You as the foreign fiancée (the beneficiary) can relax about his criminal record as it is YOUR police record that is in question and NOT the US citizen that is petitioning you. The only wrinkle to your story is that you traveled to USA and met your fiancé in the US, what type of visa were you on? Did you over stay? Can you prove that you met in the past 2 years, etc., etc...

 

Of course you?re going to need a sponsor as it sounds that his income is below the poverty level, so have HIM focus on that.

 

Again his record will have no impact on your K-1 BUT you say that he can't travel so be sure that all your documents are in perfect order as he can't join you and support you when you have your interview in Bogota.

Ok, I have been told that is my criminal record that really matters and I have none, so I guess I can stop worrying about that.

When I traveled to visit him I was on a  tourist visa and didn't overstay. I left on Feb 14 of this year and he sent the i29f shortly after I left, so we did send evidence of us meeting and everything. We have lots of photos, my passport stamps, travel itinerary, etc...

I hope that having the financial sponsor is not seen as anything bad or whatever as a reason to deny it. I think we have that part covered.

I still don't have NOA2 but I am trying to get as much as I can ready for when I do because I don't wanna waste anytime, I miss my man! I also hope that him not coming to the interview with me is seen as a bad thing either. But I guess they'll know he is on probation and that's why he can't travel...right? Like..it's not on our application but they have to do background checks and whatnot I imagine...

Hi, I am just wondering what are the usual reasons why they deny k1 visas.

 

I tend to over-worry about things and since this is so important to me because it means I can marry and live with the person I love I just start thinking what if this or that is a reason for them to deny the visa. My main worries are that my american fiancé has a criminal record but for none of the crimes listed on the i29f form or any violent or drug crimes...it was just refusal to testify, he is on probation now and can't leave the country and that's why I went to the US to meet him and he hasn't been able to visit me in my country.  

So my reasons to worry are: that he spent time in prison, that he has never come here, that we've only met once (I stayed there for almost 2 months), and that he is going to school and has a 2 day a week job for now, so money is not enough I guess but his mom will be the "backup" for the affidavit of support, also I don't have an official job because right now I am just helping my dad out with his work while I wait for the NOA2 and worry that saying I'm unemployed will affect the decision.

People cannot remember each and every question from each and every form. You listing them that way makes it very difficult to decipher. You are basically asking that people go open all the forms and look over them all and go through your list to find which question is from which form before being able to help you out. Making your questions clear and concise helps people to help you.

 

I can say that if you have no children, it is None. If you are not working, then you are unemployed and address of employer would then be N/A
The question about being issued a visa, I think is the one from the DS-156 and you simply mark yes and answer the 3 questions about it, WHEN was it issued, WHERE was it issued and WHAT TYPE of visa was issued.

 

I understand that but honestly think you don't really need to look at the forms again to remember  or understand when I mean and answer most questions if you already answered them recently. But I guess you're right.

If I have any other questions or still feel unsure about how to answer a question I will be more specific when I ask.

You can send an email to the embassy in Colombia when they have your approved I-129f packet.  Their email is: IVBogota@state.gov

 

You can use a mobile number.

 

If you are not presently employed, then just write 'unemployed'.

 

Just city and country is fine for last 10 years employment.

 

For the question 'Where do you intend to work', just put 'With Employment Authorization--Employer unknown'

 

For educational institutions, my wife wrote all schools she attended since primary.

 

For when you intend to arrive, put your estimated date, or tentative date.  We didn't put a tentative date until we had our interview date for the visa, and usually you will know if you are approved at your interview.
 

Answer all questions about previous visits to the US truthfully.  If it asks for the last time you were here, write it.  If it asks for your current tourist visa number, write it.

 

Sometimes the embassy in Bogota won't even ask for the form DS-230, just your DS-156 forms.  They never asked us for the DS-230.

Well, thanks, I did look at the example but it's still have those questions. Guess I'll wait to see if someone can help and if not I'll be more specific.

I thought people who recently filled those forms and already had their interview would understand and be able to help so that's why I asked like that.

I am trying to start filling out the forms and have some questions because I want to be sure I fill them our correctly to avoid delays. Hope you can help me answer the questions...

 

*Will the embassy send the code needed to make an appointment to my fiance's email? I looked over our I-29f and my email isn't anywhere.

*N/A and None, is it really important which one I put in? What about for example in the question about children I put in N/A and then leave the rest of spaces blank, is that ok or should I write N/A in each one?

*Phone number of where I'm gonna live, is it ok if it's a mobile phone number? And where it asks about greencard address do I put in "same as item 10"?

*On present occupation I am not sure...I am not officially working, I am just helping out my dad in his office, so do I put in unemployed or what?

*Employent in the last 10 years, on location...do I need to put in just city and country, or the address or what?

*Where do you intent to work in the US? if I don't know do I put in "unknown" or what?

*Educational institutions attended, do I put in just stuff after highschool or do I include highschool, elementary, courses, stuff I didn't finish?

*In my case, name and address of present employer, do I put in None or the address of my dad's office?
*When do you intend to arrive in the US? well, I won't know until my visa is approved, so do I leave it blank or put in a tentative date?
*Name and Telephone Numbers of Person in U.S. Who You Will Be Staying With or Visiting for Tourism or Business. Uhm,,,I'm not going for tourism or business so do I just put in my fiance's info?
*Have you ever been in the US? do I just put in the info of the last time I was there or do I have to attatch another page for times before that?
*Have you ever been issued a US visa? Do I just put in info of my current tourist visa?

Hi, I have some questions about the filing of this form. I am the benefiaciary.

I understand that both sponsor and co-sponsor have to file one each and both send me the supporting documents. 

Our Co-sponsor is going to be my fiancé's mother (who makes more than enough) since my fiancé doesn't make enough because he goes to school and works part time only.

In item 3 they both put in my name but in item 10 of that form, my fiancé should put in my name, but his mother should put in"none", right? or should she also put my name in and on "relationship" say something like "sons fiancee"?

And on item 11, should they both say "N/A (K1 visa process for permanent residence"?

Now, my fiancé spend 6 months in prison last year, so he has been working for less than a year, he has mantainded the same job but he has been getting more hours lately, so it's not like a set amount of hours, some weeks he works more than others..so for the annual income how can he calculate what amount to put in there?

If you're getting the mom to co-sponsor then it doesn't matter.  He doesn't need paystubs or a job letter, but he still needs to show his taxes (to make sure he has been filing).

 

 

 

Yes, just have him guesstimate his annual income. If he usually works 4 days, then go by that. Where is the money deposited? Have him show bank statements to prove the money gets deposited. The only reason to show all that is to show he has a job and is willing to work and trying to provide for his future spouse. They will use the co-sponsor's qualifications for approval and not his income.

Sorry to butt in, but I have a question regarding this. Jay-Kay already told me to use best quess but I am a little worried about this still.

My fiancé spend 6 months in prison last year, so he has been working for less than a year, he has mantained the same job but he has been getting more hours lately. He started working only 1 or 2 days a week and now he usually works 4 days a week, so it's not like a set amount of hours, some weeks he works more than others..so for the annual income how can he calculate what amount to put in there? He doesn't get pay stubs from his employer. He also doesn't know how to put this on the letter from his employer.

We are having his mom as co-sponsor but I believe all the info and documents from him have to be right so I just want to make sure.

I know it's not revoked, but after all it does say cancelled even if its "without prejudice", so I am afraid if I say No then they'll be like...well this visa was cancelled so why did you say No? and that if I say Yes, they'll tell me it was wrong and I should have said No and then have to do another interview or something...

My previous B1/B2 visa was "cancelled without prejudice" when I went to renew it and got a new one in my new passport.

On the DS-156 form for K1 visa it asks "Has your U.S visa ever been cancelled or revoked?" so I'm not sure if I should say yes or no, because that questions makes it sound like it was cancelled for something bad when it wasn't.

Anyone knows what I should do in this case?

As I said before, it is fraud to use a non-immigrant visa to enter US with an intention to get married and stay permanently.

If you have to return to your country, your future husband (US citizen) can apply a K-1, fiancée visa for you and get married in US. Then, you can start the AOS process.

Yes, you can get married in US and file for an Adjustment of Status but you will need to prove that you didn't have any intention to stay in US when you entered on B1 visa.

May i know whether a translation of the divorce decree (for me) is enough, or i need to get the "LETTER OF CONFIRMATION OF MARITAL STATUS" certified by the Consular Division of the Foreign Affairs Ministry too?

For the certificate of good conduct, I sent a status request email after a month they received my wife's application. They completed and mailed out her certificate after a few days. You can it a try!

You can reschedule your interview but it is always better to make it to their initial interview date.

I don't get understand as am wondering if package 3 has a deadline for me to have my medicals or I shouldn't go for my medicals until I have my passport and certificate of good conduct which I believe would take 3 months as I am a foreign student in Malaysia.


I am not familiar with K-1 visa but I believe you need to fill up some forms in packet 3 and return back to embassy. Packet 4 is the one that included the interview date! Check with the K-1 visa guide!

You will need to bring your interview letter, passport, a 2x2 pic and any vaccine records for your medical check-up. The certificate of good conduct is only needed for the interview and I believe it takes about 1-2 months to get it from KLN.

Good day fellow VJ's I contacted NVC for Package 3 and was referred to the embassy where I live and when I contacted the embassy I was told *A packet of document sent to applicant on October 5* but I haven't received anything from them. I am confused, what should I do?


Call/Email the embassy that you didn't receive the package 3 and ask if they can send you another one!

Potentially with the Guangzhou US consulate since I don't reside in Malaysia. I just noticed that my original birth certificate is in Malay. Do you know where I can officially translate it back in Malaysia?

There's a possibility that the Guangzhou Consulate requests for more supporting documents to prevent frauds, which brings me to my next question - Are there any of you out there (beneficiaries of other nationalities besides Chinese citizens) who interviewed at the Guangzhou consular office and submitted the "unmarried certificate?"


You can contact the Consulate of Malaysia in Guangzhou. The consulate usually provides translation services; make sure you want the translation into English and not Chinese.

If your have the original birth certificate in English & Malay, then you do not need any official translation.

Have you followed the K-1 guide here? The guide should explain the steps very well. Usually it takes a few weeks for NVC to receive and entered into the system but you can always call and check the status with your USCIS receipt number.

I believe K-1 visa is just a single entry to United States. You need to apply for AOS and advance parole if you need to travel out of United States.

No feedback, no RFE, our NOA1 was 3 months ago. I wouldn't listen to the Dublin Consulate because as of now, you aren't dealing with the Dublin Consulate, you are dealing with USCIS. I know that the instrucations say to ask your local consulate if you're filing from abroad. But that is referring to HOW to make the payment, ie what type of check to send, not WHO to make the payment to. From the instrucion packet, from where you quoted, #2 makes it clear that you are to make the check payable to the U.S. Department of Homeland Security.

We are filing abroad from Ireland. I emailed the Dublin, Ireland embassy for advice because I was also concerned with how to pay. I was told to get a bank draft from a Irish bank in $. We got our NOA1 today so I'm hoping that means the bank draft was fine. You should be able to go to a bank there and get a bank draft in $. Don't know if a bank draft and a money order are the same thing. Good luck!

Hi,

 

If anyone can help with this. I got a rejection letter last week saying that the form was missing my address. I am the petitioner living abroad with my fiance in Ireland and I put my address on Ireland on the I-129f form. All fields were complete so I am lost on what I am suppose to do when I resubmit? I've had no luck in getting answers from USCIS when I have called, they have transferred me to a tier 2 agent to try and help and after waiting for literally 2 hours the agent asked to put me on hold and then hung up on me. I called back a 4th time and left a number they could call me back on and of course they called at 1AM while I was sleeping!

If you plan on already having an apartment when you arrive then for now I would just put a friends address. I am not sure if this same address will be required at port of entry and they will make sure the two match? I am filing from Ireland and I put my Irish address on the I-129f AND the G-325 form. I put my friends address for the part you are talking about as we will be staying with her for the first few weeks to get settled.

This should be answered where (as the question states) your fiance intends to live. Are you and your partner planning on getting an apartment before you enter the US? You must have somewhere you intend to stay before signing a lease on an apartment?

Are you using a check or money order?

 

We filled from abroad, my fiance's mom sent us a check payable to DHS and with the amount of 340$ and we had no problems with the fee.

We are attempting to get a money order drawn in US currency. If it all is supposed to be made out to U.S. Department of Homeland Security, thats fine I just don't know what the instructions are as the embassy didn't tell me when  I called.
