smooth and she had everything they asked for. She said they never really questioned her papers.

Thanks Mrs.mnez. She has called just before I left her but all they say is that it’s still in processing. At the time I didn’t think that possibly the case had been put on an AR. I want to call because she seem to be reluctant to question or press for more of an explanation. Do they charge to give info out on the number you gave me? If they don’t it's probably cheaper for me to call actually. My rate to the Philippines is 16 cents a minute. She has been calling what she calling the Hotline. I’m not sure what the Hotline number is but every call is about $6 US.

What was your AR for? I just confirmed that our case was put on an AR. The embassy just sent out a letter requesting her to go back on April 25th but im not sure why yet. Did you have to go back to the embassy because of your AR?

Since your fiancee was given a date to go back to the embassy on April 25th, that would probably mean she will be interviewd again by the Consul. If it's possible, call the embassy again and ask what kind of documents she could bring as additional proof of the relationship or something.

On the white slip for AR(221g), there are several items there where the CO will ask for the beneficiary to bring with her the next time she is called for another appointment. I could say it's a very good sign she's being asked to report there again. Good luck and I pray for her visa approval.

Thanks Mrs.mnez
I question my fiancée about the interview last night and im back to thinking she passed the interview without a hitch and I was premature in saying we were put on an AR for sure. When I called they never told me out right that she was put on an AR and I never asked I just assummed. I now thinking something else must have come up during processing of her papers to have them request her to be asked to come back. She told me that her interview was very complete and she didn’t miss a thing. We were very careful to have everything need and made sure we had plenty of proof of everything. The interviewer even said she was very organized and very complete. The person that interviewed her took her passport and all the papers and even said.....Good luck with your new life in US when she left her interview! She was then told to wait for her name to be call to pay Delbros for the visa delivery. She never received a 221G form and she never felt that there was a problem. So maybe I was wrong saying that she left being put on AR. We had more then enough proof of our relationship too. I cant imagine that is the problem but she did have one problem at her medical. She has a bad scare on her arm from a tattoo that got infected and a very fresh one on her arm when she fell on some broken glass. The person that did her medial wanted her to come back for a mental evaluation because they feared she is violent or into self abuse! She is anything but violent so she passed the evaluation without a problem. The only other issue I can think that might make them question something is that she widowed but she had the death certificate from the NSO, pictures of the funeral and cancer that they removed from his brain trying to save his life. I would think she had enough proof but maybe they want something else for proof. I a bit confused because it sure seems like she passed without a problem and we were not put on an AR. Has anybody els
e out there had something like this happen???

When i talked to a callcenter operator, she said that there are times when even when a case is approved, a review could still be done. That is probably what the embassy did with her case. You can call this number 202-6631225 to verify more about your case. My husband just called this number awhile ago and they have a record of our case status also.

during her interview, did the consul ask to see the pics of her husband's funeral and his death certificate? Just advise your wife to bring again all the docs she brought along with her before, and this time, let her shove ALL important docs(whether they ask for it or not) to the Consul to satisfy their minds.

US Embassy and Consulate DiscussionAR in the Philippines?

My fiancée had her interview last month and thought she was approved but her visa has not arrived now for almost 6 weeks so now im beginning to question why its taking so long and im beginning to think our case has been put on a AR. After her interview all she was told was to pay for her visa delivery and she was not told she was approved or that this case needed further review. She thought since they told her to pay for delivery of the visa that she was approved. I never questioned her about the interview so I didn’t know the details until my trip there hoping to bring her home with me. I stayed as long as I could but had to return last week and im sad to leave her behind again. So my question is do they tell you your case needs further review and if you are put on a AR do they have you still pay for your visa delivery?
Thanks

Try calling the call center of the embassy in manila to verify your case status. Ive been put to AR also and when i called the embassy today, they told me that in their records, it shows that my case is currently being processed by the consul.

I think it would be advisable if you ask your fiancee to call them coz it will cost you more if you do the calling from the states. the tel number is 1909-1017878. Goodluck!

Middle East and North AfricaJust Waitings Interview tomorror 3/23/06

Well, he goes back for round 2 tomorrow in the night (my time). I'm not doing so hot. He feels very confident. The Embassy even called him to be sure he had his time correct and the papers he needs (I found this weird). I think this has all gotten to be just too much. All I wanted was my husband (married by religion only) back by my side and I feel I have to sell my soul to the government to have my life back in my own hands--and only then if I manage to "get lucky". I just feel sick... and very alone.

Hey, Girl!

I understand where your anxiety is coming from coz I, myself is scheduled for my interview on the 27th, Monday. Just keep praying and believe that everything will turn out fine. Keep us updated, ok?

[font=Comic Sans Ms]I do have a case number already[color=#CC33CC] My husband called the NVC one time and was informed that it its them (the NVC) who provides the schedule of interview. They are only given by the embassy in Manila the number of CR1/IR1 petitions they are willing to give a schedule on a specific month. Scheduling is done only during the 1st 2 weeks of the month so you could just imagine the stress it gives us everytime the month starts just to find out you are still not on the list. It would be easier for us to wait if we know my husband isn't leaving and be on tour for a year, but that's not the case for us. It's really depressing, for real!

Thank you John and Marlene for your info. I appreciate it that there is someone out there who understands our case. I will give my husband a call later and tell him what you had just said. We actually called his state Congressman and said he will work together with my husband's officers to make that letter explaining why we are requesting for an early schedule.

So you think that we should fax/send that letter directly to the embassy in manila and not at the NVC? All our documents are still at the NVC right now.

Thank so much for the valuable info and for the other's words of encouragement.

I also forgot to add this, but the orders for deployment hasn't been officially set yet. Would the Army approve of our request for that letter even if that is the case?

Thanks!

I am just wondering if there is any way for the NVC to expedite a CR1 interview in Manila? mrs. mnez.

sorry to hear the sad story...

but just keep your hopes up. the consul told you that your papers are sufficient. you have everything you need during the interview and he did not asked you for anything that you are not able to provide.

they say that these consuls have psycologist backgrounds so they know you are not lying.

they just need more time. there are several cases here on vj that they are put on AR but they are surprised to see Delbros at their doorstep in a few weeks.

I called the embassy today and was able to talk with an immigrant officer. She was kinda curt saying that inquiries regarding immigrant cases are done by calling the call center. i just tried my luck and was glad she accomodated me with my question about why I was placed on AR. I explained my situation to her as she listened. She said that its a common problem to be put on AR for expedite cases. She explained that Consuls is left with a short time to check and assess a petition before the interview. Thus, it leaves the consul to put it into review. Once they complete their processing, a beneficiary will be called again for another appointment if further docs are needed or have the visa delivered if there are no more problems seen by them.

The way i understood her explaination, an interview was done to me 1st BEFORE reviewing my docs. Normal processing is the other way around.

Kimjoshian, i happen to have a degree and MA units in Psychology that's why i was disappointed when the Consul hardly kept eye contact with me during the whole interview process. He just kept his eyes on my papers. Come to think of it, I should've winked at him and pretend to catch something in my eye just to throw him off the board! LOL ;)

IR-1 / CR-1 Spouse Visa Process & ProceduresHave my Interview Schedule already!!!!
Hey, guys!

Thank you so much for your well wishing.

To answer some of your questions:

Yes, I am a military wife and my husband did request for an expedite for my interview coz my case was completed on Dec.9, 05. My husband is deploying soon in Iraq and we wanted to be together soon before he has to leave. We faxed the letters to the NVC first ( he made a letter stating his request, and another letter from his CO proving that there is a great probablity that he is deploying). The NVC received our faxes and advised my husband to fax the exact same letters to the embassy in manila.

If you could read on my signature at the bottom, the NVC sent my papers to the embassy on March 2 upon their(the embassy's) request. The embassy was the one who scheduled us for an interview on March 27. I wouldnt even know i have an interivew if i HAVENT called the embassy to inquire if my case reached them already. They advised me to go with my medical and just get my copy of the apoointment letter (Packet4) at St. Lukes since i havnt received my copy yet (until now!).

So, off I went to the embassy yesterday for my interview. I had a big bag FULL of documents (including the original copy of the expedite request and all of his past and present military orders).

During the preliminary interview with a flipina, she just asked how we met, if both of us have been married before, if we have a joint account ( i found this absurd coz how can we have a joint account when the bank is in the US and needs to have my presence there to sign). She just asked for copies of bank statements (he gave me an ATM and the bank statement shows the amount i receive and takeout), phone cards/bills and western union copies. I have them in one folder so it can be easily reviewd by them. She asked for pics and i gave her a few loose copies. I have a scrapbook containing pics from the 4 times he came here and our civil and church wedding. She didnt ask for it and just said to show it to the Consul later.

She mentioned to me about the expedite request since she has a note about that on her file. i tried giving her the original copies but said there is no need. She then asked me to take have my fingerprinting and wait to be called by the Consul.

I was nervous BUT also a bit assured that i have everything in order. The Consul was kinda snappy and asked me if either of us have been married before and if we have kids from wedlock, how many times he's been here, when was the last time i saw him. He then asked about my husband and what he does. I told him he's in the Army and is in the States right now. He mentioned about the deployment also and inquired when it would be and what plans i have when he leaves. I replied by saying I will probably look for a job to preoccupy myself and keep my mind busy. He just glnaced briskly on the letters, and my BC, MC, etc and the loose pics. He said: "I see you married your husband the 1st time he came here. Why is that?" I wanted to snap back that its none of your business! But all i said was i knew the 1st time i met him, that he is the one im going to marry someday.

He was impersonal and didnt seem interested, but what i told him is really true. It really ticked me off at the back of my head coz he's asking personal questions with no concern. He was also talking very fast and throws one question over another. He is aware of the expedite request and even joked with me if i would want to be with my husband in Iraq. I reminded him that Filipinos arent even allowed to travel there. i wanted to add that if i could go there; i would to make sure my husband is ok. I would take a bullet for him. That's how i love my husband.

In the end, he gave back the letters, pics and statements and told me to take a seat again and wait for my number to be called again. Before i left, i asked if i have been approved or not. This is what he said :" Your papers are approvable and will just review them."

I was in a stupor coz i was left in a daze as to what it means. Maybe i was still in denial if he plans to put me on review coz i know deep in my heart that we havent missed out anything. ALL of our papers are notarized and valid. My number was called to go to Window 35 where the lady said that the consul asked for my papers to be put on review and gave me the pink slip for the Delbros and the 221g form. The consul ticked there for me to wait until further notice.

I was alone at that time and my knees were shaking in disbelievement. i couldn't believe why he had put me on review. I mean, whats the purpose of the expedite if that's what he's going to do? I read on the other forums that people on AR are put on months and months of waiting.

I called the embassy today and asked the status of my case. The lady said my papers are currently being processed by the Consul and to call again after a few days to make a follow-up. She assured me that there are cases where people are put into review and have their visas delivered a few days later. Thank God for John and Marlene who wrote me that they didn't see an approval sticker on their folder during the interview and waited for 19 days before the visa was delivered. They requested to expedite their interview also, btw.

John is assuming that maybe Consuls didn't have enough time to review my papers(and theirs also before) coz they barely had a few days to verify the authenticity of our papers and the expedite request. It is sad to note that 'maybe" these Consuls would need to double check if the deployment of my husband is indeed true and not just a ploy(especially with Filos) just to go to the states. You may never know what they are thinking, but all i can say is, the embassy is very much concerned about fraudelent papers.

In our case, our request is indeed valid and true. I should've slammed on his table the papers i have prepared for that day. My husband and I wouldn't even go through the request IF he wouldn't deploy and just wait for the normal wait for the CR1 processing which is 1yr-2 years. In my case, i finished it off in 8 months so i guess they wanted me to wait more. What the *&^?! Im in a state of depression right now. This is the 1st time i relayed my experience and was kinda embarassed at first to share this to the forum. But all of you have been great and supportive to me so i thought otherwise. Maybe this is also God's way of telling me that my experience would be helpful to another.

Thanks again and good luck to those who are to have their interviews.

P.S. a prayer for me and for those in the same situation as mine would be greatly appreciated.

My husband and I just wanted to be together for a few longer months before he leaves for a year. Isn't that too much to ask from them?? Sorry for the rambling but i need to vent this all out and maybe give the others my point of experience.

God really listens to prayers!!! After weeks of Novena and endless prayers, we were finally given an interview schedule by the US Embassy.

I called the call center of the Embassy just to inquire if they have already received my documents mailed by the NVC. They confirmed it and said they mailed me on March 9 my packet 4 and my interview is set on March 27!  I was in a stupor for 2 secs and asked again what she had said coz I thought i heard her wrong. They mailed the letter on the 9th and advised me to have my medical soon since i barely have 2 weeks to prepare for the interview. I probably sounded so excited coz the operator was giggling and wishing me good luck before we hang up. I called my husband right after that and he instantly cried tears of joy. I ended up crying myself also. :crying:

I would like to thank all of you here for being a steady set of friends who support and give good infos to each other. I especially would like to thank VJ member, JOHN and MARLENE for giving me the most valuable information about the military request. We consider you as our God sent angels.

Again, thank you guys and please pray I'll be given a very nice Consul that will approve my visa. :)

For those CR1 people who have gone thru with the interview in manila, can you give me examples of the Consul's questions so my husband and I could pratice answering them? :help: Like what do they ask you to show then aside from pics and letters?

I know this link for questions that may be asked is for K visas but I imagine some of the questions may be the same. http://www.visajourney.com/forums/index.php?autocom=custom&page;=exampleq

As for evidence...have on hand anything at all that goes to show that you have a bonafide marriage. This can also come via letters, cards from family members....also cards congratulating you on wedding etc. Any evidence of upcoming plans together.

Hope this helps a little. Im sure someone will come along that has gone through Manila. Have you looked in the Manila threads in the Foreign Forum and also the Regional Forum.

Lorelle

Thank you, Lorelle! I just received via fedex some supporting documents sent by my husband incase they ask for more paperworks (e.g. military orders, boarding passes, phone bills and bank statements). I have compiled them and put into seperate folders the papers i have for easy showing. I finished doing my medical today so all im headed for is the interview. Please offer a prayer for me. Thanks, guys!

There was a looonnngg queue of people requesting for their own copies. I'll have my medical on Friday and praying everything will turn up good. Please pray for me to pass the interview and be granted with the visa. Im starting to get nervous!

Hello, Aussie!

I received my case number July 14,2005 and completed the case at the NVC on December 9, 2005. That would be great if you could add me in. Thanks!

Oooops! The most recent IR interview schedule (for Manila) is April. That was case completed in September 2005. Again, how come?

Hi there, Classic.

Thanks for the info. Right now we have nothing left to do but wait and continously pray to be given the date. Seems that IR1 beneficiaries esp in Mnila are always living in a dark tunnel waiting for the unknown. NVC would say one thing and Embassy would say another. It's so confusing!Urgh!

Nway, God bless you and everyone here! :luv:

Hey guys!

Thanks for your responses. My hubby called the NVC and DOS yesterday and they both gave the same answers--they don't know a definite schedule for my interview yet. The info on their system says that my files have been sent to the Embassy since March 2. DOS said that the embassy requested to have my documents sent to start with the expedite process. I just don't think it would be wise for the embassy to keep it for more months before scheduling an interview, because this would forfeit the whole purpose of the expedite request. My husband is deploying in November and will be gone for a year or more, so you could just imagine my anxiety building up every single day. It's like my husband and I are running against time here. Right now I'm praying for a miracle.

My thoughts and prayers are with each and every one of you who are just like in my shoes. God bless everyone!

Hello, Konfuz!

My husband Called the NVC today to make a follow-up on our case. The operator said that they mailed my documents already yesterday, March 2, to the US Embassy in Manila. I am wondering if that means I will be given a schedule already once the embassy receives it. Any ideas?

Thanks and good luck to all of us!

That means you should already have a scheduled date. Just keep updated. You can check at Manila embassy website. They will post there 2nd week of this month the schedules for April. Good luck.

Joy ;)

I hope and pray that I have a scheduled date already. Im so nervous actually to even call or see the website and be disappointed again if I don't see my case number yet. This has been an emotional ride to me and to others also who are waiting for their date.

thank you for your encouragement! :star:

Hi,

You can call to Embassy Manila to check your case. I haven't check mine last week. So maybe my husband will call at NVC tomorrow. I hope it's good news. Wish you luck.

Hi, Joy and Kimjoshian.

You wouldn't believe it but I called the Embassy today to ask if I do have a schedule already. The operator was talking sooo slow(probably deliberately for the PLDT to earn more!). She asked several times the spelling of my last name, 1st name and my middle name. When I gave my middle name, she asked if thats my only middle name. What the heck??!! So anyway, there I was being held to wait and when she finally came back, she said they don't have any records of my case yet and to call on April 2 to make a follow-up! And here's the catch, she said that right now they are only prioritizing family and employment based status. Hello? So what does that make us?? Im so frustrated with this passing on of info from the NVC and Embassy. Its like they couldn't give out direct answers to your questions.

Does the NVC schedule the interviews for Manilla? If so, and they've mailed your case to them, it may mean you've got an interview. I say that because the NVC scheules for Montreal (Canada) and the day after we found out we had an interview, I called and the automated voice said that my case had been forwarded to my embassy and that if I had any further questions to contact them there. Sooo...it would make sense (to me anyhow) that if the NVC also schedules for Manilla, then it would be just like Canada and they'd only send the case on AFTER an interview had been scheduled.

I'm crossing my fingers for you! :)

Thanks, Chicken Little!

The weird thing is, when my husband asked if the NVC could give the interview date, they said they don't have it and just call the embassy. We're confused like crazy as to where this is leading to. It's like they are teasing or blowing our heads off! Apparently, your documents will be sent to the embassy once you're ready to be given an interview date. So we don't know what gives?? But we hope and pray that what you said is true and "maybe" I have been given a schedule already.
