IR-1 / CR-1 Spouse Visa Process & ProceduresCSC - NOA2 to NVC Delay

All, I am getting to the conclusion that all those that said that they got a negative response from NVC regarding their DS-3032 may be cases where the information provided in their email might have been wrong.

How else can we explain the fact that NVC allowed us to use IV Cover sheet to send AOS packets, saying the barcode is the same and it should be fine. I know for certain that in my case the AOS fee was generated before my DS-3032 was reviewed because of my unique case (Case number changed in between the process). Also my DS-3032 had BMB case number and it was processed after I got a new MDR case number without issue.

I am thinking that sending DS-3032 as soon as you get your Case numbers should be fine, as long as the details are correct.

I am looking forward to see someone come up with a different reason in not considering their DS-3032, unless they haven't yet realized that they made a mistake.....

We used the exact template provided and I've check and rechecked the email to make sure everything is correct so I don't believe it has to do with the actual email.

I'm thinking this may have happened to me.

I emailed the DS-3032 straight away after getting off the phone on Monday (where i got my case number and Invoice number)

When I log into the payment portal as the petitioner, for the AOS it states no fee amount and payment status as Not invoiced.

When I call the AVR it states:
Please allow 6-8 weeks for the beneficiary to receive notification.

Should I email the DS-3032 again?

My husband emailed that request straight away as well. We received an auto response but nothing else. Emailed it again last friday another auto response but nothing else. We were having issues with our bills generating. I've only just received the emails/billing notice this morning when I woke up. So once again we resent the DS-3032. I think because for one reason or another we weren't fully in the system the first 2 we sent weren't accepted so I'm hoping the email that was sent today is accepted and we can move forward. Maybe it's a UK issue lol. There are too many of us to keep up!

I'm laughing at myself here. Everytime I try to log into the payment portal and it takes just a milisecond longer to tell me in bright red letters that my case isn't available for further processing my heart skips a beat. I think oh man this is it the bill is ready to be paid! But then....whomp whomp....nothing...still not available. Let the cursing begin lol

I said to the gal who I spoke to this morning the only way I'm going to get an October interview is if these bills go out this week and get paid. From looking at timelines it seems like it takes anywhere from 1-3 weeks for them to close the case so it's gonna be a hard push really to get the case closed if they are taking 5 days to process payments. I'm in customer service so I take calls ALL day and I go out of my way to be as nice as possible even though my head is about to pop off when I'm talking to them. Blahhhhh just get with the program already lol. It took a little over a month for me to get my case number and IIN so you've GOT to be getting yours soon. We shouldn't complain really the last I looked there will still 25 people in the March queue that haven't received their NOA2 so I guess we just need to keep that in mind. At least we aren't still waiting for that :)

That was kinda my way of thinking god for bid something really really bad happened and he didn't go home he would never forgive himself and he would never forgive me for asking him to stay so that was really the only choice we had. I do think that because of having to go through all of this for so long we know we belong together. Why on earth would you put yourself through this for any other reason?? Thankfully he's a cool cucumber and I'm the only one that wants to freak out so he keeps me grounded and just says don't worry it can't be too much longer lol. I lose sleep when I finally go to bed and I know he's already snoring in la la land lol.

I called early this morning and the supervisor said she was going to send it to a manager for review because she didn't know why I haven't received anything. How long do you think I should wait to call back. I really want to call back straight away in the morning but I don't know if I should or not lol. I'm probably black listed now!

LOL....

Second time? Care to explain what happened the first time?

We went through the K1 visa process. Got the visa...now husband came over and his mom got really sick. We had a big wedding planned and whatnot. So because his mom was ill and we didn't want to have a justice of the peace wedding he decided to go back home and take care of things. Soooo he came back last October and we had our wedding then and had to start this lovely process all over lol. What can I say we are glutton for punishment! Egits is what we are.

Oh and update: I just got off the phone with an NVC operator...no case number tonight....yipeeee...not. :(

Thanks! Hope you get out of NVC quick!

LOL doesn't do me any good to have the bloody case number when nothing can be done with it! I have to laugh because otherwise I will cry. I sit cursing to myself most of the day. I will probably need professional help before I'm through with this. Since this is our 2nd time going through this nightmare immigration my husband said we used up our quick route the 1st time around now they are going to make us suffer lol

Ok. I am starting to get ticked off. Several people that got their NOA2 after me have gotten their case numbers last week and this week. I am not mad at those individuals, I am actually happy for them but I am ticked at the damn system.

What happened to the process of order? lol

I better get my case number this week sometime or your gonna hear about a earthquake in Central Ohio...

I know how you feel. I've told the operator when I call that I KNOW other people have gotten their NVC # and IIN after I did and they've already been able to pay both bills. I can't even manage to have 1 bill become available. We've sent the choice of agent twice and haven't received a response for that either. I'm not exactly sure what's going on at that office but it's becoming more and more frustrating as time passes. The only way to get an October interview is for us to get case closed this month and at this rate it's just not going to happen which is depressing. It's good that everyone else is getting closer to their loved ones I'm just concerned that something is wrong and I can't seem to find anyone that will give me a straight answer.

Another call today as the billing email has STILL not shown up. The supervisor today said she was going to send the information to a manager because she had NO idea why the emails haven't gone out. So still waiting to be able to pay anything. I think I'm going to start calling everyday until the I can pay the bills. It's been breezy and now I'm about ready to just spaz out

We emailed ours as soon as we received our NVC # and only received a confirmation from the auto response. We never got a confirmation it had been accepted so it's been emailed AGAIN today. I personally don't think it's going to do any good until it shows in the system as being ready for further processing ie...the AOS bill being generated. They are still implying that my request for that to be done is still being processed which makes no sense since people get their email or are actually able to log in and pay the bill within a couple days of giving their emails. It just doesn't make any sense to me.

We received our case number on the 19th. We still haven't received any emails. They are saying it's been forwarded to a supervisor for processing that was on the 26th. We sent our email to them regarding agent and never got a response either. I'm getting super frustrated at this point. Seriously how long can it possibly take to send an email so I can PAY THEM lol. Ugh. It's going to be a long weekend if I don't get something today.

IR-1 / CR-1 Spouse Visa Process & ProceduresIR1 NVC waiting for UK embassy to give appointment
Well I can tell you that the embassy holds interviews throughout the month not just the first 2 weeks. The reps will often advise that they only give out interviews within the first 2 weeks of the month so basically at this point you just have to wait and see what you are given. I do believe that once you have been given an interview date you can email the embassy and ask if you can get a different date if it's available but obviously that's not a guarantee. You can go to immigration timelines and view when people have been given interview dates. There are 9 interviews in sept at the London office.

It would be very helpful to everyone if you would fill in your timeline.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is this
Just because you mailed them and they were delivered at the same time doesn't mean they were reviewed at the same time. If a processor reviewed your AOS information BEFORE reviewing your IV packet it will generate a false RFE because according to them you ARE still missing information. If you've mailed both and you know they've both been received take a deep breath. When they review the 2nd packet the information will change.

IR-1 / CR-1 Spouse Visa Process & ProceduresTraveling whilst CR-1 processes and other

Hello, I am new here and have been reading some of the threads and guides here. It's all been helpful! However, I have not started off anything yet with my wife. We are waiting for the marriage certificate to come through. I think the CR-1 option is the best choice for us.

I'm not sure where to really start but I was hoping people could give their experiences/opinions on traveling whilst the I-130 would be in process. I know some feel it's not worth it and if WE HAVE to wait, so be it. But this really means a lot to us both if I will be able to do so.
As it could take a little while longer than expected, it would be really great if I could travel back to the USA on the 90 day visitor visa.
The thing that has been my concern is the possible denial of being let in. How would this work to show I have the intention of going back to the United Kingdom? I mean, if I decided to go for 3 months, it's not exactly unusual that I wouldn't have a job to return to. Also, I actually don't have my name under any kind of bills as I just live with my mum. How do they evaluate this all if they choose to question it. Would they if I said I was visiting my wife? We met in the USA, where I went to stay at hers. We didn't have the intention of getting married, but we did because it was out of love and felt natural, we had no idea there was all of this! But I did return like I said I would. Would they be more concerned because I said I wasn't going to marry? It's these kind of things I'm curious about.

Moving on from that is our relationship. We only knew each other online for a month, or a little over, then I went out to visit her. Then we got married 2 days before I left on my 2 week visit. Eventually, when the interview comes (I hope) will they really give us a hard time? I was concerned how they go by this. As they must have many cases where it is a legitimate marriage despite the early meetings. This is not in a discriminating way but do go by certain backgrounds/countries? Being from England, I'm guessing not much fraud or anything has happened in comparison to other countries.
Sorry if some of this is vague as you guys can not give an actual answer! But any advice, and stories would be much appreciated.

I'm sure in the soon time to come I'll be asking more :P

Love & peace!

My husband traveled while we were waiting. He always made sure he went through Dublin for POE just in case he was denied...only an hour flight to return...but he never had any problems. Was asked a couple questions since he had an old K1 we had previously filed in his passport but he was never "drilled"

IR-1 / CR-1 Spouse Visa Process & ProceduresWrong Info on G325..Interview in 2 wks
Hi Folks.
Last night I was going over all the paperwork I have here since our interview is in 2 weeks and I realized that 3 of the dates on my work history are wrong. I had filled out the form long before I sent it just trying to be organized and I had changed jobs..the first 2 jobs listed are the correct dates but then next 3 are wrong...basically the name of Employer moved down but I didnt adjust the dates. So now we are 2 weeks before the interview...the G325 has been reviewed and NOA2 received...NVC received and case closed...I'm not sure what I should do at this point. Should I send a letter and have John take it with him to the interview explaining my findings and list the correct dates?

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 Interview
This is information given directly from the interview appointment letter:

* IF a sponsor filed an I-864 (Affidavit of Support) AND provided the NVC with proof of
an IRS Federal Income Tax Extension in lieu of a Federal Income Tax Return, the
applicant must bring the sponsor's most recent Federal Income Tax Return to the visa
interview.
* Failure to present all necessary documents to the Consular Officer will result in the
applicant's immigrant visa being refused at the initial interview.

Because your most recent tax return that you filed was made up of foreign income it does you NO good. Your income has to be from income made in the U.S. The income doesn't count and you didn't give them a 2010 tax return so you haven't given them the required information.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR1 Visa in hand.. what now?

So.... is the I-551 stamp the visa? You say the green card is not the visa and the stamp in my passport currently, is only good for one entry only.

what is the part that they check when I go in and out of the US later in life?

I must be able to renew my passport and still have the 'visa' in it? Other wise what other proof do I have if the green card is not the visa?

Your green card is what you will use to travel. What's in your passport wont matter beyond that initial trip through. They stamp it when you come through because you have to wait to get the actual card and I suppose if you were to get stopped by police or whatnot you need to have SOMETHING showing you are able to be here.

IR-1 / CR-1 Spouse Visa Process & ProceduresURGENT! Should I get interview letter from embassy in stockholm?

I was scheduled for an interview in stockholm on october 18th a couple of weeks ago, I was sent an interview letter from NVC via email. Although, now Ive read that people have been getting interview letters also from the embassies. This worries me A LOT! I havnt received anything like that, Should I? Or is the only interview letter from NVC?

The email you received stating your appointment date/time is what you need to take with you. Some people who have rescheduled their interviews may receive letters from the embassy along with K1 folks who get packet 4 from the embassy.

I am a little confused. I qualify to sponsor my husband but I have my 403b should I add it on my assess or just leave it alone. QUESTION 28.

If you qualify by income alone you don't have to list assets. If you need to include your 403b to qualify than list it.

IR-1 / CR-1 Spouse Visa Process & ProceduresRealistically - how long till getting interview date?

That link doesn't work - also, I've had my I-130 approved, I'm at NVC stage.

I think really it's just a matter of when London lets NVC know there's an open interview spot. We found out 3 days after our case closed when our interview date was. I would think you should know within a couple weeks hopefully but saying that we found out the end of August and aren't having our interview until this thursday. Just looking at dates from when people got their interview date TO their interview date it seems like it's about 6 wks. So you make squeak in November. You could always contact the embassy and request an earlier date if it was into December.

ok so my interview is tomorrow :S nervous but here we go its what we waited for and its here so bring it on, ive read the london forum, an either the people who posted couldnt be bothered explaining it well, or was just so easy. also alot of K1s and those interview tips dont apply to meeee, so can any1 thats had the interview in London gimme some tips, an some questions ill get asked, what to wear, stuff like that, thanks guys :)

what you wear won't matter because they only see the top half of you :) Jeans and a decent top is sufficient. If you go to the Embassy review area there are plenty of reviews by people who have been there to do the CR1 visa. The same sort of questions get asked for both K1 and CR1 interviews the only difference would be when you got married vs when are you going to get married.

IR-1 / CR-1 Spouse Visa Process & ProceduresSpouse visiting while CR1 under process
QUOTE (fashr001 @ Dec 3 2009, 03:14 PM) <{POST_SNAPBACK}>
Using what visa can I bring my spouse to the US while the CR1 Visa is under process without causing delays to the process?
Is it advisable for her to come to the US while the visa is being processed?

I read that even if my spouse gets a tourist visa, the immigration officer can deny entry if they know she is an intending immigrant. Is there any other way we can be together?

Thanks for your help.

Anyone can be denied entry into the U.S. visa application pending or not. My fiance is here visiting while our K1 petition is pending and he didn't have any problems at all. He brought along evidence of ties to the UK but wasn't asked for them. He said this POE was the easiest time he's had.

IR-1 / CR-1 Spouse Visa Process & ProceduresTax Return Transcripts

Transcripts are printouts of your tax returns. Includes all w-2/1099/1040/schedules used.

I called and got mine faxed over in 20 mins.

However, if you haven't sent them in - they won't have them in the system as soon as you think - so you will have to do it the old fashion way (copies of your returns/w-2's)

I was also under the impression that even if you dont make any money you still have to file some sort of information with the IRS stating exactly that...maybe it's an exemption form or something. If you haven't filed anything for those years there's nothing for them to send to you...meaning NO TRANSCRIPTS.

I have been to England several times even before I was enaged and I NEVER had any problems until I flew to Birmingham and I told them I was going to see my fiances family. Exactly but the USC needs a visa to marry in the UK. K1 visa holders who leave without marriage and advance parole are no longer just VWP candidates BECAUSE that K1 visa is in their passport. It might work but probably only if the K1 is not actually seen by the CBP. That's not something predictable or that you can control.

IR-1 / CR-1 Spouse Visa Process & Procedurescr1 possibility

Yes, you can go through the CR1 process if you marry but to marry in the UK is possible but problematic. Your fiance entering the USA again with a used K1 visa in his passport and no Advance Parole is even more problematic. First you'll have to find a way to actually marry.

Why would it be a problem for him to come back to the U.S. for a visit? He left the country before the 90 days. If he followed the rules of the visa...didn't get married and left before the 90 days. I realize that he would have to bring strong ties to the UK but I can't imagine that there aren't people who have decided not to get married for whatever reason and have come back to the U.S. for vacation or whatever.
