Hi,
On December 3rd we got a letter saying that our I-485 had been transfered to the California Service Center for faster processing(live in South Carolina). As I understand, this is a good sign and may not require an interview. My question is: how long should this take before we receive any more information. We have not received any more information since December.

You just mentioned the thing that bothers me the most: Being stared at.

My wife comes from a part of China that is not a tourist destination and rarely has western (Caucasian) visitors. I've got you beat on the size difference, I'm a 6'4" former linebacker. Add to that a big beard, and I am so noticeable that people actually hang out of passing busses and go out of their way to get a look at me.

The people are, for the most part, just curious and almost too friendly. Everyone seems to know one word in English: HELLO!!! They seem very happy when I smile and respond with a hello. So, the problem isn't that the people respond in a bad way. The problem is there are SO MANY OF THEM, and they are all wanting to say hello to me.

When I first arrive, it doesn't bother me too much. But, my stays are typically for a couple months (or longer). By the time I leave, it feels like a physical pressure every time I go out of the house.

When I get back to America, I always take walks in places like a mall: Just to be in a crowd and to be ignored. It's refreshing.

Yes, I understand your feeling! It was not so bad in Shanghai or Nanning or Guangzhou, but in smaller cities....Luoyang , Kaifeng and Shaolin it was more noticed. When I got back to the US....the first place I went was Waffle House. Just had to have a good ol' greasy American breakfast!!

I do understand the OP's comments! I spent some considerable time in a few small cities in China before. Their sense of personal space is mostly non-existant! It's nothing to look a foot away from you to see someone starring at you intently for what seems to be FOREVER without even blinking.....AND all the while...picking their nose with reckless abandon and thinking nothing of it!! Walking down the street and trying not to step in all the SPIT that seems to be incredibly common, expelled from as young as 5 year old kids to as old as 90 year old ladies. Never understood the spitting thing. blink.gif I guess for the most part, it's just different culture, different upbringing and just overall different life experiences. I assume it's all about tolerance and if we are in another country, just have to accept it. But I do understand your feelings! blush.gif

Asia: East and PacificHow to Postpone Interview K-1
We had the exact same situation. Although my fiancee was in Cambodia, and I'm sure there might be some differences. We tried to reschedule , but was told that we cannot rechedule, but to just go to the interview as scheduled and they will instruct her further. She did this and they just told her to come back to the embassy as soon as she was ready (she did not yet receive all of our "proof" in the mail from me yet), anytime after 2pm. We had no problems. But it did make me a little concerned. Anyway, it worked out fine. Good luck with calling any embassy in asia. It seems that you never can get in touch with a real person and wind up in an endless loop of recordings!! Good luck in your journey!

Hi,
we had the same problem and I could not get around it any way I tried. I did try to save it and reprint in notepad, but as you said, it is not in Yahoo Messenger format then. I just printed the first page of every chat and submitted that. It still showed that we chatted almost everyday and it worked just fine for the interview.

The only problem is my call log, when she call me the number show up as my number on my phone bill. So i hope they will accept that. Can you guy give me some insight. Thank in advance.

Unfortunatly I was unable to attend my fiancee's interview in Phnom Penh, but as far as the embassy or interviewer is concerned, I don't think it matters. As others have said though, I am sure it would help your fiancee feel better to have your support. As far as your call log, can you explain more in more detail? What method did you two use to make calls? Calling cards, Cell phone, home phone etc? Do you have any records showing the phone number in Cambodia?

There's no place indicated on the certicate, only cert number and date. how do u fill that part out?
I'm also submitting my passport as a proof of citizenship.

my fiance mailed me her passport style photo but when compared to mine, her's is smaller...is this going to be a

Please help out if you could.

Hi proudazn! I also had many combodian traditional engagement ceremony photos. I did use many of them because it showed me an my fiancee together with her family and friends. Also it showed the date on backdrop wall behind us. Take advantage of ANY and all proof you can use. Having too much proof is not a bad thing, in my opinion.

to your question about the passport photos being different sizes. My fiancee's passport that she made in Phonm Penh was just a little smaller, but it still was within regulation size. As long as its within that size range, they won't have to match exactly. US standard size is 2 x 2 inches (5cm x 5cm or 50mm x 50mm as was printed on my fiancee's from PP)

Complete Pay stubs (2008 gross Income file)
2007 Tax Transcript
2007 W2
Explanation Letter why he has low income in 2007
Bank Statement

Co-Sponsor:
1-134 Filled out & notarized
Cert of Employment
ITR 1040 - 2007 & 2006 (the form show her huge gross income)
W2 - 2008 & 2006 photocopy..... NO 2007 ????
F 1099 R - 2007
Pay stub 1 ONLY, most recent... (said she lost her previous pay stubs)

ARE THESE TAX DOCUMENTS ENOUGH?

Hi, Marlo
I just completed my k-1 visa petition for my fiancee. The US embassy where she had her interview required that I provide the previous 3 years tax transcripts from the IRS. I was able to go to the IRS web page and order these transcripts , which were free by the way. It took only about 10 days for me to receive these.

Thanks God he is so good to me. our interview go smooth and the Consul assign to us was nice lady, she approve us without even asking a Co-sponsor, considering that my husband's in come does not meet Poverty income requirements, but the thing is that he is currently & continuously working (I arrange his 2008 pay stubs from Jan to the current date, in separate sheet of paper I did make a breakdown). I guess its a plus factor that my husband is single, no kids plus when the consul ask me whats my job I said I have been through a lot of work before I was once working in an office, become self employed, I also tell that i have a home business. So maybe she think that I can be a potential rather than become a public charge. Lastly, i ask her ''Mam when can I get our visa, She said don't worry everything is fine except to just furnish me with your NBI Clearance in your previous family name (late husband family name i used before) She said once you submit it your visa will fallow. told her '' you know Mam my husband is so lonely waiting for me since we been apart for over 1 yr now, She smile & said Yes I understand your situation but don't worry, smiling at me & my daughter. Yes, it is enough. If you have verifiable income they will not even look at a bank letter. I gave the I-134, tax return, employment letter, bank letter and check stubs. They looked at the I-134, detached everything else and gave it back to me, never looked at it.

Although there are standard practices and processes in most US embassies, some may look at this and some may not. Also maybe up to the person viewing this their information as well.

I'm all for giving the USCIS more than they ask for or need. It never hurts to have too much information, but on the other hand, not enough can cause problems. You are obviously serious about doing your petition, give them serious information and don't cut corners. An official bank statement on official bank letter head is the way to go. Good luck in your journey!

Hi there,

I have the K1 interview at the beginning of march, and putting all documents together now.
For financial support papers we got just a letter from employer with his income (triple above the poverty line), and 2 years tax returns........ also the I-134 of course.

He just recently got off school and that is why he couldn't get a 3 year tax return transcript.....also no pay stubs yet...cause he started the official work just couple months......

Do you think it will be enough proves that he actually has a great salary for 2 of us???

Please advise

Stop after first pargraph.

Triple the poverty line. You pass. But why no check stubs after 2 months? You need to prove this income with more than JUST a letter. You do not need transcripts at all, ever, where this comes from I do not know. You do not need three years tax returns, where this comes from I do not know. You need ONE year tax retruns with w-2s and/or 1099s OR a transcript which does not require attaching w-2s and/or 1099s.

His salary sounds great but he needs to PROVE it. The employment letter gives an indicagtion that the job is permanent and the income is more or less secure. Check stubs show he really makes the money. You need both. I know in Moldova (and Ukraine) things are different and pay is not so reliable, but here in the USA I cannot imagine a job at which one works and does not receive pay after a "couple of months". Most people are paid weekly, twice a month, or monthly. Get those check stubs!

Triple above the poverty line...great! But when my fiancee talked to the US embassy, they told her that she did NEED 3 year tax transcripts. If all you can get is 2, then 2 is all you will have. The letter from the employer does state how much his salery is and this is good enough. Also the extra proof that you need for income is the official letter from his bank about his previous years deposits. I bank with Bank of America and they knew what I needed and ordered it. Cost about $20. At no time did I ever need to provide any "pay stubs"to the US embassy. Although it would help I am sure. The more proof the better, but it was not requested. Good luck!

This is a fair and very common question. When I asked it of a very sharp immigration attorney, he said that affidavits are an option for people whose other evidence is very thin. You would not need those, then.

Do you also have wills, medical powers of attorney, etc.? These would be nice to add to the good evidence that you already have.

Thanks for the advice!

QUOTE (Sylvia_n_Joseph @ Mar 22 2009, 11:47 PM) <{POST_SNAPBACK}>
Face it the whole process is slanted in favor of white couples , who use visa waivers to visit all during the relationship. Those of us with a partner from a non white area have to hope that partner has several times the average income from that country just sitting in the bank for years to be able to visit us. This process doesn't come anywhere close to being equal and without prejudice. It favors older white men bringing younger partners. It favors white couples.

No no no! Visas and the USCIS have nothing to do with racial issues! That is such old world thinking and its hard to swallow that you would even suggest that. It is simply meant to ASSURE that the potential immigrant has sufficient ties to their home country, so that the US and the home country is SURE that they will return and follow LEGAL procedures! Not all immigrants are NON-White!!

I hope that's not going to be a legal wedding. You know you have to be legally married in the US when you use a K-1, right? If you are legally married in Cambodia, she will not be allowed into the US, and you'll have to start all over again with a K-3.

Oh, no problem, we already have completed the k-1 visa so it won't matter about that. We'll get married there in a traditional Khmer ceremony and the in the US also.

Hey, we'll be getting married in Cambodia in late Feb...still in the planning stage so far. Thanks for your congrats!

Marc

I hope that's not going to be a legal wedding. You know you have to be legally married in the US when you use a K-1, right? If you are legally married in Cambodia, she will not be allowed into the US, and you'll have to start all over again with a K-3.

Oh, no problem, we already have completed the k-1 visa so it won't matter about that. We'll get married there in a traditional Khmer ceremony and the in the US also.

congratulations

Hi, well, actually I made a little mistake and so it took up a little longer. When my fiancee mailed her application to the embassy in Phnom Penh, I thought maybe it would be a long time before we got an interview. But as I found out, its pretty quick. She got an interview date within about a week! The problem was that I did not send her all our paperwork yet and no way to get it to her in time for the interview. They did let us have an extension and everything worked out ok. I guess my point is, mail the paperwork you have to your fiancee as soon as you can. To this point, most things probably have gone pretty slow, but soon enough its starts going faster as you get through the process. Thanks for the congratulations and good luck with your process!

Hi, guys!
Today I got word from my fiancee that our K1 Visa was approved!! What makes this extra incredible is that it was in the Phnom Penh Cambodia Embassy, where for the past year, the Cambodian government has had an ongoing ban on foreign marriages! Come to find out, they are still approving visas, but only on a case by case basis, and only a very few! Anyway, Overall, the K1 process was very easy and with the help of this site, we had ZERO problems! Thanks for all who gave advise. One tip that I found seemed to really help. I sent a ton of paperwork to my fiancee. What I mean is that if they asked for a letter from my work, I not only sent that but a copy of my paystub and any other supporting evidence as well. Any supporting paperwork , bank statements, printed pages from my bank account...anything I could find to support the required information. My fiancee said that the interviewer at the embassy was smiling the whole time because we sent SO much information!! I guess you can never have too much proof!

Marc congrats on you K1 Approval!!! when are you getting married??? kicking.gif I wish you both be together soon!!
I am still waiting for my NOA2 ... I hope it will come soon:)
