Thank you for the help. He is here under the Visa Waiver program and was told by the customs and border person that it would severely restrict him (ie job, school). Can he marry on that and do as you advise? He is here for 2 more weeks.

There is NO restriction getting married, only on immigrating.

Yes can marry now, and you can file an I-130 now, and then he returns home while I-130 is pending, do not overstay the allowed time of the VWP, or will not be able to visit again on VWP.

Marry NOW, and forget the K-1, do a CR-1, and file an I-130. This will save you $$$ and will get green-card the moment they arrive in the CR-1 visa.

Nothing stopping a visitor from marrying, unless your state has the SSN requirement, if that's the case, then perhaps a honeymoon in Vegas is in order.

A joint sponsor wont be needed until after the petition is approved.

If you plan on getting work for the prospective immigrant shortly after coming to the USA then why the K-1?? K-1 is not work autorized, and getting authorized to work can take months to get after arrival, need to marry, and the file to adjust status, and also apply for EAD. EAD and or green-card can take 3 - 4 months or longer to get after applying to adjust status.

If work is a priority the the better visa would be to marry first, and file an I-130 for a CR-1 spouse visa. CR-1 is a GREEN-CARD visa, it gets residency status the moment they arrive in the USA and can immediately seek employment.

CR-1 also costs much less than K-1 when factoring in adjustment of status, about $800 less.

Yes you can buy a car, however insurance is needed in order to drive, this tends to be something your future spouse can buy, and get insurance for, the car.

Forget the K-3, improved processing at USCIS and NVC have eliminated it.

USCIS WILL tie the I-130 and I-129F together and approve on same date, then NVC WILL close the I-129F and proceed on with the CR-1.

K-3 served only one function, it was derived at a time when I-130 was taking years to get approved, however now since I-130 is approved at same time as I-129F the function of K-3 (Entry to USA and WAITING for I-130 approval) no longer exists, so NVC kills the K-3 in favor of the superior CR-1 or IR-1 visa.

Here is the deal, every time someone asks about wedding planning and banking on a K-1 the answer is the same, NEVER make plans that cannot be changed betting on a K-1 by a certain time.

You may make some plans if they can easily and without cost get changed.

If you want a solid wedding, then the better approach is to marry first, and then file for a spouse CR-1 visa.

OR you can always have a Legal court house marriage on the K-1, and then later have a big wedding ceramony.

K-1 visa expiration has nothing to do with when to marry, or file AOS. K-1 visa expiration has only to do with when need to use visa by to enter the USA nothing else.

Marry within 90 days after entry to the USA, if fail to do this it is not the end of the world, however will need to attach an I-130 + FEE to base the adjustment of status on.

Well this is not an IR-1/CR-1 spouse visa question, so will be moved to K-1 forum.

K-1 is not a work visa, so visa holder will not be able to take a job until they have EAD or Green-card. Can apply for EAD when they apply to adjust status, EAD can take about 90 days to get, green-card tends to come a month or so later.

Essentially K-1 visa holder will be unable to work for at least 4-6 months after arrival.

IF work shortly after arrival is desired, then the better visa is CR-1, (marry first, then apply for visa) CR-1 spouse visa costs less and gets green-card upon arrival to the USA, also with much improved processing, for most consulates CR-1 tends to take perhaps 1 - 1.5 months longer to get than a K-1.

K-1 may give you a visa is a slightly shorter time, perhaps a month or so, when factoring in the paperwork at NVC.

Compare:

K-1 (FEES ~$1800)
K-1 cannot take a job until getting EAD or Green-card, this can take MONTHS after arrival
K-1 cannot get a DL until they have EAD or Green-card, can use foreign DL in most states though.
K-1 becomes land locked and cannot travel out of the USA until having green-card or AP doc, which can take MONTHS to get.

CR-1 (FEES ~$900)
CR-1 gets green-card the moment they arrive in the USA so can take a job immediately
CR-1 gets green-card so can apply for a DL
CR-1 gets green-card so can immediately travel, conceivable the next day, passport is stamped I-551 which allows work and travel

CR-1 does not take much longer to get than a K-1

Police Records

Saudi citizens and third country nationals residing in the Kingdom process the police clearances by first obtaining a police clearance request letter from U.S. Embassy Riyadh, U.S. Consulate General Jeddah, or U.S. Consulate General Dhahran. This police clearance request letter, signed by a consular officer, must be attested by the Saudi Ministry of Affairs (current fee is SR30). The applicant must then appear personally with a passport-sized photograph and a national ID or residency permit at the regional Criminal Investigation Department for fingerprinting. Fingerprinting for women is done in a separate room. The police clearance should be available for collection after a week or two.

I already noticed that on my medical insurance he has to have the SSN, so I am looking into that too, but I can't add him until after we're married anyway. So, the SSA should allow us to apply for the SSN before we're married then? He gets here 1 month before the wedding, so we should have plenty of time then, I suppose. Yep, SSA is REQUIRED to issue K-1 a SSN within the 90 day period allowed by the I-94, for the reason I indicated "To get a Marriage License" Kind of hard to get hitiched in some states like TN and NC and a few other places that require a SSN.

Wait 2 weeks after entry because it can take USCIS that long to update records SSA uses to confirm immigrations status, and do not wait until 90 days after, SSA will not issue a number if there is less than 10 days or so of legal stay left.

Also later when you do get green-card, revisit SSA to get a replacement card without the restriction notation on it.

Many abuses with regard to SSN, K-1 is allowed one for one reason only, to get married. There is a fed law that requires people applying for a "license" to have a SSN, it has to do with dead-beat parents, the law is to track deadbeats when they apply for: (Driver's License, Fishing License, Hunting License, Business License, Marriage License....) Some states are NO SSN, NO License.. Most states do not comply for marriage license however SSA has been instructed to issue to K-1 holders only.

If you get problems with Bank threaten to take business elsewhere. Also this can be the case with med insurance, just call and ask for a supervisor.

Firstly DS-230 part 2 is not used for K-1 visas, and secondly that check box only works for immigrant visas like CR-1 and IR-1 visas.

You need to enter the USA wait about 2 weeks, and then apply for the number at an SSA office.
