It took roughly 13 days after filing a SR to get my approval, so hang in there :) Hope you get good news soon! As for the online status, a lot of people report that it's not updating until the GC prints, mine's still showing the same status as yours, despite having my approval letter in hands.

Manuela, your journey took a week, shy of 10 months...If I can imagine the worry and stress that was lifted off your shoulders. I guessed you got a good night's sleep after sometime.


Yeah I was starting to worry that they lost my papers or what... the approval letter came from San Antonio, so it looks like they sent it on to the field office so who knows how long it was delayed there... But in the end it worked out, I know they're all overworked and underfunded and I'm sure they do their best. I hope any others that are still waiting will get their approvals soon!

The email first repeated all the info I've given then, then gave me a one sentence "Your case is currently under review. You should receive a decision or notice of other action within 60 days of the date of this letter." response, that's it.

From what the internet and google says that's just their standard response. I hope my card will arrive quickly, kinda bummed that I was so early in April and now I'm the latest to get approved, but we all know we just have to be patient...

There has been more May Approvals than April in this month. Is VSS more focused on May? I called last Friday, and spoke with a level two Officer. He said that they were processing April 4th. It makes me wonder if the level two Officer sees anything different from the Level one Officer.


April 4 would be me, I hope that's true. I got a canned email answer to my service request (of course) and I'll just sit tight for a week or two before I'll bug them again.

I'm running to the mailbox every day first thing after work, I had such an early NOA date and biometrics that I'm getting really antsy about my card... I hope it'll be here soon :( Not sure if it's worth calling over though, since they're obviously working on getting the VSC cards out the door.

They have a pretty fast turnaround, mine took a bit longer because it wasn't possible to get an appointment with the Dr. in Zurich as fast as I would have liked. I had to wait more than a month to go to the Dr. in early January, but the Consulate gave me an interview date just 1 week after my visit to the Dr when I let them know about the delay and the date of my Dr.'s appointment.

Whenever I sent them any of the forms back, I got a confirmation letter within a few days, so they are fast if everything else is right on track smile.gif

:help: My FI and I are getting very frustrated with the thought of waiting and waiting, as I am sure so many of you are. On his visit next month, we are seriously debating just getting married and applying for a k-3. MY fear is the length of time it takes. Is it really more than the K-1? Does anyone have any knowledge or opinion on this? Thanks so much.

From my experience, the K-3 is taking us about 2 months longer than a K-1. My (now) wife is from Russia, and it seems to take longer for them.

We started the K-1 process, and due to personal issues, we decided to get married. If we had waited for the K-1 to finish, she could have been here in the USA *now*! But instead, we must wait anywhere from 4 to 5 months from now, for a total of about 8 months from the NOA1 date. We're hoping for sooner, but looking at processing time for others from Russia, we're not counting on it.

I haven't thoroughly researched processing times for England/UL, but they don't seem to take as long as Russia.

I havent seen my husband in 15 months.

Wow! Nerves of steel, indeed!

My wife is extremely upset that we haven't seen each other for 10 weeks. I think she really has no patience at all for this process, and it's killing us. I'm at wits end to help calm her. She's of the impression that our "situation is not normal" and wants me to visit her every 2 or 3 months until her visa is approved. Unfortunately, she has a couple of friends who have American husbands who don't have the restrictions and responsibilities I have, and can visit more often. I just can't afford traveling so much.

Sorry for my "venting" here. I just don't know what else I can do to help my wife understand this is a long and trying process, and to rest assured we will be together again (relatively) soon.

But I recommend you just be honest. If you get married do the K3 and if you don't get married do the K1. Plus the K3 isn't much longer and I feel it gives you more advantages, especially if your wife will work or you are concerned about getting the greencard faster to feel more secure.

Ummm... I guess people are missing some of my post. We are being honest. We've already cancelled the K-1 and have filed for I-130/K-3. Now we're playing the waiting game. Such is life.

What I believe used to be about 6 to 8 months for a K-3 is obviously going to take much longer now that we have this blasted IMBRA thing screwing our lives up. I understand many people will say that it only affects K-1 visas... I don't think I can agree with that blanket statement. Our K-3 has been delayed almost 2 months already, with no relief in sight. :crying:

If we didn't abandon/cancel the original K-1, I could understand a conflict. But we're being totally honest here, and we got married because we love each other and didn't want to wait any longer to be married (i.e. the paperwork was taking longer than our hearts could handle).

I tried searching ILW.com but I couldn't find anything of the sort.

I believe that since you are married you have to pursue the K-3 option. If you would go to the interview and lie about the marriage and the government would find out I think you would put yourself in a huge hole! Good luck


We *are* pursuing the K-3 option, and we have no intention of going to the K-1 interview. We've already told the government about our marriage, and requested that they cancel the existing previous K-1 petition. They're just slow about responding to our cancellation. :whistle: There's no way we could lie about the marriage anyways. My most excellent and wonderful wife has already received her Russian passport and international passport with her new surname. :yes:

My questions are whether the previous K-1 petition (which we have cancelled) will hurt, help, or not change our *new*, current K-3 visa process.

What I meant was... Since they've already done a full background check and approved everything (except for the interview), will the government - in its infinite wisdom - do the full background check again? Or will they realize... "Hey! We've already done a check on this woman!" and just move it along more quickly. I'm 99.44% sure they'll do the checks all over again. I was just hoping someone has been through this before and would say "Naw... They'll just see it's the same woman." and hasten the process a bit. :jest:

BTW: I just checked my home mailbox and got the letter from NVC saying that all the stuff was being sent to Moscow - dated March 8th. I don't check this mailbox for my physical home address often because I get tooooo much junk mail. I have a P.O. box for all my important stuff. The stupid lawyer from the K-1 used the bad mailbox for my mailing address. What a jerk he was/is! :bonk:

Hi all!

My wife and I had previously filed a K-1 petition. During the months of waiting for our lawyer to send documents (lots of problems), and the subsequent processing time, we decided to get married (January 13, 2006).

We have already started the I-130/K-3 petition process. In the meantime, our original K-1 petition was approved and sent on to the Embassy in Moscow. We recently received word that the Embassy has scheduled an interview for May 11th.

I know. I know. We should have just waited for the K-1 to finish. In hind sight, that would have gotten her here quicker. But our hearts had other things in mind. Ahhhh... The foolishness of love!

Our lawyer for the K-1 told me he sent all the necessary cancellation requests to the USCIS, et al. I've since taken a new lawyer for the K-3 because the first lawyer wanted $2,000+ dollars to restart everything. Highway robbery!! Especially after the crappy job he did with the K-1! He always had an excuse why our documents didn't get sent. (Hurricane in New Orleans - he is in Alabama; death in the family of his paralegal, he moved his office, he lost our documents -- ARGH!) It took him THREE, yes 3, MONTHS to send our K-1 petition. I won't mention the name here, but the firm is/was supposedly VERY reputable and has a purported 100% success rate.

Anyways... back to the original topic. What I am curious about:

Has anyone else had experience with filing a K-1 petion and then getting married (to the same woman) and filing a K-3 petition?

Did (could) the original K-1 petition cause any problems or questions?

Could the original K-1 petition actually speed things up any? I know it's not likely, but would they realize they've already done a background check and move it along any quicker? Yeah, yeah... I know it's just a dream.

I'll definitely share my experience as things unfold here. I'm just curious if anyone else has been down this road.

I wish mine would only take 6 months! From the posts I've seen here, a K-3 for a Russian citizen has historically taken longer, I believe. I'd be really, really happy if my wife could be here by the end of September. But with IMBRA, I think it's going to add a couple more months to the wait time. :crying:

My one and only concern is being with my husband again, regardless the cost or inconvenience of filing more applications. I can barely breathe without him. So, whichever application gets him home faster, I'm taking it! I can handle anything easier than I can handle this forced (and what I deem completely unnecessary) separation.

Again, however, I will comment what a comfort it is to see so many people here so supportive and encouraging. It's quite lovely... :)

I wholeheartedly agree! Getting my wife here with me the fastest is what I'm interested in. I don't care about paperwork. I'm a perfectionist at that kind of stuff, and can read legal-ese pretty well (I have written contracts before). So paperwork isn't a big deal. Being together with my honey is most important to me!

So much for the K-visas reuniting families quicker! At least there's movement on the horizon.

I must also mention that the I130 process is longer than I129f .. I am assuming you r comparing k3 to IR right. Our k3 took less than 6 months in total for my husband to come home. We have out AOS interview 5 days after our 1 yr anniversayr and he will have been here in the US for 6 months! I have friends who used the IR process and have taken up to 2 yrs some a little longer and none less than a year, but you do get so much more with it. But if having your spouse home with you is more important thanthe inconvenience of having to pay to file more forms and fees then I would say stick it out.. you dont have to make a decision yet anyway.. you have until it( the petition) gets to the embassy. There have been cases where the I130 was approved but the k3 got an interview date b4 the 1-130 so just let them both run until you have to make a choice.

Less than 6 months?! Wow! I wish mine would take that long. But with the new IMBRA, I think everyone is suffering with longer wait times - several months longer.

Contrary to what my lawyer told me, yes it does affect all K-visas. K-1 and K-3! If you read the actual text of the IMBRA, it states all K-visas, plain and simple. No differentiation in K-1 or K-3. Though I've seen many people speculate that it's only for K-1, that is simply not true.

And also some of us that tried to show how K-3 were also included with the IMBRA. That really doesnt matter though now, all that matters is that RFE's are finally being sent out to all those waiting at NBC. Good to see.

Have not received anything yet but need to ask: do you send back the RFE by itself? Or submit the entire I-129f package again? (I thought that was the procedure for RFEs.) Anybody get any instructions?

I recieved my RFE since Saturday and according to it all I have to return is the letter along withthe questions. Just two sheets. It did not mention anwhere on it that I need to resubmitt the I129F package.

Pray tell... What kind of questions? I'm still waiting for my RFE to arrive.

Hang in there! I only recently received mine not long ago. Another K-3 couple I met online has already received their I-130 NOA2, but I've seen no action on mine, as well as no activity after my RFE response. As another friend reminded me, sometimes we get stuck on a *SLOW* desk. I'm hoping for more activity on mine. I guess we all have to hope for the best, but remember that this is our wonderful government taking their own sweet time bringing our families together again. :crying:

I call embassy and was told it is not needed for interview. Does anyone else have experience with this?

Just wanted to confirm this.

My fiancee received a call from the embassy today (Oct 13) in which they told her to make sure and use the new form, not the old Russian version they sent with the packet. We already had prepared the new form, but I am glad the embassy is also notifying people.

Thanks for the update! I imagine my wife will get a phone call in the next day or two.

I've already got the new form ready for her. I just got my passport back with my tourist visa to Russia. I'm leaving on the 18th to be with her, :dance: and bring her back after the interview.

Good information :thumbs: On a quick search of the DOS site in the forms section it appears that the DS-156 is now only available in evisa format, unlike other forms that are still available for download. So I would say this is going to apply across the board for all embassies/consulates. Just a matter of when each embassy/consulate implements the requirement. I would say, members should check with their consulate prior to submitting the DS-156.

And Austin, nice job on catching that, seems Moscow is not exactly consistent on what they're doing. Looks like we simply need to fill that stuff out and print out the forms, actually seems like a better of way of doing things, for future applicants.

Thanks. I did call the Embassy in Moscow (a little after midnight today). That's where I verified the information before I posted. I wanted to be sure before I posted so that I didn't scare anyone needlessly. :) I think we have enough stress about all this stuff already! :wacko: :blink: :dead: :bonk:

I don't know the purpose of the barcode exactly. I did some playing around, and the barcode changed when I made a change to my wife's occupation. It may be some kind of mathematical checksum for data entry, but I don't have proof of that. It's just a guess.

I just got off the phone with the Embassy in Moscow. They will NOT accept old versions of the DS-156 form beginning October 25th! :o They are requiring the new, electronically-generated version from the Department of State web site.

See the full announcement here (Embassy web site). Here's an excerpt from the web page:

Attention! Beginning October 25, all non-immigrant visa applicants must submit a completed Electronic Visa Application Form. The Electronic Visa Application Form must be filled out online at http://evisaforms.state.gov. After filling out the form online, applicants will be able to print a copy of their visa application form, which will include their data in a barcode format.

The Electronic Visa Application Form is not available in the Russian language. Answers to the questions on the application must be in English and must use English characters. The applicants are welcome to use the Russian language translation to guide them through the online English Electronic Visa Application Form.

My lawyer did not tell me about this change, and my wife has not received any new information from the Embassy regarding the change. I doubt the Embassy will send anything. My wife is totally upset and confused how the Embassy could change this and not tell the visa applicants. I agree. It's awful. :angry:

Oh, and there's a statement in their web page about the list of documents that says that the DS-156 is required in the Russian language. That is also no longer correct, according to the Embassy reprepresentative, effective with interviews beginning October 25!

What a wonderful beauracracy, eh?!

I agree with you. My ex-wife has remarried (VERY quickly after our divorce - within 31 or 32 DAYS - BIG red flag!) and is doing whatever it takes for her to stay in the U.S. - after I married her for love, brought her to this country, and got her Conditional Green Card. And that's when it really went downhill. Final count: Me: Bankruptcy - financial ruin after being forced to support her during separation before divorce was final - over 1 year. Divorce.

Ex-wife: Financial gain of about $45,000 to $50,000 in the past year. That would be equivalent to about 75 years' salary (at her most current rate - according to her) in her country (Russia).

I understand she's going to have a hard time getting permanent residency based on the quick (lightning) re-marry and because I filed for divorce less than one year after marriage (she had only been in the U.S. for two weeks when she physically abused me, have a police report about it). We had reconciled, but it only lasted long enough for her to get her conditional green card, then she went psycho again.

Another way to do the barcode:

Download this FREE barcode font (TrueType): http://www.barcodesi...e-barcode-font/

Install into your Windows "Fonts" folder. That is, just copy the files to the "Fonts" folder. Sorry... I don't know the install steps for a Macintosh.

Use the font in your favorite text editor.

When you create a "3 of 9" barcode (as is needed here), BE SURE to start and end with "*". For example, if you're creating a barcode for 1234567890, you would make the barcode for:

*1234567890*

The "*" is necessary at the start and end for readers to decode the barcode. No "check digit" is needed, but a little white space is needed before and after so the reader can prepare for the code.

I used Microsoft Word, typed "*XXX1234567890*" (without the quotes, of course), repeated this on the next line, and then changed the font on the first line to the barcode font. Then you can adjust font size as needed. I think 24- or 28-point worked well for the barcode, and 14-point for the text below.

This often means someone has been looking at your case, although it doesn't guarantee that anything is happening. It's a good predictor though.

Mine was touched just a little over a month ago, and is still not approved. :crying: It looks like sometimes it doesn't predict anything. :wacko:

Don't walk... RUN away from this lawyer!! Do everything in your power to get your money back. File a complaint with the Bar in the state where this lawyer practices.

Then, listen to the advice on this site. I made the big mistake of hiring a lawyer to do mine, and it only cost me more and more money. BIG mistake! You can do 100% of the work if you're willing to ask questions here.

Besides, you must do all the work to get the information to your lawyer - only for them to type it on the form. Do yourself a favor and do it yourself. All this bull about lawyers being able to influence USCIS and embassy interviews is a crock!

We got the same bad advice and filed our I-129F before my fiancee's divorce was final. We already have our NOA1, what do we do now? We don't trust our lawyer anymore, much less any other lawyer (no offense to the lawyers here). Do we withdraw our petition or write USCIS? Please Help!
Talk to an immigration attorney. An initial consultation shouldn't cost an arm and a leg. Mine cost me $50.00 and said I can call back with questions any time!
